which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modernize the technology for delivering unemployment compensation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unemployment Insurance Technology Modernization Act of 2021</short-title></quote>.</text></section><section id="id45A0E5648D4A4F01BFFC1D974FC5196B"><enum>2.</enum><header>Modernization of technology for delivering unemployment compensation</header><subsection id="id109315E668BE40BB9631BF2C4751ACC3"><enum>(a)</enum><header>Establishment</header><paragraph id="id66AF615C13AF468FADEC6316AFDF31F2"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall develop, operate, and maintain a modular set of technology capabilities to modernize the delivery of unemployment compensation (in this section referred to as the <quote>technology capabilities</quote>).</text></paragraph><paragraph id="id9AA42F4831714B5296829F48C8465C60"><enum>(2)</enum><header>Purposes</header><text>The purposes of developing the technology capabilities are the following:</text><subparagraph id="id68B5D24C26EC40DA957ED8AA513C5C2F"><enum>(A)</enum><text>For such capabilities to be utilized for any Federal administrative function associated with the provision of unemployment compensation.</text></subparagraph><subparagraph id="id4C1DB0EAA5504F61958F82B5E455D42E"><enum>(B)</enum><text>To provide States with modular, open system technology capabilities and shared services to administer their unemployment compensation programs.</text></subparagraph></paragraph><paragraph id="id0F17C2ACA0F84086A97C461CDC555022"><enum>(3)</enum><header>Consultation</header><text>In developing, operating, and maintaining the technology capabilities under paragraph (1), the Secretary shall—</text><subparagraph id="idC44471B9505F408CB8BAEB23528BD720"><enum>(A)</enum><text>coordinate with the Administrator; and</text></subparagraph><subparagraph id="id44E3637DB90B40F3AE8F4AD623EFDA62"><enum>(B)</enum><text>consult, design, and conduct usability testing with—</text><clause id="idAB3267DDA08E45CA8299AF8F9B717A22"><enum>(i)</enum><text>current and former claimants;</text></clause><clause id="idC69690B4AD2845529CC445B7F0074581"><enum>(ii)</enum><text>employers that participate in unemployment compensation programs;</text></clause><clause id="id26FDF14CB03347D9B8F1E798C122FC76"><enum>(iii)</enum><text>employees of State workforce agencies;</text></clause><clause id="id06FB8BCA81954490B58A48306C48363B"><enum>(iv)</enum><text>experts in technology and user experience;</text></clause><clause id="id3F1E0A2487AC45C1A63D8ACB31968F9F"><enum>(v)</enum><text>Federal administrators of unemployment compensation;</text></clause><clause id="id79C5A4581DD54E348ED93B5211DECD58"><enum>(vi)</enum><text>any other potential user of the technology capabilities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id47DF249315D4486E96138ADFC97FC013"><enum>(vii)</enum><text>subject matter experts as deemed appropriate by the Secretary.</text></clause></subparagraph></paragraph></subsection><subsection id="id41B1837671BD4A7792C2238D8011B50D"><enum>(b)</enum><header>Requirements</header><paragraph id="id70F025FE440147B7B047419BA903B977"><enum>(1)</enum><header>In general</header><text>The technology capabilities shall—</text><subparagraph id="id844ADF036B5445AD8D5B21EF27F0A05A"><enum>(A)</enum><text>incorporate a modular open systems approach and include modular components for each function necessary to administer an unemployment compensation program, including—</text><clause id="id3F96CE6D65EE442F990C9706EF185486"><enum>(i)</enum><text>receiving, processing, and paying claims for unemployment compensation, including disaster benefits;</text></clause><clause id="idC60EB46B4BDF40E2B27F1E26749DF642"><enum>(ii)</enum><text>online claim filing;</text></clause><clause id="idECC53B81BA204BF3BF8F8BF5B23F027B"><enum>(iii)</enum><text>the determination of claimant eligibility;</text></clause><clause id="id4FD7BD495EA94815B973FC9AC06740C1"><enum>(iv)</enum><text>the collection of unemployment taxes;</text></clause><clause id="idFFFF790188E44F18AF5CAFB0D13CB0BF"><enum>(v)</enum><text>the submission of employer wage records;</text></clause><clause id="id2221F9AEB6734194A91B0B8155EA4130"><enum>(vi)</enum><text>the appeals and adjudication processes for claimants and employers;</text></clause><clause id="id7BE410972E394E84A88394AEE6345899"><enum>(vii)</enum><text>sharing relevant data among States and the Secretary; and</text></clause><clause id="idAF169AAF67244C31814CA6959A72EF06"><enum>(viii)</enum><text>any other functionality that addresses the issues and goals identified during the pre-development study described in subsection (c)(1);</text></clause></subparagraph><subparagraph id="id3958DC334FA042AE887232906E203B79"><enum>(B)</enum><text>comply with best practices and standards for privacy and cybersecurity, including digital identity proofing services, identified in consultation with the Director of the National Institute of Standards and Technology (NIST) and the Director of the Cybersecurity and Infrastructure Security Agency (CISA);</text></subparagraph><subparagraph id="id97870AA948B64898A4B5C803E4386135"><enum>(C)</enum><text>prioritize end-to-end user experience for claimants, employers, and administrators of unemployment compensation programs;</text></subparagraph><subparagraph id="id00739D579A204147BC91D294FE5F2567"><enum>(D)</enum><text>include centralized Federal technology capabilities that allow for the storage, exposure, and exchange of data required by States to administer their unemployment compensation programs (with the respective States retaining possession of such data without regard to the storage, exposure, or exchange of such data in the Federal technology capabilities);</text></subparagraph><subparagraph id="id218A66B66FA844A29B74F97489933933"><enum>(E)</enum><text>provide States with the option to use only some of the modular components of the Federal technology capabilities while continuing to utilize State technology capabilities to store any data required to administer their unemployment compensation program in a State database, provided that the State database meets any guidelines established by the Secretary that enable machine-to-machine interfaces to facilitate communication among States and between such State and the Federal Government;</text></subparagraph><subparagraph id="id40C7846572E74C47BEF44C8CA16E1A54"><enum>(F)</enum><text>allow States to easily adapt the modular components of the Federal technology capabilities to meet the requirements of their unique unemployment compensation programs;</text></subparagraph><subparagraph id="id90B4C591B85D4C8F9DEF2973A3D8C065"><enum>(G)</enum><text>ensure the timely and accurate payment of benefits, including measures to minimize susceptibility to attacks by organized criminal networks seeking to defraud State or Federal unemployment compensation programs; and</text></subparagraph><subparagraph id="idE1EBA6CCDB104DF195C74F2CB7F2E75C"><enum>(H)</enum><text>to the extent practicable, be made available (along with any associated data produced under this section) to support other interagency and intergovernmental activities as appropriate.</text></subparagraph></paragraph><paragraph id="id3901FDBA7D304C3CABD5DF4ECB9FB038"><enum>(2)</enum><header>Accessibility requirements for online claim filing</header><text>With respect to the online claim filing component described in paragraph (1)(A)(ii), such component shall—</text><subparagraph id="id61BBF63C65224295A8C95BCB819D5C8F"><enum>(A)</enum><text>ensure that the process of filing initial and continuing claims for unemployment compensation can be readily understood and accomplished by the vast majority of claimants, including individuals with limited English proficiency, individuals with disabilities (in compliance with section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>)), older individuals, and individuals with literacy challenges;</text></subparagraph><subparagraph id="id94bce264537b44a6ac3ab735eecdd666"><enum>(B)</enum><text>be available in any language spoken by more than 1 percent of the national population or any State’s population (with such translations completed by human translators rather than translation software) and comply with the requirements of the Plain Writing Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/5/301">5 U.S.C. 301</external-xref> note);</text></subparagraph><subparagraph id="ide0bae60139154578a6601c6eeb1de604"><enum>(C)</enum><text>be accessible and optimized for all commonly used desktop computers, tablets, and mobile devices and operating systems such that any features of the online claim filing component (such as the ability to upload documentation) that are available in the desktop version of the online claim filing component are also available in the tablet and mobile versions;</text></subparagraph><subparagraph id="id7653d3f2e1c843bc8c8d8070922e6452"><enum>(D)</enum><text>allow for electronic submission of documentation required to support a claim, including the ability of claimants to scan or photograph and submit documentation using a tablet or mobile device; </text></subparagraph><subparagraph id="id6456cd3a215e4f84bb6c71975cc7e7e1"><enum>(E)</enum><text>be available 24 hours a day, 7 days a week, with the exception of scheduled and emergency maintenance that the State conducts, to the extent practicable, at nonpeak hours;</text></subparagraph><subparagraph id="idEC5EEB4E054848368824C210E2777244"><enum>(F)</enum><text>provide self-service account recovery that can be completed online; and</text></subparagraph><subparagraph id="id269589817ad2440d9211b6fa25cc95a5"><enum>(G)</enum><text>deploy multiple methods of communication with claimants, such as short message service (SMS) message, email, postal mail, live chat, or chatbots.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37F4EEAC515E4A6EBE5E0AA6A1EF4BEE"><enum>(3)</enum><header>Requirements regarding high-risk automated decision systems</header><subparagraph commented="no" display-inline="no-display-inline" id="idD1AF9BBDA7224EAC86AED13A7B6D0BBB"><enum>(A)</enum><header>In general</header><text>The technology capabilities shall not rely solely on a high-risk automated decision system to deny a claim for unemployment compensation, reduce the amount of unemployment compensation for which a claimant is eligible, or deny the right of a claimant to appeal an unemployment compensation decision.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7397E0CDAA294384B2FA41996852F543"><enum>(B)</enum><header>Partial reliance</header><clause commented="no" display-inline="no-display-inline" id="idDC38DF7BEEB64F1C921B3B367E74C706"><enum>(i)</enum><header>In general</header><text>If any of the technology capabilities rely on a high-risk automated decision system to determine that a claimant is ineligible for unemployment compensation, to reduce the amount of unemployment compensation for which a claimant is eligible, or to deny the right of a claimant to appeal an unemployment compensation decision, the Secretary shall—</text><subclause commented="no" display-inline="no-display-inline" id="idEE93FBD0E758485AA9C3D7FB34845B0C"><enum>(I)</enum><text>require that an employee of a State workforce agency review the determination before—</text><item commented="no" display-inline="no-display-inline" id="id8A1ADF401A634CD3A64858E2296FA2A6"><enum>(aa)</enum><text>the claim for unemployment compensation of such claimant may be denied;</text></item><item commented="no" display-inline="no-display-inline" id="id5319D9B860D94D6E96605DED3D6F9620"><enum>(bb)</enum><text>the amount of unemployment compensation for which such claimant is eligible may be reduced; or</text></item><item commented="no" display-inline="no-display-inline" id="id16AA493407EF4356BF45900EB7A2F384"><enum>(cc)</enum><text>the right of such claimant to appeal an unemployment compensation decision may be denied;</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id7238BB245460439588770AF9D46925F2"><enum>(II)</enum><text>consult with experts in the Federal Government (including the Director of the National Institute of Standards and Technology and the Director of the National Science Foundation), regarding the potential benefits and risks of partial reliance on a high-risk automated decision system;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id59A0F6FCC16F48A7971F04F14D503651"><enum>(III)</enum><text>prior to utilizing such part of the technology capabilities that relies on a high-risk automated decision system—</text><item commented="no" display-inline="no-display-inline" id="id9AB33AC3CB1843178373692A48EC3F12"><enum>(aa)</enum><text>establish clear methods to measure the accuracy of such part of the technology capabilities; and</text></item><item commented="no" display-inline="no-display-inline" id="id4A38D37F8D024549A7E68BEB9A4B1689"><enum>(bb)</enum><text>ensure that such part of the technology capabilities minimizes the occurrence of biased results based on race, gender, ethnicity, disability status, income, occupation, or other personal characteristics as determined by the Secretary, and prevents any increase in such bias;</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idD92C276BCF86495E9A70D320B79BC25A"><enum>(IV)</enum><text>develop algorithmic impact assessments, incorporating public feedback and expert agency review, to proactively assess the necessity of additional formal policies and safeguards to mitigate risks; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id848B60DCBDF4403D9B0CA05A40999D92"><enum>(V)</enum><text>establish transparency requirements that include an annual public disclosure of any use of a high-risk automated decision system, a plain language explanation of the decision making structure of such high-risk automated decision system, and the details regarding such use and related outcomes.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id85E10BA31C7A4F178306475A9A63DA99"><enum>(ii)</enum><header>Training</header><text>The Secretary shall establish best practices for training any relevant employee of the Department or a State workforce agency to reduce the impact of automation bias.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF8392A78459B404284E888EA3233AEB8"><enum>(C)</enum><header>Monitoring</header><text>The Secretary shall continuously monitor claim determinations that rely, in part, on the use of a high-risk automated decision system to ensure that biased results based on the characteristics described in subparagraph (B)(i)(III)(bb) do not occur.</text></subparagraph></paragraph></subsection><subsection id="idDFAF92BF21BA427DB3B2E0C09C631A30"><enum>(c)</enum><header>Pre-Development study and report</header><paragraph id="id380A429BA3B646078A432DEB65C2470F"><enum>(1)</enum><header>Study</header><text>Prior to the development of the technology capabilities under subsection (a) or the procurement of such technology capabilities under subsection (g), the Secretary, in coordination with the Administrator, shall conduct a study assessing the technology needs of Federal and State unemployment compensation programs. Such study shall consider the following:</text><subparagraph id="id5BE2EDC8AD8A4ECBB6E8C8FBCC418302"><enum>(A)</enum><text>The Federal and State capabilities that need to be upgraded or replaced to ensure the smooth administration of their respective unemployment compensation programs.</text></subparagraph><subparagraph id="id5177C03EB157402FA70FBAD693929CC7"><enum>(B)</enum><text>How to design and develop a federally maintained system that serves the needs of both the Federal Government and each of the State unemployment compensation programs.</text></subparagraph><subparagraph id="idEECBF0502304427980964CBB9400906B"><enum>(C)</enum><text>The features necessary to effectively respond to rapid changes in volume in times of emergency, including features that enable easy adaptation of, and updates to, such technology capabilities in order to implement new rules or benefits.</text></subparagraph><subparagraph id="idD23B1BE5A30C419FBD74D2E7D0408600"><enum>(D)</enum><text>The features necessary to ensure the technology capabilities have the capacity to handle an increased number of claims during periods of high unemployment.</text></subparagraph><subparagraph id="id6BF40F67E1624F818FC4F8CBE5D1BE3E"><enum>(E)</enum><text>How the technology capabilities can prioritize claimant experience and ensure accessibility, including by soliciting feedback from claimants and claimant representatives during the development process.</text></subparagraph><subparagraph id="id76B10FE373144AA6939ADE228442711F"><enum>(F)</enum><text>How the technology capabilities can ensure effective and equitable benefit delivery, including the following:</text><clause id="idD9FB379E0F4045E5AAD9C0A59EBD202B"><enum>(i)</enum><text>The standardization of data collection and reporting across States to facilitate administration and interoperability.</text></clause><clause id="idEAB4B5110A2640068CD855BC6DF16E42"><enum>(ii)</enum><text>The features that will facilitate accurate and timely delivery of benefits and reduce the time from successful unemployment compensation claim to benefit delivery.</text></clause><clause id="id6EEA44B609504CE9B4BF7B26C075F09C"><enum>(iii)</enum><text>The features that will help to identify and prevent organized fraud schemes without causing unreasonable delays for legitimate claimants or penalizing mistakes.</text></clause><clause id="id182F2FAE0EED49A89BFD7FABDB6163A4"><enum>(iv)</enum><text>The appropriate level of ongoing audit and analysis needed to evaluate the effectiveness and equitability of benefit delivery.</text></clause><clause id="id1CBBE8726D1246548F7B0E8802CF810F"><enum>(v)</enum><text>How privacy-protective data exposure and exchange between government entities and privacy-protective public reporting could be utilized to improve and ensure effective and equitable benefit delivery.</text></clause></subparagraph><subparagraph id="id657FABBFB238447A932336622651C349"><enum>(G)</enum><text>How the technology capabilities can improve the employer experience, including tax payment, the submission of wage information, and the verification of claim information.</text></subparagraph><subparagraph id="idA34A9544E9844A33B1A25D5976572191"><enum>(H)</enum><text>How the technology capabilities can improve processes for employees of State workforce agencies.</text></subparagraph><subparagraph id="id3D61F84F578C4F8C8EC41BD44F02403B"><enum>(I)</enum><text>The information security measures necessary to protect claimants' personal data while enabling auditing and research, including recommendations for privacy-protective technologies, such as secure multi-party computation, that can enable such auditing and research in a manner that does not involve sharing data on individual claimants.</text></subparagraph><subparagraph id="id36C8FE25A8654A04BA602274E568AC31"><enum>(J)</enum><text>How the technology capabilities can improve data sharing among States and the Federal Government with respect to recipiency, benefit levels, timeliness, and accuracy.</text></subparagraph><subparagraph id="idEAC41C9C4FE34425A4E2E046A54A70B9"><enum>(K)</enum><text>How the technology capabilities can minimize disparities in unemployment compensation recipiency by race, gender, ethnicity, disability status, income, or occupation, and prevent any increase in such disparities.</text></subparagraph><subparagraph id="id27D145D226E44F05ACB6847B70FF8F97"><enum>(L)</enum><text>Potential approaches for development or procurement of the technology capabilities, including, for each approach presented, range estimates for development, implementation, and operational costs, and range estimates of capability delivery schedules.</text></subparagraph></paragraph><paragraph commented="no" id="idFEB594795A0642ADB1565CA5D5AE4B09"><enum>(2)</enum><header>Report</header><text>Not later than 4 months after the date of enactment of this section, the Secretary, in coordination with the Administrator, shall submit to Congress a report containing the results of the study conducted under paragraph (1), together with the Department's strategy for development and procurement of the technology capabilities, including any recommendations for such legislation and administrative action as the Secretary determines appropriate.</text></paragraph></subsection><subsection id="idEA8138F9521D41ED84912B05EE09F7CA"><enum>(d)</enum><header>Digital Services Team</header><paragraph id="id259871329C344A75AB2013EDA350B679"><enum>(1)</enum><header>Establishment</header><text>The Secretary, in coordination with the Administrator, shall establish in the Department a Digital Services Team (in this section referred to as the <quote>Team</quote>).</text></paragraph><paragraph id="idF3713D90845942E48D63E3FEDF63E7B3"><enum>(2)</enum><header>Membership</header><text>The Team shall include—</text><subparagraph id="id1FD9174081E24247968CE20F4DE7A93B"><enum>(A)</enum><text>technology experts;</text></subparagraph><subparagraph id="idC57CAFBCF4E34F93B4A0654BAEBA3CBE"><enum>(B)</enum><text>user experience experts;</text></subparagraph><subparagraph id="id56AD257DE9074D5AA6C0466D4FF8D2E3"><enum>(C)</enum><text>an experienced technical team leader with experience in human-centered design and modern software development practices; and</text></subparagraph><subparagraph commented="no" id="id3CACD9326CAC44CEB1D157A8B660DAA1"><enum>(D)</enum><text>any other member deemed appropriate by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" id="id235A57C172B54E12831583D9478E4B38"><enum>(3)</enum><header>Duties</header><text>The Team shall carry out the following duties:</text><subparagraph commented="no" id="id624B93DAC8214ED2B527EA770911D565"><enum>(A)</enum><text>Assist the Secretary in the development, operation, and maintenance of the technology capabilities under subsection (a).</text></subparagraph><subparagraph commented="no" id="idED2A532C69914D7C9F788118B1CA5270"><enum>(B)</enum><text>After the development and deployment of the technology capabilities under subsection (a) is complete, assist the Secretary in operating and overseeing the maintenance and continued improvement of the technology capabilities, including by providing technological assistance—</text><clause commented="no" id="idECCA0A5106FE4A9DA248CCAC0BB3D226"><enum>(i)</enum><text>to State workforce agencies; and</text></clause><clause commented="no" id="id7DD32096A6CF43B7B271149FD4F77793"><enum>(ii)</enum><text>to States seeking to adapt their State databases to interface with the Federally provided modular and open systems technology capabilities described in subsection (b)(1)(E).</text></clause></subparagraph><subparagraph commented="no" id="id88E719A370BB4F21840274654353674F"><enum>(C)</enum><text>Ensure the Department has sufficient in-house technical expertise and procurement support.</text></subparagraph><subparagraph commented="no" id="id906354F3C1E14405B7994F6660A30888"><enum>(D)</enum><text>Assist the Department with technology needs.</text></subparagraph><subparagraph commented="no" id="idDD8B7D8B90674CFEA5D3FCE3304CCDF8"><enum>(E)</enum><text>Engage in such other activities deemed appropriate by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC884D78B9CF84B1EBD7B3D803D4686D4"><enum>(4)</enum><header>Staff and resources</header><text>The Secretary shall ensure that the Team has such staff, resources, and access to information as may be necessary to carry out the duties of the Team.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB3A58F863F814BB599354E829E7BB706"><enum>(5)</enum><header>Digital Services Team Funding</header><text>Out of any money in the Treasury not otherwise appropriated, there are appropriated to the Secretary $5,000,000 to carry out this subsection. Amounts appropriated under the preceding sentence shall remain available until expended.</text></paragraph></subsection><subsection id="id640B48706C194849A6EF4748FE8BF48A"><enum>(e)</enum><header>Pilot program</header><text>Prior to the deployment of the technology capabilities to all States, the Secretary shall select not fewer than 4 States to participate in a pilot program to test the technology capabilities and demonstrate that such technology capabilities meet the requirements and end-to-end user experience needs established by this Act, including those identified in the pre-development study described in subsection (c)(1).</text></subsection><subsection commented="no" id="idD7850D39EE8B4C7ABFC316455E8CBF6D"><enum>(f)</enum><header>Data sharing</header><text>To enable the storage, exposure, and exchange of data required by States to administer their unemployment compensation programs, the Secretary shall—</text><paragraph id="id76eac995059f4ec89dfaff0a379a445d"><enum>(1)</enum><text>establish Computer Matching Agreements in accordance with the Computer Matching and Privacy Protection Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/5/552a">5 U.S.C. 552a</external-xref> note) to obtain information necessary to verify a claimant's eligibility for unemployment compensation;</text></paragraph><paragraph id="idae2cccaeed6145e0b478cc96f216d2a6"><enum>(2)</enum><text>determine appropriate aggregate data to share on a regular basis with the public through the Data.gov internet website pursuant to the Foundations for Evidence-Based Policy Making Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/5/101">5 U.S.C. 101</external-xref> note);</text></paragraph><paragraph id="idda33d64e594d4b32aa290ff0228c135c"><enum>(3)</enum><text>establish appropriate controls and monitoring to make available only the data necessary for States to administer their unemployment compensation programs; and</text></paragraph><paragraph id="id733f75570bf84b4785595b359007ec9c"><enum>(4)</enum><text>establish a data retention policy for retaining or archiving historical unemployment compensation program data as deemed appropriate.</text></paragraph></subsection><subsection id="idD6F63EF3E348462AA65CA26C12494F3C"><enum>(g)</enum><header>Procurement and contracts with private vendors</header><text>If the Secretary contracts with a private vendor to procure or develop or assist with the development of the technology capabilities under subsection (a), the Secretary shall—</text><paragraph id="id97521FB2BDEA4034AD4D9F92BA65D691"><enum>(1)</enum><text>ensure that any agreement with such private vendor stipulates that the resulting technology capabilities and associated research, applications, automated processes, and associated metadata shall be the proprietary information of the Federal Government;</text></paragraph><paragraph id="id4E38EF6137E7454FBD6300A71153E03A"><enum>(2)</enum><text>follow best practices for Government IT procurement to de-risk projects; and</text></paragraph><paragraph id="id218444659FE845DEB4EF83BA1B2D08F0"><enum>(3)</enum><text>provide funding based on program outcomes rather than volume.</text></paragraph></subsection><subsection id="id94F7DC66696B4AD29BDE727FF29C06A5"><enum>(h)</enum><header>Oversight</header><paragraph id="idC6599E342A0D47CC82B1FF04831C3AC9"><enum>(1)</enum><header>Oversight</header><text>During and after the development of the technology capabilities under subsection (a), the Secretary shall—</text><subparagraph id="id35B2B683FB6642808BBDAB47EEBA73C3"><enum>(A)</enum><text>respond to requests from Congress for updates on the development of the technology capabilities; and</text></subparagraph><subparagraph id="idF145D849CACA49CE8DB47FB95201D5BC"><enum>(B)</enum><text>participate in oversight hearings and demonstrations of the technology capabilities as requested by Congress.</text></subparagraph></paragraph><paragraph id="idF197804525394D2D8CA24746D478BFEE"><enum>(2)</enum><header>Publicly available status</header><text>Not later than 6 months after the date of enactment of this section, the Secretary shall establish and maintain publicly available content, available on the internet website of the Department, that provides the status of—</text><subparagraph id="id72C0C6C8543440BCA9E1A66A5A551970"><enum>(A)</enum><text>the technology capabilities being developed under this section;</text></subparagraph><subparagraph id="idCAA976F0F34144CC90CFD1C2BDC66C86"><enum>(B)</enum><text>the metrics of success for such development;</text></subparagraph><subparagraph id="idBDC2ADFB5EB148C7A3A122B0AA6309B9"><enum>(C)</enum><text>the results from piloting and testing of such technology capabilities; and</text></subparagraph><subparagraph id="id2FBE0BB78D7F4741B24591265088F4DD"><enum>(D)</enum><text>deployment of such technology capabilities in each of the States and the Federal Government.</text></subparagraph></paragraph></subsection><subsection id="idC9C8EA49AEC247A6ABBF437929EC5214"><enum>(i)</enum><header>Technology Capabilities Modernization Funding</header><text>Out of any money in the Treasury not otherwise appropriated, there are appropriated to the Secretary $500,000,000 to carry out this section (other than subsection (d)). Amounts appropriated under the preceding sentence shall remain available until expended.</text></subsection><subsection id="idB966622FFA004FC6B68050D1183D0F48"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idFAF1EFB6D35E4053A8961FBC19F8D28A"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the United States Digital Service.</text></paragraph><paragraph id="idB4739D1BDCA34C9291F031CBC96CB707"><enum>(2)</enum><header>Automated decision system</header><text>The term <term>automated decision system</term> means a computational process, including one derived from machine learning, statistics, or other data processing or artificial intelligence techniques, that makes a decision or facilitates human decision making that impacts claimants.</text></paragraph><paragraph id="idC537BFA5D9274CC48047C8091BA75286"><enum>(3)</enum><header>Automation bias</header><text>The term <term>automation bias</term> means the tendency for humans to over-rely on the recommendation of an automated decision system, to place overconfidence in such recommendation based on perceived superiority to analog or human processes, or to ignore evidence that would indicate the automated decision system has made an error.</text></paragraph><paragraph id="id484868A67E644A41843F39891E9BA204"><enum>(4)</enum><header>Claimant</header><text>The term <term>claimant</term> means a claimant for unemployment compensation.</text></paragraph><paragraph id="id3DF5FD93525F4F6EA2304F322BEDCBBB"><enum>(5)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Labor.</text></paragraph><paragraph id="id270CDBACC54243F6AC3C74CDCF064FA3"><enum>(6)</enum><header>High-risk automated decision system</header><text>The term <term>high-risk automated decision system</term> means an automated decision system that—</text><subparagraph id="idbdb8b1c508034d0e82fb023eb265d7cf"><enum>(A)</enum><text>poses a significant risk—</text><clause id="ida2a61565afaa43da9e2a33062ec6b7f8"><enum>(i)</enum><text>to the privacy or security of personal information of claimants; or</text></clause><clause id="id61a9df78bc184aa199163edc15f3be0d"><enum>(ii)</enum><text>of resulting in or contributing to inaccurate, unfair, biased, or discriminatory decisions impacting claimants;</text></clause></subparagraph><subparagraph id="id9db35c7af587400aa2139242e33bcce5"><enum>(B)</enum><text>makes decisions, or facilitates human decision making, based on systematic evaluations of current and historical claimant data, including attempts to analyze or predict sensitive aspects of claimants' lives or characteristics or activities that may affect their eligibility for unemployment compensation, such as their reason for separation from employment, availability for work, work search activities, work performance, economic situation, health, personal preferences, interests, behavior, location, or movements, that—</text><clause id="id103250d0d67d4673b2313bfd6a5570a4"><enum>(i)</enum><text>alter legal rights of the claimants; or</text></clause><clause id="id9b75b0aa06d54059ab715ee2a105a5e4"><enum>(ii)</enum><text>otherwise significantly impact the claimants;</text></clause></subparagraph><subparagraph commented="no" id="id186d9a6c86684c918efd32ad5dbe066c"><enum>(C)</enum><text>involves the personal information of a significant number of claimants regarding race, color, national origin, political opinions, religion, trade union membership, genetic data, biometric data, health, gender, gender identity, sexuality, sexual orientation, disability status, criminal convictions, or arrests; or</text></subparagraph><subparagraph commented="no" id="iddd1c1cd42a5547d0b1c1753dbe8d37a8"><enum>(D)</enum><text>meets any other criteria deemed appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="id5A46587CB0F746C7A2D7D08FB4354B69"><enum>(7)</enum><header>Modular open systems approach</header><text>The term <term>modular open systems approach</term> means an integrated business and technical strategy that—</text><subparagraph id="id4ac16cddd3564af2884c2daa9cd60d30"><enum>(A)</enum><text>employs a modular design that uses system interfaces between a system platform and a system component, between system components, or between system platforms;</text></subparagraph><subparagraph id="id21d02bed3611443f8426e00ba1d539b9"><enum>(B)</enum><text>is subjected to verification to ensure system interfaces comply with, if available and suitable, widely supported and consensus-based standards; and</text></subparagraph><subparagraph id="id2a806a937dd14076bd493a7f99aee799"><enum>(C)</enum><text>uses a system architecture that allows severable system platforms or components at the appropriate level to be incrementally added, removed, or replaced throughout the life cycle of a system platform or component while yielding—</text><clause id="ida516a88c3c9143cb84d256c83ef7b497"><enum>(i)</enum><text>significant cost savings or avoidance;</text></clause><clause id="id408b0e2a4ac84e8e8068c4b83605f7ec"><enum>(ii)</enum><text>schedule reduction;</text></clause><clause id="id69dbf829eab54f3ab1c271e1adae89f2"><enum>(iii)</enum><text>opportunities for technical upgrades;</text></clause><clause id="iddef3990cd0044cdb8cf091e0b5da43d6"><enum>(iv)</enum><text>increased interoperability; or</text></clause><clause id="id501218929afc444bb4db7ae59828ad6d"><enum>(v)</enum><text>other benefits during the sustainment phase.</text></clause></subparagraph></paragraph><paragraph id="idE4DD0192B4B542D5A22E9EDC4789DAF1"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="idCFC0C3B3BA534CE6B9F22A69F03DD7C8"><enum>(9)</enum><header>Secure multi-party computation</header><text>The term <term>secure multi-party computation</term> means a computerized system that enables different participating entities in possession of private sets of data to link and aggregate their data sets for the exclusive purpose of performing a finite number of pre-approved computations without transferring or otherwise revealing any private data to each other or anyone else.</text></paragraph><paragraph id="id5B017AB83A47429BB71F4CC9869E28B6"><enum>(10)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and the United States Virgin Islands.</text></paragraph></subsection></section></legis-body></bill>
