id="H5D3FCC82A26A42079CACC78AA8248532" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SBIR and STTR Extension Act of 2022</short-title></quote>.</text></section><section id="H41E06D60B31243889AD9A93D75C93CA9" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H97E9B53628E346AA9FF3B9A9A50B07D9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Administration; Administrator</header><text display-inline="yes-display-inline">The terms <term>Administration</term> and <term>Administrator</term> mean the Small Business Administration and the Administrator thereof, respectively.</text></paragraph><paragraph id="H003B7BA28DF84B2494712D7CC4C05ADE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Federal agency; Phase I; Phase II; Phase III; SBIR; STTR</header><text display-inline="yes-display-inline">The terms <term>Federal agency</term>, <term>Phase I</term>, <term>Phase II</term>, <term>Phase III</term>, <term>SBIR</term>, and <term>STTR</term> have the meanings given those terms, respectively, in section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>).</text></paragraph></section><section id="HA8D6C5ACEEA34414B5E1AF13571BB291" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Reauthorization of SBIR and STTR programs and pilot programs</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by striking <quote>2022</quote> each place that term appears and inserting <quote>2025</quote>.</text></section><section id="H4A51D87E14104A0E82A404BBEB8E37F7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Foreign risk management</header><subsection id="H18C1B0D23C344D60A06164B03FB1638D" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>) is amended—</text><paragraph id="H727CAD133D0F48F6BB6B42F943C6F28B" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (13)(B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H618271B2BBB046B4971D90EBFBE21706" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6400EE713A364A3098FD9012AACBDCBE"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9F3CBE2DA11643C3B0435324EFB596FB"><paragraph id="HBCC019EA477244E3B211F442813616AF" commented="no" display-inline="no-display-inline"><enum>(15)</enum><text display-inline="yes-display-inline">the term <term>covered individual</term> means an individual who—</text><subparagraph id="H86F210C828214EEE8435CC77FE4D8601" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">contributes in a substantive, meaningful way to the scientific development or execution of a research and development project proposed to be carried out with a research and development award from a Federal research agency; and</text></subparagraph><subparagraph id="HED515AAAADE44C9BA67F33807BBFBF4A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is designated as a covered individual by the Federal research agency concerned;</text></subparagraph></paragraph><paragraph id="HF4A56E7374304181A35A60EBD298CBE6" commented="no" display-inline="no-display-inline"><enum>(16)</enum><text display-inline="yes-display-inline">the term <term>foreign affiliation</term> means a funded or unfunded academic, professional, or institutional appointment or position with a foreign government or government-owned entity, whether full-time, part-time, or voluntary (including adjunct, visiting, or honorary);</text></paragraph><paragraph id="H0A802A12ABA14A0886259F1FBA11CF7A" commented="no" display-inline="no-display-inline"><enum>(17)</enum><text display-inline="yes-display-inline">the term <term>foreign country of concern</term> means the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, the Islamic Republic of Iran, or any other country determined to be a country of concern by the Secretary of State;</text></paragraph><paragraph id="HF9E96EBABF404822BEFC59BFB3ACE72C" commented="no" display-inline="no-display-inline"><enum>(18)</enum><text display-inline="yes-display-inline">the term <term>malign foreign talent recruitment program</term> has the meaning given such term in section 10638 of the Research and Development, Competition, and Innovation Act (division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>); and</text></paragraph><paragraph id="H2086D4D3B4E240C9BFFD98C3B92E0A83" commented="no" display-inline="no-display-inline"><enum>(19)</enum><text display-inline="yes-display-inline">the term <term>federally funded award</term> means a Phase I, Phase II (including a Phase II award under subsection (cc)), or Phase III SBIR or STTR award made using a funding agreement.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9BC5920A5BDA436CA47D5522EE14926D" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Due diligence program to assess security risks</header><paragraph id="HBF054C2D0DD046E3AAF9D89549D7558A" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB6361F9AA31C4DE7B5A145F9FD00B02D"><subsection id="H57D72964C6364042AED5B908E17A7586" commented="no" display-inline="no-display-inline"><enum>(vv)</enum><header display-inline="yes-display-inline">Due diligence program to assess security risks</header><paragraph id="H96CC30081B3C4C84B8997D59176E75A8" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The head of each Federal agency required to establish an SBIR or STTR program, in coordination with the Administrator, shall establish and implement a due diligence program to assess security risks presented by small business concerns seeking a federally funded award.</text></paragraph><paragraph commented="no" id="H930ABC0A56AA44059ECD3C3DC598CBBE" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Risks</header><text display-inline="yes-display-inline">Each program established under paragraph (1) shall—</text><subparagraph commented="no" id="H19432BC70D154F779C1AAA6C07C454A0" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">assess, using a risk-based approach as appropriate, the cybersecurity practices, patent analysis, employee analysis, and foreign ownership of a small business concern seeking an award, including the financial ties and obligations (which shall include surety, equity, and debt obligations) of the small business concern and employees of the small business concern to a foreign country, foreign person, or foreign entity; and</text></subparagraph><subparagraph commented="no" id="H63826387248449F7B6CAF691945EF285" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">assess awards and proposals or applications, as applicable, using a risk-based approach as appropriate, including through the use of open-source analysis and analytical tools, for the nondisclosures of information required under (g)(13).</text></subparagraph></paragraph><paragraph commented="no" id="H02294E47357341E1B77B24CC883F8B79" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Administrative costs</header><subparagraph commented="no" id="H7D975B747B084ED08563947F33F56BEF" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In addition to the amount allocated under subsection (mm)(1), each Federal agency required to establish an SBIR program may allocate not more than 2 percent of the funds allocated to the SBIR program of the Federal agency for the cost of establishing the due diligence program required under this subsection.</text></subparagraph><subparagraph commented="no" id="H5E5276D0F9044268A956B64FAE4A5B6F" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Reporting</header><clause commented="no" id="HECCC3E2768044751831DE0271C460452" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than December 31 of the year in which this subparagraph is enacted, and not later than December 31 of each year thereafter, the head of a Federal agency that exercises the authority under subparagraph (A) shall submit to the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives, the Committee on Small Business and Entrepreneurship of the Senate, and the Administrator, for the covered year—</text><subclause commented="no" id="H82487C7AE56F4536A298E8C5A728971D" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the total funds allowed to be allocated for the cost of establishing the due diligence program required under this subsection;</text></subclause><subclause commented="no" id="H8003E561DA554FF5A0D3C3A41C5D182A" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the total amount of funds obligated or expended under subparagraph (A); and</text></subclause><subclause commented="no" id="H58DAA52C0B2F4D6F9C3EA837FE0D1E33" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">the due diligence activities carried out or to be carried out using amounts allocated under subparagraph (A).</text></subclause></clause><clause commented="no" id="H09B5CB5D64DB4638A4382DCEA90B0A95" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Annual report inclusion</header><text display-inline="yes-display-inline">The Administrator shall include the information submitted by head of a Federal agency under clause (i) in the next annual report submitted under subsection (b)(7) after the Administrator receives such information.</text></clause><clause commented="no" id="HD28AD69EFCCC4934A7154EC5CEF257FC" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Covered year</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>covered year</term> means, with respect to the information required under clause (i), the year covered by the annual report submitted under subsection (b)(7) in which the Administrator is required to include such information by clause (ii).</text></clause></subparagraph><subparagraph id="H0A2C13113B5B47CFB2AA2661771DCA1D" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Termination date</header><text display-inline="yes-display-inline">This paragraph shall terminate on September 30, 2025.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph><paragraph id="H7673A137459E49C08D6ACED523FAD56E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Implementation</header><subparagraph id="HBF87F358E2BB4D148BD18378A5F19CC5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the head of a Federal agency required to establish an SBIR or STTR program shall implement a due diligence program under subsection (vv) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by paragraph (1), at the Federal agency that, to the extent practicable, incorporates the applicable best practices disseminated under paragraph (3).</text></subparagraph><subparagraph id="HDB9A5D5651F44F9B8C2CC210B4937235" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Paperwork Reduction Act</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>), shall not apply to the implementation of a due diligence program under subsection (vv) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by paragraph (1).</text></subparagraph><subparagraph id="H0B87F180A8FA4C4895145564597A787A" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, and on a recurring basis until implementation is complete, each Federal agency required to establish a due diligence program under subsection (vv) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by paragraph (1), shall brief the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives on the implementation of the due diligence program.</text></subparagraph></paragraph><paragraph id="HE2497CEC3B644D478ED4A5725A20134E" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Best practices</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall—</text><subparagraph id="H804953E2A4E54C3F8A708A2892143275" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in coordination with the Director of the Office of Science and Technology Policy and in consultation with the Committee on Foreign Investment in the United States, disseminate among Federal agencies required to establish an SBIR or STTR program best practices of those Federal agencies for due diligence programs required under subsection (vv) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by paragraph (1); and</text></subparagraph><subparagraph id="H3322B02BA7F24A5B8644CAEFE26A5C53" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in consultation with the Committee on Foreign Investment in the United States, provide to Federal agencies described in subparagraph (A) guidance on the business relationships required to be disclosed under paragraph (13)(G) of subsection (g) and paragraph (17)(G) of subsection (o) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by this Act.</text></subparagraph></paragraph><paragraph id="H99305264FAFF4D5D996AD4C1F3644FA4" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">GAO study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter for 3 years, the Comptroller General of the United States shall conduct a study and submit to the Committee on Small Business and Entrepreneurship and the Committee on Armed Services of the Senate and the Committee on Small Business, the Committee on Armed Services, and the Committee on Science, Space, and Technology of the House of Representatives a report on the implementation and best practices of due diligence programs established under subsection (vv) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by paragraph (1), across Federal agencies required to establish an SBIR or STTR program.</text></paragraph><paragraph id="H12D3EF1A138B4E33BA989199A4A77737" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in subsection (vv) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by paragraph (1), shall be construed to—</text><subparagraph id="H5229DADCE76D4966AC00747DED358352" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">apply to any Federal agency with a due diligence program that applies to the SBIR or STTR programs required under subsection (vv) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by paragraph (1), in existence as of the date of enactment of this Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA20D2ED3E5544D7E9EB080106EA8AC84"><enum>(B)</enum><text display-inline="yes-display-inline">restrict any Federal agency from taking due diligence measures in addition to those required under such subsection (vv) at the Federal agency.</text></subparagraph></paragraph></subsection><subsection id="H7458F3581D7D43B48BA8981711257E70" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Disclosures regarding ties to People’s Republic of China and other foreign countries</header><paragraph id="H2A800ACD7A2B4AF789699DF4E8C4D290" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">SBIR</header><text display-inline="yes-display-inline">Section 9(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(g)</external-xref>) is amended—</text><subparagraph id="H83E8537638614A1295E675768FE2A388" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H792A72BF02EF43399D6EB6517363FB71" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (12), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="HD8C35CCB42C64A6F8F99E1BB2E968FD9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H110AB0E39A444E7DAA7C499D5E439350"><paragraph id="H25E187F989B846C889233269BB076F64" commented="no" display-inline="no-display-inline"><enum>(13)</enum><text display-inline="yes-display-inline">require each small business concern submitting a proposal or application for a federally funded award to disclose in the proposal or application—</text><subparagraph id="H9AE1F484195248A2B1E3B39A00789219" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the identity of all owners and covered individuals of the small business concern who are a party to any foreign talent recruitment program of any foreign country of concern, including the People’s Republic of China;</text></subparagraph><subparagraph id="H769CC6C4833F4F4F84ACEA6D2053DBCB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the existence of any joint venture or subsidiary of the small business concern that is based in, funded by, or has a foreign affiliation with any foreign country of concern, including the People’s Republic of China;</text></subparagraph><subparagraph id="H7D1A5B2CBD264E6091D730926E159617" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any current or pending contractual or financial obligation or other agreement specific to a business arrangement, or joint venture-like arrangement with an enterprise owned by a foreign state or any foreign entity;</text></subparagraph><subparagraph id="H884A1C3EA38F4373877A2DE98327EFBF" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">whether the small business concern is wholly owned in the People’s Republic of China or another foreign country of concern;</text></subparagraph><subparagraph id="H3503EE4D7BC440ABAB7D5581224A9B95" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the percentage, if any, of venture capital or institutional investment by an entity that has a general partner or individual holding a leadership role in such entity who has a foreign affiliation with any foreign country of concern, including the People’s Republic of China;</text></subparagraph><subparagraph id="HCACC021689CB4A2FB692846BD2C55C30" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">any technology licensing or intellectual property sales to a foreign country of concern, including the People’s Republic of China, during the 5-year period preceding submission of the proposal; and</text></subparagraph><subparagraph id="HEFC4CED0392C491B8B49523BA34FBE6C" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">any foreign business entity, offshore entity, or entity outside the United States related to the small business concern;</text></subparagraph></paragraph><paragraph commented="no" id="H408EDBEFFB46430796FCC88C4DCF210F" display-inline="no-display-inline"><enum>(14)</enum><text display-inline="yes-display-inline">after reviewing the disclosures of a small business concern under paragraph (13), and if determined appropriate by the head of such Federal agency, request such small business concern to provide true copies of any contractual or financial obligation or other agreement specific to a business arrangement, or joint-venture like arrangement with an enterprise owned by a foreign state or any foreign entity in effect during the 5-year period preceding submission of the proposal with respect to which such small business concern made such disclosures;</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1931A7C92EE347E0A3374ACD45CB737C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">STTR</header><text display-inline="yes-display-inline">Section 9(o) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(o)</external-xref>) is amended—</text><subparagraph id="HCFCE314987C849FBA7CB7D1781AB96FC" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (15), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the existence of any joint venture or subsidiary of the small business concern that is based in, funded by, or has a foreign affiliation with any foreign country of concern, including the People’s Republic of China;</text></subparagraph><subparagraph id="H40A9C5B726734A089350490CE431858C" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any current or pending contractual or financial obligation or other agreement specific to a business arrangement, or joint venture-like arrangement with an enterprise owned by a foreign state or any foreign entity;</text></subparagraph><subparagraph id="HFE33E7438A5C45EE9EE5BD63ABFF1420" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">whether the small business concern is wholly owned in the People’s Republic of China or another foreign country;</text></subparagraph><subparagraph id="HE252C33C4B144C5D9C5309BFE883BB58" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the percentage, if any, of venture capital or institutional investment by an entity that has a general partner or individual holding a leadership role in such entity who has a foreign affiliation with any foreign country of concern, including the People’s Republic of China;</text></subparagraph><subparagraph id="H6600C798AC484905AC8C1E60D070854F" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">any technology licensing or intellectual property sales to a foreign country of concern, including the People’s Republic of China, during the 5-year period preceding submission of the proposal; and</text></subparagraph><subparagraph id="HB708AEBBCA4D4F1BBA323CE91565A429" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">any foreign business entity, offshore entity, or entity outside the United States related to the small business concern;</text></subparagraph></paragraph><paragraph commented="no" id="H47FE73F5E0F94E5C99FA69C177DA4544" display-inline="no-display-inline"><enum>(18)</enum><text display-inline="yes-display-inline">after reviewing the disclosures of a small business concern under paragraph (17), and if determined appropriate by the head of such Federal agency, request such small business concern to provide true copies of any contractual or financial obligation or other agreement specific to a business arrangement, or joint-venture like arrangement with an enterprise owned by a foreign state or any foreign entity in effect during the 5-year period preceding submission of the proposal with respect to which such small business concern made such disclosures;</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H13E4B62C7C5342F8BC6AB480841C461E" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Denial of awards</header><paragraph id="H7E9D1BE88A934F5EB9E984586496B6FC" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">SBIR</header><text display-inline="yes-display-inline">Section 9(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(g)</external-xref>), as amended by subsection (c)(1), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H31DC506766CF46FABD27FB722339A28D"><paragraph id="H9725033A82244FE68D6FEC0AC98CE57C" commented="no" id="HEBC4142DB3A9445DB9AD6EAB01AD6450" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">interfere with the capacity for activities supported id="HB0FEDECE34AD4E2E97F1C99CA062ABC8" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Agency recovery authority and ongoing reporting</header><subsection id="H3C0746DE06C6473B9605E25239A13F6D" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">SBIR</header><text display-inline="yes-display-inline">Section 9(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(g)</external-xref>), as amended by section 4(d)(1), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" display-inline="yes-display-inline">Report on adversarial military and foreign influence in the SBIR and STTR programs</header><subsection id="H4268A3E167AD4E4083A60220A24EA5EC" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Covered agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered agency</term> means—</text><paragraph id="H22BF9C41ED864709886C7C6783907624" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of Defense;</text></paragraph><paragraph id="H5B3CCD34935A48868CA09F970897EFAA" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the Department of Energy;</text></paragraph><paragraph id="H9EE274EC32E54B7D9D97896905EA2A85" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the Department of Health and Human Services; or</text></paragraph><paragraph id="H9C4E215A893F455DA4C14BCA27708889" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the National Science Foundation.</text></paragraph></subsection><subsection id="HA6E017AD1C0346D7A4521E016CE7B7FF" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header><paragraph id="H4FA71707BCBE44779D2BFE9BF3D78D69" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not later than 180 days after the date of enactment of this Act, the head of each covered agency shall submit a report assessing the adversarial military and foreign influences in the SBIR and STTR programs at the covered agency to—</text><subparagraph id="HBE468F7327DA41E897CDA722E73B8B47" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Armed Services, the Committee on Small Business and Entrepreneurship, and the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3319EA0A3DCD45829A8E0279256826BF"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Armed Services, the Committee on Small Business, and the Committee on Science, Space, and Technology of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HF56559B087CB4A4280A64C738FBC8E4C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Department of Health and Human Services</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall submit 2 reports under paragraph (1)— </text><subparagraph id="idD15DE6775C0040669B85A3D1F55BCA7A" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">1 assessing the adversarial military and foreign influences in the SBIR and STTR programs of the National Institutes of Health; and </text></subparagraph><subparagraph id="id2E221457625D4576B66741A5F78FC2A3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">1 assessing the adversarial military and foreign influences in the SBIR and STTR programs of the Department of Health and Human Services other than those of the National Institutes of Health.</text></subparagraph></paragraph></subsection><subsection id="HB768E5AB22914BDD8C3838EFCAAF28CD" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted by a covered agency under subsection (b) shall include an analysis of—</text><paragraph id="H5CA0E354BE804F4B97D3CF8F3503AA77" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the national security and research and integrity risks of the SBIR and STTR programs of the covered agency; and</text></paragraph><paragraph id="H6C5FE6141039400997ADB045DA3456C4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the capability of such covered agency to identify and mitigate such risks.</text></paragraph></subsection><subsection id="HE8930B49F3D943DDB8D932DAC6A47D61" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">Each report submitted under subsection (b) shall be in unclassified form, but may include a classified annex.</text></subsection><subsection id="H88B569ECDF3B4BCD9D4EFA99A0052310" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Independent entity contracting</header><text display-inline="yes-display-inline">The head of each covered agency, in coordination with the heads of other Federal agencies, as appropriate, may enter into a contract with an independent entity to prepare a report required under subsection (b).</text></subsection></section><section id="H3A26CEB3EDE94EADAE5F561126811FF5" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Program on innovation open topics</header><subsection display-inline="yes-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by this Act, is further amended—</text><paragraph id="H8ADCFB4D87C34DD2B26BC9CB171BF399" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(7)—</text><subparagraph id="HC96B3170FE7A4865947BCFA81139FCA0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="H09FCA8D3BE994719A30E43BDAF7E81B9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text agency participating in the SBIR or STTR program in innovation open topics as compared to conventional topics, and how many small business concerns receive funding from open topics compared to conventional topics;</text></subparagraph><subparagraph id="H5AA8EE0B91544B9E893017AB9E069E68" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">the total number and dollar amount, and average size, of awards made by each Federal agency participating in the SBIR or STTR program, by phase, from—</text><clause commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB90ADFBFB64B4BC19B8C239D6B3C781B"><subsection id="HF6B128C2525D47759458C0E16CFF5479" commented="no" display-inline="no-display-inline"><enum>(ww)</enum><header display-inline="yes-display-inline">Program on innovation open topics</header><paragraph id="H9F2F638E7C4E485D84FAF644B735D1B1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Secretary of Defense shall establish innovation open topic activities using the SBIR and STTR programs of the Department of Defense in order to—</text><subparagraph id="HD9EE6CDFB859450D89A6E2496B23941B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">increase the transition of commercial technology to the Department of Defense;</text></subparagraph><subparagraph id="HBCC5A145E0FE4F3EBEBB33C6F7FB3505" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">expand the small business nontraditional industrial base;</text></subparagraph><subparagraph id="HF6EFFC5617CF4C32976A22A87588B6BB" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">increase commercialization derived from investments of the Department of Defense; and</text></subparagraph><subparagraph id="H5EA2018D7EA94523B6E0A8BBC5A17B5B" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">expand the ability for qualifying small business concerns to propose technology solutions to meet the needs of the Department of Defense.</text></subparagraph></paragraph><paragraph id="H7DA3E00320DE422B9B2C12670BB82B6D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Frequency</header><text display-inline="yes-display-inline">The Secretary of Defense shall conduct not less than 1 open topic announcement at each component of the Department of Defense per fiscal year.</text></paragraph><paragraph id="H2016EDAC29934E19B772B13720258A53" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Secretary of Defense shall provide a briefing on the establishment of the program required under paragraph (1) to—</text><subparagraph id="H18D05386791D4CC39CB70BA12B8D22C9" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Armed Services and the Committee on Small Business and Entrepreneurship of the Senate; and</text></subparagraph><subparagraph id="HA9B07DADBC904E19B88A068DA537367F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Small Business, the Committee on Armed Services, and the Committee on Science, Space, and Technology of the House of Representatives.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H0ECF336C09674262B53450F781A8B58C" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">GAO report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter for 3 years, the Comptroller General of the United States shall submit to Congress and issue a publicly available report comparing open topics and conventional topics under the SBIR and STTR programs that includes, to the extent practicable—</text><paragraph commented="no" id="HBAE004A72AC64B449D14704A746F991E" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the percentage of small business concerns that progress from Phase I to Phase II awards, then to Phase III awards;</text></paragraph><paragraph commented="no" id="HE086F6CE606F480CA2E5CB29912D116C" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the number of awards under the SBIR and STTR programs made to first-time applicants and first-time awardees;</text></paragraph><paragraph commented="no" id="H5A3A7DA51C844DC4961FA22CC4554736" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the number of awards under the SBIR and STTR programs made to non-traditional small business concerns, including those owned by women, minorities, and veterans;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFE04CBC4391A429BBA2BDF0C1822EB28"><enum>(4)</enum><text display-inline="yes-display-inline">a description of outreach and assistance efforts by the Department of Defense to encourage and prepare new and diverse small business concerns to participate in the program established under subsection (ww) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as added by subsection (a);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H620963198B6E451CAE772D09388ED09B"><enum>(5)</enum><text display-inline="yes-display-inline">the length of time to review and disburse awards under such subsection (ww), evaluated in a manner enabling normalized comparisons of such times taken by each Federal agency that is required to establish an SBIR or STTR program and offers open topics;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2BC3ACA176E04CC1A496DD20245798BD"><enum>(6)</enum><text display-inline="yes-display-inline">the ratio, and an assessment, of the amount of funding allocated towards open topics as compared to conventional topics at each Federal agency that is required to establish an SBIR or STTR program and offers open topics; and</text></paragraph><paragraph id="H387B6BDA49E841FDA3E776F8E5E62CEE" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">a comparison of the types of technology and end users funded under open topics compared to the types of technology and end users funded under conventional topics.</text></paragraph></subsection></section><section id="H2580534E49E342F19652501EAAD6DAE6" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Increased minimum performance standards for experienced firms</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by this Act, is further amended—</text><paragraph id="H6482EDBBE1EC431B8D26551B5A5687B4" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(7), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD2C45E4DC44A416CBB944FEC58CDC23F"><subparagraph id="H9090FE90D99245638DFA990D8AC97F0E" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">the minimum performance standards established under subsection (qq), including any applicable modifications under paragraph (3) of such subsection, and the number of small business concerns that did not meet those minimum performance standards, provided that the Administrator does not publish any personally identifiable information, the identity of each such small business concern, or any otherwise sensitive information; and</text></subparagraph><subparagraph commented="no" id="H4E3FB6FCB445480B9DE0B384B8265E51" display-inline="no-display-inline"><enum>(L)</enum><text display-inline="yes-display-inline">the aggregate number and dollar amount of SBIR and STTR awards made pursuant to waivers under subsection (qq)(3)(E), provided that the Administrator does not publish any personally identifiable information, the identity of each such small business concern, or any otherwise sensitive information;</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="H5A94D3384A7442E3BDDE04019294E1F4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (qq)—</text><subparagraph id="H1C7746AFA2D04DAD8BD87209AE81EBA3" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively;</text></subparagraph><subparagraph commented="no" id="H33A0D0D21C394AEEBB10F21708F2E22E" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD67F35160BAA45DC91F9A3DA94AE1E4D"><paragraph commented="no" id="H0B5432D7918947F2BE84479DF51F9B8C" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Increased minimum performance standards for experienced firms</header><subparagraph commented="no" id="H0BADE2BAAB004BFAA907E1C881A4AC9D" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Progress to Phase II success</header><clause commented="no" id="H3B247EA7A05E40FBBF54FFFBFFFC219E" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to a small business concern that received or receives more than 50 Phase I awards during a covered period, each minimum performance standard established under paragraph (1)(A)(ii) shall be doubled for such covered period.</text></clause><clause commented="no" id="H4D597648B6E64F4FA81CA5F97BEB82A7" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Consequence of failure to meet standard</header><text display-inline="yes-display-inline">If the head of a Federal agency determines that a small business concern that received a Phase I award from the Federal agency is not meeting an applicable increased minimum performance standard modified under clause (i), the small business concern may not receive more than 20 total Phase I awards and Phase II awards under subsection (cc) from each Federal agency during the 1-year period beginning on the date on which such determination is made.</text></clause><clause commented="no" id="H0510C0C4C522493FBA0696DB51928135" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Covered period defined</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>covered period</term> means a consecutive period of 5 fiscal years preceding the most recent fiscal year.</text></clause></subparagraph><subparagraph commented="no" id="H98644C91ED554AFAA61305267C81B420" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Progress to Phase III success</header><clause commented="no" id="H4684333AFB03455281F6870A87D21FE3" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each minimum performance standard established under paragraph (2)(A)(ii) shall—</text><subclause commented="no" id="H732ACA41B45947B7819724A7063683D4" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to a small business concern that received or receives more than 50 Phase II awards during a covered period, require an average of $250,000 of aggregate sales and investments per Phase II award received during such covered period; and</text></subclause><subclause commented="no" id="HE895644568034C22805B8CF74353DF47" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to a small business concern that received or receives more than 100 Phase II awards during a covered period, require an average of $450,000 of aggregate sales and investments per Phase II award received during such covered period.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HAF5D9245EF914694948C27A0BFA93C8F"><enum>(ii)</enum><header display-inline="yes-display-inline">Consequence of failure to meet standard</header><text display-inline="yes-display-inline">If the head of a Federal agency determines that a small business concern that received a Phase I award from the agency is not meeting an applicable increased minimum performance standard modified under clause (i), the small business concern may not receive more than 20 total Phase I awards and Phase II awards under subsection (cc) from each agency during the 1-year period beginning on the date on which such determination is made.</text></clause><clause commented="no" id="H2E203475D39A45E39E0934AF5FF042A6" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Documentation</header><subclause commented="no" id="H1E84B68621394C439C5FC34C9653B793" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A small business concern that is subject to an increased minimum performance standard described in clause (i) shall submit to the Administrator supporting documentation evidencing that all covered sales of the small business concern were properly used to meet the increased minimum performance standard.</text></subclause><subclause commented="no" id="H00A952A809A74AAAAFCAB4D0EE25D05D" display-inline="no-display-inline"><enum>(II)</enum><header display-inline="yes-display-inline">Covered sale defined</header><text display-inline="yes-display-inline">In this clause, the term <term>covered sale</term> means a sale by a small business concern—</text><item id="HCF740DB8C2EA4E31849CE96C4BEB3C41" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">that the small business concern claims to be attributable to an SBIR or STTR award;</text></item><item commented="no" id="HE2D2021A408446A780DE9929A25C19F2" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">for which no amount of the payment was or is made using Federal funds;</text></item><item commented="no" id="HBB31B4826B9E4ADE97156B67D85255FF" display-inline="no-display-inline"><enum>(cc)</enum><text display-inline="yes-display-inline">which the small business concern uses to meet an applicable increased minimum performance standard under clause (i); and</text></item><item commented="no" id="HD52A96AE9239424B914DB8F412E358F5" display-inline="no-display-inline"><enum>(dd)</enum><text display-inline="yes-display-inline">that was or is received during the 5 fiscal years immediately preceding the fiscal year in which the small business concern uses the sale to meet the increased minimum performance standard.</text></item></subclause></clause><clause commented="no" id="HE083614DF58340C4879B824892762351" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Covered period defined</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>covered period</term> means a consecutive period of 10 fiscal years preceding the most recent 2 fiscal years.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEC48D983AEAE48B1A103DF1AFDA053FB"><enum>(C)</enum><header display-inline="yes-display-inline">Patents for increased minimum performance standards</header><text display-inline="yes-display-inline">A small business concern with respect to which an increased minimum performance standard under subparagraph (B) applies may not meet the increased minimum performance standard by obtaining patents.</text></subparagraph><subparagraph commented="no" id="H15938E1BAB054EC68BE6BCF3DB59BEF1" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">Subparagraphs (A) through (C) shall take effect on April 1, 2023.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3300D8CC949D4097BC9B947872F9CB47"><enum>(E)</enum><header display-inline="yes-display-inline">Waiver</header><clause commented="no" id="H854010A4042044FA87055CB742202F60" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may, upon the request of a senior official of a Federal agency, grant a waiver with respect to a topic for the SBIR or STTR program of the Federal agency if—</text><subclause commented="no" display-inline="no-display-inline" id="H3F5DE9F1461042FC87B2F85F882322E2"><enum>(I)</enum><text display-inline="yes-display-inline">the topic is critical to the mission of the Federal agency or relates to national security; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3EC76512E57543CEABC7765D3122DE66"><enum>(II)</enum><text display-inline="yes-display-inline">the official submits to the Administrator a request for the waiver in accordance with clause (iii).</text></subclause></clause><clause commented="no" id="HBEBA540799AE45EFA2CC74A117FCFFD6" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Waiver effects</header><text display-inline="yes-display-inline">If the Administration grants a waiver with respect to a topic for the SBIR or STTR program of a Federal agency, subparagraphs (A)(ii) and (B)(ii) shall not prohibit any covered small business concern from receiving an SBIR or STTR award under such topic.</text></clause><clause commented="no" id="H12774190F8E24294914E3CFB42867E7A" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Agency request and congressional notification</header><text display-inline="yes-display-inline">Not later than 15 days before the release of a solicitation including a topic for which a senior official of a Federal agency is requesting a waiver under clause (i), the senior official shall submit to the Administrator, the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives, and the Committee on Small Business and Entrepreneurship of the Senate a request for the waiver.</text></clause><clause commented="no" id="H740BB22C0AF543BBA1321D245ECC20A7" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Administrator determination and congressional notification</header><text display-inline="yes-display-inline">Not later than 15 days after receiving a request for a waiver under clause (i), the Administrator shall make a determination with respect to the request and notify the senior official at the Federal agency that made the request, the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives, and the Committee on Small Business and Entrepreneurship of the Senate of the determination.</text></clause><clause commented="no" id="H3437BD5ACFD34F72B401968F3BAF55F1" display-inline="no-display-inline"><enum>(v)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subparagraph:</text><subclause commented="no" id="H37356ADC5AEF42BE8CBC3F7A9D7B33C5" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">Covered small business concern</header><text display-inline="yes-display-inline">The term <term>covered small business concern</term> means a small business concern that is subject to the consequences under subparagraph (A)(ii) or (B)(ii) pursuant to a determination by the head of a Federal agency that such small business concern did not meet an increased minimum performance standard that was applicable to such small business concern.</text></subclause><subclause commented="no" id="H7A8C1530B8CC437EA469B18B5365B015" display-inline="no-display-inline"><enum>(II)</enum><header display-inline="yes-display-inline">Senior official</header><text display-inline="yes-display-inline">The term <term>senior official</term> means an individual appointed to a position in a Federal agency that is classified above GS–15 pursuant section 5108 of title 5, United States Code, or any equivalent position, as determined by the Administrator.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H7E2C40887B0042C8B556603881FC2CAA" display-inline="no-display-inline"><enum>(F)</enum><header display-inline="yes-display-inline">Reporting</header><clause commented="no" id="HEC70764C66BF4D228555AA9FEDC15C7B" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than July 1, 2023, and annually thereafter, the Administrator shall submit to Congress a list of the small business concerns that did not meet—</text><subclause commented="no" id="HC72F2B33DD664285AD19108746770C9F" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">an applicable minimum performance standard established under paragraph (1)(A)(ii) or (2)(A)(ii); or</text></subclause><subclause commented="no" id="H8181546BF37640118515C875ED5CE0D4" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">an applicable increased minimum performance standard.</text></subclause></clause><clause commented="no" id="H80BAB2E54013410FB8044AC795B27D53" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Waivers</header><text display-inline="yes-display-inline">Each list submitted under clause (i) shall identify each small business concern that received an SBIR or STTR award pursuant to a waiver granted under subparagraph (E) by the Administrator during the period covered by the list.</text></clause><clause commented="no" id="HC35604336C5549A7A5D5E28531EB6953" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Confidentiality</header><text display-inline="yes-display-inline">Each list submitted under clause (i) shall be confidential and exempt from disclosure under section 552(b)(3) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></clause></subparagraph><subparagraph commented="no" id="H92192418DFCD4E598B9D10CB2ACB0FEB" display-inline="no-display-inline"><enum>(G)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Not later than April 1, 2023, the Administration shall implement the increased minimum performance standards under this paragraph.</text></subparagraph><subparagraph commented="no" id="H2921732138F344E890F24C55051B291D" display-inline="no-display-inline"><enum>(H)</enum><header display-inline="yes-display-inline">Rules of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be construed—</text><clause commented="no" id="H5ACA992E3AD4436389250D8FC1B49799" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to prohibit a small business concern from participating in a Phase I (or Phase II if under the authority of subsection (cc)) of an SBIR or STTR program under paragraph (1)(B) or (2)(B) solely on the basis of a determination by the head of a Federal agency that the small business concern is not meeting an increased minimum performance standard; or</text></clause><clause commented="no" id="HF9BB24A044744667B02A6D43E0B66B4B" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">to prevent the head of a Federal agency from implementing more restrictive limitations on the number of federally funded Phase I awards and direct to Phase II awards under subsection (cc) that may be awarded to a small business concern than the limitations described in subparagraphs (A)(ii) and (B)(ii).</text></clause></subparagraph><subparagraph commented="no" id="H4FB65A64F6824ECBA3AC9AC3C9A070EE" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">This paragraph shall terminate on September 30, 2025.</text></subparagraph></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="H4B5BC405ADD243438E869A1622FD74DB" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (5), as so redesignated, by striking <quote>paragraph (3)(A)</quote> and inserting <quote>paragraph (4)(A)</quote>; and</text></subparagraph><subparagraph id="H95CC34C734AA4185AE4FDE8507BDE2DF" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H400D170C45334FBCAA5E5A79F0F16328"><paragraph id="HDF4CC7CDBC924535861C7E34C5C13877" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Inspector general audit</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Administrator implements the increased minimum performance standards under paragraph (3), and periodically thereafter, the Inspector General of the Administration shall—</text><subparagraph id="HEF77927BD990403C9FF311911EB47EE2" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an audit on whether the small business concerns subject to increased minimum performance standards under paragraph (3)(B) verified—</text><clause id="H69C42EFCB6E7459DA77426002CD492C3" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the sales by and investments in the small business concerns—</text><subclause id="H396869EE46C9491B9C6C1515B3546891" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">during the 5 fiscal years immediately preceding the fiscal year in which the small business concern used such sales and investments to meet an applicable increased performance standard; and</text></subclause><subclause id="H06EE6D0A4B9240F3BA1AC4C0C19054E1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">as a direct result of a Phase I award or Phase II award made under subsection (cc) during the covered period (as defined in paragraph (3)(B)(iv)), consistent with the definition of Phase III, as applicable;</text></subclause></clause><clause id="H213CBE2B66D54F92B3714E1CC44CFB9F" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">any third-party revenue the small business concerns list as investments or incomes to meet the increased minimum performance standard—</text><subclause id="H45CEB4B3F7EF40378C0894B6BD484E7A" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">is a direct result of a Phase I award or Phase II award made under subsection (cc) during the covered period (as defined in paragraph (3)(B)(iv)); and</text></subclause><subclause id="H0997CA8E01AD4669A5CCD7A5EE7AD9C5" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">consistent with the requirements of the Administrator as in effect on September 30, 2022, or any successor requirements; and</text></subclause></clause><clause id="H13078C6CD34B494E888D0A09D0A74EA8" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">any dollar amounts such small business concerns list as investments or income to meet such increased minimum performance standard the providence of which is unclear and that is not directly attributable to a Phase I award or Phase II award made under subsection (cc) during the covered period (as defined in paragraph (3)(B)(iv)), consistent with the definition of Phase III, as applicable;</text></clause></subparagraph><subparagraph id="HADC3E37C35AA45C797C6A682D64BBAF8" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">assess the self-certification requirements for the minimum performance standards established under paragraph (2)(A)(ii) and the increased minimum performance standards under paragraph (3)(B); and</text></subparagraph><subparagraph id="H6BBA64FE34D34F82906929716292E2FB" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives a report on the audit conducted under subparagraph (A) and the assessment conducted under subparagraph (B).</text></subparagraph></paragraph><paragraph commented="no" id="HCF1CC16B1CBD4671B348F86997311186" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Increased minimum performance standard defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>increased minimum performance standard</term> means a minimum performance standard established under paragraph (1)(A)(ii) or (2)(A)(ii) as modified under subparagraph (A) or (B), respectively, of paragraph (3) with respect to a small business concern.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" id="HA3249123D6B04E6B83E54A402632DE7A" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Prohibition against writing solicitation topics</header><subsection commented="no" id="HFA598D137AB049E8A1F9AD8EE2C9F79A" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by this Act, is further amended by adding at the end the following subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H21CF424328B34CEE9CB2A33FE66B6464"><subsection commented="no" id="H2031033D6E614D79BA3881F25F340330" display-inline="no-display-inline"><enum>(xx)</enum><header display-inline="yes-display-inline">Additional provisions relating to solicitation topics</header><paragraph commented="no" id="H0885712471D3450FBE16DBDC581E4F23" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A Federal agency required to establish an SBIR or STTR program shall implement a multi-level review and approval process within the Federal agency for solicitation topics to ensure adequate competition and that no private individual or entity is shaping the requirements for eligibility for the solicitation topic after the selection of the solicitation topic, except that the Federal agency may amend the requirements to clarify the solicitation topic.</text></paragraph><paragraph commented="no" id="H1AE554F1F21341B7B7DCE32C9BE7D581" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Referral</header><text display-inline="yes-display-inline">A Federal agency that does not comply with paragraph (1) shall be referred to the Inspector General of the Administration for further investigation.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="H5274BBBF0F7844C7BE95C5B24998C04A" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">GAO study on multiple award winners</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives a report, which shall be made publicly available, on small business concerns that are awarded not less than 50 Phase II awards under the SBIR or STTR programs during the consecutive period of 10 fiscal years preceding the most recent 2 fiscal years, including, to the extent practicable, an analysis of— </text><paragraph commented="no" id="H8483513A60394BC4BB9D6B58AD6BD79C" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the impact of the small business concerns on the SBIR and STTR programs;</text></paragraph><paragraph commented="no" id="id7F57EEC2E8DE458ABD2C038AF04729F1" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the ratio of the number of Phase II awards received by the small business concerns to the total number of Phase II awards;</text></paragraph><paragraph commented="no" id="HAC66E930ECA0424CA33E81978514DE2F" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the ability of the small business concerns to commercialize and meet the tenets of the SBIR and STTR programs;</text></paragraph><paragraph commented="no" id="H063A7DE55BAB4EA7A3D4C336F2F83700" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the impact on new entrants and seeding technology necessary to the Federal agency mission or commercial markets and, with respect to the Department of Defense, whether the types of technology the small business concerns are pursuing are primarily hardware, software, or system components for the warfighter;</text></paragraph><paragraph commented="no" id="HD548ABCAB4CB43DC9B5E4F5BAFFB2773" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">an evaluation and study of varying levels of award caps and lifetime program earning caps;</text></paragraph><paragraph commented="no" id="H1AA48B5512B842379B1DA96E9A4FE4D7" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">an assessment of the increased minimum performance standards under paragraph (3) of section 9(qq) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(qq)</external-xref>), as added by section 8, on the behavior of those concerns and on the SBIR and STTR programs, and whether to continue such increased minimum performance standards; and</text></paragraph><paragraph commented="no" id="H78C136B812B544A0A3B0B262074A28DC" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">recommendations on whether alternative minimum performance standards under section 9(qq) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(qq)</external-xref>) should be considered, and the extent to which such alternative minimum performance standards preserve the competitive, merit-based foundation of the SBIR and STTR programs.</text></paragraph></section><section commented="no" id="HA14EEF6D0DE2478AB19DD2EE310F8080" display-inline="no-display-inline" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">GAO report on subcontracting in SBIR and STTR programs</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives a report evaluating, to the extent practicable, the following:</text><paragraph commented="no" id="HE7BEDCDA13BF4F6A880808498EEABF8E" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The extent to which SBIR awardees and STTR awardees are in compliance with the Federal Funding Accountability and Transparency Act (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note).</text></paragraph><paragraph commented="no" id="H08FD19A6D6DB4D64892E506C8550B1E1" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The extent to which SBIR awardees and STTR awardees enter into subcontracting agreements with respect to an SBIR or STTR award.</text></paragraph><paragraph commented="no" id="H6AA15837793341FC982C8B7F573697B0" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The total number and dollar amount of subcontracts entered into between an SBIR awardee or an STTR awardee and a concern that is not a small business concern (including such concerns that are defense contractors) with respect to an SBIR or STTR award.</text></paragraph><paragraph commented="no" id="H3ADFEC4279D5449D82C72D79B4C8778E" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">A description of the type and purpose of subcontracting agreements described in paragraph (2).</text></paragraph><paragraph commented="no" id="H163E9A0A82CC450ABD3EFB42A33E1AF8" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">An analysis of whether the use of subcontracts by an SBIR awardee or an STTR awardee is consistent with the
