which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of State to designate certain Mexican drug cartels as foreign terrorist organizations, and to submit a report to Congress justifying such designations in accordance with section 219 of the Immigration and Nationality Act.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD0BFFDB6A91E4B5589F7B7E8B0E584CE"><section section-type="section-one" id="H1210E948CD99454485648C7A05CB2EB9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drug Cartel Terrorist Designation Act</short-title></quote>.</text></section><section id="H61E429A0233F41C2B3F9545AC1FA5DF3"><enum>2.</enum><header>Report on designation of certain drug cartels as foreign terrorist organizations</header><subsection id="H0C6C17AC91AB44179C588A3292803294"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that each of the drug cartels referred to in subsection (c) meets the criteria for designation as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></subsection><subsection id="H585F8BD1A94741EAA57791D14298A8BC"><enum>(b)</enum><header>Defined term</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="H9C3401C8A3F84685A5151D349B10C9DB" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD13852B36E54BD89704FA56D7C7022C"><enum>(2)</enum><text>the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs of the Senate</committee-name>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C0D2B2A4AF04123A5FC5CD0E73E36AE"><enum>(3)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5B4E7540E5241F4A801BE4F092DBE02"><enum>(4)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0B337CF7CFA44DE984CC50F9EC3ABA1"><enum>(5)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8917CBF62F7E4D15831D0DA0AA601CA8"><enum>(6)</enum><text>the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>;</text></paragraph><paragraph id="HA41BC0A805F64ADDBD494859D7E54C51"><enum>(7)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>;</text></paragraph><paragraph id="id649756C240524BE7B2DE3BC0E7A09DFF"><enum>(8)</enum><text>the <committee-name committee-id="">Committee on Financial Services of the House of Representatives</committee-name>;</text></paragraph><paragraph id="idCFBFB46E9F1944EC8B4B9AE4C11FE14B"><enum>(9)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>;</text></paragraph><paragraph id="id47095D94D1D24E34839DB0EECC2A0FE4"><enum>(10)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>;</text></paragraph><paragraph id="idC7A4F8F343DE406EBC01AC32CC29820B"><enum>(11)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and </text></paragraph><paragraph id="idE7E144C3DCF4486DAB6A8550F5BF3500"><enum>(12)</enum><text>the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>.</text></paragraph></subsection><subsection id="HBEB3471FEDAE47C59C1A55310F2EF652"><enum>(c)</enum><header>Designation</header><paragraph id="id254C26AD3B4A48FE85B2031EB19EAD44"><enum>(1)</enum><header>In general</header><text>The Secretary of State shall designate each of the following Mexican drug cartels as a foreign terrorist organization under section 219(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>):</text><subparagraph id="H0DE03A1212204E0E9D9E6EF5B63F9532"><enum>(A)</enum><text>The Reynosa/Los Metros faction of the Gulf Cartel.</text></subparagraph><subparagraph id="HBDBC29D13BA043DF96A62ABCD26D17EF"><enum>(B)</enum><text>The Cartel Del Noreste faction of Los Zetas.</text></subparagraph><subparagraph id="id4868491d60084912a7b11d89d65bfbe8"><enum>(C)</enum><text>The Jalisco New Generation Cartel.</text></subparagraph><subparagraph id="id8F28773EA20047769312C5E4FDB29E19"><enum>(D)</enum><text>The Sinaloa Cartel.</text></subparagraph></paragraph><paragraph id="idF0A53677761548FEB07B5B1790DC92AA"><enum>(2)</enum><header>Additional cartels</header><text>The Secretary of State shall designate any Mexican drug cartel, or any faction of such a cartel, as a foreign terrorist organization if such cartel or faction meets the criteria described in such section 219(a).</text></paragraph></subsection><subsection id="H4F51E62B245C474A9E59B26985B89243"><enum>(d)</enum><header>Report</header><paragraph id="H8D5220713E4F42D0957647768C4C9A76"><enum>(1)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of State, in consultation with the Director of National Intelligence, shall submit to the appropriate committees of Congress a detailed report regarding—</text><subparagraph id="id637FF2BDF68349E6A05AB7CC44141628"><enum>(A)</enum><text display-inline="yes-display-inline">each of the drug cartels referred to in subsection (c)(1) that describes the criteria justifying their designations as foreign terrorist organizations under section 219(a)of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>); and</text></subparagraph><subparagraph id="id2FC640751D22419588F36745FAC961CE"><enum>(B)</enum><text>all other Mexican drug cartels, or factions of cartels, that the Secretary determines pursuant to subsection (c)(2) meet the criteria for designation as foreign terrorist organizations under such section 219(a), including the specific criteria justifying each such designation.</text></subparagraph></paragraph><paragraph id="HDDA796C915C34C45983C07C75B38DFD3"><enum>(2)</enum><header>Form</header><text>The report required under paragraph (1)—</text><subparagraph id="HD6CCAE2414EA497B869FFD0364B7D532"><enum>(A)</enum><text>shall be submitted in unclassified form, but may include a classified annex;</text></subparagraph><subparagraph id="H4D9A724DE35E452CAE85C62C804080F5"><enum>(B)</enum><text>shall be made available only in electronic form; and </text></subparagraph><subparagraph id="id7CCAED2384814566A64C3B574E30FA4A"><enum>(C)</enum><text>may not be printed, except upon a request for a printed copy from a congressional office.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
