which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize grants for emotional support services for incarcerated victims of sexual abuse, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sexual Abuse Services in Detention Act</short-title></quote>.</text></section><section id="id61fd73d413df4edb8d6c226148f66766"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id420e54d91ce94713b811a312b3253cc9"><enum>(1)</enum><header>Emotional support service</header><text>The term <term>emotional support service</term>—</text><subparagraph id="id534e1d3f09ff465dac81c817fe0f593c"><enum>(A)</enum><text>means emotional support services or counseling for individuals who have experienced sexual abuse at any time in their life; and</text></subparagraph><subparagraph id="id378d805db7174529b9504cae4c5fb810"><enum>(B)</enum><text>includes—</text><clause id="id0918b4d171a746e1ba9c4a604741e430"><enum>(i)</enum><text>crisis intervention services;</text></clause><clause id="id5db6fef2d8494bab8bbe17526d115c0d"><enum>(ii)</enum><text>education about dynamics of sexual abuse and sexual harassment;</text></clause><clause id="id0ac8c009e315416ea86ad751379e8d7b"><enum>(iii)</enum><text>sharing resources;</text></clause><clause id="id7c37cf8886584264b176e081bbc52060"><enum>(iv)</enum><text>safety planning and discussion of reporting options;</text></clause><clause id="ide4b6bc5fd54e4f41b541c068ea1af903"><enum>(v)</enum><text>telephone hotline services; and</text></clause><clause id="id6214141c028c402e8791cac90c5cd016"><enum>(vi)</enum><text>assistance processing trauma reactions and building coping skills.</text></clause></subparagraph></paragraph><paragraph id="idf89b0b523b7d49f4b6cd4229edaa6cfd"><enum>(2)</enum><header>Emotional support service provider</header><text>The term <term>emotional support service provider</term> means a nonprofit, nongovernmental organization that has—</text><subparagraph id="id263cdfbf81ea42198ae79eee703cf8f0"><enum>(A)</enum><text>special expertise and broad experience in providing sexual abuse and rape crisis counseling services for survivors, including victims of sexual abuse in correctional settings; and</text></subparagraph><subparagraph id="iddd97693790c14d12a0214096c382c899"><enum>(B)</enum><text>experience with correctional services, such as—</text><clause id="id6580936c93cb493c99c5a82ee019fab5"><enum>(i)</enum><text>understanding the unique dynamics of custodial sexual abuse;</text></clause><clause id="idd09bf577eeb843e38c779822d3c0e65d"><enum>(ii)</enum><text>understanding correctional practices and correctional security concerns; or</text></clause><clause id="id8b0cbc9bd8cc498097f0654f0726b7b8"><enum>(iii)</enum><text>providing technical assistance and training to correctional officers and administrators.</text></clause></subparagraph></paragraph><paragraph id="idf04eb2456f9b4ad5bd1d35dc2d5f2f00"><enum>(3)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and that is exempt from taxation under section 501(a) of such Code. </text></paragraph><paragraph id="idFB1F2528315A45229378B5C4B3DD858D"><enum>(4)</enum><header>Training services</header><text>The term <term>training services</term> means providing education, training, and technical assistance on providing emotional support services in corrections settings for incarcerated survivors and victims of sexual abuse.</text></paragraph></section><section id="id116B38D0E4A446268C6C825B6C7395B1"><enum>3.</enum><header>Emotional support services for sexual abuse victims in detention facilities</header><subsection id="idE5EFC52AEEA44117A5EF841742AC13AE"><enum>(a)</enum><header>Grants authorized</header><text>The Attorney General, acting through the Director of the Office for Victims of Crime, may award grants to emotional support service providers for the purpose of collaborating with Federal, State, local, or Tribal authorities to provide emotional support services in corrections settings for incarcerated survivors and victims of sexual abuse.</text></subsection><subsection id="id772307696F054F7286918CECC3E6E085"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $10,000,000 for each of fiscal years 2023 through 2028 to carry out this section. </text></subsection><subsection id="idE7F49A2CC6FA469C956B88EE07A03862"><enum>(c)</enum><header>Supplement, Not Supplant</header><text>Amounts made available under this section shall supplement and not supplant any other authorization, appropriation, or grant.</text></subsection></section><section id="id9D81BEADA90948D58C64AF5A50F2E995"><enum>4.</enum><header>Training grants</header><subsection id="id46F6B09AD7234632BD05E89BAE9D38C3"><enum>(a)</enum><header>Eligible entity</header><text>In this section, the term <term>eligible entity</term> mean an entity that has experience providing training services in the manner described in subsection (c). </text></subsection><subsection id="idBDE89819ECF144DEB964928EA15557CE"><enum>(b)</enum><header>Authority</header><text> The Attorney General may award grants to eligible entities to carry out the activities described in subsection (c).</text></subsection><subsection id="idFA8D4F2624FD445F9D597D1063E18977"><enum>(c)</enum><header>Use of Funds</header><text>An eligible entity that receives a grant under subsection (b) shall use amounts received under the grant to—</text><paragraph id="id8223B69090144104B39BFAE9AAC17CC2"><enum>(1)</enum><text>provide training services to a corrections agency or facility seeking to offer emotional support services at the institution; </text></paragraph><paragraph id="id64676A8E1BD249B7B48BF16F13C04D02"><enum>(2)</enum><text>provide training services to correctional officers and administrators; and </text></paragraph><paragraph id="id2D2D17B34E6541179276C45127E16489"><enum>(3)</enum><text>collect and maintain data on a biannual basis on the usage volume for training services described in paragraphs (1) and (2). </text></paragraph></subsection><subsection id="id6C9ECFA2811E453B8E3D6A80A49CA43C"><enum>(d)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated $5,000,000 to carry out this section for each of fiscal years 2023 through 2028. </text></subsection></section><section id="idCADCC57ECEA642BEACD84DAE50958E5B"><enum>5.</enum><header>Sexual Abuse Services in Detention Resource Center</header><subsection id="idB8951F8C6F544BCA8D7E9AE22CD95850"><enum>(a)</enum><header>Eligible Organization</header><text>In this section, the term <term>eligible organization</term> means a nonprofit organization that has special expertise and broad experience in providing the information, guidance, and technical assistance described in subsection (b). </text></subsection><subsection id="id9F03CAA82B7C4B5EBBF9B167731F0EB5"><enum>(b)</enum><header>Establishment</header><text>The Attorney General shall establish a national resource center that shall—</text><paragraph id="idf8c6e40e365945388c556de252f89ee6"><enum>(1)</enum><text>provide guidance and training series to corrections agencies, prisons, jails, and other detention facilities on establishing, administering, operating, and supporting emotional support services for sexual abuse victims in correctional or detention facilities; </text></paragraph><paragraph id="id5dbc37d24159405fa4c8f17d6d82af5d"><enum>(2)</enum><text>provide guidance and training services to emotional support service providers on establishing, administering, operating, and supporting emotional support services for sexual abuse victims in correctional or detention facilities; and</text></paragraph><paragraph id="id7cf99451723746f19777852368930c10"><enum>(3)</enum><text>collect, compile, and disseminate resources on the delivery of emotional support services in correctional or detention settings, including—</text><subparagraph id="ide906f77b926144a980cfb45d15061683"><enum>(A)</enum><text>training services;</text></subparagraph><subparagraph id="id8ef4a8ce0c794ca0af27195758ef2501"><enum>(B)</enum><text>research; and</text></subparagraph><subparagraph id="id4035b25528b74263aa0c9db47b7a9311"><enum>(C)</enum><text>best practices.</text></subparagraph></paragraph></subsection><subsection id="idba480dda53a54cd1b98b8c45c917a6aa"><enum>(c)</enum><header>Grant</header><text>The Attorney General may make a grant to an eligible organization to provide for the establishment, functioning, or implementation of subsection (b).</text></subsection><subsection id="id1abab000df7e4742a4926184b051ce6e"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $2,000,000 for each of fiscal years 2023 through 2028 to carry out this section. </text></subsection></section></legis-body></bill>
