leaves a course of education, paid for with certain educational assistance, to perform certain service, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HACC804B244714E2E8C125D399DBC005E"><section section-type="section-one" id="H36B8567ACEC246E69A9E502052903935"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protections for Student Veterans Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="H8917069F6B2B41509F3CBC5EEA9A0CBE"><enum>2.</enum><header>Establishment of protections for a member of the Armed Forces who leaves a course of education, paid for with certain educational assistance, to perform certain service</header><subsection id="H9BC1A60ACF0A4596AFB6EC43BEC90D4C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/36">Chapter 36</external-xref> of title 38, United States Code, amended by inserting after section 3691 the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H22A35D33B4DF437B97F1D1E48EB5A9CF"><section id="H517A793184C54880A66F9F9F79CCFA2F"><enum>3691A.</enum><header>Withdrawal or leave of absence from certain education</header><subsection id="HD0166E0287CA4891B53688874A9DAC5A"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="yes-display-inline" id="id73CABBFE709F49538EE6D153C0654C44"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD5D8AF3861344D79A6AD3D55E532CA23"><enum>(A)</enum><text>Subject to subparagraph (B), a covered individual may, after receiving orders to enter a period of covered service, withdraw or take a leave of absence from covered education.</text></subparagraph><subparagraph id="id838E0C3B2C75493094CBA757635487CA" indent="up2"><enum>(B)</enum><text>Subparagraph (A) shall not apply to a covered individual who is not abiding the regularly prescribed standards and practices of the educational institution concerned for attendance, conduct, and progress.</text></subparagraph></paragraph><paragraph id="H6C52DEDCD4D44FB29AE5A92CB3056DDC" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idBF35B8D3CDF146B39C2A76DCA950C9E5"><enum>(A)</enum><text display-inline="yes-display-inline">The institution concerned may not take any adverse action described in subparagraph (B) against a covered individual on the basis that such covered individual withdraws or takes a leave of absence under paragraph (1).</text></subparagraph><subparagraph indent="up1" id="id742E1BAB4DB841A6A91D4CC2CD89E21F"><enum>(B)</enum><text display-inline="yes-display-inline">The adverse actions described in this subparagraph are as follows:</text><clause id="HB38CD23186E7443FA108C58261B90C4C"><enum>(i)</enum><text display-inline="yes-display-inline">The assignment of a failing grade to a covered individual for covered education.</text></clause><clause id="HD5BF50BED68E419CB36FA302F6087DB5"><enum>(ii)</enum><text display-inline="yes-display-inline">The reduction of the grade point average of a covered individual for covered education.</text></clause><clause id="HE87E5E2E8BB640079C753C01EF67FCA7"><enum>(iii)</enum><text display-inline="yes-display-inline">The characterization of any absence of a covered individual from covered education as unexcused.</text></clause><clause id="HE08894883B274D6597E4D2BB5A1A0529"><enum>(iv)</enum><text display-inline="yes-display-inline">The assessment of any financial penalty against a covered individual.</text></clause></subparagraph></paragraph></subsection><subsection id="HCB5762811B28432199F00868DE6EDF5A"><enum>(b)</enum><header>Withdrawal</header><text display-inline="yes-display-inline">If a covered individual withdraws from covered education under subsection (a), the institution concerned shall refund all tuition and fees (including payments for housing) for the academic term from which the covered individual withdraws.</text></subsection><subsection id="H562BF79A484E4A77BBA867C66EC6AEF8"><enum>(c)</enum><header>Leave of absence</header><text display-inline="yes-display-inline">If a covered individual takes a leave of absence from covered education under subsection (a), the institution concerned shall—</text><paragraph id="HD97CFFA9CDB6480BB6AA18CF9E752DF6"><enum>(1)</enum><text display-inline="yes-display-inline">assign a grade of <quote>incomplete</quote> (or equivalent) to the covered individual for covered education for the academic term from which the covered individual takes such leave of absence; and</text></paragraph><paragraph id="H4F8E538B8293419685262841EEDF9F8C"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, permit the covered individual, upon completion of the period of covered service, to complete such academic term.</text></paragraph></subsection><subsection id="HAF63A50FE713458AA7E82BCC371606CC"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H6DB10F91F9DE41A693159A220DE09400"><enum>(1)</enum><text>The term <term>covered education</term> means a course of education—</text><subparagraph id="HD5F5E8ACF3AD4CFFA34A742C05C1F48C"><enum>(A)</enum><text display-inline="yes-display-inline">at an institution of higher education; and</text></subparagraph><subparagraph id="HD4123AC10C1D4B598D9F6892D89575AA"><enum>(B)</enum><text display-inline="yes-display-inline">paid for with educational assistance furnished under a law administered by the Secretary.</text></subparagraph></paragraph><paragraph id="H309107DD6F434724812CAC5F75B3D4F0"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>covered individual</term> means an individual who—</text><subparagraph id="id7F26B8482CCB48EFB594C4B2A03688AE"><enum>(A)</enum><text display-inline="yes-display-inline">is enrolled in covered education; and</text></subparagraph><subparagraph id="idF561EEC6BEF841F58FD5120C2F4C141E"><enum>(B)</enum><text>is—</text><clause id="idF8AB07E586D74957B8D77D1E6C99E201"><enum>(i)</enum><text>a member of the Armed Forces (including the reserve components); or</text></clause><clause id="id3FB8BD7D78694C6583E9CF4DA001AFEC"><enum>(ii)</enum><text>the spouse of a member described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="H57A36486C86C453E83B1EA112616C553"><enum>(3)</enum><text>The term <term>covered service</term> means—</text><subparagraph id="H49A46CB92AE24AF086878C94716FE340"><enum>(A)</enum><text display-inline="yes-display-inline">active service or inactive-duty training, as such terms are defined in section 101 of title 10; or</text></subparagraph><subparagraph id="H6A334CE4E8724300B61ED77A6B8931B4"><enum>(B)</enum><text display-inline="yes-display-inline">State active duty, as defined in section 4303 of this title.</text></subparagraph></paragraph><paragraph id="H53AC50D287AC4643959DF6CFC41523C1"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>institution concerned</term> means, with respect to a covered individual, the institution of higher education where the covered individual is enrolled in covered education.</text></paragraph><paragraph id="H76F10405C3B44303AA558200D7208252"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="HA4A921FD39C24FFC83978112B1A5DDB0"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>period of covered service</term> means the period beginning on the date on which a covered individual or the spouse of a covered individual enters covered service and ending on the date on which the covered individual or spouse is released from covered service or dies while in covered service.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id79774411359C4B15B71DED38C9F20E06"><enum>(b)</enum><header>Report</header><paragraph id="id8573697E60F94917A65E459C75991B5D"><enum>(1)</enum><header>In general</header><text>Not later two years after the date of the enactment of this Act and not later than five years after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the use of the authority under section 3691A(a) of title 38, United States Code, as added by subsection (a).</text></paragraph><paragraph id="id4060B4950DE54AACA35B21A6D4128933"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include the following:</text><subparagraph id="id03887876b47d45999ad6331f198159ce"><enum>(A)</enum><text>The number of covered individuals using the authority described in paragraph (1), disaggregated by—</text><clause id="id8E875283D39B47B383FCB7DA38E85D06"><enum>(i)</enum><text>in the cases in which the covered individual is a member of the Armed Forces, the component of the Armed Forces of which the covered individual is a member; and</text></clause><clause id="id0891E969409E4E8A9AE87F71CEF90638" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>in the cases in which the covered individual is a spouse of a member of the Armed Forces, the component of the Armed Forces of such member.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20528DCB6A6048A096884774CA5F0F49"><enum>(B)</enum><text>The number of times that such authority was used, disaggregated by—</text><clause id="idff067719d4224238aea377b45eb641f0"><enum>(i)</enum><text>whether the authority was used for a leave of absence or a withdrawal;</text></clause><clause id="id30779528E2B74A269458CC8B3AAD6E64"><enum>(ii)</enum><text>the type of covered duty for which the authority was used;</text></clause><clause id="id34D8A60EBDF7487B9C5EBC00EA8074DC"><enum>(iii)</enum><text>the program of educational assistance that was being used to pay for the program of education from which the covered individual withdrew or took a leave of absence; and</text></clause><clause id="id40A7DC01BD074C8390082183A4C1F8EA"><enum>(iv)</enum><text>the duration of the covered duty for which the authority was used.</text></clause></subparagraph></paragraph></subsection><subsection id="H08C974D55561470381E0A806A59298A2"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents at the beginning of such chapter is amended by inserting after the item relating to section 3691 the following new item:</text><quoted-block
