<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 5006</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To designate the month of September as African Diaspora Heritage Month. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>African Diaspora Heritage Month Act of 2022</short-title></quote>.</text></section><section id="id94E2CD5846524F898D17597BB1D000F2" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id435EBA8278EA4BAD8A8E15EB941D8638" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the African diaspora population in the United States has grown significantly in recent years, with the number of African immigrants growing at a rate of almost 246 percent from 2000 to 2019;</text></paragraph><paragraph id="idA0BC984600954BCE868FD2E2AEE69851" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the African diaspora community is one of the most diverse communities in the United States, inclusive of people who speak multiple languages, whose rich heritage comes from all across the African continent, and whose members practice various faiths;</text></paragraph><paragraph id="id8135E5DEB06541DDA097930361F2DF85" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">during the 17th, 18th, and 19th centuries, a significant number of enslaved people from Africa were brought to the United States;</text></paragraph><paragraph id="id32A9A2D14459495699F9CC3AAD4F1123" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">immigrants of African origin boast some of the highest educational achievements of any immigrant group;</text></paragraph><paragraph id="id483C4C4B6C764532BD89A93134E1D6B7" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">African diaspora households contribute billions of dollars to the economy of the United States, with an estimated $10,100,000,000 in Federal taxes, $4,700,000,000 in State and local taxes, and a spending power of more than $40,300,000,000 in 2015;</text></paragraph><paragraph id="id75AA39BC14724F76B3F118E7A6348CAD" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">Sub-Saharan African immigrants living in the United States, Europe, and elsewhere sent back $46,000,000,000 in remittances to the continent of Africa in 2021;</text></paragraph><paragraph id="id1C24B89C09904D4B899069BAD6231C01" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">Government agencies, including the International Development Finance Corporation, the Department of Commerce, the Department of the Treasury, and the United States Trade Representative are critical to investments and enduring mutual partnerships between the United States and African nations;</text></paragraph><paragraph id="idCDD031F154954C5883316D1B702F7794" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">in 2019, through the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3701">19 U.S.C. 3701 et seq.</external-xref>), the United States imported $8,400,000,000 in goods, up 2.4 percent as compared to 2001; </text></paragraph><paragraph id="id7D7CBF0DAFCE425C92B70A9CECE5860D" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">Prosper Africa and other similar Government initiatives are critical to building and strengthening ties between the United States and African businesses;</text></paragraph><paragraph id="idE302869B36B643A2819271B086669EF1" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">the total two-way goods trade with Sub-Saharan Africa totaled $44,900,000,000 in 2021, a 22 percent increase from $36,800,000,000 in 2019;</text></paragraph><paragraph id="idF90350D2A45E4C588A66177B408526B9" commented="no" display-inline="no-display-inline"><enum>(11)</enum><text display-inline="yes-display-inline">the African diaspora plays an invaluable role in shaping Government policy;</text></paragraph><paragraph id="idE905EA18760147DE892263C60DA82DA2" commented="no" display-inline="no-display-inline"><enum>(12)</enum><text display-inline="yes-display-inline">members of the African diaspora have an invaluable understanding of cross-cultural engagement between the United States and Africa, existing relations and networks on the African continent, and can support efforts to facilitate stronger ties between the United States and Africa;</text></paragraph><paragraph id="id61DC3C594F264E4C8AA1FD43A47FB33C" commented="no" display-inline="no-display-inline"><enum>(13)</enum><text display-inline="yes-display-inline">the United States is committed to strengthening the government-to-government relationships between the United States and countries throughout the African continent;</text></paragraph><paragraph id="idCC9E7944E4664D31B68148752E23CA24" commented="no" display-inline="no-display-inline"><enum>(14)</enum><text display-inline="yes-display-inline">Congress strongly supports the United States hosting a second United States-Africa Leaders Summit in December 2022, and urges collaboration between the Government and the African diaspora community in the United States in advance, during, and after the Summit as an opportunity to strengthen ties between the United States and African nations;</text></paragraph><paragraph id="id39FE10C9790549BFAEC1F738115BEBF2" commented="no" display-inline="no-display-inline"><enum>(15)</enum><text display-inline="yes-display-inline">the African diaspora harbors a deep commitment to family and community, an enduring work ethic, and a perseverance to succeed and contribute to the society of the United States; and</text></paragraph><paragraph id="idCFFE23C722DE4BFD9C4B9716F298E52A" commented="no" display-inline="no-display-inline"><enum>(16)</enum><text display-inline="yes-display-inline">all members of the African diaspora in the United States deserve access to Federal resources and a voice in the Government of the United States.</text></paragraph></section><section id="idCFF8CD991D9E4FE39363C3BDFC14A912" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">African Diaspora Heritage Month</header><subsection id="idA5C74FB0D16B4F09815AEC23043D55C8" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/1">Chapter 1</external-xref> of title 36, United States Code, is amended—</text><paragraph id="id94DC166D705B4CF48BAED8DD13ED0AD1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating the second section 146 as section 147; and</text></paragraph><paragraph id="id365B2DF7BB0C4CCF82D3944408664AFC" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idA4722023FB3C48CF8C8AEF1F78EEEAD1"><section id="idA38CF4FC2EF4478DB86CD891F6345009" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>148.</enum><header display-inline="yes-display-inline">African Diaspora Heritage Month</header><subsection id="idb26211ee40ce4e19806b2b17455af07d" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Designation</header><text display-inline="yes-display-inline">September is African Diaspora Heritage Month.</text></subsection><subsection id="idac5f498b28ea468c9c0022cc073576b5" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Proclamations</header><text display-inline="yes-display-inline">The President is requested to issue each year a proclamation calling on the people of the United States, and the chief executive officers of each State of the United States, the District of Columbia, and each territory and possession of the United States are requested to issue each year proclamations calling on the people of their respective jurisdictions, to observe African Diaspora Heritage Month with appropriate programs, ceremonies, and activities.</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8FF0E0DC29C74D98A53C31A2BC338334" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/1">chapter 1</external-xref> of title 36, United States Code, is amended—</text><paragraph id="idBD83903F4C324FBA9C02E9F694E69280" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the item relating to the second section 146 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3EF873F3A37A453FADC0025D1FBCD287"><toc><toc-entry level="section" bold="off">147.
