 Puerto Rico for the areas affected by Hurricane Fiona.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H4F1E1F8333164026ADE480AEEE016B52" style="OLC"><section id="id154F688C983B4C05B9F9214C8ECD5D09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Puerto Rico Recovery Act</short-title></quote>.</text></section><section id="H867E4A25B8BF4AF3970AD6E695B5A4E4" section-type="subsequent-section"><enum>2.</enum><header>Temporary exemptions from Jones Act restrictions for vessels providing hurricane relief to Puerto Rico</header><subsection id="id2CE2527FFCFF4C3FAAA772A2C62F267F"><enum>(a)</enum><header>Temporary exemption for Puerto Rican hurricane relief</header><paragraph id="idC377103B45D644B59F3F27F414BBA387"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding sections 12112, 12103, and 55102 of title 46, United States Code, the Secretary of the department in which the Coast Guard is operating (referred to in this section as <quote>the Secretary</quote>) shall exempt a vessel from the requirements of such sections if the Secretary determines that the owner or operator of the vessel has reasonably demonstrated that the exemption is needed to provide disaster relief to Puerto Rico for areas affected by Hurricane Fiona.</text></paragraph><paragraph id="id042152382BAA4CBFBEB73F2858FD5245"><enum>(2)</enum><header>Process</header><subparagraph id="id11731D9C0AF042D5BD08FAD65538409B"><enum>(A)</enum><header>Request</header><text>An owner or operator of a vessel may request an exemption under paragraph (1), and the Secretary shall approve or deny the request by not later than 72 hours after the request is made.</text></subparagraph><subparagraph id="id9FFCB5127D9D4DA487A017D6CD171D13"><enum>(B)</enum><header>Public denial statement</header><text>In any case where the Secretary denies an exemption request under subparagraph (A), the Secretary shall promptly provide a public, detailed statement regarding the reasoning and analysis for the denial.</text></subparagraph><subparagraph id="id4BF30D9B3F6640739919EBC903F5C889"><enum>(C)</enum><header>Deemed approval</header><text>If the Secretary does not approve or deny a request according to the terms of subparagraph (A), the request shall be deemed to be approved.</text></subparagraph></paragraph></subsection><subsection id="idC73DE6C923114768815D27D991FD5F8F"><enum>(b)</enum><header>Period of exemption</header><text>An exemption approved under subsection (a) shall be valid until the earlier of—</text><paragraph id="idB2CC94757ED44F58B7282D12481B4690"><enum>(1)</enum><text>the date that is 1 year after the date on which the exemption was approved; or</text></paragraph><paragraph id="id26EE36BE0AF04A2B84E8A82CA20F70A2"><enum>(2)</enum><text>the date on which the major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref>) on September 22, 2022 expires.</text></paragraph></subsection><subsection id="id68D3D42A84BB4AB5997980FDD0ED0843"><enum>(c)</enum><header>Applicability</header><text>This section, and any exemption issued under this section, shall cease to have effect on the date described in subsection (b)(2).</text></subsection></section></legis-body></bill>
