<official-title>To amend part D of title IV of the Social Security Act to allow States to use incentive payments available under the child support enforcement program to improve parent-child relationships, increase child support collections, and improve outcomes for children by supporting parenting time agreements for noncustodial parents in uncontested agreements, and for other purposes. </official-title>

<section commented="no" display-inline="no-display-inline" section-type="section-one" id="S1"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Adequate Resources to Enhance Needed Time with Sons and daughters Act of 2021</short-title></quote> or the <quote><short-title>PARENTS Act of 2021</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id2D337DD54B3C43CA93FC2471ABA1DD15"><enum>2.</enum><header display-inline="yes-display-inline">Expanding permitted uses of incentive payments</header><text display-inline="no-display-inline">Section 458 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/658a">42 U.S.C. 658a</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idE93E4247AAB24DAEAB1D56508B18169C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id9EF9F2A80C874EF59BEB855CC8DA1306"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idB2799B333E4D4EE18DD870EBD5081817"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idEA8476BF13A3403BADA9557CA17568D8"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following new paragraph:</text>

<paragraph commented="no" display-inline="no-display-inline" id="idECC634BC8F4142938D175441492E5F13"><enum>(2)</enum><text display-inline="yes-display-inline">to develop, implement, and evaluate procedures for establishing a parenting time agreement when establishing an initial or modified child support order or a medical support order (including procedures for carrying out a parenting time agreement made prior to the establishment or modification of any such order); or</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id6C3613EE6ADF464FA4E56A347E0A7D1B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text>

<subsection commented="no" display-inline="no-display-inline" id="id463EB64DCF384C008B0E96428B3305F5"><enum>(g)</enum><header display-inline="yes-display-inline">Definitions of parenting time agreement and noncustodial parent</header>
<paragraph commented="no" display-inline="no-display-inline" id="idB1C4617DCC5E4FECA87E644D5BB69008"><enum>(1)</enum><header display-inline="yes-display-inline">Parenting time agreement</header><text display-inline="yes-display-inline">For purposes of subsection (f)(2), the term <term>parenting time agreement</term> means an agreement governing how much time a child spends with the child's custodial parent and the child's noncustodial parent that is mutually agreed to by the parents and is not contested by either parent in any forum. </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id57C88A5A5DD34A7B84EB3C3894FCAA39"><enum>(2)</enum><header display-inline="yes-display-inline">Noncustodial parent</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the term <term>noncustodial parent</term> means the parent of a child that the child does not live with for the majority of the child's time.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
