which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the President to supplement disaster response plans to account for catastrophic incidents disabling 1 or more critical infrastructure sectors or significantly disrupting the critical functions of modern society, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Everyone Safe and Securing Lives by Emergency Readiness Act</short-title></quote> or the <quote><short-title>KESSLER Act</short-title></quote>.</text></section><section id="id7cce1d1deba5460792e47e672c05ec20"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id2e2776ff0c484267940e4250aa749d64"><enum>(1)</enum><text>the integration of connected technologies has become essential to the operation of modern critical infrastructure;</text></paragraph><paragraph id="id85183abaa2364ee7acbbc0fa51f9614f"><enum>(2)</enum><text>reliance on connected technologies and interoperability across critical infrastructure sectors create new vulnerabilities that may be used against the United States;</text></paragraph><paragraph id="id97973f2fa9524909b2f688dcf3c381f4"><enum>(3)</enum><text>adversaries of the United States have targeted critical infrastructure and are likely to increase attacks on essential services in the United States should global conflicts escalate;</text></paragraph><paragraph id="id56715cc5d5694c9ca31e0ea307fe2a6f"><enum>(4)</enum><text>while strong defenses and mitigation measures are essential to the safety of the United States, no strategy can stop all catastrophic events;</text></paragraph><paragraph id="idbe4548a9e8fd40bd90b6daab2f325bd0"><enum>(5)</enum><text>the Federal Government must prepare Federal, State, and local governments, along with the people of the United States, to promote the general welfare of the civilian population of the United States even if most or all critical infrastructure sectors are impacted by catastrophic events; and</text></paragraph><paragraph id="id6daeb6c82de84329ae2c744606f524c3"><enum>(6)</enum><text>such preparations must include coordination with State, local, and Tribal governments, private sector entities, and individual citizens. </text></paragraph></section><section id="idBA31D7D6F6CF4EB29E0D47F5FC1C3A17"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id071511705a184da884837eff6a1b5e69"><enum>(1)</enum><header>Basic need</header><text>The term <term>basic need</term>—</text><subparagraph id="id8f489fe7812f451588a7a846b0fb2a22"><enum>(A)</enum><text>means any good, service, or activity necessary to protect the health, safety, and general welfare of the civilian population of the United States; and</text></subparagraph><subparagraph id="id76265888a5ac4daea9505145de3b56d2"><enum>(B)</enum><text>includes—</text><clause id="id3ba02d75407d4040a46c94ac71826b21"><enum>(i)</enum><text>food;</text></clause><clause id="id7cb64c86973c421bbf69bd014c1dcb6f"><enum>(ii)</enum><text>water;</text></clause><clause id="idf8fb50bec70c4975a747aff1923d6a72"><enum>(iii)</enum><text>shelter;</text></clause><clause id="idf9f3a32752624db98d5b1e822777c2c4"><enum>(iv)</enum><text>basic communication services; </text></clause><clause id="id244BFC62BDB7496EB62E1BC76E3DBCFF"><enum>(v)</enum><text>basic sanitation and health services; and</text></clause><clause id="idc78cbc1af69844c28efc14ff32972af1"><enum>(vi)</enum><text>public safety.</text></clause></subparagraph></paragraph><paragraph id="id17a0ae14d9a845efa31ff5d6e703c6f8"><enum>(2)</enum><header>Catastrophic incident</header><text>The term <term>catastrophic incident</term>—</text><subparagraph id="id9e1d97a918cc494eac32e5ef2f8ad285"><enum>(A)</enum><text>means any natural or man-made disaster that results in extraordinary levels of casualties or damage, mass evacuations, or disruption severely affecting the population, infrastructure, environment, economy, national morale, or government functions in an area; and</text></subparagraph><subparagraph id="id3b74afdb6cae4e1384fae51e9162d9c0"><enum>(B)</enum><text>may include an incident—</text><clause id="ida4f7766dda6c4e889d437b6621515814"><enum>(i)</enum><text>with a sustained national impact over a prolonged period of time;</text></clause><clause id="id7aa22b25bd23438e8908ad822e98290f"><enum>(ii)</enum><text>that may rapidly exceed resources available to State and local government and private sector authorities in the impacted area; or</text></clause><clause id="id66b65c9e42d04a65a6e6b0cd92c3de43"><enum>(iii)</enum><text>that may significantly interrupt governmental operations and emergency services to such an extent that national security could be threatened. </text></clause></subparagraph></paragraph><paragraph id="id08dc7f6ff22949cbacded41ba17430ea"><enum>(3)</enum><header>Critical infrastructure</header><text>The term <term>critical infrastructure</term> has the meaning given the term in section 1016(e) of the Critical Infrastructure Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>).</text></paragraph><paragraph id="id650fc0f6739840b294717538a544a764"><enum>(4)</enum><header>National exercise program</header><text>The term <term>national exercise program</term> means activities carried out to test and evaluate the national preparedness goal and related plans and strategies as described in section 648(b) of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/748">6 U.S.C. 748(b)</external-xref>).</text></paragraph><paragraph id="idb0c2cc2b3c624dacacf251b9cfcdb7d3" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native Tribe, band, nation, pueblo, village, community, component band, or component reservation, that is individually identified (including parenthetically) in the most recent list published pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>). </text></paragraph></section><section id="idafade0bbe6284da4ae68ab96db09235a"><enum>4.</enum><header>Enhanced catastrophic incident annex</header><subsection id="idb29c7d0e0d8b4c68ae99ba968477ef67"><enum>(a)</enum><header>In general</header><text>The President, with support from the committee, shall supplement each Federal Interagency Operational Plan to include an annex containing a strategy to ensure the health, safety, and general welfare of the civilian population affected by catastrophic incidents by—</text><paragraph id="id9b1c645d8a9441e7a580b2cdbc917e66"><enum>(1)</enum><text>providing for the basic needs of the civilian population of the United States that is impacted by catastrophic incidents in the United States;</text></paragraph><paragraph id="id3b821f80047a48dca3cf54ace09bf7ac"><enum>(2)</enum><text>coordinating response efforts with State and local governments, the private sector, and nonprofit relief organizations;</text></paragraph><paragraph id="ide09b729b3802481c956e5ea41e534b80"><enum>(3)</enum><text>promoting personal and local readiness and non-reliance on government relief during periods of heightened tension or after catastrophic incidents; and</text></paragraph><paragraph id="id958ac571d5554898b07fc03ef01c5b71"><enum>(4)</enum><text>developing international partnerships with allied nations for the provision of relief services and goods.</text></paragraph></subsection><subsection id="idc6f5302bbada427faf5a91d5e3ed59d8"><enum>(b)</enum><header>Elements of the strategy</header><text>The strategy required under subsection (a) shall include a description of—</text><paragraph id="id8893cad04f9d4c3384b7067a0a736109"><enum>(1)</enum><text>actions the President will take to ensure the basic needs of the civilian population of the United States in a catastrophic incident are met;</text></paragraph><paragraph id="iddf920c360b754d0489573302f9bdd94b"><enum>(2)</enum><text>how the President will coordinate with non-Federal entities to multiply resources and enhance relief capabilities, including—</text><subparagraph id="id2ee59cf8604c4a21a48d3442a0299074"><enum>(A)</enum><text>State and local governments;</text></subparagraph><subparagraph id="id6dee6da51d394de28840edb17c8eeafa"><enum>(B)</enum><text>Tribal governments;</text></subparagraph><subparagraph id="id6b0748e6d3614a8a80b8b151ae0d7e8a"><enum>(C)</enum><text>State disaster relief agencies;</text></subparagraph><subparagraph id="id30e11e39f2f0494dafeb117275d91a60"><enum>(D)</enum><text>State and local disaster relief managers;</text></subparagraph><subparagraph id="idc81e39d430e145d29c2ef6d8c14dd182"><enum>(E)</enum><text>State National Guards;</text></subparagraph><subparagraph id="id699f0c5560d34c1296ab9a64f2b68047"><enum>(F)</enum><text>law enforcement and first response entities; and</text></subparagraph><subparagraph id="idabd406dcadf741c1b9341f13a71a4045"><enum>(G)</enum><text>nonprofit relief services;</text></subparagraph></paragraph><paragraph id="id4a622fb74db34c9cab94136f3d19310d"><enum>(3)</enum><text>actions the President will take to enhance individual resiliency to the effects of a catastrophic incident, which actions shall include—</text><subparagraph id="id56781223e6f44d5b805177c61552e695"><enum>(A)</enum><text>readiness alerts to the public during periods of elevated threat;</text></subparagraph><subparagraph id="id0e5ae9e0461d4f8ab0140901fbb7e31d"><enum>(B)</enum><text>efforts to enhance domestic supply and availability of critical goods and basic necessities; and</text></subparagraph><subparagraph id="id43ab8241d67b47a28e04955f81de8456"><enum>(C)</enum><text>information campaigns to ensure the public is aware of response plans and services that will be activated when necessary;</text></subparagraph></paragraph><paragraph id="id52729aa085e546a18c8ef1301be7f724"><enum>(4)</enum><text>efforts the President will undertake and agreements the President will seek with international allies to enhance the readiness of the United States to provide for the general welfare;</text></paragraph><paragraph id="id4e0ac202f5ac46c390a928727a660a02"><enum>(5)</enum><text>how the strategy will be implemented should multiple levels of critical infrastructure be destroyed or taken offline entirely for an extended period of time; and</text></paragraph><paragraph id="idf29160f1debc4fd5b61dbd5152b19c39"><enum>(6)</enum><text>the authorities the President would implicate in responding to a catastrophic incident.</text></paragraph></subsection><subsection id="id2bc0b890fa7a4ba4895e2023478c6e71"><enum>(c)</enum><header>Assumptions</header><text>In designing the strategy under subsection (a), the President shall account for certain factors to make the strategy operationally viable, including the assumption that—</text><paragraph id="id01be5a83d11444e98a6a42a3771da545"><enum>(1)</enum><text>multiple levels of critical infrastructure have been taken offline or destroyed by catastrophic incidents or the effects of catastrophic incidents;</text></paragraph><paragraph id="id07aa3d7c4f4b44c591f34153cae9075b"><enum>(2)</enum><text>impacted sectors may include—</text><subparagraph id="iddf49525d32544e989ff2e5f9369c46e5"><enum>(A)</enum><text>the transportation sector;</text></subparagraph><subparagraph id="id73ffdb73a73a4c5795452d209cd6a74e"><enum>(B)</enum><text>the communication sector;</text></subparagraph><subparagraph id="id1e52505ba51141cfa81774f08cb09b09"><enum>(C)</enum><text>the energy sector;</text></subparagraph><subparagraph id="id08aa9e02ce2d4c2d8c04d4739e7e4516"><enum>(D)</enum><text>the healthcare and public health sector;</text></subparagraph><subparagraph id="id33bcac11eabd4e17828ddc808ce10578"><enum>(E)</enum><text>the water and wastewater sector; and</text></subparagraph><subparagraph id="id00e3d475cfea4935866f9060a9c30449"><enum>(F)</enum><text>the financial sector;</text></subparagraph></paragraph><paragraph id="id7698993e171a423fac2d89936bc8beb8"><enum>(3)</enum><text>State, local, Tribal, and territorial governments have been equally affected or made largely inoperable by catastrophic incidents or the effects of catastrophic incidents;</text></paragraph><paragraph id="id29c368d9c7924a14a464192eb1073dad"><enum>(4)</enum><text>the emergency has exceeded the response capabilities of State and local governments under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) and other relevant disaster response laws; and</text></paragraph><paragraph id="id814b5da208b046c8a27bca185a8d00f6"><enum>(5)</enum><text>the United States military is sufficiently engaged in armed or cyber conflict with State or non-State adversaries, or is otherwise unable to augment domestic response capabilities in a significant manner due to a catastrophic incident.</text></paragraph></subsection><subsection id="id7466dd6b2f1b4f14949b0e3ca88704f1"><enum>(d)</enum><header>Existing plans</header><text>The President may incorporate existing contingency plans in the strategy developed under subsection (a) so long as those contingency plans are amended to be operational in accordance with the requirements under this section.</text></subsection><subsection id="id84a30983754c4ab98681839ec06d40bf"><enum>(e)</enum><header>Availability</header><text>The strategy developed under subsection (a) shall be available to the public but may include a classified, or other restricted, annex to be made available to the appropriate committees of Congress and appropriate government entities. </text></subsection></section><section id="id7f6f1ccd88f54a23bf910c1fc0ae46fb"><enum>5.</enum><header>Validation of the strategy through an exercise</header><text display-inline="no-display-inline">Not later than 1 year after the addition of the annex required under section 4, the Department of Homeland Security shall lead an exercise as part of the national exercise program, in coordination with the committee, to test and enhance the operationalization of the strategy.</text></section><section id="idef18a20da24e4e8c8a89e8f6fc6e8e96"><enum>6.</enum><header>Recommendations</header><subsection id="idd3ce6079f68442ef94f47a5682a9233f"><enum>(a)</enum><header>In general</header><text>The President shall provide recommendations to Congress for—</text><paragraph id="id65af31a46b3649cbb574153a8793259c"><enum>(1)</enum><text>actions that should be taken to prepare the United States to implement the strategy required under section 4, increase readiness, and address preparedness gaps for responding to the impacts of catastrophic incidents on citizens of the United States; and</text></paragraph><paragraph id="id187510e773c84a528dba475e482b003b"><enum>(2)</enum><text>additional authorities that should be considered for Federal agencies and the President to more effectively implement the strategy required under section 4.</text></paragraph></subsection><subsection id="idbe52fcb7aa814e6cb2476a807bcf084a"><enum>(b)</enum><header>Inclusion in reports</header><text>The President may include the recommendations required under subsection (a) in a report submitted under section 7.</text></subsection></section><section id="ida29c33a0868645c599a76665254a6c83"><enum>7.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Not later than 1 year after the date on which the Department of Homeland Security leads the exercise under section 5, the President shall submit to Congress a report that includes—</text><paragraph id="id36ff9755d5f94f8f934c0a5ceb19f59d"><enum>(1)</enum><text>a description of the efforts of the President to develop and update the strategy required under section 4; and</text></paragraph><paragraph id="idebe152a4477a43208611ee12cdadfa12"><enum>(2)</enum><text>an after-action report following the conduct of the exercise described in section 5. </text></paragraph></section></legis-body></bill>
