which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Credit Union Act to permit credit unions to serve certain underserved areas, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" changed="not-changed" id="HA7AE4AFEC242450B9A51C5D9BEB51002"><section section-type="section-one" id="HE0C8711214604972BDDE61ED711443F5" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Financial Access for Underserved Communities Act</short-title></quote>.</text></section><section id="HD08B8C98B87E4EEF915ACCF4B072F197"><enum>2.</enum><header>Credit union service to underserved areas</header><text display-inline="no-display-inline">Section 109 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1759">12 U.S.C. 1759</external-xref>) is amended—</text><paragraph id="H2B13FED98A13494EB58509252906158A"><enum>(1)</enum><text>in subsection (c)(2)—</text><subparagraph id="H62E99054C44F40669EBD3C517DD08301"><enum>(A)</enum><text>by striking <quote>the field of membership category of which is described in subsection (b)(2),</quote>;</text></subparagraph><subparagraph id="HAC893B945D8C491FBCEBDFF89F1F8049"><enum>(B)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" id="HEA412E926C6845FA92A77634D604167C" display-inline="no-display-inline"><subparagraph id="H3753EA097452465296C7628537BD51F9"><enum>(A)</enum><text display-inline="yes-display-inline">the Board determines that the local community, neighborhood, or rural district is an underserved area; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H877A791F509D4B479C495E7AA200A8C0"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>not later than 2 years after having such underserved area added to the credit union’s charter,</quote> before <quote>the credit union</quote>; and</text></subparagraph></paragraph><paragraph id="H9CDB510C6AE44E33A9C5698E75E594C9"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HE75840744FBD42D29D83CDE32EBD263D" display-inline="no-display-inline"><subsection id="H02F5054C43964C9EA16750036AD5C7A3"><enum>(h)</enum><header>Change of field of membership To include underserved areas</header><paragraph id="HD1B3F68DDA0A4FFF81094338701BA95D"><enum>(1)</enum><header>In general</header><text>If an existing Federal credit union applies to the Board to alter or expand the field of membership of the credit union to serve an underserved area, the credit union shall submit a business and marketing plan with such application that explains the ability and intent of the credit union to serve the population of the underserved area through the change in field of membership.</text></paragraph><paragraph id="H4340A852822842B19F1D44E8C294B8B7"><enum>(2)</enum><header>Report by credit union</header><text>Not later than 2 years after the date on which an application described under paragraph (1) is approved, the credit union, as part of the ordinary course of the examination cycle and supervision process, shall submit a report to the Administration that includes—</text><subparagraph id="H6CE916E8B88445BE891BDD74B8EBF797" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an estimate of the number of members of the credit union who are members by reason of the application, including breakdowns by each State (including the District of Columbia and each territory of the United States), Tribal government entity, and congressional district;</text></subparagraph><subparagraph id="HD1812C8D79894A42BE91AA9BE97DBEB9" commented="no"><enum>(B)</enum><text>a description of the types of financial services utilized by members of the credit union who are members by reason of the application; </text></subparagraph><subparagraph id="H8137E0743AB94F479E401FE34134A502" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">an update of the implementation of the credit union of the business and marketing plan described under paragraph (1); and</text></subparagraph><subparagraph id="HDCEDBE1413424AD4B5CAFA81AFE79BB5"><enum>(D)</enum><text display-inline="yes-display-inline">a description of the types of financial education programs made available to members of the credit union, including those who are members by reason of the application and those in rural areas, where applicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H7E96A14154974ED791A366BB9FB9FC6B"><enum>3.</enum><header>Member business lending in underserved areas</header><text display-inline="no-display-inline">Section 107A(c)(1)(B) of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1757a">12 U.S.C. 1757a(c)(1)(B)</external-xref>) is amended—</text><paragraph id="HB342C36D4B8D4F4C9A153AB745830F0E"><enum>(1)</enum><text>in clause (iv), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H13B48236F1C8456098E5E93170C9E475"><enum>(2)</enum><text>in clause (v), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H5ADDB8DEE4AC4637B2BD04F04EF3716B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2CDE05BF9F7E48FEAF3F8B0814DBE695" display-inline="no-display-inline"><clause id="HE518F0329B53454ABDCD718034BA3A08"><enum>(vi)</enum><text display-inline="yes-display-inline">that is made to a member or associated borrower that lives in or operates in an underserved area.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HF37D9527710647EB805A88F83A114FC0"><enum>4.</enum><header>Underserved area defined</header><text display-inline="no-display-inline">Section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>) is amended—</text><paragraph id="HA52BDBF3642F41D587A454B85BDFAD9A"><enum>(1)</enum><text>in paragraph (8), by striking <quote>; and</quote> and inserting a period;</text></paragraph><paragraph id="H306D6F80735E4ACD9B3B3F2665673E35"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H81CE68193A9348F796979FAEE3285754"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H33DF37731C4B4B6994E1EEBD2117FC3E" display-inline="no-display-inline"><paragraph id="H9BF6E193E9104123A5899EC3F9AF6B50"><enum>(10)</enum><text display-inline="yes-display-inline">the term <term>underserved area</term> means a geographic area consisting of 1 or more population census tracts or 1 or more counties, that encompass or are located within—</text><subparagraph id="HECFFE4F5AB6B48DDA602EF075A8FAFBF"><enum>(A)</enum><text>an investment area, as defined in section 103(16) of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702(16)</external-xref>);</text></subparagraph><subparagraph id="HAA54FEF8BECB4DC0B6A053F93E852AF5"><enum>(B)</enum><text display-inline="yes-display-inline">groups of contiguous census tracts in which at least 85 percent individually qualify as low-income communities, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986; or</text></subparagraph><subparagraph id="H65AC696C486146818DFABD389FE26630"><enum>(C)</enum><text display-inline="yes-display-inline">an area that is more than 10 miles, as measured from each point along the perimeter of the area, from the nearest branch of a depository institution, as defined in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>) or credit union.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HDE7EE29CC4BE46FAA8535351CF4659A0"><enum>5.</enum><header>Reports by the National Credit Union Administration</header><subsection id="HA910F1B86C1C4268A292C1405F979D98" changed="not-changed"><enum>(a)</enum><header>Initial report</header><text display-inline="yes-display-inline">During the 1-year period beginning on the date that is 2 years after the date of enactment of this Act, the National Credit Union Administration shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report on the implementation of the amendments made by this Act.</text></subsection><subsection id="HD784213374F948B89AA4B02BC8A0C327" changed="not-changed"><enum>(b)</enum><header>Update</header><text display-inline="yes-display-inline">On the date that is 5 years after the date on which the report required under subsection (a) is submitted, the National Credit Union Administration shall submit to the committees described that subsection an updated report.</text></subsection></section><section id="H4F847592FCD044048CA331DF3D0C0BC8" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act may be construed to prevent or otherwise impede the ability of insured depository institutions, as defined in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>) to establish branches and provide banking services in underserved areas.</text></section></legis-body></bill>
