<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5045</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220929">September 29, 2022</action-date><action-desc><sponsor name-id="S306">Mr. Menendez</sponsor> (for himself, <cosponsor name-id="S270">Mr. Schumer</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, and <cosponsor name-id="S364">Mr. Murphy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Justice for United States Victims of State Sponsored Terrorism Act to authorize appropriations for catch-up payments from the United States Victims of State Sponsored Terrorism Fund.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H93811B361B3049B7B6AEA6C97AB9CDC3"><section id="id00a877838d2440b2b9e9e12190568412" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for 9/11 Families Act</short-title></quote>.</text></section><section id="H86F6670DDDFA4750B5849AACA470FB77"><enum>2.</enum><header>Appropriations</header><subsection display-inline="no-display-inline" id="H60F944E59D9F4500AB2F67538D0E4367"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 404(d)(4)(C) of the Justice for United States Victims of State Sponsored Terrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20144">34 U.S.C. 20144(d)(4)(C)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBE707E6DE64B4BCEB699387EE0447DA9"><clause id="H5140F0BABB1C41F788298605FD37115E"><enum>(iv)</enum><header>Authorization</header><subclause id="H244C72C085B9461B86A8CB3E0B1A4C2C"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The Special Master shall authorize lump sum catch-up payments in amounts equal to the amounts described in subclauses (I), (II), and (III) of clause (iii).</text></subclause><subclause id="H78932A216927454CA14E111D973E95A3"><enum>(II)</enum><header>Appropriations</header><item id="H6E672A352958425AB03F73AB6AE616EB"><enum>(aa)</enum><header>In general</header><text>There are authorized to be appropriated and there are appropriated to the Fund such sums as are necessary to carry out this clause, to remain available until expended.</text></item><item id="H541212A764DC4B70B31D4920949BB326"><enum>(bb)</enum><header>Limitation</header><text>Amounts appropriated pursuant to item (aa) may not be used for a purpose other than to make lump sum catch-up payments under this clause.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6DC566D7620847F9AB49FEB2066DF0CF"><enum>(b)</enum><header>Emergency designation</header><paragraph id="H0F1D913D9F8D4F389B355BC28FE53FF4"><enum>(1)</enum><header>In general</header><text>The amounts provided under the amendments made by subsection (a) are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></paragraph><paragraph id="HFA5B0EF82D0A4A2BAA60EEF0B2FB68EE"><enum>(2)</enum><header>Designation in the Senate and the House</header><text>The amendments made by subsection (a) are designated as an emergency requirement pursuant to subsections (a) and (b) of section 4001 of S. Con. Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022.</text></paragraph></subsection><subsection id="HD5BD3A20B6564CCE9666E671A9E23711"><enum>(c)</enum><header>Rescission</header><text>Of the unobligated balances of amounts made available under the heading <quote>Small Business Administration—Business Loans Program Account, CARES Act</quote>, for carrying out paragraphs (36) and (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), $2,982,000,000 are hereby rescinded.</text></subsection></section></legis-body></bill>
