which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Deposit Insurance Act and the Federal Credit Union Act to provide exceptions to the prohibition on participation by individuals convicted of certain offenses, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H8148B6725D3247D6AF4DDB87807CE3BF"><section section-type="section-one" id="idDE23372798424AD3A836324167EB5150"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Hiring in Banking Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="S1"><enum>2.</enum><header>Penalties for unauthorized participation by convicted individual</header><subsection id="id576D3619787947E8BD53DB39975A69C6"><enum>(a)</enum><header>Insured depository institutions</header><text display-inline="yes-display-inline">Section 19(a) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1829">12 U.S.C. 1829(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id222C5FA75D7C473CAE3C3F8962EA93BA"><paragraph id="idDDECC1410507497292CCCC095604824D"><enum>(3)</enum><header>Prior written consent not required</header><subparagraph id="id46C1E1DD89044680BC8AA891BF7B4373"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the prior written consent of the Corporation shall not be required under paragraph (1) for any person who has been convicted of an offense referred to in paragraph (1)(A) or has agreed to enter into a pretrial diversion or similar program with a prosecution for such an offense—</text><clause id="id66a3860eb3924639aa8f541e6677a276"><enum>(i)</enum><text>after the 7-year period beginning on the date that the sentencing or program requirements in connection with the conviction or pretrial diversion or similar program have been completed;</text></clause><clause id="idc17170a86849449daed9e297bfd9d6a5"><enum>(ii)</enum><text>after the 30-month period beginning on the date that the sentencing or program requirements in connection with the conviction or pretrial diversion or similar program have been completed if the person who committed the offense was under 21 years of age; or</text></clause><clause id="idced6b3820d414a93a0bcc01feff92b7b"><enum>(iii)</enum><text>if the conviction or agreement for such offense has been pardoned, sealed, or expunged even if any record of the conviction or program entry remain accessible by courts, law enforcement, or in connection with the employment or application for employment of the person in a position where a criminal background check is required by law.</text></clause></subparagraph><subparagraph id="idf0b2180ed27a4c5b9a3ea915d0c991f7"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph (A) shall not apply to—</text><clause id="idbb24867a665c494983c45023734805fa"><enum>(i)</enum><text>any offense described in paragraph (2)(A);</text></clause><clause id="idd02386a2fee54d9e906dc35c340a1310"><enum>(ii)</enum><text>any person who intends to acquire control of any insured depository institution; or</text></clause><clause id="id38a829db5ab64fd3b05385ba3870310a"><enum>(iii)</enum><text>any person who seeks to become a director or executive officer of any insured depository institution.</text></clause></subparagraph><subparagraph id="idd7dca57f23fd46299b9cb5fd3f5ea2ec"><enum>(C)</enum><header>Definitions</header><text>In this paragraph—</text><clause id="idD6052887FBD3470297AB7C8155B6A8CA"><enum>(i)</enum><text>the term <term>control</term> has the meaning given the term in section 7(j)(8); and</text></clause><clause id="id15D81EF0C1E94EFB8CE516E3431E5BA9"><enum>(ii)</enum><text>the term <term>executive officer</term> has the meaning given the term in section 22(h) of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/375b">12 U.S.C. 375b(h)</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id844073EFF513463C905A0FD27F3F35FF"><enum>(b)</enum><header>Insured credit unions</header><text>Section 205(d) of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1785">12 U.S.C. 1785(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA99E162B57744C8BB8E9DA7859017A61"><paragraph id="id5DBE821D7C3043C9A91DEE159A860D03"><enum>(4)</enum><header>Prior written consent not required</header><subparagraph id="id83D612DA123C4AE8BA10F294204BC702"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the prior written consent of the Board shall not be required under paragraph (1) for any person who has been convicted of an offense referred to in paragraph (1)(A) or has agreed to enter into a pretrial diversion or similar program with a prosecution for such an offense—</text><clause id="idB10ACFAF56364A4F87592421C61D9471"><enum>(i)</enum><text>after the 7-year period beginning on the date that the sentencing or program requirements in connection with the conviction or pretrial diversion or similar program have been completed;</text></clause><clause id="id5A33BBEE9D5446DD9E79CD1A81021F55"><enum>(ii)</enum><text>after the 30-month period beginning on the date that the sentencing or program requirements in connection with the conviction or pretrial diversion or similar program have been completed if the person who committed the offense was under 21 years of age; or</text></clause><clause id="id743806B794564C13ADEB6FDB007C9977"><enum>(iii)</enum><text>if the conviction or agreement for such offense has been pardoned, sealed, or expunged even if any record of the conviction or program entry remain accessible by courts, law enforcement, or in connection with the employment or application for employment of the person in a position where a criminal background check is required by law.</text></clause></subparagraph><subparagraph id="idAE782797756C4E3694B1EC78F1CBD964"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph (A) shall not apply to—</text><clause id="id4C677C2DD012415391B5F7A13C070F86"><enum>(i)</enum><text>any offense described in paragraph (2)(A); or</text></clause><clause id="id52BA31FDC009447880E8356116FF2677"><enum>(ii)</enum><text>any person who seeks to become a director or senior executive officer, as defined under section 212(f).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
