which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Interior and the Secretary of Agriculture to implement measures to better prepare for and more quickly respond to wildfires on certain public land and in certain National Forests.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>More Hasty Response to Firefighting Act of 2022</short-title></quote>.</text></section><section id="id4076e71ac75f47e3a907131d93035542"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id26316c31da6d48c587a3304b3720763c"><enum>(1)</enum><header>Initial attack</header><text>The term <term>initial attack</term> means an aggressive action to put a fire out by the first resources to arrive, consistent with firefighter and public safety and values to be protected. </text></paragraph><paragraph id="id2205b03a6274417a8b5d80be43f8f43a"><enum>(2)</enum><header>National forest</header><text>The term <term>National Forest</term> means a unit of the National Forest System located west of the 100th meridian.</text></paragraph><paragraph id="id3199cc36a3194180a858896397aad579"><enum>(3)</enum><header>Public land</header><text>The term <term>public land</term> has the meaning given the term <quote>public lands</quote> in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph><paragraph id="id7C4EADF3BB584FA59A3EE729CF309B32"><enum>(4)</enum><header>Qualifying unit</header><text>The term <term>qualifying unit</term> means a National Forest or unit of public land for which the Secretary concerned has developed potential operational delineations for wildfires.</text></paragraph><paragraph id="ida92ba7ec3c6a443da17379a79b6979ed"><enum>(5)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="ida69dfcf990ad41fab84d1c0f5b752ee2"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service, with respect to a National Forest; and</text></subparagraph><subparagraph id="id4682fe64a87a43219db295a97927cf3b"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public land.</text></subparagraph></paragraph></section><section id="idc2e55036adab4ad6be45e50f7cce3693"><enum>3.</enum><header>Notification and training</header><subsection id="id54AF2C1A042E4C39984B7515596E05A6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to each qualifying unit, the Secretary concerned shall—</text><paragraph id="ide8d16bac8113441a868197f1ff5160ec"><enum>(1)</enum><text>notify each person who is authorized to carry out timber harvesting work or vegetation management work within the boundaries of the qualifying unit of—</text><subparagraph id="id5057a14e27b74481a5ae392e13f2dc16"><enum>(A)</enum><text>the strategic response zone in which the contractor is authorized to carry out the work;</text></subparagraph><subparagraph id="id989999a39383484189df8a09c2bc9b16"><enum>(B)</enum><text>the potential-fire response strategy developed for that strategic response zone;</text></subparagraph><subparagraph id="id6bdb0309fb86421dba38007d97037973"><enum>(C)</enum><text>each training offered under paragraph (2); and</text></subparagraph><subparagraph id="idc93cd21554764796b38174c9d11e4412"><enum>(D)</enum><text>the financial incentive established under paragraph (3) for attending that training;</text></subparagraph></paragraph><paragraph id="id92951b7f7b2e4256bede4b0f016a3178"><enum>(2)</enum><text>in coordination with the National Wildfire Coordinating Group, offer a 1-day training in the vicinity of that qualifying unit each fiscal year, beginning with fiscal year 2024, in basic firefighting safety and resource protection, specifically for persons who routinely carry out timber harvesting work or vegetation management work; and </text></paragraph><paragraph id="id18381c1e61464131a81348c025549ac2"><enum>(3)</enum><text>provide, not more frequently than once per fiscal year for fiscal year 2024 and each fiscal year thereafter, $1,000 to each company described in subsection (b).</text></paragraph></subsection><subsection id="id4E033D110D05478E806E3B80C655BC9F"><enum>(b)</enum><header>Company described</header><text>A company referred to in subsection (a)(3) is a company—</text><paragraph id="idBB8EDF7A98D544B8BA58FAE2A5D50B1F"><enum>(1)</enum><text>to which the Administrator of General Services has assigned a Unique Entity Identifier;</text></paragraph><paragraph id="ida23a4febcffb42f982328682a9658723"><enum>(2)</enum><text>that—</text><subparagraph id="id6458788b723d49d3aff830c37d76a229"><enum>(A)</enum><text>has placed not fewer than 1 bid to carry out timber harvesting work or vegetation management work within the boundaries of a qualifying unit during the previous fiscal year; or</text></subparagraph><subparagraph id="id9abcf2507e974bc9a90357845cdbd7dc"><enum>(B)</enum><text>is authorized to carry out timber harvesting work or vegetation management work within the boundaries of a qualifying unit during that fiscal year; </text></subparagraph></paragraph><paragraph id="idd00f0bf474984a85af6aecc7e9ca3083"><enum>(3)</enum><text>each of the employees of which that may carry out timber harvesting work or vegetation management work within the boundaries of a qualifying unit attends a training offered under subsection (a)(2); and</text></paragraph><paragraph id="idb6c99f6d26bf4a51b9762e12fda1c815"><enum>(4)</enum><text>that submits to the Secretary concerned a certification of attendance described in paragraph (3) at such time and in such manner as the Secretary concerned may prescribe. </text></paragraph></subsection></section><section id="idcfd3969d43e446f589282334d5a24d58"><enum>4.</enum><header>Initial attack of wildfires by trained persons</header><subsection id="id1ecb3d68e5db4b20a65296b1e1e89fcc"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law (including regulations), on discovery of a wildfire within the boundaries of a qualifying unit by a person described in subsection (b), the person may undertake initial attack within the qualifying unit on the wildfire, including suppressing, containing, or extinguishing the wildfire, if—</text><paragraph id="id66890718a53244f888954138af49bc83"><enum>(1)</enum><text>the person has completed a training offered under section 3(a)(2) or a similar training, as determined by the Secretary concerned;</text></paragraph><paragraph id="id00d04357f0454a679e5e26bbbdfb75b8"><enum>(2)</enum><text>the total area burned by the wildfire is approximately 5 acres or less in size; and</text></paragraph><paragraph id="id538746c94d104be3b233eaedba61d2e3"><enum>(3)</enum><text>the initial attack on the wildfire is consistent with the potential-fire response strategy for the strategic response zone in which the wildfire is occurring.</text></paragraph></subsection><subsection id="id998f23aab8f74e94b2d18152f061cf7a"><enum>(b)</enum><header>Person described</header><text>A person referred to in subsection (a) is—</text><paragraph id="id6df4ea236ed34c748ba98cbce9c21a88"><enum>(1)</enum><text>a person described in section 3(a)(1); </text></paragraph><paragraph id="id4872375323dc4da69b34a1e4e2233ade"><enum>(2)</enum><text>a landowner who—</text><subparagraph id="idbd72c34a1224443c9628a105cd426832"><enum>(A)</enum><text>owns not fewer than 1,000 acres of land adjacent to a qualifying unit; and</text></subparagraph><subparagraph id="id3332c61af5bf4b77a41e0c41699e0920"><enum>(B)</enum><text>routinely carries out timber harvesting work or vegetation management work; or</text></subparagraph></paragraph><paragraph id="idcb79372967fb464cb3dbec1bbd4e77b9"><enum>(3)</enum><text>an employee of a landowner described in paragraph (2) the employment of whom relates to timber harvesting work or vegetation management work on the land described in that paragraph. </text></paragraph></subsection><subsection id="id3515e1d97dc748de912099b0a4c6a986"><enum>(c)</enum><header>Notification requirement</header><text>If a person undertakes an initial attack authorized under subsection (a), the person, to the maximum extent practicable, shall immediately—</text><paragraph id="ida3a8e48922dd434288dd033fedaec19d"><enum>(1)</enum><text>alert the local emergency dispatch center; and</text></paragraph><paragraph id="ida0f59825111743cbafd09a2e16a5d3e5"><enum>(2)</enum><text>notify the Secretary concerned of—</text><subparagraph id="idA138F2671B454AA08A815C2CF40D7FB0"><enum>(A)</enum><text>the location of the wildfire; and </text></subparagraph><subparagraph id="id1EA4A90BF58D49A99A31DF43655B0BD7"><enum>(B)</enum><text>the initial attack being undertaken.</text></subparagraph></paragraph></subsection><subsection id="id6acb411d31124808b6071b5392c5ceb3"><enum>(d)</enum><header>Reimbursement of costs</header><text>The Secretary concerned shall not provide reimbursement or compensation to a person for undertaking an initial attack authorized under subsection (a).</text></subsection><subsection id="id1839b3bb68e54e3ba1c90b3db5638304"><enum>(e)</enum><header>Liability</header><paragraph id="idf776bf42652f4ddcb7799a4a38d21add"><enum>(1)</enum><header>Liability of persons</header><text>A person undertaking an initial attack authorized under subsection (a) shall not be subject to enforcement, civil or criminal penalties, citizen suits, or any other liability (including any liability for response costs, damage to natural resources, or contribution) for undertaking the initial attack.</text></paragraph><paragraph id="id237efd5b11c44c809c06b43eb460e5ab"><enum>(2)</enum><header>Liability of the Federal Government</header><text>The Secretary concerned shall not be liable for an initial attack undertaken by a person pursuant to subsection (a).</text></paragraph><paragraph id="id6f28670d33b546e2b5d50428fae1988a"><enum>(3)</enum><header>Savings clause</header><text>Nothing in paragraph (1) limits the liability of—</text><subparagraph id="id7f447a7668c84d3390e02bbb3f87ed96"><enum>(A)</enum><text>any person not authorized to undertake an initial attack under subsection (a);</text></subparagraph><subparagraph id="idd4a249ba607a494293562f20fd92b7a6"><enum>(B)</enum><text>a person that was responsible for starting the applicable fire; or</text></subparagraph><subparagraph id="id945eeff386d541ff990f17126acb01de"><enum>(C)</enum><text>a person described in section 3(a)(1) that was not in compliance with the terms of the authorization to carry out timber harvesting work or vegetation management work provided by the Secretary concerned.</text></subparagraph></paragraph></subsection></section><section id="ida8cfb8f5565b4c26b77c45a4576b60ee"><enum>5.</enum><header>Fire prevention measures</header><text display-inline="no-display-inline">As part of an authorization to carry out timber harvesting work or vegetation management work within the boundaries of a qualifying unit, the Secretary concerned shall—</text><paragraph id="ide99286278e164d24985c91c08df533a3"><enum>(1)</enum><text>establish and operate a decision support tool, to be known as a <quote>project activity level</quote>, to support regulation for fire prevention purposes of an authorized party carrying out timber harvesting work or vegetation management work within the boundaries of the qualifying unit; and</text></paragraph><paragraph id="idea87dd941e7346bcb7772e80443947f1"><enum>(2)</enum><text>require the authorized party to have appropriate personnel, tools, and equipment onsite and immediately available for suppressing operations fires, negligent fires, and other fires in the work area.</text></paragraph></section><section id="id51aa67d45d0e440193cf292ecc41fa6a"><enum>6.</enum><header>State and local agency response</header><subsection id="idB27BA0151A8444E8B9430E3EEE88BC30"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary concerned may—</text><paragraph id="id492d97f68ba348c8ada6267039269748"><enum>(1)</enum><text>authorize any State or local firefighting agency to undertake initial attack on a wildfire described in subsection (b), including suppressing, containing, or extinguishing the wildfire, without further approval by the Secretary concerned, if consistent with the potential-fire response strategy for the strategic response zone in which the wildfire is occurring; and</text></paragraph><paragraph id="id3250aa605f4244649b67ff67e98d5d4e"><enum>(2)</enum><text>enter into partnerships with State and local firefighting agencies to dispatch multiple firefighting resources located near a wildfire described in subsection (b) to undertake initial attack on the wildfire, including suppressing, containing, or extinguishing the wildfire, if consistent with the potential-fire response strategy for the strategic response zone in which the wildfire is occurring. </text></paragraph></subsection><subsection id="idF6C969267C8A41CD8311776A652F0FE1"><enum>(b)</enum><header>Wildfire described</header><text>A wildfire referred to in subsection (a) is a wildfire that—</text><paragraph id="idA3C8D5E641C84FF79FA5786B0C933A15"><enum>(1)</enum><text>is located within the boundaries of a qualifying unit; and</text></paragraph><paragraph id="id39E08D22367443BCB7529F0B4CD04E9F"><enum>(2)</enum><text>has burned not more than approximately 10 acres.</text></paragraph></subsection></section></legis-body></bill>
