which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish Department of Homeland Security funding restrictions on institutions of higher education that have a relationship with Confucius Institutes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3830206995C448A79C6AAF2BAF963511"><section commented="no" section-type="section-one" id="HA90C5667ED9543438A754890E73AC971"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Restrictions on Confucius Institutes and Chinese Entities of Concern Act</short-title></quote>.</text></section><section id="HF5411FEA50674F39905760A37D991583"><enum>2.</enum><header>Limitations on Confucius Institutes’ host schools</header><subsection id="H1A2D02BDEACD453EA6042AD7723C223E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H98C32402E4B44DA1A3D41CD96A0E3D80"><enum>(1)</enum><header>Chinese entity of concern</header><text>The term <quote>Chinese entity of concern</quote> means any university or college in the People’s Republic of China that—</text><subparagraph id="H68286B10CBD0471FB0E49474C8C7AF7B"><enum>(A)</enum><text>is involved in the implementation of military-civil fusion;</text></subparagraph><subparagraph id="H4E17AC5646EC4BA68D225F1890C5232E"><enum>(B)</enum><text>participates in the Chinese defense industrial base;</text></subparagraph><subparagraph id="HD1A662C1B5BC4DC289DF569D63C33960"><enum>(C)</enum><text>is affiliated with the Chinese State Administration for Science, Technology and Industry for the National Defense;</text></subparagraph><subparagraph id="HD80C57FC01094DBAA48A90BA43ABF11E"><enum>(D)</enum><text>receives funding from any organization subordinate to the Central Military Commission of the Chinese Communist Party; or</text></subparagraph><subparagraph id="HF3BC1769FFAE4E959AE9E7F6736CE349"><enum>(E)</enum><text>provides support to any security, defense, police, or intelligence organization of the Government of the People’s Republic of China or the Chinese Communist Party.</text></subparagraph></paragraph><paragraph id="H3506DDEBE50E40D4B4CFD22E5EF16EE0"><enum>(2)</enum><header>Confucius Institute</header><text>The term <quote>Confucius Institute</quote> means a cultural institute funded by the Government of the People’s Republic of China.</text></paragraph><paragraph id="H76A7CF6899D249A6A85E2665B555CE8D"><enum>(3)</enum><header>Institution</header><text>The term <quote>institution</quote> has the meaning given the term <term>institution of higher education</term> in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph id="HCFFE6EA619034184BE1B4D75EF5BF921"><enum>(4)</enum><header>Relationship</header><text>The term <quote>relationship</quote> means, with respect to an institution, any contract awarded, agreement entered into, or any in-kind donation or gift, received from a Confucius Institute or Chinese entity of concern.</text></paragraph></subsection><subsection commented="no" id="H18880D566297421FBB3A4D08D2ED3A56"><enum>(b)</enum><header>Restrictions on institutions of higher education</header><paragraph commented="no" id="id05CDACB1AA104854B8E72FD1FBFB9888"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning the first October 1 occurring after the date that is 1 year after the date of the enactment of this Act, the Secretary of Homeland Security shall ensure that an institution that has a relationship with a Confucius Institute or a Chinese entity of concern is ineligible to receive any Science and Technology or Research and Development funds from the Department of Homeland Security.</text></paragraph><paragraph commented="no" id="idB8165016A21B4166AAA750CF652771BE"><enum>(2)</enum><header>Eligibility after termination</header><text display-inline="yes-display-inline">An institution described in paragraph (1) may receive Science and Technology or Research and Development funds from the Department of Homeland Security if the institution terminates the relationship between the institution and the Confucius Institute or Chinese entity of concern with which the institution has a relationship.</text></paragraph></subsection></section></legis-body></bill>
