which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Green Spaces, Green Vehicles Initiative to facilitate the installation of zero-emissions vehicle infrastructure on National Forest System land, National Park System land, and certain related land, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Green Spaces, Green Vehicles Act of 2021</short-title></quote>.</text></section><section id="id2604374904FF4796B8E3763AC1FE789D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idC41D3EA2B236484E8A5FD641D03C753C"><enum>(1)</enum><header>Appropriate agency head</header><text>The term <term>appropriate agency head</term> means—</text><subparagraph id="idE391E72564C3449E9000B817966A74C1"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service, with respect to National Forest System land; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB618B2DC99F949509FCCFDE098A7114D"><enum>(B)</enum><text>the Secretary of the Interior, acting through the Director of the National Park Service, with respect to National Park System land.</text></subparagraph></paragraph><paragraph id="id0C6C3EAF6AEB48E8AEB939CBAEAF9902"><enum>(2)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idD84787753B174DB28E0AB7B95600B830"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></subparagraph><subparagraph id="id83AA4E9807954B53A0C91E1FAF16A4BC"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></subparagraph><subparagraph id="idA860374F8034496A804220D9534AF24C"><enum>(C)</enum><text>the Committee on Appropriations of the House of Representatives;</text></subparagraph><subparagraph id="idB68471F80D574098B1C858EF7182077B"><enum>(D)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph id="id6BFCE9C950FE487D84AE2D50D9985A08"><enum>(E)</enum><text>the Committee on Appropriations of the Senate.</text></subparagraph></paragraph><paragraph id="idB4BC166DFAEF44E5AF96CAE744E90B90"><enum>(3)</enum><header>Covered land</header><text display-inline="yes-display-inline">The term <term>covered land</term> means—</text><subparagraph id="idFB113ABC79914398ADD6A1B84A20D6BE"><enum>(A)</enum><text display-inline="yes-display-inline">National Forest System land;</text></subparagraph><subparagraph id="idD090722FA44C4FCC8B4D86463C00417E"><enum>(B)</enum><text display-inline="yes-display-inline">National Park System land; and</text></subparagraph><subparagraph id="id919FFEEE05244F219A61E38627253776"><enum>(C)</enum><text>any land, including land owned by a unit of local government or Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>))—</text><clause id="id2D649F7D21624E96AD639825972DCACB"><enum>(i)</enum><text>that is located not more than 25 miles from land described in subparagraph (A) or (B); and</text></clause><clause id="id8D72ED3766214C78A5C0F0B33340BD14"><enum>(ii)</enum><text>with respect to which the Secretary or an appropriate agency head has entered into an agreement with the owner of the land for the installation of zero-emissions vehicle infrastructure on the land, after making a determination that the infrastructure to be installed under the agreement is related to providing zero-emissions vehicles with access to land described in subparagraph (A) or (B).</text></clause></subparagraph></paragraph><paragraph id="id5BE50E8BBC784739A55FBB7720B0FDAA"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy, acting through the Assistant Secretary for Energy Efficiency and Renewable Energy.</text></paragraph><paragraph id="id64F4C80033B740D78E43DE7980F1C0F9"><enum>(5)</enum><header>Zero-emissions vehicle infrastructure</header><text>The term <term>zero-emissions vehicle infrastructure</term> means infrastructure used to charge or fuel a zero-emissions vehicle.</text></paragraph><paragraph commented="no" id="id29913072824F41DB952F6FB1657D7806"><enum>(6)</enum><header>Zero-emissions vehicle</header><text>The term <term>zero-emissions vehicle</term> means—</text><subparagraph id="idfe1f28811ecc4d2ab016d21e4076e08d"><enum>(A)</enum><text>a zero-emission vehicle (as defined in section 88.102–94 of title 40, Code of Federal Regulations (or successor regulations)); or</text></subparagraph><subparagraph id="idfdb7034045a242c9b7c5d425dcef44cf"><enum>(B)</enum><text>a vehicle that produces zero exhaust emissions of any criteria pollutant (or precursor pollutant) or greenhouse gas under any possible operational modes or conditions.</text></subparagraph></paragraph></section><section id="idc52f68ae8e2a49f68400f01a7c9cd30c"><enum>3.</enum><header>Establishment of Green Spaces, Green Vehicles Initiative</header><subsection id="id7D110AFD81F14312BF1755F9121B252E"><enum>(a)</enum><header>Establishment</header><text>The Secretary and the appropriate agency heads shall collaborate on an initiative, to be known as the <quote>Green Spaces, Green Vehicles Initiative</quote>, to facilitate the installation and use of zero-emissions vehicle infrastructure on covered land.</text></subsection><subsection id="idC7BFC2D1C4F34AB9980F2CBECF8CC423"><enum>(b)</enum><header>Duties</header><text>The Secretary and the appropriate agency heads shall facilitate the installation and use of zero-emissions vehicle infrastructure on covered land—</text><paragraph id="id38A11CB4E0DD45BCAD0A592F98076A2D"><enum>(1)</enum><text>by entering into agreements with public, private, or nonprofit entities for the acquisition, installation, and operation, including use-fee processing and collection, on covered land of publicly accessible zero-emissions vehicle infrastructure that is directly related to the charging or fueling of a vehicle in accordance with this section;</text></paragraph><paragraph id="id117D4B827B3C4E28AF6125417C85153C"><enum>(2)</enum><text>by acquiring, in coordination with the Administrator of General Services, zero-emissions vehicles, including shuttle vehicles, for the fleets of the Forest Service and the National Park Service;</text></paragraph><paragraph id="id3E843BF5403C4D05A8BE7122BA71E260"><enum>(3)</enum><text>by providing information to the public, including by publishing a map on any relevant agency website, regarding the availability of existing and planned zero-emissions vehicle infrastructure on covered land; and</text></paragraph><paragraph id="id850DBEFAFD2E45DE8F9D85FB71FEB785"><enum>(4)</enum><text>by allowing for the use of charging infrastructure by employees of the Forest Service and the National Park Service to charge vehicles used by the employees in commuting to or from work.</text></paragraph></subsection><subsection id="idFBFCA02C0CAA4C5188A137EE768284EE"><enum>(c)</enum><header>Requirement</header><text>In carrying out this section, the Secretary and the appropriate agency heads shall ensure that the installation and use of zero-emissions vehicle infrastructure on covered land—</text><paragraph id="id3FB6DF2057A142C8A27F437CE78616D8"><enum>(1)</enum><text>is consistent with—</text><subparagraph id="id75B4DF3D36A04821B6EC9BCD6E189665"><enum>(A)</enum><text>all rules established for the covered land on which the zero-emissions vehicle infrastructure is installed;</text></subparagraph><subparagraph id="idEC5ABD3AFB55407A80496F01FB50F085"><enum>(B)</enum><text>any applicable general management plan prepared under section 100502 of title 54, United States Code, for that covered land;</text></subparagraph><subparagraph id="id8CAB039E3D544CE686FAE5A8BBC4C3BE"><enum>(C)</enum><text>any applicable land and resource management plan developed under section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>) for that covered land; and</text></subparagraph><subparagraph id="id2B967A0EAED741A6876DD61FD30D2F74"><enum>(D)</enum><text>any other organizing or other document relating to the management of that covered land; and</text></subparagraph></paragraph><paragraph id="id8115674CFAC24ADC99A17BBE7E5518B4"><enum>(2)</enum><text>complies with all applicable laws relating to the management of the covered land.</text></paragraph></subsection><subsection id="idC9BCEDF1B35C44F8B7A86EF5C86DB426"><enum>(d)</enum><header>Considerations</header><text>In determining the location for zero-emissions vehicle infrastructure acquired and installed on covered land under subsection (b), the Secretary and the appropriate agency heads shall consider whether a proposed location would—</text><paragraph id="id2287D60ED95D41FF9DC7C5AD0B3F4D89"><enum>(1)</enum><text>support the use of zero-emissions vehicles by Federal fleets and visitors to Federal facilities;</text></paragraph><paragraph id="idc09e39fb67ae4ac1aff23be625333e30"><enum>(2)</enum><text>complement, to the extent feasible, alternative fueling corridor networks established under section 151 of title 23, United States Code;</text></paragraph><paragraph id="id4d20636460a740b992c6de5c9c6ae401"><enum>(3)</enum><text>meet current or anticipated market demands for charging or fueling infrastructure; and</text></paragraph><paragraph id="idfdb77d81c8d7400aad9a7c7d9e87fa39"><enum>(4)</enum><text>enable or accelerate the construction of charging or fueling infrastructure that would be unlikely to be completed without Federal assistance.</text></paragraph></subsection><subsection id="id8cc80aa7a8774eadab48547dbb139a29"><enum>(e)</enum><header>Location of infrastructure</header><text>Any zero-emissions vehicle infrastructure acquired, installed, or operated under subsection (b) shall be located on covered land.</text></subsection><subsection id="ida0cd1199481f4f8e9937230761e163ec"><enum>(f)</enum><header>Funding</header><paragraph id="idA9C51CF3B69C4929BBCC2DAC71712753"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $72,000,000 for each fiscal year.</text></paragraph><paragraph id="idA49F58C035DB4A42847DD99882AAFD90"><enum>(2)</enum><header>Limitations on use of funds</header><subparagraph id="idA2331000589C43D59CC7B33C9C0B03A8"><enum>(A)</enum><header>Federal fleets</header><text>Not more than 20 percent of any funds appropriated to carry out this section may be used to acquire zero-emissions vehicles under subsection (b)(2).</text></subparagraph><subparagraph id="idEFBABBBFF6EA41B78F1776D4C39B57D9"><enum>(B)</enum><header>Urbanized areas</header><text>Not more than 30 percent of any funds appropriated to carry out this section may be used to acquire, install, or operate zero-emissions vehicle infrastructure in an urbanized area (as designated by the Bureau of the Census).</text></subparagraph><subparagraph id="id208DB88137CA4EC686B17955E6CAE768"><enum>(C)</enum><header>Administrative costs</header><text>Not more than 2 percent of any funds appropriated to carry out this section may be used for administrative costs.</text></subparagraph></paragraph></subsection></section><section id="id9387E98F4D7347C6BABDF34AF2068843"><enum>4.</enum><header>Agreements for shuttle or other transportation services on National Forest System land and National
 Park System land</header><text display-inline="no-display-inline">In entering into an agreement with an entity to provide shuttle or other transportation services on or to covered land, an appropriate agency head shall give priority consideration to an entity that would provide the applicable services using zero-emissions vehicles.</text></section><section id="idCC2F5787E2454793B17D355DE3BE7102"><enum>5.</enum><header>Alternative fuel use by light duty Federal vehicles</header><text display-inline="no-display-inline">Section 400AA(a) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6374">42 U.S.C. 6374(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB215D7E0FFFB42FDBA9B251CE4DDEB8B"><paragraph id="id69AD467C52184F6AB7A4C83565B32E1D"><enum>(5)</enum><text>For purposes of making a determination under paragraph (1) as to whether the acquisition of alternative fueled vehicles is practicable for the fleet of the Forest Service or the National Park Service, the Secretary, in cooperation with the Secretary of Agriculture or the Secretary of the Interior, as applicable, shall take into account the availability on National Forest System land or National Park System land, as applicable, of zero-emissions vehicle infrastructure (as defined in section 2 of the <short-title>Green Spaces, Green Vehicles Act of 2021</short-title>) acquired and installed under section 3 of the <short-title>Green Spaces, Green Vehicles Act of 2021</short-title>.</text></paragraph><paragraph commented="no" id="id3FBB5773B75F4BD2B54F32D15269D5BB"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id08ABF5CD65484F2D827A717139F3DAE2"><enum>(A)</enum><text>Notwithstanding any other provision of law, the Secretary, in cooperation with the Secretary of Agriculture or the Secretary of the Interior, as applicable, shall develop a strategy to, by 2030, increase the number of zero-emissions vehicles (as defined in section 2 of the <short-title>Green Spaces, Green Vehicles Act of 2021</short-title>) in the fleet and used in shuttle operations of each of the Forest Service and the National Park Service to the greater of—</text><clause commented="no" id="id51F908A71B4A414FB2C6032423103624" indent="up1"><enum>(i)</enum><text>a number that is equal to 125 percent of the number of zero-emissions vehicles in the fleet and shuttle operations of each agency on the date of enactment of this paragraph; and</text></clause><clause commented="no" id="id79AAF8058ACB40A498857FE78150FEC2" indent="up1"><enum>(ii)</enum><text>a number that is equal to 25 percent of all vehicles in the fleet and shuttle operations of each agency.</text></clause></subparagraph><subparagraph commented="no" id="id08B312F8DD6847C287DA62F016BF9905" indent="up1"><enum>(B)</enum><text>The strategy developed under subparagraph (A) shall be updated not less frequently than once every 2 years.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idB149F2396B974B399016D9DB7F99C6B3"><enum>6.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, and biennially thereafter, the Secretary and the appropriate agency heads shall submit to the appropriate committees of Congress a report that describes—</text><paragraph id="id1A6A4E6B98684F3EA66B623700B345C1"><enum>(1)</enum><text>the location of—</text><subparagraph id="idAD76CC3F6EED4A6491D5A444516B8BD2"><enum>(A)</enum><text>any zero-emissions vehicle infrastructure acquired, installed, or operated, or planned to be acquired, installed, or operated, under section 3(b)(1); and</text></subparagraph><subparagraph id="id3CDF4314EE594ED39901711FA52AFF17"><enum>(B)</enum><text>any zero-emissions vehicles acquired for the fleet of the Forest Service or the National Park Service under section 3(b)(2);</text></subparagraph></paragraph><paragraph id="id340F086DE6634C50A8864FFBBC84AE25"><enum>(2)</enum><text>the amount of Federal funds expended to carry out each duty under section 3(b);</text></paragraph><paragraph id="id41351C690AF64FDCAD919BB2BC100703"><enum>(3)</enum><text>any allocation of costs or benefits between the Federal Government and private or nonprofit entities under an agreement entered into by the Secretary or the appropriate agency heads under section 3(b)(1);</text></paragraph><paragraph id="idE7C75CEA91A74E60A34883221F342878"><enum>(4)</enum><text>the justifications for the expenditure of funds to carry out section 3 during the period covered by the report, including, with respect to any zero-emissions vehicle infrastructure installed during the period covered by the report, an analysis of each of the considerations under section 3(d);</text></paragraph><paragraph id="id0c7db59b934c4ef9b3fc34bd214f32a9"><enum>(5)</enum><text>if applicable, any challenges in acquiring the necessary workforce to install, operate, or maintain—</text><subparagraph id="idb8f59e5fa8fd4f538955148466cd7231"><enum>(A)</enum><text>any zero-emissions vehicle infrastructure acquired, installed, or operated, or planned to be acquired, installed, or operated, under section 3(b)(1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id602e89375f5749519cadad9f53e55994"><enum>(B)</enum><text>any zero-emissions vehicles acquired for the fleet of the Forest Service or the National Park Service under section 3(b)(2);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4E89940032E6497EBA014FD804138EF7"><enum>(6)</enum><text>with respect to each agreement for shuttle or other transportation services on or to covered land entered into by an appropriate agency head during the period covered by the report, how the appropriate agency head complied with the requirements of section 4;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7122CA79E1B544C68A2AB66A5FC2A899"><enum>(7)</enum><text>the strategy developed under paragraph (6)(A) of section 400AA(a) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6374">42 U.S.C. 6374(a)</external-xref>) (including any updates to the strategy under paragraph (6)(B) of that section); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id895C96ECBF7347048D00B1FFACC4689C"><enum>(8)</enum><text>any recommendations of the Secretary with respect to any additional funding or authority needed to carry out paragraph (6) of section 400AA(a) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6374">42 U.S.C. 6374(a)</external-xref>).</text></paragraph></section></legis-body></bill>
