<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5022</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220929">September 29, 2022</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> (for herself, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, and <cosponsor name-id="S380">Mr. Peters</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow recipients of certain loans made or guaranteed by the Small Business Administration to use the loan proceeds to provide childcare services to employees, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Childcare Development of Employee Solutions for Early Rearing in Towns with Shortages Act</short-title></quote> or the <quote><short-title>Childcare DESERTS Act</short-title></quote>.</text></section><section id="id1D77746B80FB4A8B8780167E6F09B544"><enum>2.</enum><header>Childcare services as allowable expense under business loan and 504/CDC loan programs</header><subsection id="idEFA6B0F39B744524A07CEBE17CBB37EC"><enum>(a)</enum><header>Business loans</header><text>Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8686AA20CEAA4DBFA4CEBC806C0D2767"><paragraph id="idDF2D103CEF524E9BB5B1276DBECF2BDF"><enum>(38)</enum><header>Childcare services</header><text>The Administration may guarantee loans under this subsection to a small business concern for which the proceeds are used to provide childcare services to members of the immediate family of employees of the small business concern.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA54272E1FF744EFDA399F4206EF31D29"><enum>(b)</enum><header>504/CDC loans</header><text>Section 502(1) of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/696">15 U.S.C. 696(1)</external-xref>) is amended—</text><paragraph id="id689C08C3AF5D45BB95D0A2744ED6C021"><enum>(1)</enum><text>by striking <quote>borrower to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id64354DAF31DB4807B009D4B325A0D680"><text>borrower—</text><subparagraph id="idD241A0AB31124BF4A0763BCC0BDE2048"><enum>(A)</enum><text>to</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id0439F6B897F2400CAA0738364BC95BEB"><enum>(2)</enum><text>in subparagraph (A), as so designated, by striking <quote>and for a</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id9823D718937645FFBDF596161AFBE46E"><text>; and</text><subparagraph id="id2D6F2B27FA9B478282C685421E8EA6A8"><enum>(B)</enum><text>for—</text><clause id="id11ED1149147D40FFB1526C1792B8B4D6"><enum>(i)</enum><text>a</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idBD19E2D6AF97437E85AF3A9470EEB858"><enum>(3)</enum><text>in subparagraph (B), as so designated—</text><subparagraph id="id0C8E39779EFA4ECB9A1B3046472B7369"><enum>(A)</enum><text>in clause (i), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id2A32680E4C284302AD09F871BA438598"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0C001D488B1240B2BFCB7348BB78C2EA"><clause id="id8F73214392984643BBD9F463F74CD820"><enum>(ii)</enum><text>providing childcare services to members of the immediate family of employees of the small business concern.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id31728AA941B84D0EA6C27DC7DC255284"><enum>(c)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator of the Small Business Administration, in partnership with the Assistant Secretary of the Administration for Children and Families, shall issue regulations to implement the amendments made by this Act. </text></subsection></section></legis-body></bill>
