which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to establish a pilot program for the establishment and use of a pre-fire-suppression stand density index, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Catastrophic Wildfire Prevention Act of 2022</short-title></quote>.</text></section><section id="idCC4897822F094C2BB044469BD57398E1"><enum>2.</enum><header>Pilot program</header><subsection id="idC901DFAF899D406A8C689682F0803547"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idA4629F22B1C648CA8996C87ADF47ECCF"><enum>(1)</enum><header>Area of the National Forest System</header><text>The term <term>area of the National Forest System</term> means all or a portion of a unit of the National Forest System that is located west of the 100th meridian.</text></paragraph><paragraph id="id0E18BF883F424EB6AF7B86CAC769517D"><enum>(2)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under subsection (b).</text></paragraph><paragraph id="id546e0bb93c764e99a8877eaecaae8b32"><enum>(3)</enum><header>Pre-fire-suppression stand density index</header><text>The term <term>pre-fire-suppression stand density index</term> means an estimate of the naturally occurring or ecologically balanced stand density index of a forest, as developed from historical surveys or appropriate scientific inference, before fire suppression regimens became common practice.</text></paragraph><paragraph id="idAAB6D01DC1C4433A8813E134BE741CAA"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="idbf7f8b30d87d4e51963622c6e436135a"><enum>(5)</enum><header>Stand density index</header><text>The term <term>stand density index</term> means an expression of relative stand density based on the predictable relationship between average tree size and trees per unit area in dense stands. </text></paragraph><paragraph id="id8FB3F96536A342E5B62F4BCA3B08F3C9"><enum>(6)</enum><header>Treatment</header><text>The term <term>treatment</term> means—</text><subparagraph id="idB4922EE032344A5FA632345C44EDEC28"><enum>(A)</enum><text>a mechanical treatment of hazardous fuels;</text></subparagraph><subparagraph id="idFD9A6B15493F427B84CC0BD462CBACA1"><enum>(B)</enum><text>a stewardship end-result contracting project;</text></subparagraph><subparagraph id="id5CCA4D0CD47B42C5882CD09C509658E6"><enum>(C)</enum><text>restoration services; or</text></subparagraph><subparagraph id="idB21D3EC27DEA443D9A68243DA073CD08"><enum>(D)</enum><text>timber harvesting.</text></subparagraph></paragraph></subsection><subsection id="id9b19debac90946f9ba0f94643f819093"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a pilot program under which the Secretary shall—</text><paragraph id="ided45c7db570a4b698d33c12b9aabbca6"><enum>(1)</enum><text>collaborate with State or local forest management agencies—</text><subparagraph id="id06431AC8CBCB4364AA2116677A60C5A5"><enum>(A)</enum><text>to identify areas of the National Forest System for potential selection under paragraph (3) for inclusion in the pilot program; and</text></subparagraph><subparagraph id="idA97DC817135745299EF0043EB42A9806"><enum>(B)</enum><text>to research and establish a pre-fire-suppression stand density index for each area of the National Forest System identified under subparagraph (A);</text></subparagraph></paragraph><paragraph id="idab9160c7bc5742b3b4a2b2219c2dd0fa"><enum>(2)</enum><text>evaluate how closely each pre-fire-suppression stand density index established under paragraph (1)(B) reflects current forest conditions and current published resource management objectives established by the Secretary for the applicable area of the National Forest System; and</text></paragraph><paragraph id="id75d14712da1c4d17883024a2b4dec976"><enum>(3)</enum><text>select, in consultation with State or local forest management agencies, not fewer than 8 areas of the National Forest System identified under paragraph (1)(A) with respect to which the area and neighboring communities may benefit from using a pre-fire-suppression stand density index as a benchmark for treatments by— </text><subparagraph id="id69e55a7113364e27a4212c7fb20342bd"><enum>(A)</enum><text>reducing the chances of catastrophic wildfire;</text></subparagraph><subparagraph id="id584b19a22fe04c008987e56a979f2d97"><enum>(B)</enum><text>increasing forest health;</text></subparagraph><subparagraph id="idfc890722f2d944369040abaa42634d1c"><enum>(C)</enum><text>increasing forest resilience;</text></subparagraph><subparagraph id="id0c806e5573eb4ef0aa3b25639dfcaa8b"><enum>(D)</enum><text>increasing ecological diversity; or</text></subparagraph><subparagraph id="id5a37f4d0adcd407c99ead91fcdd622a3"><enum>(E)</enum><text>improving such other criteria as the Secretary, in consultation with State or local forest management agencies, determine to be appropriate. </text></subparagraph></paragraph></subsection><subsection id="idfdd265c6a6eb4e9ba70d7f2772493d89"><enum>(c)</enum><header>Implementation</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall begin to conduct treatments on areas of the National Forest System selected under subsection (b)(3), and update applicable land and resource management plans to include objectives and benchmarks, in accordance with the applicable pre-fire-suppression stand density index established under subsection (b)(1)(B).</text></subsection><subsection id="id1f48bc317401403797634ee6b1cf289f"><enum>(d)</enum><header>Selection of areas</header><text>In selecting areas of the National Forest System for inclusion in the pilot program under subsection (b)(3) and conducting treatments under subsection (c), the Secretary shall—</text><paragraph id="idD949BBBECE324F758C22A32B87C7C9A4"><enum>(1)</enum><text>give priority to an area—</text><subparagraph id="id1e4a5f8ae3c04931a6891e6e27130227"><enum>(A)</enum><text>within the wildland-urban interface (as defined in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>));</text></subparagraph><subparagraph id="ide38adddd523c479ea489f5dd4881dd3d"><enum>(B)</enum><text>constituting a community watershed;</text></subparagraph><subparagraph id="ide1b896273acd4a17a586f487836ecb6a"><enum>(C)</enum><text>vulnerable to erosion;</text></subparagraph><subparagraph id="idaedab9e9f944481eaaa5f4712fd61845"><enum>(D)</enum><text>hosting multiple-use activities;</text></subparagraph><subparagraph id="iddca0ec32bc9647e7bb116c32667bf149"><enum>(E)</enum><text>critical to supporting wildlife or plant species health; or</text></subparagraph><subparagraph id="id524AB35725754AFCBB63BE1995B05A6A"><enum>(F)</enum><text>with respect to which a treatment is necessary to prevent catastrophic wildfire; and</text></subparagraph></paragraph><paragraph id="id4a2ed7c0625448bd8dea3b85d34d0259"><enum>(2)</enum><text>select a geographically diverse sample of areas of the National Forest System, which shall include not fewer than 3 areas of the National Forest System in the southwest United States. </text></paragraph></subsection><subsection id="idd53a77c747c64c3d8376e24fac9e128e"><enum>(e)</enum><header>Funding</header><text>The Secretary shall carry out this section using funds otherwise made available to the Secretary for fuels reduction treatments.</text></subsection></section></legis-body></bill>
