<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 4949</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 38, United States Code, to address green burial sections in national cemeteries, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="idca72be8385d74a2295153d675269c990" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Cemeteries Preservation and Protection Act of 2022</short-title></quote>.</text></section><section id="idDE43911FC87E472CA6726E29D2FEBDA8" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Plot and interment allowances for veterans buried before March 15, 2022, in cemeteries on trust land owned by, or held in trust for, tribal organizations</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs shall pay a plot or interment allowance under paragraph (1) of section 2303(b) of title 38, United States Code, for a veteran if—</text><paragraph id="id2E0CB3CB7F6042A8A208A5BF522D5964" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the veteran was buried, before March 15, 2022, in a cemetery, or in a section of a cemetery, that is on trust land owned by, or held in trust for, a tribal organization;</text></paragraph><paragraph id="ida00b3cba91774413ae2a19ddd1a982b9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the tribal organization that is responsible for operating and maintaining the cemetery, or the section of cemetery, applies for such allowance;</text></paragraph><paragraph id="id713055AF020548F8BEB2298CCE0EA7B6" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">a plot or interment allowance was not already paid for the burial of such veteran under paragraph (2) of such section; and</text></paragraph><paragraph id="idC6A44ECC153644958DA8731634EEFF5D" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the burial of the veteran otherwise meets the requirements under paragraph (1) of such section.</text></paragraph></section><section id="idEDB97773A72541C49ACB37BBE36F64C0" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Green burial sections at national cemeteries</header><text display-inline="no-display-inline">Section 2404 of title 38, United States Code, is amended—</text><paragraph id="id815DE41E5FC5459E8564112B054906CE" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(2)—</text><subparagraph id="id6562D170FE104C248804495187520E98" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idF93CBF36B3E941EA8A996733B2B3BA1E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idC458668BB97E45079C81FE133AB05625" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block act-name="" id="idD49936E3CD574B36BC4D0A2A5364A7F3" style="USC" display-inline="no-display-inline"><subparagraph id="idEF278E8562B44A779221E3987862738B" indent="up1" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of grave sites in a green burial section designated under subsection (i), the Secretary may provide for grave markers of such type as the Secretary considers appropriate.</text></subparagraph><after-quoted-block display="yes">; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id22798ECE885E47E996B86FD42B060545" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text><quoted-block act-name="" id="idF587ED1A2B084099B65AD657056B3D81" style="USC" display-inline="no-display-inline"><subsection id="id87A248A431B84240BF6136195B216B63" commented="no" display-inline="no-display-inline"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id80ACA14983624191A2995A2A1C80409C"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary may designate one or more sections in any national cemetery as green burial sections.</text></paragraph><paragraph id="idB3922A3D832A4E749E0242E4F6904B4A" indent="up1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>green burial section</term> means a section of a cemetery in which the remains of individuals interred in that section—</text><subparagraph id="id25C13E8910114308BDFBAD09579DF869" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">have been prepared for interment in a manner that does not involve chemicals or embalming fluids; and</text></subparagraph><subparagraph id="id606AF3FAE91240438DC84698C5FFAB84" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">have been interred in a natural manner or in completely biodegradable burial receptacles.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="idB29100B3EEF2456F9C0F952BC39FC3C6" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Transfer of administrative jurisdiction over land at Fort Bliss, Texas, for expansion of Fort Bliss National Cemetery</header><subsection id="idFD044B143E5E4B49A95C2BE327296347" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Transfer authorized</header><text display-inline="yes-display-inline">The Secretary of the Army may transfer to the Secretary of Veterans Affairs administrative jurisdiction over a parcel of real property consisting of approximately two acres located at Fort Bliss, Texas, directly adjacent to, and contiguous with, Fort Bliss National Cemetery.</text></subsection><subsection id="id04A3C19978D14D64A30E665C25ADA6A1" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Condition of transfer</header><paragraph id="id2783302F411E44B0B5BBF8D3090407B2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As a condition of the transfer authorized by subsection (a), the Secretary of Veterans Affairs may complete appropriate environmental, cultural resource, and other due diligence activities on the real property described in subsection (c) before determining whether the property is suitable for cemetery purposes.</text></paragraph><paragraph id="idCE120BBA836A47E7BB35BA9D07C22E26" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall coordinate with the Secretary of the Army as needed during the performance of the activities described in paragraph (1).</text></paragraph></subsection><subsection id="id893397F576714A2996490B5C430D70AA" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Description of property</header><paragraph id="idADD5E2AC853B4140918A15BD87806BE1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The exact acreage and legal description of the real property to be transferred under this section shall be determined by a survey satisfactory to the Secretary the Army.</text></paragraph><paragraph id="id5F92907F03654D5BA1F6F0D27CFB63E9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Cost of survey</header><text display-inline="yes-display-inline">The cost of the survey described in paragraph (1) shall be borne by the Secretary of Veterans Affairs.</text></paragraph></subsection><subsection id="id2EB3BE217F6B47DE9909D6F5663D823F" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Additional terms and conditions; costs of transfer</header><paragraph id="id2BDC782D3F3B4734B29E6DFAF4E344DC" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Additional terms and conditions</header><text display-inline="yes-display-inline">The Secretary of the Army may require such additional terms and conditions in connection with the transfer under this section as the Secretary considers appropriate to protect the interests of the United States.</text></paragraph><paragraph id="id4A29DFBC42F24EA5832582E4B151CF7B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Reimbursement of costs </header><subparagraph id="id092594F4D6BF4028B694BC820B7F5488" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall reimburse the Secretary of the Defense for costs incurred by the Secretary of the Army in implementing this section, including the costs of any surveys.</text></subparagraph><subparagraph id="idD7F3C19A05344EDE9B776737864CAA84" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">No payment for value of real property</header><text display-inline="yes-display-inline">Notwithstanding any other legal requirement that might otherwise apply, the Secretary of Veterans Affairs shall not be required to make payment of any kind for the value of the real property described in subsection (c).</text></subparagraph></paragraph></subsection></section><section id="id9963F67391274F4490F09253ED3E4108" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Transfer of Department of the Interior land for use as a national cemetery</header><text display-inline="no-display-inline">Section 2406 of title 38, United States Code, is amended—</text><paragraph id="id6534364170AA4E83870DD5A370F2B421" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>As additional lands</quote> and inserting <quote>(a) <header-in-text level="subsection" style="USC">In general</header-in-text>.—As additional lands</quote>; and</text></paragraph><paragraph id="id7EC2B47F86A5425AA9A53EA599445876" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text><quoted-block act-name="" id="id973AE1FBFDDF4E1984FB282F22227D37" style="USC" display-inline="no-display-inline"><subsection id="idF8FCB2785E67434D8490313B1BE01AE8" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Transfer of Department of the Interior land for use as a national cemetery</header><text display-inline="yes-display-inline">Notwithstanding section 204(d) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1714">43 U.S.C. 1714(d)</external-xref>), if the Secretary and the Secretary of the Interior agree to a transfer under subsection (a) of any land for use by the Department as a national cemetery, the land shall be—</text><paragraph id="id73553A674ED54988B3AC3997435143D5" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">withdrawn from all forms of appropriation under the public land laws, including the mining laws, the mineral leasing laws, and the geothermal leasing laws;</text></paragraph><paragraph id="id97AAC9A27CC049FEB9A318C3B0BB6D62" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">subject to valid existing rights;</text></paragraph><paragraph id="id978781144FA14C7BB7E981D7E8B9FF08" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">transferred to the administrative jurisdiction of the Secretary of Veterans Affairs; and</text></paragraph><paragraph id="idBC79B04E529B4360A6A4BDED4F998E28" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">deemed to be property (as defined in section 102(9) of title 40) for as long as the land remains under the administrative jurisdiction of the Secretary of Veterans Affairs.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="idEE5CBBB27E7E4836A8BEF259AE306C18" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Expansion of prohibition against interment or memorialization in the National Cemetery Administration or Arlington National Cemetery of persons committing certain crimes</header><subsection id="id3692BA6524FF4D33B5059265B79ECC2E" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2411 of title 38, United States Code, is amended—</text><paragraph id="id1032DA4B30664452B0037610CEF3B73C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading—</text><subparagraph id="id890465B1461841E4ADEC3213CFD694C8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote><header-in-text level="section" style="USC">certain</header-in-text></quote> before <quote><header-in-text level="section" style="USC">Federal</header-in-text></quote>; and</text></subparagraph><subparagraph id="id9C1577A88E534330BB13C7978978FDBF" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="section" style="USC">capital</header-in-text></quote>;</text></subparagraph></paragraph><paragraph id="id5A2F2E63A1344084B16405782EC1012D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="id796FB01C77D849A289E46A481B0E6A73" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text><clause id="id5BE08207E883423BB830EA101A27C130" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/42/16901">42 U.S.C. 16901 et seq.</external-xref>);</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/34/20901">34 U.S.C. 20901 et seq.</external-xref>); and</quote>; and</text></clause><clause id="idE8C5A7EF0BAD445BAA73ED6CD1A2C0C2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>or to a period of 99 years or more</quote> after <quote>life imprisonment</quote>; and</text></clause></subparagraph><subparagraph id="idEDBF6AE4B6DF4899B7737ECDAC1C4F54" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block act-name="" id="id4005D8C35DB54D66A2E0B1F91FE05A9E" style="USC" display-inline="no-display-inline"><paragraph id="id22372D097CB749ED89C36E71F6F43983" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">A person who—</text><subparagraph id="id2CCCFC8D42DC43DC9AB185818512F3B5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">is found (as provided in subsection (c)) to have committed a Federal or State crime that would cause the person to be a tier III sex offender for purposes of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20901">34 U.S.C. 20901 et seq.</external-xref>); but</text></subparagraph><subparagraph id="idCC3F7BE14C6A45159AA0D7DACFC6ED7E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">has not been convicted of such crime by reason of such person not being available for trial due to death or flight to avoid prosecution.</text></subparagraph></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC78C950AE21C4CA0A6F8BDCA22BCCC1C"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>subsection (b)(3)</quote> and inserting <quote>paragraph (3) or (5) of subsection (b)</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9E3316CF21E9450FAE79C2DC06CF4CB6"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (d)(2)(A)(ii), by striking <quote>or a State capital crime</quote> and inserting <quote>, a State capital crime, or a Federal or State crime that would cause the person to be a tier III sex offender for purposes of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20901">34 U.S.C. 20901 et seq.</external-xref>),</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF217A565B59B43169A0D92630CD26EF9"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (e)(1)(B), by striking <quote>or a State capital crime</quote> and inserting <quote>, a State capital crime, or a Federal or State crime that would cause the person to be a tier III sex offender for purposes of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20901">34 U.S.C. 20901 et seq.</external-xref>),</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB76D0F21983946CE9EC7E8A342A2E9E5"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 24 of such title is amended by striking the item relating to section 2411 and inserting the following new item:</text><quoted-block display-inline="no-display-inline" id="id29BC90AAF55C4288AAB95E73C604A867" style="OLC"><toc><toc-entry bold="off" level="section">2411.
