which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 13, 2022</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the perpetuation, administration, and funding of Federal Executive Boards, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Government Efficiency and Workforce Development through Federal Executive Boards Act of 2022</short-title></quote>.</text></section><section id="id6599892ab7ee49ce9479eac6b47bec56"><enum>2.</enum><header>Federal Executive Boards</header><subsection id="ide5c929a783dd41328ede186d52236e8f"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/11">Chapter 11</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id1D28F62284E64495A045CC32D764DC47"><section id="idccc1fbe41b154955b054c086ae05c8b0"><enum>1106.</enum><header>Federal Executive Boards</header><subsection id="idf3f29da274ab42f78da9f00074850da1"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are to—</text><paragraph id="idec69b45dca56445c9fdf5ff888af1bd7"><enum>(1)</enum><text>strengthen the strategic coordination, communication, and management of Government activities across the United States, including to improve the experience of citizens interacting with agencies, and to incorporate field perspectives into the preparation of Federal workforce policy goals;</text></paragraph><paragraph id="id3a210eabe13743c2b41f323f3c80f5d6"><enum>(2)</enum><text>facilitate interagency collaboration to improve the efficiency and effectiveness of Federal programs and initiatives;</text></paragraph><paragraph id="idf3f0314c86f44c32a8e1f2e008c9c58c"><enum>(3)</enum><text>facilitate communication and collaboration on Federal emergency preparedness and continuity of operations for the Federal workforce in applicable geographic areas;</text></paragraph><paragraph id="idf00d209d21594f32abe8b8d5de8f9edb"><enum>(4)</enum><text>facilitate strategies and programs for recruiting, training, managing, and retaining Federal employees, as well as sharing best practices for improving the workforce experience and access to education and training;</text></paragraph><paragraph id="id0bf231c0aca8422191e39ecb55f2f852"><enum>(5)</enum><text>facilitate relationships with State and local governments, colleges and universities, and local nonprofit organizations that collaborate with the Federal Government; and</text></paragraph><paragraph id="idb5e87e1401b94bd295e001600eb71bee"><enum>(6)</enum><text>provide stable funding for Federal Executive Boards to enable the activities described in paragraphs (1) through (5). </text></paragraph></subsection><subsection id="id28ca004825214c09959f852a0948b46a"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idade39b1b48d64e09bebf64ba747b748b"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term>—</text><subparagraph id="iddf6b7222c7c64052a27ca0285e69f024"><enum>(A)</enum><text>means an Executive agency, as defined in section 105; and</text></subparagraph><subparagraph id="id0e3c3062e1e54ce8ba3600c7a38ef10c"><enum>(B)</enum><text>does not include the Government Accountability Office.</text></subparagraph></paragraph><paragraph id="id106ec6946cd447b899c70d8f95a2f37e" commented="no"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph><paragraph id="id5c71bc40c01a49af95ba44c57b4b7d14"><enum>(3)</enum><header>Federal Executive Board</header><text>The term <term>Federal Executive Board</term> means an interagency entity—</text><subparagraph id="id1d83ac2cc04a429cb59e60d9fe618e41"><enum>(A)</enum><text>established by the Director—</text><clause id="idff1d6b0868af4c52b00ab1021741a725"><enum>(i)</enum><text>in coordination with the Director of the Office of Management and Budget and the Administrator of General Services; and </text></clause><clause id="id223A1E0150A045F797761ACFD2A25653"><enum>(ii)</enum><text>in consultation with the headquarters of appropriate agencies;</text></clause></subparagraph><subparagraph id="id5FAFE10183CB4BC8A9135EDFB3692231"><enum>(B)</enum><text>located in a geographic area with a high concentration of Federal employees outside the Washington, D.C., metropolitan area; and</text></subparagraph><subparagraph id="idC9B254A2E15C485F82E68A2FFFEDA7B8"><enum>(C)</enum><text>focused on strengthening the management and administration of agency activities and coordination among local Federal officers to implement national initiatives in that geographic area.</text></subparagraph></paragraph><paragraph id="id37C33C044B914B9B83CDC20AA6F6B6C0"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="idD31053B015DA46B9AC6295817EB91EE0"><enum>(5)</enum><header>State Apprenticeship Agency</header><text>The term <term>State Apprenticeship Agency</term> has the meaning given the term in section 29.2 of title 29, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection id="id1692366feec24e69bddc08f35abb8f47"><enum>(c)</enum><header>Perpetuation and continued support</header><paragraph id="id13ddb9c7e7f9496a9758683df100e7a6"><enum>(1)</enum><header>In general</header><text>The Director, in coordination with the Director of the Office of Management and Budget and the Administrator of General Services, shall continue to support the existence of Federal Executive Boards in geographic areas outside the Washington, D.C., metropolitan area.</text></paragraph><paragraph id="id4fa88fd564ac439184a7ddd6f9a2a49c"><enum>(2)</enum><header>Consultation</header><text>Before establishing any new Federal Executive Boards that are not in existence on the date of enactment of this section, the Director shall conduct a review of existing Federal Executive Boards and consult with the headquarters of appropriate agencies to guide the determination of the number and location of Federal Executive Boards.</text></paragraph><paragraph id="idc24eb18af3f742278d74bff5ba722b60"><enum>(3)</enum><header>Location</header><text>The Director shall develop a set of criteria to establish and evaluate the number and locations of Federal Executive Boards that shall—</text><subparagraph id="idC5FB37A10C6547B0A8A689A3D77714F7"><enum>(A)</enum><text>factor in contemporary Federal workforce data as of the date of enactment of this section; and</text></subparagraph><subparagraph id="id836EF67D909142BFBAC9536B76254560"><enum>(B)</enum><text>be informed by the annual changes in workforce data, including the geographic disbursement of the Federal workforce and the role of remote work options.</text></subparagraph></paragraph><paragraph id="id9aa7250c07ec41c39f96ad564ebdc01d"><enum>(4)</enum><header>Membership</header><subparagraph id="ida5788cb605bd43648f08b53e84f36a4f"><enum>(A)</enum><header>In general</header><text>Each Federal Executive Board for a geographic area shall consist of the most senior officer of each agency in that geographic area.</text></subparagraph><subparagraph id="idf5e19dcbc5a2449badcd27d5a7f3f47d"><enum>(B)</enum><header>Alternate representative</header><text>The senior officer of an agency described in subparagraph (A) may designate, by title of office, an alternate representative, who shall—</text><clause id="id6b2f16ac714e4147a7f4ac53dacf668c"><enum>(i)</enum><text>be a senior officer in the agency; and</text></clause><clause id="ida13962288b12425fa12b5dcda6f6e073"><enum>(ii)</enum><text>attend meetings and otherwise represent the agency on the Federal Executive Board in absence of the most senior officer. </text></clause></subparagraph></paragraph></subsection><subsection id="idf9e5670ba15248be8766f01c40f705de"><enum>(d)</enum><header>Administration and oversight</header><text>The Director, in coordination with the Director of the Office of Management and Budget and the Administrator of General Services, shall administer and oversee Federal Executive Boards, including—</text><paragraph id="ida9b1e9366a3a44d5877db6d8db1a7ffc"><enum>(1)</enum><text>establishing staffing and accountability policies, including performance standards, for employees responsible for administering Federal Executive Boards with an opportunity for employee customer service feedback from agencies participating in Federal Executive Boards;</text></paragraph><paragraph id="id64c5bc9f047842d8aab60c28e8c5850e"><enum>(2)</enum><text>establishing communications policies for the dissemination of information to agencies participating in Federal Executive Boards; and</text></paragraph><paragraph id="ide1f5c014956b4ca9ae31665f71e170e5"><enum>(3)</enum><text>administering Federal Executive Board funding through the fund established in subsection (f). </text></paragraph></subsection><subsection id="id3228ee044f9b4385a86d5bbb847759e9"><enum>(e)</enum><header>Governance and activities</header><paragraph id="idfcab6e4ac47d4a5fbd4bde4b3478cbf6"><enum>(1)</enum><header>In general</header><text>Each Federal Executive Board shall—</text><subparagraph id="id6f90d9816bc94b56bc0476a1e2ebae58"><enum>(A)</enum><text>subject to the approval of the Director, adopt charters or other rules for the internal governance of the Federal Executive Board;</text></subparagraph><subparagraph id="id19bbd1ad7b7a446b89cd993f227a9d27"><enum>(B)</enum><text>elect a Chairperson from among the members of the Federal Executive Board, who shall serve for a set term;</text></subparagraph><subparagraph id="idd53bb788fc854ea78453d203b7384525"><enum>(C)</enum><text>serve as an instrument of outreach relating to agency activities in the geographic area;</text></subparagraph><subparagraph id="idf481eb29e692463bb59074152921d1d3"><enum>(D)</enum><text>provide a forum to amplify the exchange of information relating to programs and management methods and problems—</text><clause id="id0d85bf97930e48f1a7b39f94f38d40f9"><enum>(i)</enum><text>between the national headquarters of agencies and the field; and</text></clause><clause id="id16cc1956d7ef4ca38553de546462f283"><enum>(ii)</enum><text>among field elements in geographic areas;</text></clause></subparagraph><subparagraph id="id1e03186bd946499cbf8391fca611ef9f"><enum>(E)</enum><text>develop local coordinated approaches to the development and operation of programs that have common characteristics or serve the same populations; </text></subparagraph><subparagraph id="ided3efa49517e4cfd9931c7a302b0600e"><enum>(F)</enum><text>communicate management initiatives and other concerns from Federal officers and employees in the Washington, D.C., metropolitan area to Federal officers and employees in the geographic area to achieve better mutual understanding and support;</text></subparagraph><subparagraph id="id2a79aa6fe721464da26b93a7d0415d2e"><enum>(G)</enum><text>develop relationships with State and local governments, institutions of higher education, and nongovernmental organizations to help fulfill the roles and responsibilities of the Federal Executive Board;</text></subparagraph><subparagraph id="idb8252aaf5e714d9da1a38bc479b6deda"><enum>(H)</enum><text>in coordination with appropriate agencies and consistent with any relevant memoranda of understanding between the Office of Personnel Management and those agencies, facilitate communication, collaboration, and training to prepare the Federal workforce for emergencies and continuity of operations;</text></subparagraph><subparagraph id="id7a1e66ee455c4cd5bc0e4716faea5917"><enum>(I)</enum><text>in coordination with appropriate agencies, support agency efforts to place and recruit students in training opportunities, particularly apprenticeships and paid internships;</text></subparagraph><subparagraph id="id6d42063230df48a8a60d82fdc231f9cc"><enum>(J)</enum><text>consult with the Secretary of Labor or State Apprenticeship Agencies on the process for establishing registered apprenticeship programs within agencies, as appropriate;</text></subparagraph><subparagraph id="id707c5862f13a477b81a1767cfa352ea0"><enum>(K)</enum><text>consult with State workforce development boards and local workforce development boards as established in sections 101 and 107 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>, 3122), respectively, as appropriate;</text></subparagraph><subparagraph id="id319271f3c1154a04a2e0f406fe78e1f0"><enum>(L)</enum><text>as appropriate and in accordance with law, rules, and policies, lead cross-agency talent management initiatives—</text><clause id="idda3eb7f59b594b949b06c7012711091b"><enum>(i)</enum><text>including interagency—</text><subclause id="id80c2d6e6f15d440eab50dfa0ad0b700e"><enum>(I)</enum><text>recruitment and hiring activities;</text></subclause><subclause id="idcd4309efa0d64defad036e827af7b5aa"><enum>(II)</enum><text>internships and apprenticeships;</text></subclause><subclause id="id074d0574341b457b8fa3b2c284c79b6e"><enum>(III)</enum><text>onboarding and leadership and management development; and</text></subclause><subclause id="idad20c4340f3b4682b4ce5577817d0cb1"><enum>(IV)</enum><text>mentorship programs; and</text></subclause></clause><clause id="idd32cf4f176144719a0fb77c70087d08d"><enum>(ii)</enum><text>by prioritizing initiatives related to—</text><subclause id="id52e795dd47014202b8f7b512f5dfaf83"><enum>(I)</enum><text>conducting outreach to communities of individuals with demographics that are underrepresented in a given occupation or agency; and</text></subclause><subclause id="id0dcb01a1dd5644d5abbbde2da75daf42"><enum>(II)</enum><text>addressing skills gaps within the Federal Government related to high-risk areas as identified by the Government Accountability Office;</text></subclause></clause></subparagraph><subparagraph id="id95fdcafeab254a2f83d788661d30396f"><enum>(M)</enum><text>coordinate with the Transition Assistance Centers established to carry out the Transition Assistance Program of the Department of Defense to help members of the Armed Forces who are transitioning to civilian life apply for Government positions in the geographic location of the Federal Executive Board;</text></subparagraph><subparagraph id="id17df2c00109e491f867fd817e3b8fb0d"><enum>(N)</enum><text>as appropriate, serve as a collaborative space where employees from across agencies can participate in innovation projects relevant to Federal initiatives by applying human-centered design, user-experience design, or other creativity methods; and </text></subparagraph><subparagraph id="idba9d4698a8e64f9aab5ceef9c075b64b"><enum>(O)</enum><text>take other actions as agreed to by the Federal Executive Board and the Director, in consultation with the Director of the Office of Management and Budget and the Administrator of General Services.</text></subparagraph></paragraph><paragraph id="id45fae85fdbc54391abd38d004c4d10e6"><enum>(2)</enum><header>Coordination of certain activities</header><text>The facilitation of communication, collaboration, and training described in paragraph (1)(H) shall, when appropriate, be coordinated and defined through written agreements entered into between the Director and the heads of the applicable agencies.</text></paragraph><paragraph id="id26c02983b1984baf93f4888d816c4b17"><enum>(3)</enum><header>Non-monetary donations</header><text>Each Federal Executive Board may accept donations of supplies, services, land, and equipment consistent with the purposes described in paragraphs (1) through (5) of subsection (a), including to assist in carrying out the activities described in paragraph (1) of this subsection. </text></paragraph><paragraph id="idc7c0f6e2114f466090a428407ced7d1a"><enum>(4)</enum><header>Programmatic assessments</header><text>Not less frequently than semi-annually or following each major programmatic activity, each Federal Executive Board shall assess the experience of participants or other relevant stakeholders in each program provided by the Federal Executive Board. </text></paragraph></subsection><subsection id="id690fa013b3814ee9902e502c36dfd137"><enum>(f)</enum><header>Funding</header><paragraph id="id0856b65a25fa4343a5cca3a4512fc9a2"><enum>(1)</enum><header>Establishment of fund</header><text>The Director, in coordination with the Director of the Office of Management and Budget and the Administrator of General Services, shall establish a Federal Executive Board Fund within the Office of Personnel Management for financing essential Federal Executive Board functions for the purposes of staffing and operating expenses.</text></paragraph><paragraph id="id5040735789fa4c21ae8bf5715ad011bf"><enum>(2)</enum><header>Deposits</header><text>There shall be deposited in the fund established under paragraph (1) amounts transferred to the fund pursuant to paragraph (3) from each agency participating in Federal Executive Boards, according to a formula established by the Director—</text><subparagraph id="id460b7bad753d4438b93e7db0a0bd7fb0"><enum>(A)</enum><text>in consultation with the headquarters of those agencies; and</text></subparagraph><subparagraph id="ida764ced1f7db4b569105265a6c05837b"><enum>(B)</enum><text>in coordination with the Director of the Office of Management and Budget and the Administrator of General Services.</text></subparagraph></paragraph><paragraph id="id8f191c701f12426e9734bd51a3e362dc"><enum>(3)</enum><header>Contributions</header><subparagraph id="idB3201538C9B441C2AE5ADE806A14EB46"><enum>(A)</enum><header>Contribution transfers</header><text>Subject to the formula for contributions established by the Director under paragraph (2), each agency participating in Federal Executive Boards shall transfer amounts to the fund established under paragraph (1).</text></subparagraph><subparagraph id="ida5e5f08c61ee4f8485b1196a4f7393f9"><enum>(B)</enum><header>Formula</header><clause id="id3C0E48796F2A4C55AD623EBA157F8E24"><enum>(i)</enum><header>In general</header><text>The formula for contributions established by the Director under paragraph (2) shall consider the number of employees in each agency in all geographic areas served by Federal Executive Boards. </text></clause><clause id="id753AE1DD856C4786A22D75DD4B3E9632"><enum>(ii)</enum><header>Recalculation</header><text>The contribution of the headquarters of each agency under clause (i) to the fund established under paragraph (1) shall be recalculated not less frequently than every 2 years.</text></clause></subparagraph><subparagraph id="id081db747be084307862dc3fe1fc89276"><enum>(C)</enum><header>In-kind contributions</header><text>At the discretion of the Director, an agency may provide in-kind contributions instead of, or in addition to, providing monetary contributions to the fund established under paragraph (1).</text></subparagraph></paragraph><paragraph id="idf99e9f6638124c5abd3740f9774eafcd"><enum>(4)</enum><header>Minimum amount</header><subparagraph id="idcf3c6f0503234f389cad07496cb8a38b"><enum>(A)</enum><header>In general</header><text>The fund established under paragraph (1) shall include a minimum of $15,000,000 in each fiscal year, to remain available until expended.</text></subparagraph><subparagraph id="idb669d5eac430430ebd770130c35f895f"><enum>(B)</enum><header>Adjustment</header><text>The Director shall adjust the amount required under subparagraph (A) every 2 years on a schedule aligned with the recalculation described in paragraph (3)(A)(ii) to reflect—</text><clause id="id34703f05d8e04b3a86e1ece54ccf596e"><enum>(i)</enum><text>the percentage increase, if any, in the Consumer Price Index for all Urban Consumers as determined by the Bureau of Labor Statistics; and</text></clause><clause id="idf99576c3824d43aabc29b9af91fa1ef7"><enum>(ii)</enum><text>any changes in costs related to Federal pay changes authorized by the President or by an Act of Congress. </text></clause></subparagraph></paragraph><paragraph id="idca6d0e40d68a48bd8b843e70caa12d21"><enum>(5)</enum><header>Use of excess amounts</header><text>Any unobligated and unexpended balances in the fund established under paragraph (1) that the Director determines to be in excess of amounts needed for Federal Executive Board functions shall be allocated among the Federal Executive Boards for the activities described in subsection (e) by the Director—</text><subparagraph id="id9d936bb12c2e45ca9d006c40f69c0e33"><enum>(A)</enum><text>in coordination with the Director of the Office of Management and Budget and the Administrator of General Services; and </text></subparagraph><subparagraph id="idB83ACCE9594A4FA9B7326FE3E8DB33C7"><enum>(B)</enum><text>in consultation with the headquarters of agencies participating in Federal Executive Boards.</text></subparagraph></paragraph><paragraph id="idf150ac30e9094c02b5f6ff349bad3ab2"><enum>(6)</enum><header>Administrative and oversight costs</header><text>The Office of Personnel Management shall pay for costs relating to administrative and oversight activities conducted under subsection (d) from appropriations made available to the Office of Personnel Management.</text></paragraph></subsection><subsection id="idb7a32db7bcd7478a9d96f36baf2c5220"><enum>(g)</enum><header>Reports</header><text>The Director, in coordination with the Director of the Office of Management and Budget and the Administrator of General Services, shall submit biennial reports to Congress and to agencies participating in Federal Executive Boards on the outcomes of and budget matters related to Federal Executive Boards.</text></subsection><subsection id="ida00df29a1c3b4752a4110123d5927b77"><enum>(h)</enum><header>Regulations</header><text>The Director, in coordination with the Director of the Office of Management and Budget and the Administrator of General Services, shall prescribe regulations necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ID0a663af7b1ac42f5a178facf6b48f382"><enum>(b)</enum><header>Report</header><paragraph id="id21F11B42EA05455D990ECB0039A2516E"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>Federal Executive Board</term> has the meaning given the term in section 1106(b) of title 5, United States Code, as added by subsection (a) of this section.</text></paragraph><paragraph id="id97CB32A1F5C34F4F991BC997B4163310"><enum>(2)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Director of the Office of Personnel Management, in coordination with the Director of the Office of Management and Budget and the Administrator of General Services, shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report that includes—</text><subparagraph id="ID9eeb3a13d53f476dab875d4203eefa3f"><enum>(A)</enum><text>a description of essential Federal Executive Board functions;</text></subparagraph><subparagraph id="ID3b71f404a42b4249b1e320cd2dc85c2a"><enum>(B)</enum><text>details of staffing requirements for each Federal Executive Board;
