<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 495</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210301">March 1, 2021</action-date><action-desc><sponsor name-id="S303">Mr. Thune</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prioritize the allocation of H–2B visas for States with low unemployment rates.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id2ED2A0CCD5FB4927A598B048D5810A0B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prioritizing Help to Businesses Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idC7BA03CA1DDC453D855D36CE51AF27D8"><enum>2.</enum><header>Prioritizing the allocation of H–2B visas for States with low unemployment rates</header><text display-inline="no-display-inline">Section 214(g)(10) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(10)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA0CDA5DECCF74F52A333EBD8B1FD3369"><paragraph id="id3546552B333445E88F06A183D35DE4BC" indent="up1"><enum>(10)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9F1DFCD20DD64011A24842AD9B7C4FBB"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraphs (B) and (C), the numerical limitation under paragraph (1)(B) shall not apply to H–2B visas issued to aliens for positions that are certified for employment pursuant to subpart A of part 655 of title 20, Code of Federal Regulations, to perform service or labor in a State that had a seasonally adjusted unemployment rate of 3.5 percent or lower in at least 3 of the 6 most recent monthly reports issued by the Bureau of Labor Statistics during the previous fiscal half year corresponding to each allotment period of H–2B visas pursuant to subpart A of part 655 of title 20, Code of Federal Regulations.</text></subparagraph><subparagraph id="id21A2AB3721B646BD882D7567712C83C9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The number of aliens exempted from the numerical limitation pursuant to subparagraph (A) in any State during any fiscal year may not exceed the lesser of—</text><clause id="id0D8044B7CE7C44FCAD06230319B376E0"><enum>(i)</enum><text display-inline="yes-display-inline">125 percent of the number of visas issued to aliens working in such State during the most recently concluded fiscal year; or</text></clause><clause id="id61279D0EEC16427E976A651E03C64B93"><enum>(ii)</enum><text display-inline="yes-display-inline">2,500.</text></clause></subparagraph><subparagraph id="idBE686FB74A9F4230A25D5B718B6B46BF" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">If more H–2B visa applications are received in a fiscal year on behalf of aliens desiring to work in a State described in subparagraph (A) than the limit set forth in subparagraph (B)—</text><clause id="id32209826FC474402A23728E6E9ADC4A5"><enum>(i)</enum><text display-inline="yes-display-inline">eligible applicants, in a number equal to such limit, shall be selected, by lottery, from such applications for the exemption under subparagraph (A); and</text></clause><clause id="id97B126B16A904F429EC754595C44BCAB"><enum>(ii)</enum><text display-inline="yes-display-inline">the remaining applicants shall be subject to the numerical limitation under paragraph (1)(B).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
