which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve disaster assistance programs of the Department of Agriculture, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="idFB803B7DA1C1423DA5EDDB653A9A8C78" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agriculture Disaster Assistance Improvement Act of 2022</short-title></quote>.</text></section><section id="idC1393735D5584DEBB7B77A764E206F2C" section-type="subsequent-section"><enum>2.</enum><header>Emergency conservation program</header><text display-inline="no-display-inline">Title IV of the Agricultural Credit Act of 1978 is amended by inserting after section 402B (<external-xref legal-doc="usc" parsable-cite="usc/16/2202b">16 U.S.C. 2202b</external-xref>) the following:</text><quoted-block id="id72B8EC7A8F084BBF8AAE348706DFA50B" display-inline="no-display-inline" style="OLC"><section id="id7E8240D62DDC45A69AB9DCDE50B88F92"><enum>402C.</enum><header>Additional requirements for the emergency conservation program</header><subsection id="id1D492CA13AD247A984CAEFC74A7CD2EA"><enum>(a)</enum><header>Eligibility of Federal, State, and local land users</header><paragraph id="id0A096A7EAD114E18A021E0FDF53E4C7E"><enum>(1)</enum><header>In general</header><text>An agricultural producer eligible to receive payments under sections 401 and 402 includes a person that—</text><subparagraph id="id39302C962DD04011948BD4B1A929F8F7"><enum>(A)</enum><text>holds a permit from the Federal Government to conduct agricultural production or grazing on Federal land; or</text></subparagraph><subparagraph id="idA52F63AC25E44BDA98AA9BAD66C84627"><enum>(B)</enum><text>leases land from a State or unit of local government to conduct agricultural production or grazing on that land.</text></subparagraph></paragraph><paragraph id="id436CB649F88C45438E246F8D74AF9763"><enum>(2)</enum><header>Effect</header><text>Nothing in this subsection authorizes the Secretary to make a payment under section 401 or 402 to a State or unit of local government.</text></paragraph></subsection><subsection id="id928F587801544E87B44D362DE3C4DB76"><enum>(b)</enum><header>Permanent improvements</header><text>Emergency measures eligible for payments under sections 401 and 402 include—</text><paragraph id="id0EF15000650F483984410C8A5904BE93"><enum>(1)</enum><text>new permanent measures, including permanent water wells and pipelines; and</text></paragraph><paragraph id="id2ED3F0356FD24D22AC5E7A866C571570"><enum>(2)</enum><text>replacement or restoration of existing emergency measures with permanent measures, including permanent water wells and pipelines.</text></paragraph></subsection><subsection id="id22978BD919C743DBAD1752DD0D390DF7"><enum>(c)</enum><header>Streamlining application process</header><paragraph id="id08FCDD30FBE5488CB89AC6FBDE7AA27A"><enum>(1)</enum><header>Waiver of public comment</header><text>During a drought emergency, as determined by the Secretary, the 30-day public comment period required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) shall be waived with respect to an application to carry out emergency measures under section 401 or 402 on land administered by the Secretary of the Interior, acting through the Director of the Bureau of Land Management (referred to in this subsection as the <term>Secretary of the Interior</term>).</text></paragraph><paragraph id="id702ECCDE72014B17ACE25483E0D9E2B6"><enum>(2)</enum><header>Acceptance of NRCS reviews</header><text>With respect to an application to carry out emergency measures under section 401 or 402 on land administered by the Secretary of the Interior, the Secretary of the Interior may accept—</text><subparagraph id="id0BEE896AD91D4738A677F72AC39152AE"><enum>(A)</enum><text>during a drought emergency, as determined by the Secretary, an archeological review conducted by the Secretary, acting through the Chief of the Natural Resources Conservation Service, for purposes of an archeological review required to be conducted;</text></subparagraph><subparagraph id="id4918DA52C73F4B3E8EA1F194FFDE83D0"><enum>(B)</enum><text>an environmental review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) conducted by the Secretary, acting through the Chief of the Natural Resources Conservation Service, for purposes of such an environmental review required to be conducted; and</text></subparagraph><subparagraph id="id86AB80A200EA4A7DADDB3BCC0CEA5550" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>a review under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) conducted by the Secretary, acting through the Chief of the Natural Resources Conservation Service, for purposes of such a review required to be conducted.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section section-type="subsequent-section" id="id81749CCCFDBA4D15ADFEF4865CC786AA"><enum>3.</enum><header>Emergency forest restoration program</header><text display-inline="no-display-inline">Section 407 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206</external-xref>) is amended—</text><paragraph id="idD9C3514F5B044D66AD442935FCE7103E"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id2C7DC09764BF4DFBBEC4F7109B866D2F"><enum>(A)</enum><text>by redesignating paragraphs (1) through (3) as paragraphs (3) through (5), respectively;</text></subparagraph><subparagraph id="idE7B892E95135427E8A6AF0F4A3DAB738"><enum>(B)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id18FB681D2E8841BA9BC825F578A2F108"><paragraph id="idC130C34C4BEE438BB2781F60B5D925CC"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="idBD380C2152C14E9DBA47E6EA83FA2191"><enum>(A)</enum><text>with respect to nonindustrial private forest land, an owner of the nonindustrial private forest land; </text></subparagraph><subparagraph id="id34B461CAF31E4ABE9F70F7824AD84FC0"><enum>(B)</enum><text>with respect to Federal land, a person that holds a permit from the Federal Government to conduct agricultural production or grazing on the Federal land; and </text></subparagraph><subparagraph id="idFFBF247EA6304F1A86BA503E0769D764"><enum>(C)</enum><text>with respect to land owned by a State or a unit of local government, a person that leases land from the State or unit of local government to conduct agricultural production or grazing on that land.</text></subparagraph></paragraph><paragraph id="id8B9DEA6D721B407DAD007F57F7790196"><enum>(2)</enum><header>Eligible land</header><text>The term <term>eligible land</term> means—</text><subparagraph id="idB46EA778E17C4D72A87B822995BB434F"><enum>(A)</enum><text>nonindustrial private forest land; </text></subparagraph><subparagraph id="idFD6441ECDAF24E8892A11766B8F0935A"><enum>(B)</enum><text>Federal land; and</text></subparagraph><subparagraph id="id6D84289917B6496581105B8EBF40309D"><enum>(C)</enum><text>land owned by a State or unit of local government.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idCFC5AD9466AF4142B36551DB061E5364"><enum>(C)</enum><text>in paragraph (3) (as so redesignated)—</text><clause id="id6DC9F3E9C8F0489393112D9699B596C5"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="id862F07236C504BBB9917E725B9D6FCB5"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>nonindustrial private forest land</quote> and inserting <quote>eligible land</quote>; and</text></subclause><subclause id="id81DA25F8BBC344BEA0AC08FBF8AADB5F"><enum>(II)</enum><text>by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and indenting appropriately;</text></subclause></clause><clause id="idB5B5ABA6B90C4A009665FCC9D1ADE3E3"><enum>(ii)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text></clause><clause id="id58438F828DE24E72A4A3E859C6E57F8A"><enum>(iii)</enum><text>in the matter preceding clause (i) (as so redesignated), by striking <quote>The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F1210BDA6D44910958FD12257302139"><subparagraph id="idBB759632DA0943CF845AFD23E739FC4F"><enum>(A)</enum><header>In general</header><text>The term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idA27971A954854321967692A469A373BE"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB6B310511F5442D6B175AADAF7F1A0D9"><subparagraph id="id315CDF75E09C428E871640A6DFAD6853"><enum>(B)</enum><header>Inclusions</header><text>The term <term>emergency measures</term> includes—</text><clause id="idDC7622ABA603460EB74F0ABAB051692F"><enum>(i)</enum><text>new permanent measures described in subparagraph (A), including permanent water wells and pipelines; and</text></clause><clause id="id99589038AC1B45AC84D60F2B531ED0EB"><enum>(ii)</enum><text>replacement or restoration of existing emergency measures with permanent measures described in subparagraph (A), including permanent water wells and pipelines.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id37527526A7AF4965BC8A9B1E142A67D4"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id8644E26C15414A9EBAAAE9CC71A0A495"><enum>(A)</enum><text>by striking <quote>an owner of nonindustrial private forest land who</quote> and inserting <quote>an eligible entity that</quote>; and</text></subparagraph><subparagraph id="id5586BD52A58C474387FDFFE7BEA93138"><enum>(B)</enum><text>by striking <quote>restore the land</quote> and inserting <quote>restore eligible land</quote>;</text></subparagraph></paragraph><paragraph id="id703C6C162B4C4411A63790C9C0089BCC"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="idE7484C42B2EA408F85588ABC0365C8D1"><enum>(A)</enum><text>by striking <quote>owner must</quote> and inserting <quote>eligible entity shall</quote>; and</text></subparagraph><subparagraph id="idC8496D3432EE48119A82B9EDCF153637"><enum>(B)</enum><text>by striking <quote>nonindustrial private forest land</quote> and inserting <quote>eligible land</quote>;</text></subparagraph></paragraph><paragraph id="id8E24C78681634C3BA66B622A82809B51"><enum>(4)</enum><text>in subsection (d), by striking <quote>an owner of nonindustrial private forest land</quote> and inserting <quote>an eligible entity</quote>;</text></paragraph><paragraph id="id4193B23E3AA5465F9C012E781101D343"><enum>(5)</enum><text>by redesignating subsection (e) as subsection (g); and</text></paragraph><paragraph id="id7F058C1CC35B4F04A0FA7FAAF65D5ACB"><enum>(6)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDA028352FA6D4F908A2EFD7A439038F1"><subsection id="id219E47E14821427EBB80D72A067EB4EF"><enum>(e)</enum><header>Streamlining application process</header><paragraph id="idB6AFE1ADCD9847239CF97D1987200B85"><enum>(1)</enum><header>Waiver of public comment</header><text>During a drought emergency, as determined by the Secretary, the 30-day public comment period required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) shall be waived with respect to an application to carry out emergency measures under this section on land administered by the Secretary of the Interior, acting through the Director of the Bureau of Land Management (referred to in this subsection as the <term>Secretary of the Interior</term>).</text></paragraph><paragraph id="idD6E233218F204AD3AEF529C7B363E9BC"><enum>(2)</enum><header>Acceptance of NRCS reviews</header><text>With respect to an application to carry out emergency measures under this section on land administered by the Secretary of the Interior, the Secretary of the Interior may accept—</text><subparagraph id="id3DFB231C10F84A0587016DD2A675F1DD"><enum>(A)</enum><text>during a drought emergency, as determined by the Secretary, an archeological review conducted by the Secretary, acting through the Chief of the Natural Resources Conservation Service, for purposes of an archeological review required to be conducted;</text></subparagraph><subparagraph id="id049FE0FEE14C432B84711F8E68C1D0CC"><enum>(B)</enum><text>an environmental review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) conducted by the Secretary, acting through the Chief of the Natural Resources Conservation Service, for purposes of such an environmental review required to be conducted; and</text></subparagraph><subparagraph id="id685703BC85D7455698958ECDC70F6DF1" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>a review under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) conducted by the Secretary, acting through the Chief of the Natural Resources Conservation Service, for purposes of such a review required to be conducted.</text></subparagraph></paragraph></subsection><subsection id="idF5E712B5040E40E4863ACA1DD2C3EA72"><enum>(f)</enum><header>Effect</header><text>Nothing in this section authorizes the Secretary to make a payment under this section to a State or unit of local government.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section section-type="subsequent-section" id="idFB89629E57AE404F81EDD6123E39D616"><enum>4.</enum><header>Livestock forage disaster program</header><text display-inline="no-display-inline">Section 1501(c)(3)(D)(ii)(I) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9081">7 U.S.C. 9081(c)(3)(D)(ii)(I)</external-xref>) is amended—</text><paragraph id="idD5C1109C4A1C4D7EBBD1999D1AE6B20D"><enum>(1)</enum><text>by striking <quote>at least 8 consecutive</quote> and inserting the following: “not less than—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id55AEB8A1791E4315A90EC97F519F9117"><item id="id123B144A84674853B9C4F1ACF8CEA47B"><enum>(aa)</enum><text>4 consecutive weeks during the normal grazing period for the county, as determined by the Secretary, shall be eligible to receive assistance under this paragraph in an amount equal to 1 monthly payment using the monthly payment rate determined under subparagraph (B); or</text></item><item id="id726EB28D5659437BAC5F899B75DE2A9A"><enum>(bb)</enum><text>8 consecutive</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idA6573EAC0E414F3BA7AA5FC973C103C7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in item (bb) (as so designated), by striking <quote>1 monthly payment</quote> and inserting <quote>2 monthly payments</quote>.</text></paragraph></section><section display-inline="no-display-inline" commented="no" id="id695F0B98E81648CAB68EDF75D000831A"><enum>5.</enum><header>Emergency assistance for livestock, honey bees, and farm-raised fish</header><subsection display-inline="no-display-inline" commented="no" id="id971EC901AB54492495FE92F48F30D1A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1501(d) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9081">7 U.S.C. 9081(d)</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" commented="no" id="idC5993F5ABFC14BCDB10CE57A8E58AE8B"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>drought,</quote> after <quote>adverse weather,</quote>;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idDE6D3E25A22146659C3A353415D56C85"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>adverse weather or drought (such as added transportation costs, feed costs, and reduced honey crops for eligible producers of honey bees),</quote> after <quote>disease,</quote>;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id5C7F07059FBB4615B5D0EA821863F98E"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph display-inline="no-display-inline" commented="no" id="id4251E86C3A044EE2AEE4ED441E5A7CED"><enum>(A)</enum><text>by striking <quote>In the case</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7AC906BFD9FA4593957270DC9204F6E1"><subparagraph display-inline="no-display-inline" commented="no" id="idE3F70BE8FE3D4267B5278F1CCBB61411"><enum>(A)</enum><header>In general</header><text>In the case</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id1C142908545946F49A6D917462C0B193"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id580CF11C5E614349896F1E4F92BB5C2A"><subparagraph display-inline="no-display-inline" commented="no" id="id3A357035BFAF47A8B417EDFE0AFDAD63"><enum>(B)</enum><header>Requirements</header><text>The payment rate under subparagraph (A) shall—</text><clause display-inline="no-display-inline" commented="no" id="id98F836244E984841916B575DC2CC9732"><enum>(i)</enum><text>in the case of eligible producers of honey bees, incorporate per-hive and per-colony rates of loss; and</text></clause><clause display-inline="no-display-inline" commented="no" id="id63AA5F5F73C24556BC7A3CA479B3BE5F"><enum>(ii)</enum><text>incorporate a standardized expected mortality rate of 15 percent.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idD9EE5514601C40FFA4832FA1DC299616"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00E5063AE1B841A2B4E6EF3279F71234"><paragraph display-inline="no-display-inline" commented="no" id="id50DF854D92DD4FD896EDF1B761C91B8A"><enum>(5)</enum><header>Documentation</header><subparagraph display-inline="no-display-inline" commented="no" id="id9C0BE442C12343EAAEBF788AA96153B1"><enum>(A)</enum><header>In general</header><text>Any requirements for the submission of documentation by an eligible producer to receive a payment under this subsection shall be consistent nationwide.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idD4FFE4005A0B48B0ADB821D73B4E4FC3"><enum>(B)</enum><header>Producers of honey bees</header><text>The Secretary, in consultation with eligible producers of honey bees, shall establish a standard, for purposes of this subsection, for—</text><clause display-inline="no-display-inline" commented="no" id="idFA2EC5D39D1445F3A2775BCB3E688DAF"><enum>(i)</enum><text>collecting data; and</text></clause><clause display-inline="no-display-inline" commented="no" id="idCD3EC376954A4CEF8BD900991FC167B8"><enum>(ii)</enum><text>setting an annual rate for replacing colonies and hives of honey bees.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id138E851046F64B4AB36182C78DB4F199"><enum>(b)</enum><header>Applicability to producers of honey bees</header><text>The Secretary of Agriculture shall apply the amendments made by subsection (a) to producers of honey bees such that there is no limit on the size of a beekeeping operation with respect to those amendments.</text></subsection></section><section id="id26f40f4759b14813a668c0c162bafa9d"><enum>6.</enum><header>Drought monitor interagency working group</header><subsection id="id5b0a3390e5ba4d0a9a57348cf6d6506c"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall establish an interagency working group (referred to in this section as the <term>working group</term>) to improve the availability of consistent, accurate, and reliable data for use in producing the United States Drought Monitor in accordance with section 12512 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/5856">7 U.S.C. 5856</external-xref>).</text></subsection><subsection id="id56bd45b9fbe14f84bbf1b5af32278c54"><enum>(b)</enum><header>Membership</header><text>The working group shall consist of not fewer than—</text><paragraph id="ida8c0d2212b584f3abc54406d3398c381"><enum>(1)</enum><text>3 representatives from the Department of Agriculture, including 1 representative from each of—</text><subparagraph id="idb47236837a504c248b807dc4e4f57c44"><enum>(A)</enum><text>the Office of the Chief Economist, who shall serve as the Chair of the working group; </text></subparagraph><subparagraph id="id5164b41cc6714f989e6f015841887257"><enum>(B)</enum><text>the Forest Service; and</text></subparagraph><subparagraph id="id506c162e091f4965bd5b27dbe50f5cc9"><enum>(C)</enum><text>the Farm Service Agency; </text></subparagraph></paragraph><paragraph id="idebc6509b6cb144e285596ffdc57c3b2e"><enum>(2)</enum><text>4 representatives from the National Oceanic and Atmospheric Administration, including 1 representative from each of—</text><subparagraph id="ide1df89c4c7084252961182f6785d4865"><enum>(A)</enum><text>the Climate Prediction Center;</text></subparagraph><subparagraph id="id63b4e0f57a924b75aa426eea0c559877"><enum>(B)</enum><text>the National Centers for Environmental Information;</text></subparagraph><subparagraph id="id5624cf36192f4babb0bcc9a0efa6aae7"><enum>(C)</enum><text>the National Integrated Drought Information System; and</text></subparagraph><subparagraph id="id7fad9393258946a79e1c6111a9f49fb6"><enum>(D)</enum><text>the National Mesonet Program; </text></subparagraph></paragraph><paragraph id="id2549cf3610a34d55a70234b82fc42853"><enum>(3)</enum><text>1 representative from the National Drought Mitigation Center;</text></paragraph><paragraph id="id81454f01f98b4d089097aa54cc54c1b0"><enum>(4)</enum><text>1 representative from the Department of the Interior; and</text></paragraph><paragraph id="idc4f4f965809846478c4022074befac3b"><enum>(5)</enum><text>3 representatives from mesonet programs in States—</text><subparagraph id="id551109fe402749759420a1568ad49301"><enum>(A)</enum><text>that have experienced severe drought, as determined by the United States Drought Monitor, in not less than 5 calendar years during the period of calendar years 2012 through 2021; and</text></subparagraph><subparagraph id="id319a73d3816c46f58f1725f0282a717d"><enum>(B)</enum><text>more than 50 percent of the land area of which is designated by the Economic Research Service as a Level 1 frontier and remote area.</text></subparagraph></paragraph></subsection><subsection id="idefdeb3dde1484b1bb742cd9ae32b1ec2"><enum>(c)</enum><header>Duties</header><text>The working group shall—</text><paragraph id="id5e501744bf804840bc243a0d0f4724d0"><enum>(1)</enum><text>develop a means for the inclusion of additional in-situ data into the process of developing the United States Drought Monitor, including—</text><subparagraph id="id95767d1510b04ba3849ff38956bc8d62"><enum>(A)</enum><text>determining minimum requirements for data to be included in the United States Drought Monitor;</text></subparagraph><subparagraph id="id95d97199ea5f4e439170bfe7b23d13b7"><enum>(B)</enum><text>identifying data available from other government agencies, including through portals managed by the National Oceanic and Atmospheric Administration; and</text></subparagraph><subparagraph id="ide37850a892994873aed6f583f7711a30"><enum>(C)</enum><text>identifying gaps in coverage and determining solutions to address those gaps; </text></subparagraph></paragraph><paragraph id="id22c8bba5800e4cc992590630f6ef1b31"><enum>(2)</enum><text>identify and address potential barriers to the use of existing data, including—</text><subparagraph id="ide5b52c3053234c639fbabd41ea684a00"><enum>(A)</enum><text>identifying Federal datasets that would be of immediate use in developing the United States Drought Monitor where access is restricted to some or all authors of the United States Drought Monitor; and</text></subparagraph><subparagraph id="iddf8e7d2e909a42c780c4603dc340ec00"><enum>(B)</enum><text>developing proposed accommodations, modifications to contractual agreements, or updates to interagency memoranda of understanding to allow for incorporation of datasets identified under subparagraph (A);</text></subparagraph></paragraph><paragraph id="id4814f804e57248b0bfb56855e54093b4"><enum>(3)</enum><text>develop an open and transparent methodology for vetting data products developed using remote sensing or modeling;</text></paragraph><paragraph id="id75a1f82bfec9465683f1cd4b83666be0"><enum>(4)</enum><text>if determined appropriate by the working group, develop a methodology for inclusion of data that may otherwise be excluded from the United States Drought Monitor due to shorter periods of record; and</text></paragraph><paragraph id="ida2737ef3563f4216909827a46b9923af"><enum>(5)</enum><text>identify and address any other issues relating to data availability and quality, as determined appropriate by the Chair of the working group.</text></paragraph></subsection><subsection id="id684b8f16555b47968bfe1302a3934d90"><enum>(d)</enum><header>Report</header><paragraph id="idB5A5938F3BBE4EC9AABC06F8CB7A0456"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the working group shall submit to the Secretary of Agriculture, the Secretary of Commerce, the Secretary of the Interior, and the relevant committees of Congress a report containing recommendations for changes in policies, regulations, guidance documents, or existing law to meet the objectives described in subsection (c).</text></paragraph><paragraph id="idF4DC1FA35D3A4E78AF643811D96BF25C"><enum>(2)</enum><header>Definition of relevant committees of Congress</header><text>In this subsection, the term <term>relevant committees of Congress</term> means—</text><subparagraph id="id5461DE5E417445ABAA23BDB8D6ACEA53"><enum>(A)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></subparagraph><subparagraph id="id3953D0C5BAC54785AF5EFC8B32CC86EF"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="id7CB47BFD6A8C495CBCAF3992BF5A3E6F"><enum>(C)</enum><text>the Committee on Agriculture of the House of Representatives; and</text></subparagraph><subparagraph id="idA39270D762614EEBA02C6799C27E2C13"><enum>(D)</enum><text>the Committee on Science, Space, and Technology of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="iddb526bff0cc14f668951d97d4453d589"><enum>(e)</enum><header>Action by the Secretary</header><text>Not later than 180 days after the date of submission of the report under subsection (d), the Secretary of Agriculture, in coordination with the Secretary of Commerce and the Secretary of the Interior, shall incorporate, to the extent practicable, the recommendations of the working group to improve the United States Drought Monitor in accordance with section 12512 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/5856">7 U.S.C. 5856</external-xref>).</text></subsection><subsection id="idfbd758dd51ff4aa1b2543a76efd91d42"><enum>(f)</enum><header>Termination</header><text>The working group shall terminate on the date that is 90 days after the date on which the report is submitted under subsection (d).</text></subsection></section><section id="idae5f329ea10d4b2c84e37f178638201e"><enum>7.</enum><header>Alignment of Farm Service Agency and Forest Service drought response</header><subsection id="idc94a86cf529b48e58a3c613950cb575a"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of submission of the report under section 6(d), the Administrator of the Farm Service Agency and the Chief of the Forest Service shall enter into a memorandum of understanding to better align drought response activities of the Farm Service Agency and the Forest Service (referred to in this section as the <term>agencies</term>).</text></subsection><subsection id="ida978f3250aa944f1bae89b6d7b8b23ad"><enum>(b)</enum><header>Contents</header><text>The memorandum of understanding entered into under subsection (a) shall include—</text><paragraph id="id1baaeae0f92e49d8ba5b90938ef4be17"><enum>(1)</enum><text>a commitment to better align practices of the agencies with respect to determining the severity of regional drought conditions;</text></paragraph><paragraph id="id625bf2ed894743ff95b0aeffcd3db7ef"><enum>(2)</enum><text>a strategy for amending those determinations to ensure consistent policy with respect to drought response in cases where the agencies are making inconsistent determinations within the same spatial scale;</text></paragraph><paragraph id="idbea3f756e86a459ab68da027f0d78adb"><enum>(3)</enum><text>an agreement to utilize, to the extent practicable, the United States Drought Monitor in making those determinations; and</text></paragraph><paragraph id="id215a3c6e61314d1d83f911e3b163181a"><enum>(4)</enum><text>an agreement to provide consistent information to grazing permittees, operators, and other stakeholders affected by determinations relating to drought. </text></paragraph></subsection></section></legis-body></bill>
