which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the unauthorized possession of a firearm at a Federal election site.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2BA4BB9C50564808A9EC2AFFB65E94DC"><section section-type="section-one" id="H3722F01093EF47FDAC738004099253A0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vote Without Fear Act</short-title></quote>.</text></section><section id="H7CD0CE0F670C4D3EA6F6E7781EB40FB1"><enum>2.</enum><header>Prohibition on unauthorized firearm possession at a Federal election site</header><subsection id="HF54C2DF93D0D48CFAA4A21A9562F9309"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HE8DB0137D25342DBB8648B0B45E01013"><section id="HCDA7842E1F87411A8C91EF3B70CC2AEB"><enum>935.</enum><header>Prohibition on unauthorized firearm possession at a Federal election site</header><subsection id="HB6209376BF634C6087FC8227C26D512B"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Federal election site</term> means a building or any part thereof at which an employee of the United States, a State, or a political subdivision thereof is engaged in—</text><paragraph id="H880CE9D164B84BE8A50E9C0DA253EE78"><enum>(1)</enum><text>the administration of a polling place in an election for Federal office; or</text></paragraph><paragraph id="H355799B5904C47509AB330C58DF1E611"><enum>(2)</enum><text>the processing or counting of ballots cast in such an election.</text></paragraph></subsection><subsection id="id0C2E0B7B34444F9990A10C66EA258B8C"><enum>(b)</enum><header>Possession of firearm near Federal election site</header><paragraph id="idB1E714AEDCF34EA0AD75A3C08DEE145D"><enum>(1)</enum><header>Offense</header><subparagraph id="id16635D9586C64CF486BB6566C04C86F2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), it shall be unlawful for an individual to knowingly possess or cause to be present a firearm in, or within 100 yards of an entrance to, a place that the individual knows, or has reasonable cause to believe, is a Federal election site.</text></subparagraph><subparagraph id="HCC9F19727F1543D293E5934C366246E5"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph (A) shall not apply to—</text><clause id="id21648AB60767470191374C020B380213"><enum>(i)</enum><text>the possession of a firearm by a law enforcement officer employed by the United States, a State, or a political subdivision thereof, or a private security guard hired or arranged for by the owner or manager of a building in which there is a Federal election site, who is authorized by law to possess a firearm and who is on duty;</text></clause><clause id="idC90F6A3829D542EEBDECCF6FFEA38A5D"><enum>(ii)</enum><text>the possession of a firearm in a vehicle within 100 yards of an entrance to a Federal election site, if the firearm is not removed from the vehicle or brandished while the vehicle is in, or within 100 yards of the entrance to, a Federal election site; or</text></clause><clause id="idC516F316A44A4EDCB39EF6521A7540DE"><enum>(iii)</enum><text>the otherwise lawful possession of a firearm in a place of residence, in a place of business, or on private property, in or within 100 yards of an entrance to a Federal election site.</text></clause></subparagraph></paragraph><paragraph id="id21F492673D664C6199AF5E64DA98A109"><enum>(2)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any individual who violates paragraph (1), or attempts to do so, shall be fined under this title, imprisoned not more than 1 year, or both.</text></paragraph></subsection><subsection id="HFAB77D775BFF47068973009E6677A195"><enum>(c)</enum><header>Possession of firearm near Federal election site with intent for use in crime</header><paragraph id="idF4A58672C67C4E319E7A3627C3AEB2AF"><enum>(1)</enum><header>Offense</header><text display-inline="yes-display-inline">It shall be unlawful for an individual, with intent that a firearm be used in the commission of a crime, to knowingly possess or cause to be present the firearm in, or within 100 yards of an entrance to, a place that the individual knows, or has reasonable cause to believe, is a Federal election site.</text></paragraph><paragraph id="id64A6B5A0281448648EF604DB3EF402D0"><enum>(2)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any individual who violates paragraph (1), or attempts to do so, shall be fined under this title, imprisoned not more than 5 years, or both.</text></paragraph></subsection><subsection id="H39A4A108C57C43609B39265F0E2E249B"><enum>(d)</enum><header>Homicide</header><text>An individual who kills any other individual in the course of a violation of subsection (b) or (c), or in the course of an attack on a Federal election site involving the use of a firearm, or attempts or conspires to do so, shall be punished as provided in—</text><paragraph id="id1467E1CF718243CA8827D186D5F6DCCE"><enum>(1)</enum><text>section 1111, in the case of murder (as defined in that section);</text></paragraph><paragraph id="id6A73428E178647FA92596800A4B02E4E"><enum>(2)</enum><text>section 1112, in the case of manslaughter (as defined in that section);</text></paragraph><paragraph id="id604C976F9FA446DDBF80962707DD91E8"><enum>(3)</enum><text>section 1113, in the case of attempt to commit murder or manslaughter (as those terms are so defined); or</text></paragraph><paragraph id="id6973A2C7553449F48132EE64ADB713B3"><enum>(4)</enum><text>section 1117, in the case of conspiracy to commit murder (as so defined).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H23C9820161F3448ABA94B53790673254"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB06C0B2FAF124150A5D772B8A7168CE4"><toc regeneration="no-regeneration"><toc-entry level="section">935.
