<official-title>To provide for the reestablishment of the National Fish and Seafood Promotional Council, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seafood Marketing Act of 2022</short-title></quote>.</text></section> <section id="idC1884237A5004F65B72EE28A7EFAE5CC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
<paragraph id="id6b7ae2d7d6b64e8293e115475f5f0bee"><enum>(1)</enum><text>The public health benefits of eating seafood for brain health, heart health, mental health, and overall wellness are well researched and established.</text></paragraph> <paragraph id="id410b9b4840e747349e7c8c968366c9c0"><enum>(2)</enum><text>Prominent organizations have consistently recommended eating at least 2 servings of seafood per week, including—</text>
<subparagraph id="id3B667A6C697A44B394AFA7EA8BE83FBB"><enum>(A)</enum><text>the Department of Agriculture and the Department of Health and Human Services in the Dietary Guidelines for Americans in 2010, 2015, and 2020;</text></subparagraph> <subparagraph id="id9E4BA0FC2DF94D608BAB313E99932E8E"><enum>(B)</enum><text>the Food and Drug Administration since 2004; and </text></subparagraph>
<subparagraph id="idE85E1C6726824605B30CF3968D549E1B"><enum>(C)</enum><text>the American Heart Association.</text></subparagraph></paragraph> <paragraph id="iddbd186975d3e48028fb933c031e35f5f"><enum>(3)</enum><text>Only 1 in 5 people in the United States follow the Dietary Guidelines for Americans to eat at least 2 servings of seafood per week, according to the Centers for Disease Control and Prevention.</text></paragraph>
<paragraph id="id921b53d5412d407c84f6bca792feb235"><enum>(4)</enum><text>Eating seafood at least twice per week can reduce the risk of dying from heart disease by 36 percent.</text></paragraph> <paragraph id="id73d404687d6745d3bfb969efa5b73b60"><enum>(5)</enum><text>More than 877,500 people in the United States die of heart disease or stroke each year, and the economic toll is approximately $363,000,000,000 in healthcare costs and lost productivity.</text></paragraph>
<paragraph id="id47e0bb4baef54f43b86400c1384408b4"><enum>(6)</enum><text>Close to 55,000 deaths per year are associated with insufficient seafood consumption in the United States.</text></paragraph> <paragraph id="id6c314c7177cf4cc8a25b3b521838a5c5"><enum>(7)</enum><text>Pregnant people in the United States eat on average 1.8 ounces of seafood per week compared to the dietary recommendation of 8 to 12 ounces of seafood per week.</text></paragraph>
<paragraph id="idECD34A64CCED4D7CBC3B8A7C75DB4BE4"><enum>(8)</enum><text>Strong medical evidence shows that nutrients specific to seafood reduce the risk of preterm birth by more than 40 percent. In the United States, 1 in 10 infants are born prematurely, which can negatively impact brain development, vision, and hearing. </text></paragraph> <paragraph id="id682fba5d31ee436b9255e2ac29094af6"><enum>(9)</enum><text>Public education campaigns have effectively communicated the health and nutritional benefits of other dietary recommendations.</text></paragraph>
<paragraph id="ida031c8639b88404ca39882b958b99076"><enum>(10)</enum><text>A previous effort to promote the public health benefits of eating seafood was conducted by the National Fish and Seafood Promotional Council, which was Federally funded from 1987 to 1991.</text></paragraph> <paragraph id="idfe67b0b7be3e4e8d83bc7df2a042bc47"><enum>(11)</enum><text>The Marine Fisheries Advisory Committee of the National Oceanic and Atmospheric Administration published a report in July 2020 recommending establishing a National Seafood Council to elevate the narrative of the nutritional value of seafood, which the report states could directly improve the health of the people of the United States.</text></paragraph>
<paragraph id="id31b26534c0a94ecdb8c90c89c4399281"><enum>(12)</enum><text>Increasing the awareness and perception of edible invasive non-native species of seafood can help control aquatic invasive species populations and sustain native stocks. </text></paragraph></section> <section id="idC4C5EC1465D243BB9014659DE6C02427"><enum>3.</enum><header>Reestablishment of National Fish and Seafood Promotional Council</header> <subsection id="id510C3D21F2AF474CB1C411FCAA627232"><enum>(a)</enum><header>First meeting</header><text>Section 205(g) of the Fish and Seafood Promotion Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4004">16 U.S.C. 4004(g)</external-xref>) is amended by striking <quote>first meet</quote> and all that follows and inserting <quote>first meet not later than 180 days after the date of the enactment of the <short-title>Seafood Marketing Act of 2022</short-title>.</quote>.</text></subsection>
<subsection id="idCD6BFDA8A0E741BA96C8D5554455BB84"><enum>(b)</enum><header>Initial appointments</header><text>Section 207(a)(5) of the Fish and Seafood Promotion Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4006">16 U.S.C. 4006(a)(5)</external-xref>) is amended by striking <quote>within ninety</quote> and all that follows and inserting <quote>not later than 90 days after the date of the enactment of the <short-title>Seafood Marketing Act of 2022</short-title>.</quote>.</text></subsection> <subsection id="id68595FBAB8524E72845055A577620FBE"><enum>(c)</enum><header>Termination</header><text>Section 206(g) of the Fish and Seafood Promotion Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4005">16 U.S.C. 4005(g)</external-xref>) is amended by striking <quote>December 31, 1991</quote> and inserting <quote>December 31, 2027</quote>.</text></subsection></section>
<section id="idD547161C906C48889C1F0FC1F49A2D50"><enum>4.</enum><header>Modifications to qualifications for voting members of National Fish and Seafood Promotional Council</header><text display-inline="no-display-inline">Section 205(d) of the Fish and Seafood Promotion Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4004">16 U.S.C. 4004(d)</external-xref>)—</text> <paragraph id="idB0488403DC0D463C9E1D84C31C76D6CA"><enum>(1)</enum><text>in paragraph (1), by striking subparagraphs (E) and (F) and inserting the following:</text>

<subparagraph id="id2856C72111C84A30A0175DD49D2A4728" indent="up1"><enum>(E)</enum><text>one member-at-large with demonstrated expertise in fresh-water and inland commercial fisheries who is not a resident of the States of the Alaska, Pacific, Southeast, and Northeast regions; </text></subparagraph> <subparagraph indent="up1" id="idF577736B05F3470FB67DCC1D5656F93F"><enum>(F)</enum><text>one member-at-large who is a person professionally engaged in consumer marketing and the dissemination of information pertaining to the nutritional benefits and preparation of seafood and seafood products; and </text></subparagraph>
<subparagraph id="id9bc1232bc21a4207b82eaa285c99fde0" indent="up1"><enum>(G)</enum><text>one member-at-large with demonstrated expertise in scientific research on the nutrition and public health benefits of seafood consumption.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="idcf7e7ef0cc544876b4490b88db2a9a90"><enum>(2)</enum><text>by amending paragraph (2) to read as follows:</text>

<paragraph id="id3ee3134f6502466fa1493537bbddcb16" indent="up1"><enum>(2)</enum><text>Of the members appointed pursuant to each of subparagraphs (A) through (D) of paragraph (1), one shall be a harvester, one shall be a processor or a receiver, and at least one shall have demonstrated marketing expertise.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="idA8154586D57A4B429C4D01986143DE12"><enum>5.</enum><header>Funding for Fisheries Promotion Fund</header><text display-inline="no-display-inline">Section 209 of the Fish and Seafood Promotion Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4008">16 U.S.C. 4008</external-xref>) is amended—</text>
<paragraph id="id7D68C4A5DE6F4A9487AE4DB9BB98B70E"><enum>(1)</enum><text>in subsection (b), by amending paragraph (1) to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idBA77829CD3C14CB999AB36858D109BAF"> <paragraph id="id508FB9ADBA21481ABF1F3BB7BB2D5133"><enum>(1)</enum><text>amounts appropriated pursuant to the authorization of appropriations under subsection (e) of this section;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="id31E76849D70142CE8A340F3CB28D95E1"><enum>(2)</enum><text>in subsection (d), by striking <quote>fiscal year 1987 through fiscal year 1991</quote> and inserting <quote>fiscal year 2023 through fiscal year 2027</quote>; and</text></paragraph> <paragraph id="id3CE580D0BD644D65894706D4B3DB7B36"><enum>(3)</enum><text>by adding at the end the following:</text>

<subsection id="id0951C997AD5549058BDBCCC19AFE0B4C"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for the Fund $25,000,000 for each of fiscal years 2023 through 2027.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="id0500157BF6BC40659DCC3ED1752CA810"><enum>6.</enum><header>Definition of seafood in Fish and Seafood Promotion Act of 1986</header> <subsection id="id867C16193DD1421E95E9EAF113A51FAE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 204 of the Fish and Seafood Promotion Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4003">16 U.S.C. 4003</external-xref>) is amended—</text>
<paragraph id="idBB8A819ADA1D4481A71AFCBEDD7073F4"><enum>(1)</enum><text>by striking paragraph (3);</text></paragraph> <paragraph id="idB5B8F78175A743FBAD12067138DBA4EA"><enum>(2)</enum><text>by redesignating paragraphs (4) through (14) as paragraphs (3) through (13), respectively; and</text></paragraph>
<paragraph id="idA635D30F5D63432EAC49449F685904BC"><enum>(3)</enum><text>by inserting after paragraph (13), as redesignated, the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idD900AAF25E8B4A139A59517F47B097F7"> <paragraph id="id3F1AFCAEF6774033A8307C056B976882"><enum>(14)</enum><text><quote>seafood</quote> means finfish, mollusks, crustaceans, seaweed, and all other forms of aquatic life used for human consumption; the term does not include marine mammals and seabirds;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id49536F1B4CA047DCB80860B63BDD153A" commented="no"><enum>(b)</enum><header>Conforming amendments</header><text>The Fish and Seafood Promotion Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4001">16 U.S.C. 4001 et seq.</external-xref>) is amended—</text> <paragraph commented="no" id="idEEA9ECF2279F4518BEA5379EB9C6E954"><enum>(1)</enum><text>in section 202 (<external-xref legal-doc="usc" parsable-cite="usc/16/4001">16 U.S.C. 4001</external-xref>)—</text>
<subparagraph commented="no" id="id3FEAC13743FB4F92B5859837287C91CA"><enum>(A)</enum><text>in paragraph (1), by striking <quote>fish resources</quote> and inserting <quote>seafood resources</quote>;</text></subparagraph> <subparagraph commented="no" id="id619A7A42F7E24CB18E63BF75224FA769"><enum>(B)</enum><text>in paragraph (3), by striking <quote>fish contribute</quote> and inserting <quote>seafood contributes</quote>; and</text></subparagraph>
<subparagraph commented="no" id="id731DE05BD0004C4F8213F8D65AB14A94"><enum>(C)</enum><text>in paragraph (6), by striking <quote>fish species</quote> and inserting <quote>seafood species</quote>;</text></subparagraph></paragraph> <paragraph commented="no" id="idF1B3B8E530864EF2AF28E9D82A47B554"><enum>(2)</enum><text>in section 203 (<external-xref legal-doc="usc" parsable-cite="usc/16/4002">16 U.S.C. 4002</external-xref>)—</text>
