which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To condition civil and military assistance to the Government of Colombia on certain recurring certifications from the Secretary of State. </official-title></form><legis-body id="HAE0A292FD4214517966196233225462C"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Colombia Assistance Used Transparently by Institutionalizing Oversight Now Act of 2022 </short-title></quote> or the <quote><short-title>CAUTION Act</short-title></quote>.</text></section><section id="id1e7c9a4d014f4e7da37360f2f60f4cf4"><enum>2.</enum><header>Certification requirements for civil and military assistance to Colombia</header><subsection id="id6A68F083F814497FB15569645CBF9EA1"><enum>(a)</enum><header>Conditions on civil and military assistance</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no civil or military assistance to Colombia may be obligated or expended unless the Secretary of State certifies to the appropriate congressional committees that, during the reporting period, the Government of Colombia—</text><paragraph id="id3a81a3994d08443f93c2b89434830fd5"><enum>(1)</enum><text>has not sought to erode cooperation with the United States in the areas of military, intelligence, and counter-terrorism; </text></paragraph><paragraph id="id150f08b3201d41cba5dfbbede902354d"><enum>(2)</enum><text>is asserting its sovereignty against the Governments of Cuba, Iran, Nicaragua, the People’s Republic of China, and Venezuela, including by denying all access to military or intelligence infrastructure to those governments;</text></paragraph><paragraph id="id9c65ab384cb146a98c2efe18e879f9d7"><enum>(3)</enum><text>has not taken significant steps to recognize, legitimize, or engage any foreign terrorist organization; and</text></paragraph><paragraph id="id55da902283874d6b9bb22284995bbdd1"><enum>(4)</enum><text>has not interfered with the Special Jurisdiction for Peace’s efforts to investigate and, as appropriate, sentence current or former members of the Revolutionary Armed Forces of Colombia who committed acts of terrorism or gross violations of human rights.</text></paragraph></subsection><subsection id="id7d3eb53b2aea431b8a86f81835e6e176"><enum>(b)</enum><header>Additional conditions on civil assistance</header><text>Notwithstanding any other provision of law, no civil assistance to Colombia may be obligated or expended unless the Secretary of State certifies to the appropriate congressional committees that, during the reporting period, in addition to meeting the conditions described under subsection (a), the Government of Colombia—</text><paragraph id="id1328e6856415467a80589419bcb60f63"><enum>(1)</enum><text>is guaranteeing the rights, freedoms, and responsibilities enshrined in the Colombian Constitution of 1991, including—</text><subparagraph id="idcefd4dcff80949b6a0a286b7a7aecba6"><enum>(A)</enum><text>freedom of expression;</text></subparagraph><subparagraph id="id94431c27ff1e4545aaa4749cef4de76b"><enum>(B)</enum><text>freedom of the press;</text></subparagraph><subparagraph id="ide1152531e40f4e18bffadc120c53f660"><enum>(C)</enum><text>the guarantee of due process;</text></subparagraph><subparagraph id="id2d5e87580c35410399e4b3f93841c68b"><enum>(D)</enum><text>the right to private property and other rights acquired in accordance with civil laws; and</text></subparagraph><subparagraph id="id481f32ac75dd4d3baae2ad9daeb4fedb"><enum>(E)</enum><text>protections against coercion of citizens voting in elections;</text></subparagraph></paragraph><paragraph id="idd9ecca4a31754db7bf2c7beba0476181"><enum>(2)</enum><text>is significantly cooperating with the United States Government to—</text><subparagraph id="id5b86e597bfef4f69b2fae0f8bbbb655e"><enum>(A)</enum><text>reduce irregular migration, improve border security, and combat human smuggling and trafficking;</text></subparagraph><subparagraph id="id5b70e7d9830947f49078c26ebe0692d7"><enum>(B)</enum><text>target the cultivation, production, processing, trafficking, distribution, commercialization, financing, and selling of illicit drugs, including opioids and cocaine; and</text></subparagraph><subparagraph id="idace697d5cae14f4c865985df3747c011"><enum>(C)</enum><text>counter the activities of criminal gangs and transnational criminal organizations;</text></subparagraph></paragraph><paragraph id="ide8cad50f840746e1a7027482f57bc439"><enum>(3)</enum><text>is taking steps to ensure transparency and prevent corruption related to efforts by the Chinese Communist Party or the Government of the People’s Republic of China to acquire or invest in Colombian energy or raw materials sectors; and</text></paragraph><paragraph id="id685d514e917d49b686381f321c1e1f34"><enum>(4)</enum><text>has not interfered in the transparency, operation, or independence of the Office of the Inspector General of Colombia.</text></paragraph></subsection></section><section id="idf6536393b5f2481fa35f47384e0780d3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id5457b315f2b042d198bfa132b96e1493"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives. </text></paragraph><paragraph id="id7264d718c7614ac08d2025484db3b257"><enum>(2)</enum><header>Civil assistance</header><text>The term <term>civil assistance</term> means development assistance, International Narcotics Control and Law Enforcement (INCLE) program assistance, and Economic Support Fund assistance. </text></paragraph><paragraph id="id5c28653b0c90473683c1173c64011c96"><enum>(3)</enum><header>Military assistance</header><text>The term <term>military assistance</term> means foreign military financing (FMF), International Military and Education Training (IMET), and Nonproliferation, Anti-terrorism, Demining, and Related Programs (NADR) assistance. </text></paragraph><paragraph id="id9d45fb2afb07428d92436edd9b879cb2"><enum>(4)</enum><header>Foreign terrorist organizations</header><text>The term <term>foreign terrorist organization</term> means an organization designated pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>) or Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism). </text></paragraph><paragraph id="idfd38d63b02ff4fc8bc1dad5baccfe44c"><enum>(5)</enum><header>Reporting time period</header><text>The term <term>reporting time period</term> means since August 7, 2022, or the previous 12 months, whichever is less.</text></paragraph></section><section id="iddee1035ea5c74237a457f479417a5598"><enum>4.</enum><header>Termination and sunset</header><text display-inline="no-display-inline"> The restrictions imposed by this Act shall terminate on the date on which the President certifies to the appropriate congressional committees that Colombia has conducted a free and fair election after the date of the enactment of this Act. </text></section></legis-body></bill>
