which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide enhanced protections for election workers.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Election Worker Protection Act of 2022</short-title></quote>.</text></section><section id="id16F8FC424EC14343AAD5B304210119AB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idA8580E562FC84C0086DC5ADC38DC6706"><enum>(1)</enum><header>Election worker</header><text>The term <quote>election worker</quote> means an individual who is an election official, poll worker, or an election volunteer in connection with the administration of an election for a Federal office. </text></paragraph><paragraph id="id8B61324A7B54404CA79FA2C2A73555C0"><enum>(2)</enum><header>Personally identifiable information</header><text>The term <quote>personally identifiable information</quote> has the meaning given the term <quote>restricted personal information</quote> in section 119 of title 18, United States Code. </text></paragraph></section><section id="idb455f6fec9204b998a96429b2335f9b9"><enum>3.</enum><header>Grants to States for election worker recruitment, training, and safety</header><subsection id="idaba8dca091f94fa896c61e9ee86211b9"><enum>(a)</enum><header>In general</header><text>Subtitle D of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21001">52 U.S.C. 21001 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4465FC5053284D448F874D46A854C4D5"><part id="idD74477B41F294550BCE9A1A01D854E5B" style="OLC"><enum>7</enum><header>Election worker recruitment, training, and safety</header><section id="id923325E3CA1D4831A512CDB7133FDE82" section-type="subsequent-section"><enum>297.</enum><header>Grants to States for poll worker and election volunteer recruitment and training</header><subsection id="id469644876E54435997DD47FDC6BEFB66"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Election Worker Protection Act of 2022</short-title>, the Commission shall, subject to the availability of appropriations provided to carry out this section, make a grant to each eligible State for recruiting and training individuals to serve as poll workers and election volunteers on dates of elections for public office.</text></subsection><subsection id="id9d3bf6f14371451781652d250fb447dc"><enum>(b)</enum><header>Use of Commission materials and training program development</header><paragraph id="idD396D5BE7C35425CB662FB429AA223F0"><enum>(1)</enum><header>In general</header><text>In carrying out activities using funds under a grant provided under this section, the recipient of the grant shall— </text><subparagraph id="idAFF1A7BB4A1C44E49A3FF9DCE4027B9C"><enum>(A)</enum><text>use the materials prepared by the Commission on successful practices for poll worker and election volunteer recruiting, training, and retention as an interactive training tool; and </text></subparagraph><subparagraph id="idDA2B532D6690474EA11D8C32AAA595D8"><enum>(B)</enum><text>develop training programs with the participation and input of experts in adult learning.</text></subparagraph></paragraph><paragraph id="ida21bbaacb7d34930ae6fe199773fd759"><enum>(2)</enum><header>Access and cultural considerations</header><text>The Commission shall ensure that the materials described in paragraph (1)(A) provide training in methods that will enable poll workers and election volunteers to provide access and delivery of services that meet the unique needs of each voter in a culturally competent manner with respect to each voter who uses the services, including voters who have limited English proficiency, are of diverse cultural or ethnic backgrounds, or have disabilities, regardless of gender, sexual orientation, or gender identity.</text></paragraph></subsection><subsection id="idea51e95cb430423cbdc579290b4f7e87"><enum>(c)</enum><header>Requirements for eligibility</header><paragraph id="id6bf464c8fe9140da9c7833c961f18fec"><enum>(1)</enum><header>Application</header><text>Each State that desires to receive a payment under this section shall submit an application for the payment to the Commission at such time, in such manner, and containing such information as the Commission may reasonably require.</text></paragraph><paragraph id="ida4aece5437ab4e3298ecb3bb9f9d811b"><enum>(2)</enum><header>Contents of application</header><text>Each application submitted under paragraph (1) shall—</text><subparagraph id="idb789c097d72448e89347d359787a07a2"><enum>(A)</enum><text>describe the activities for which assistance under this section is sought;</text></subparagraph><subparagraph id="id3f5f3aef94f44a15b85dda0df0b1c1c7"><enum>(B)</enum><text>provide assurances that— </text><clause id="idCF2C6F5C2241434E88296787FB207F58"><enum>(i)</enum><text>the funds provided under this section will be used to supplement and not supplant other funds used to carry out the activities; </text></clause><clause id="id1d1db26c353a446088482bc62f2db9ba"><enum>(ii)</enum><text>the State will furnish the Commission with information about individuals who served as poll workers and election volunteers after recruitment and training with the funds provided under this section; and</text></clause><clause id="id460861b5ff8e4697a25c3c560ecf0905"><enum>(iii)</enum><text>the State will dedicate poll worker and election volunteer recruitment efforts with respect to—</text><subclause id="id09135f13cb844291ab2c28ffe1ff985c"><enum>(I)</enum><text>youth and minors, including by recruiting at institutions of higher education and secondary education; and</text></subclause><subclause id="id9f8ae9dc385f4b529ebfdb7aaff469bf"><enum>(II)</enum><text>diversity, including with respect to race, ethnicity, and disability; and</text></subclause></clause></subparagraph><subparagraph id="idc9ab86f706294240b1d70e134eca3ba9"><enum>(C)</enum><text>provide such additional information and certifications as the Commission determines to be essential to ensure compliance with the requirements of this section.</text></subparagraph></paragraph></subsection><subsection id="id2ca7e1c68a6b45a8ba4a4a09e118b2ac"><enum>(d)</enum><header>Amount of grant</header><paragraph id="idecaccd76676b4e57b685ef35948cc43c"><enum>(1)</enum><header>In general</header><text>The amount of a grant made to a State under this section shall be equal to the product of—</text><subparagraph id="id00e2ce8f3b3541db8a254d5ba7d1efbe"><enum>(A)</enum><text>the aggregate amount made available for grants to States under this section; and</text></subparagraph><subparagraph id="id2cec40ca3d3d47e2b0d459cc58941172"><enum>(B)</enum><text>the voting age population percentage for the State.</text></subparagraph></paragraph><paragraph id="id0f27d89cad1349af93a1c52d980c90e0"><enum>(2)</enum><header>Voting age population percentage defined</header><text>In paragraph (1), the <quote>voting age population percentage</quote> for a State is the quotient of—</text><subparagraph id="id454ab1bceb9949d4bdb2889dd7040b67"><enum>(A)</enum><text>the voting age population of the State (as determined on the basis of the most recent information available from the Bureau of the Census); and</text></subparagraph><subparagraph id="id2258e75237b94f4dbaa6dc81cb327caa"><enum>(B)</enum><text>the total voting age population of all States (as determined on the basis of the most recent information available from the Bureau of the Census).</text></subparagraph></paragraph></subsection><subsection id="id6378db10db9d4b65a13194b4474100b4"><enum>(e)</enum><header>Rules for States that do not submit an application and grants to political subdivisions</header><paragraph id="idB25804996AA94B12ABF3D326468B93BC"><enum>(1)</enum><header>In general</header><text>If a State fails to submit an application under subsection (c) at the time established by the Commission for such submission, the Commission may offer to political subdivisions within that State the opportunity to apply for a payment under this section. </text></paragraph><paragraph id="id587140C0E57A48DC92158CBBEF918001" commented="no"><enum>(2)</enum><header>Contents of application</header><text>Each application submitted under paragraph (1) shall—</text><subparagraph id="id3F993CF6F04F450887F807C5AE08EE45" commented="no"><enum>(A)</enum><text>describe the activities for which assistance under this section is sought;</text></subparagraph><subparagraph id="idA1741CBE2A984BF38D20822E4BA9FA39" commented="no"><enum>(B)</enum><text>provide assurances that— </text><clause id="id108E3EC31E1D474287638BC338131AD0" commented="no"><enum>(i)</enum><text>the funds provided under this section will be used to supplement and not supplant other funds used to carry out the activities; </text></clause><clause id="idCD15A0A52DEC471AA127B8B99C410528" commented="no"><enum>(ii)</enum><text>the political subdivision will furnish the Commission with information about individuals who served as poll workers and election volunteers after recruitment and training with the funds provided under this section; and</text></clause><clause id="idA8618F154B5E4A2CBD4655206F832129" commented="no"><enum>(iii)</enum><text>the political subdivision will dedicate poll worker and election volunteer recruitment efforts with respect to—</text><subclause id="idC397A1EDAB0244ECA8BDFBE066025CC2" commented="no"><enum>(I)</enum><text>youth and minors, including by recruiting at institutions of higher education and secondary education; and</text></subclause><subclause id="idA42062D04AB24C07B4B5A4BDD376B635" commented="no"><enum>(II)</enum><text>diversity, including with respect to race, ethnicity, and disability; and</text></subclause></clause></subparagraph><subparagraph id="idCC8AA5667E834885A3443B112D59F828" commented="no"><enum>(C)</enum><text>provide such additional information and certifications as the Commission determines to be essential to ensure compliance with the requirements of this section.</text></subparagraph></paragraph><paragraph id="idC09672CE58F64C66B76202FD6C9E66F0"><enum>(3)</enum><header>Amount of grants for political subdivisions</header><text>The amount of a grant made to a political subdivision under this subsection shall be an amount that bears the same proportion to the amount determined with respect to the State in which the political subdivision is located as—</text><subparagraph id="id21D9D68FC3C049599548F2E907F0F120"><enum>(A)</enum><text>the aggregate amount made available for grants to States under this section; and</text></subparagraph><subparagraph id="idBC51DE8144474870801C3B0E842FE375"><enum>(B)</enum><text>the voting age population percentage for the political subdivision of the State. </text></subparagraph></paragraph></subsection><subsection id="idE7C650FD2021458F8208AB8E2200EDF9"><enum>(f)</enum><header>Reports to Congress</header><paragraph id="idb7a80a457bef4acfac67f019de250a29"><enum>(1)</enum><header>Relevant committees</header><text>In this subsection, the term <quote>relevant committees</quote> means—</text><subparagraph id="id69BD41031C0B4BEE833328B9ABC53F62"><enum>(A)</enum><text>the Committees on Rules and Administration and Appropriations of the Senate; and</text></subparagraph><subparagraph id="id20F4C0E333B141B39F6E16A35D358617"><enum>(B)</enum><text>the Committees on Administration and Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id483FBE9A73DA472AA63B7414BAF3FAB8"><enum>(2)</enum><header>Reports by recipients of grants</header><text>Not later than 180 days after the date on which the Commission makes a final grant to a State under this section, the recipient shall submit a report to the Commission on the activities the State conducted with the funds provided under the grant.</text></paragraph><paragraph id="id839fe45022ce404e9072869b4ca0ae17"><enum>(3)</enum><header>Reports by Commission</header><text>Not later than 1 year after the date on which the Commission makes the final grant under this section, the Commission shall submit a report to the relevant committees regarding— </text><subparagraph id="idF073E21A2C324891A7B14503E2179F56"><enum>(A)</enum><text>the grants made under this section; </text></subparagraph><subparagraph id="id2AC5511E147441CAB2B6DB5B13832219"><enum>(B)</enum><text>the activities carried out by recipients using funds provided under the grants; and</text></subparagraph><subparagraph id="id7193E6E23812435CA2236CBA0C5A7E8E"><enum>(C)</enum><text>such recommendations relating to recruitment and training of election workers as the Commission considers appropriate.</text></subparagraph></paragraph></subsection><subsection id="idbd03c6391db147798ecfa86f8c9509d1"><enum>(g)</enum><header>Funding</header><paragraph id="id57d89ec991434c6bb0b0da7333f9be5c"><enum>(1)</enum><header>Authorization</header><text>There is authorized to be appropriated to the Commission for fiscal year 2023 and each succeeding fiscal year such sums as may be necessary for payments under this section, to remain available until expended.</text></paragraph><paragraph id="id403819983b1a4265bdcac9e4e511bc77"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amount appropriated for any fiscal year to carry out this section, not more than 3 percent shall be available for administrative expenses of the Commission.</text></paragraph></subsection></section><section id="idbfc719f998d94141846be4523166f5be"><enum>298.</enum><header>Grants to States for election worker safety</header><subsection id="id44f01710c6424d89b0aec0d337328363"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Election Worker Protection Act of 2022</short-title>, the Commission shall, subject to the availability of appropriations provided to carry out this section, make a grant to each eligible State for physical security services and social media threat monitoring for election workers.</text></subsection><subsection id="id95a4708140ba4b01826aea8279e737a4"><enum>(b)</enum><header>Requirements for eligibility</header><paragraph id="id029909a3120d46f6baa84c522789549d"><enum>(1)</enum><header>Application</header><text>Each State that desires to receive a payment under this section shall submit an application for the payment to the Commission at such time, in such manner, and containing such information as the Commission may reasonably require.</text></paragraph><paragraph id="id2801a83b686b47b886070ee1ef7b0da2"><enum>(2)</enum><header>Contents of application</header><text>Each application submitted under paragraph (1) shall—</text><subparagraph id="idd72ae5c809bb4774b61d2a1a84e6f509"><enum>(A)</enum><text>describe the activities for which assistance under this section is sought; and</text></subparagraph><subparagraph id="idc359f98fc6e24057b3b3de2c83840a88"><enum>(B)</enum><text>provide assurances that—</text><clause id="id7D7B3138D5E841FE82BEC84B332DA2D9"><enum>(i)</enum><text>the funds provided under this section will be used to supplement and not supplant other funds used to carry out the activities; and</text></clause><clause id="idf9f11344e0f74c269cee81f33f951b6a"><enum>(ii)</enum><text>the State will furnish the Commission with information on the number of individuals provided services under this section.</text></clause></subparagraph></paragraph></subsection><subsection id="id6A8BA741E6A64999B8DEFD4CDEB8360B"><enum>(c)</enum><header>Rules for States that do not submit an application and grants to political subdivisions</header><paragraph id="id36A43540ECBA40F38A1339BD4B93ACA9"><enum>(1)</enum><header>In general</header><text>If a State fails to submit an application under subsection (b) at the time established by the Commission for such submission, the Commission may offer to political subdivisions within that State the opportunity to apply for a payment under this section. </text></paragraph><paragraph id="id707DC4EC8FAD484E8EA8C1F26B6C0E30" commented="no"><enum>(2)</enum><header>Contents of application</header><text>Each application submitted under paragraph (1) shall—</text><subparagraph id="id09104F2C1E76443193F12AB383F634B0" commented="no"><enum>(A)</enum><text>describe the activities for which assistance under this section is sought; and</text></subparagraph><subparagraph id="id6BC873A536DE4D6694506B373549878C" commented="no"><enum>(B)</enum><text>provide assurances that—</text><clause id="id899F4A8F32C540459931B15772A841FD" commented="no"><enum>(i)</enum><text>the funds provided under this section will be used to supplement and not supplant other funds used to carry out the activities; and</text></clause><clause id="idEEF304A03A524B8BBFCB58DBB50F2716" commented="no"><enum>(ii)</enum><text>the political subdivision will furnish the Commission with information on the number of individuals provided services under this section.</text></clause></subparagraph></paragraph><paragraph id="id2C087B0E90474F4EB94E42FB4016341C"><enum>(3)</enum><header>Amount of grants for political subdivisions</header><text>The amount of a grant made to a political subdivision under this subsection shall be an amount that bears the same proportion to the amount determined with respect to the State in which the political subdivision is located as—</text><subparagraph id="id32F40D2783064CA0926CC77DC4334A19"><enum>(A)</enum><text>the aggregate amount made available for grants to States under this section; and</text></subparagraph><subparagraph id="id9CF11366C871453291FF0AAB705456E3"><enum>(B)</enum><text>the voting age population percentage for the political subdivision of the State. </text></subparagraph></paragraph></subsection><subsection id="id5a20afbd10484632afd7a285d2a489d7"><enum>(d)</enum><header>Reports to Congress</header><paragraph id="id3D0207A5BF874E2EB5BF9A527DD0B85E"><enum>(1)</enum><header>Relevant committees</header><text>In this subsection, the term <quote>relevant committees</quote> means—</text><subparagraph id="idDE05D9ED7B3540E38C569B6CC61B61E3"><enum>(A)</enum><text>the Committees on Rules and Administration and Appropriations of the Senate; and</text></subparagraph><subparagraph id="id8C986F013CB54F1B87444C65BF84CA05"><enum>(B)</enum><text>the Committees on Administration and Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idF354310BFE8C4046B57B8E7216A15421"><enum>(2)</enum><header>Reports by recipients of grants</header><text>Not later than 180 days after the date on which the Commission makes a final grant to a State under this section, the recipient shall submit a report to the Commission on the activities the State conducted with the funds provided under the grant.</text></paragraph><paragraph id="id47B8C36DD6794AD78DFE50E76B4B319D"><enum>(3)</enum><header>Reports by Commission</header><text>Not later than 1 year after the date on which the Commission makes the final grant under this section, the Commission shall submit a report to the relevant committees regarding— </text><subparagraph id="idC4410EA86B7F411DA55C7441D1CC3CA9"><enum>(A)</enum><text>the grants made under this section; </text></subparagraph><subparagraph id="id7BF78A5C37774E82A38872E0B6C960E8"><enum>(B)</enum><text>the activities carried out by recipients using funds provided under the grants; and</text></subparagraph><subparagraph id="id0B7E95AC03084151AD1735A1B2D37529"><enum>(C)</enum><text>such recommendations for physical security services and social media threat monitoring as the Commission considers appropriate.</text></subparagraph></paragraph></subsection><subsection id="id127F172A4DB34468B4E59DDE6DABF1EA" commented="no"><enum>(e)</enum><header>Funding</header><text>There is authorized to be appropriated to the Commission for fiscal year 2023 and each succeeding fiscal year such sums as may be necessary for payments under this section, to remain available until expended.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idDAB6434C120C47A0A71439338A703E43"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Help America Vote Act of 2002 is amended by adding at the end of the items relating to subtitle D of title II the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57330811510B4EE7BF3E23692BCB9B53"><toc><toc-entry level="part">PART 7—Election worker recruitment, training, and safety</toc-entry><toc-entry level="section">Sec. 297. Grants to States for election worker recruitment and training</toc-entry><toc-entry level="section" bold="off">Sec. 298. Grants to States for election worker safety.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idf392d8601e544a228941c0368153f5f2"><enum>4.</enum><header>Department of Justice training resources for addressing threats to election workers</header><subsection id="id184B05F8CE4347029414E348301E0F7A"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General shall review training resources provided to Federal, State, local, and Tribal law enforcement agencies and ensure that the Department of Justice offers programs that include training and resources to assist State, local, and Tribal law enforcement agencies in understanding, detecting, deterring, and investigating threats to election workers. </text></subsection><subsection id="id7A67968D85864BE0A6C45DC699F7A09E"><enum>(b)</enum><header>Training</header><text display-inline="yes-display-inline">The Attorney General shall make training available to Department prosecutors and to Assistant United States Attorneys on countering and prosecuting threats to election workers.</text></subsection></section><section id="idf6c3d5f9e65a44c7bbbecb4a72ca1484"><enum>5.</enum><header>Grant program to prevent disclosure of personal information of election workers</header><subsection id="id811B93691D6D41CE90B195C2BCBB464B"><enum>(a)</enum><header>Authorization</header><text>Not later than 1 year after the date of enactment of this Act, the Attorney General shall establish a program to provide grants to create or expand programs designed to protect the personally identifiable information of election workers to entities that—</text><paragraph id="id8910c6f83a874cf9a4ce2057f9870d3f"><enum>(1)</enum><text>are—</text><subparagraph id="idd6c2295a02f14a4dac111219f4f5c776"><enum>(A)</enum><text>States or units of local government (as those terms are defined in section 901 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>)); or</text></subparagraph><subparagraph id="id8f129763e31449cd9805aa37b6619c93"><enum>(B)</enum><text>agencies of States or units of local government; and</text></subparagraph></paragraph><paragraph id="id8af00df76ec74c4895353207c9412c05"><enum>(2)</enum><text>operate a State or local database or registry that contains personally identifiable information.</text></paragraph></subsection><subsection id="id8d3dc6da589145b79449b2a02889423e"><enum>(b)</enum><header>Application</header><text>Each entity described in subsection (a) that desires a payment under this section shall submit to the Attorney General an application at such time, in such manner, and containing such information as the Attorney General may reasonably require.</text></subsection><subsection id="idd580c44206fd4c5aa5c44d807246095c"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to provide grants to entities described in subsection (a) to create or expand programs designed to protect the personally identifiable information of election workers, including through—</text><paragraph id="idef81beea8a95442a942af0f9155ad7df"><enum>(1)</enum><text>the creation of programs to redact or remove the personally identifiable information of election workers, upon request, from public records maintained by State agencies, including by hiring third parties to redact or remove the personally identifiable information of election workers from public records;</text></paragraph><paragraph id="ide81c2e673d41421ead2a64cf583cb22f"><enum>(2)</enum><text>the expansion of existing programs to protect personally identifiable information of election workers;</text></paragraph><paragraph id="id4cda9d8f7d54494ba87683a62957fd3d"><enum>(3)</enum><text>the development or improvement of protocols, procedures, and policies to prevent the release of personally identifiable information of election workers;</text></paragraph><paragraph id="ide9ea04120c344c3c88c23192c27960c0"><enum>(4)</enum><text>the defrayment of costs of modifying or improving existing databases and registries to ensure that personally identifiable information of election workers is protected from release; and</text></paragraph><paragraph id="id88cdf277e867418797dba99ca80c2a5a"><enum>(5)</enum><text>the development of confidential opt-out systems that allow election workers to request that personally identifiable information is not included in publicly accessible databases or registries.</text></paragraph></subsection><subsection id="id5845f256bd134e3da16ecab0770f2dee"><enum>(d)</enum><header>Report</header><paragraph id="id1c5f6d6132ee485589af19a5a42e5576"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and biennially thereafter, the Comptroller General of the United States shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives an annual report that includes a detailed description of the amount spent by States and local governments using funds under this section relating to protection of personally identifiable information of election workers.</text></paragraph><paragraph id="ida3b5e8f767a24449829458c1fd4eb341"><enum>(2)</enum><header>States and local governments</header><text>Not later than 180 days after the date on which a State or local government receives funds under this section, the State or local government shall submit to the Comptroller General a report that, with respect to that State or local government, contains the information described in paragraph (1) to be included in the report required under that paragraph. </text></paragraph></subsection></section><section id="idfb2db1bcd1fc4dd79a83f52e5e936745"><enum>6.</enum><header>Harassment of election workers prohibited</header><subsection id="id238bbc0a8d2c474d84f6e5e6022edbf5"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/29">Chapter 29</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id3409d936ce834847ae2084e9fee703b3"><section id="id18480af95e324a9d8f01c52f2a2477b6"><enum>613.</enum><header>Harassment of election workers</header><subsection id="id1a72b07087764e1c8abfcb193736b054"><enum>(a)</enum><header>Election worker</header><text>For purposes of this section, the term <quote>election worker</quote> means an individual who is an election official, poll worker, or election volunteer in connection with an election for a Federal office. </text></subsection><subsection id="id2B188D77697F41B4B4A28569B9850F4C"><enum>(b)</enum><header>Harassment of election workers</header><text>It shall be unlawful for any person, whether acting under color of law or otherwise, to intimidate, threaten, coerce, or attempt to intimidate, threaten, or coerce an election worker with intent to impede, intimidate, or interfere with that election worker while the election worker is engaged in the performance of official duties, or with intent to retaliate against the election worker on the basis of the performance of such duties.</text></subsection><subsection id="id918fa6f3c98042bfb19d704e98322dcc"><enum>(c)</enum><header>Penalty</header><text>Any person who violates subsection (b) shall be fined not more than $100,000, imprisoned for not more than 5 years, or both.</text></subsection><subsection id="id5EC292B612104584B63694E08444FC6A"><enum>(d)</enum><header>Special agents</header><text>The Attorney General, acting through the Director of the Federal Bureau of Investigation, shall assign a special agent to each field office of the Federal Bureau of Investigation to investigate threats against election workers.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idaf1e3910bfb149b684bef1f3043ee45e" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/29">chapter 29</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="id44bdaf3e-a89d-4a74-aacd-aaae007f6c1b"><toc><toc-entry level="section" idref="id18480af95e324a9d8f01c52f2a2477b6">613. Harassment of election workers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idda6c99d1987b4c1e822a8810b539d9c1"><enum>7.</enum><header>Making intimidation of tabulation, canvas, and certification efforts a crime</header><text display-inline="no-display-inline">Section 12(1) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20511">52 U.S.C. 20511</external-xref>) is amended—</text><paragraph id="id7efd94b00bbd4502a0301939225b5da1"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>; or</quote> at the end; and</text></paragraph><paragraph id="id691e608009d4464db7717e110fb47e3c"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id346de97cce374524bca4f650c003b48b"><subparagraph id="idd17d4ade7ddd4d2d96cceae736f06719"><enum>(D)</enum><text>processing or scanning ballots, or tabulating, canvassing, or certifying voting results; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id6cbcd012e6704a8388548fd91024e377"><enum>8.</enum><header>Prohibition of doxxing of election workers</header><text display-inline="no-display-inline">Section 119(b)(2) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC68F071826864E5699CE41F678D86438"><subparagraph id="idde3c5607d227484f847de7c769c5ec81"><enum>(E)</enum><text>or an election official, poll worker, or an election volunteer in connection with an election for a Federal office.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idecff566bac3349c4989165113c83130a"><enum>9.</enum><header>Preventing poll observer interference</header><subsection id="idd553c183591c4a20b02f9598baf3c915"><enum>(a)</enum><header>Voter protection requirements</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>) is amended by inserting after section 303 the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57593BB8AF16402A91A46B453C809342"><section id="idFDF7ABB2C7B2494F82B2D4C1D076CEE7"><enum>303A.</enum><header>Voter protection requirements</header><subsection id="id3a3d2b3dbad64bd8941e923bf00f0849"><enum>(a)</enum><header>In general</header><text>A State or local election official may remove a poll observer from a polling location for an election for Federal office or any location where processing, scanning, tabulating, canvassing, or certifying voting results in such an election is occurring on the basis that the State or local election official has a reasonable basis to believe that the observer—</text><paragraph id="id9dce5d5c399e4eb28b8bfac115acb1c1"><enum>(1)</enum><text>has engaged in, or imminently will engage in, intimidation or deceptive practices prohibited by Federal law; or</text></paragraph><paragraph id="id39d859d19f90483c9df022e96f44be06"><enum>(2)</enum><text>has disrupted, or will disrupt, the voting, processing, scanning, tabulating, or canvassing of ballots or the certification of results.</text></paragraph></subsection><subsection id="id6556308fe3d74057a04f01c31bb4aec2"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in subsection (a) may be construed to prevent a State or a unit of local government in a State from permitting the removal of a poll observer for reasons other than those described in subsection (a).</text></subsection><subsection id="idf48fa28cda184bf2b4ddfbee31f501ea"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall apply with respect to elections for Federal office occurring on and after the date of enactment of the <short-title>Election Worker Protection Act of 2022</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id66fed5e48ae04d3eb763d8e3a6c65bb9" commented="no"><enum>(b)</enum><header>Conforming amendment relating to voluntary guidance</header><text>Section 311(b) of the Help America Vote Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/52/21101">52 U.S.C. 21101(b)</external-xref>) is amended—</text><paragraph commented="no" id="id1681DDAA8ED049C483399F731C667CF3"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end; </text></paragraph><paragraph commented="no" id="id23C50828429847D6A1AD14DE26F25B32"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and </text></paragraph><paragraph commented="no" id="idCB63E99F81004D68B85C05717AEACD45"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id918D5DAF502A4961957F3CC1DEFB42A3"><paragraph commented="no" id="id0E93B68652374790926DE815AD7D7C5D"><enum>(4)</enum><text>in the case of recommendations with respect to section 303A, January 1, 2024. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd4452ee968654789b04d89306fb51239"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents of the Help America Vote Act of 2002 is amended by inserting after the item relating to section 303 the following:</text><quoted-block style="OLC" id="idd9c25853-cb1c-4845-afa6-dc9b0c224407"><toc><toc-entry level="section" idref="idFDF7ABB2C7B2494F82B2D4C1D076CEE7">Sec. 303A.
