which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an office to coordinate work relating to behavioral health crisis care and to improve the National Suicide Prevention Lifeline program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>988 Coordination and Improvement Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idCED8855DA1AF4D1080371A7C2B25CBCD"><enum>2.</enum><header>Behavioral Health Crisis Coordinating Office</header><text display-inline="no-display-inline">Part A of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0e8140be2466482586457a07da8cd175"><section id="id756927e7633c4fef94d277f93ba80e05"><enum>506B.</enum><header>Behavioral Health Crisis Coordinating Office</header><subsection id="id65e070328dc842f6826e99b54e48e582"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish, within the Substance Abuse and Mental Health Services Administration, an office to coordinate work relating to behavioral health crisis care across the operating divisions and agencies of the Department of Health and Human Services, including the Substance Abuse and Mental Health Services Administration, the Centers for Medicare &amp; Medicaid Services, and the Health Resources and Services Administration, and other Federal Government and external stakeholders.</text></subsection><subsection id="id07b68d204c6a442085647220bf21d37c"><enum>(b)</enum><header>Duty</header><text>The office established under subsection (a) shall—</text><paragraph id="id2ef1fc21c504450a8b72a5f8bd2ecb81"><enum>(1)</enum><text>convene Federal, State, Tribal, local, and private partners;</text></paragraph><paragraph id="idb22e5240c8cb41fca23a55d6fd5aad92"><enum>(2)</enum><text>launch and manage Federal workgroups charged with making recommendations regarding behavioral health crisis issues, including with respect to health care best practices, workforce development, mental health disparities, data collection, technology, geolocation and call routing, program oversight, public education, and engagement; and</text></paragraph><paragraph id="id38095232d02d4336881f4babebac7527"><enum>(3)</enum><text>support technical assistance, data analysis, and evaluation functions in order to assist States, local governmental entities, territories, Indian Tribes, and Tribal communities in developing crisis care systems and establish nationwide best practices with the objective of expanding the capacity of, and access to, local 988 Suicide and Crisis Lifeline call centers, mobile crisis care, crisis stabilization, psychiatric emergency services, rapid post-crisis follow-up care, and essential community services provided by—</text><subparagraph id="ide9e8f4fbc833475cb7c5bb0f899b6c4c"><enum>(A)</enum><text>the National Suicide Prevention and Mental Health Crisis Hotline and Response System; </text></subparagraph><subparagraph id="id173EBB0304F149D281C512E50B664A69"><enum>(B)</enum><text>the Veterans Crisis Line;</text></subparagraph><subparagraph id="id1ca2332924724f08b5af5debb7042978"><enum>(C)</enum><text>community mental health centers (as defined in section 1861(ff)(3)(B) of the Social Security Act);</text></subparagraph><subparagraph id="id5054f5f5f04b44f6bf7d6ce19eee8a80"><enum>(D)</enum><text>Federally qualified health centers (as defined in section 1861(aa) of the Social Security Act); </text></subparagraph><subparagraph id="ide2f73475efef42739ca8ec718bc6758a"><enum>(E)</enum><text>certified community behavioral health clinics, as described in section 223 of the Protecting Access to Medicare Act of 2014; and</text></subparagraph><subparagraph id="idde10d075dd8544268fca2669aa6204d8"><enum>(F)</enum><text>other community mental health, substance use disorder, and essential community service providers, as determined by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="id3f93458a16f245a6933f896d998f09c7"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id84269D4AFAD54090B106B791A1B3D8A7"><enum>3.</enum><header>National Suicide Prevention Lifeline program access to specialized services</header><text display-inline="no-display-inline">Section 520E–3 of the Public Health Service Act (290bb–36c) is amended— </text><paragraph id="id4f8722f6e58f4aeaa9c7fec82ba151da"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id91ef18e7b2a34813aac19a1c83da5d22"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="id3504ff557e8c41b4beedb8cd4dca5c6f"><enum>(i)</enum><text>by inserting after <quote>suicide prevention hotline</quote> the following: <quote>, under the universal telephone number designated under section 251(e)(4) of the Communications Act of 1934,</quote>; and</text></clause><clause id="id1e6e4dce593e426cb6fad678be9489e8"><enum>(ii)</enum><text>by striking <quote>; and</quote> at the end and inserting a semicolon;</text></clause></subparagraph><subparagraph id="iddb72ef8061c0447d9f71e4c9d06919f1"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idf9c597b03e0844588b338ac8742d81d5"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE758735AE02042BE92FA9A8693510BD8"><paragraph id="ideec7bb0e8e6b4b19bd1ee52a532d05a1"><enum>(4)</enum><text>supporting access by high-risk populations, including LGBTQ+ youth and other members of the LGBTQ+ community, American Indian and Alaska Natives, individuals who reside in rural counties, veterans, racial and ethnic minorities, and other high-risk populations, to specialized services through the program, in accordance with subsection (c) and as determined by the Office of the Assistant Secretary.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idc359e8f09d534955bbff882d74fc1c5b"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="id0d4b5043f86b47208968908ea512468b"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id41dcf02b383b444785e5fe3968393276"><subsection id="id6c391def67ed47c185b45281de2ba2d8"><enum>(c)</enum><header>Access to specialized services</header><paragraph id="id07FF843509B6482CBC75982AF63666DB"><enum>(1)</enum><header>Consultation</header><text>Wherever possible, the Office of the Assistant Secretary shall, in determining which approaches to use to support access to specialized services under subsection (b)(4) to the populations described in such subsection, consult with organizations that have—</text><subparagraph id="id6c48dbb250e342b9b6606dcf6d3aed15"><enum>(A)</enum><text>experience working with such populations; or</text></subparagraph><subparagraph id="id5127ec036756450998ad7aae4c140f3f"><enum>(B)</enum><text>technological expertise in effective crisis response using such digital and technology approaches.</text></subparagraph></paragraph><paragraph id="idb8949da57ad84e29bdb49cc87132e38d"><enum>(2)</enum><header>Examples of specialized services</header><text>Efforts to support access to specialized services under subsection (b)(4) may include—</text><subparagraph id="id306cfd73101c4a2281850fddf6c9ad55" commented="no"><enum>(A)</enum><text>updates and development of training resources that can help crisis counselors better address the needs of high-risk populations;</text></subparagraph><subparagraph id="id40a98ec3d5a84431bc73af17ab81cf2a" commented="no"><enum>(B)</enum><text>adapting the program network center membership processes to incorporate organizations providing specialized services for high-risk populations;</text></subparagraph><subparagraph id="idedf9a98def7548a1bd0bb24963725b05" commented="no"><enum>(C)</enum><text>designing and implementing transfer processes;</text></subparagraph><subparagraph id="id12f08af4b6da473f92f4639b011b534d" commented="no"><enum>(D)</enum><text>providing additional technical assistance to centers participating in the program to ensure compliance with the training expectations in working with high-risk populations; and</text></subparagraph><subparagraph id="id0c7aa68898f04a4fb3b9beaa20ab58f5" commented="no"><enum>(E)</enum><text>the use of digital and technology approaches to improve access for high risk populations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idAC3DCEB88C614DD29D7EEA463B780102"><enum>4.</enum><header>Department of Health and Human Services report</header><subsection id="idbff7f492392a48e2ba58bc6404364763"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services shall submit a report to Congress assessing the progress of the Department of Health and Human Services in implementation of the 9–8–8 dialing code for the 988 Suicide and Crisis Lifeline operated pursuant to the program under section 520E–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-36c">42 U.S.C. 290bb–36c</external-xref>).</text></subsection><subsection id="id5191ad9e50f649e8916c657d2957fcbe"><enum>(b)</enum><header>Content</header><text>The report required under subsection (a) shall include—</text><paragraph id="id91fa7c38c5fc449a9e2d1fa806e5f15d"><enum>(1)</enum><text>an assessment of the performance of the 988 Suicide and Crisis Lifeline and any partner organizations of the Lifeline;</text></paragraph><paragraph id="id8a8123169ffa40ebaaa02637d405a928"><enum>(2)</enum><text>an update on efforts to provide specialized resources to high-risk populations, including LGBTQ+ youth and other members of the LGBTQ+ community, American Indian and Alaska Natives, individuals who reside in rural counties, veterans, racial and ethnic minorities, and other high-risk populations;</text></paragraph><paragraph id="ida19afedef20b444498a12addc7709fee"><enum>(3)</enum><text>State and regional variation with respect to access to crisis call centers, including average speed to answer, answer rates, hours of operation, and funding sources;</text></paragraph><paragraph id="id303f88649ba84ddfabafefc5daf938a5"><enum>(4)</enum><text>the capacity of the 988 Suicide and Crisis Lifeline to handle texts and chats; </text></paragraph><paragraph id="id45F1C23122174358B1B4D6BC674D3987"><enum>(5)</enum><text>any needed programmatic or technological enhancements to connect callers to local services; and</text></paragraph><paragraph id="idab83b13eb2cf45ba88b7090b1ef77ea9"><enum>(6)</enum><text>obstacles identified by States, political subdivisions of States, Indian Tribes, or villages or regional corporations serving a region established pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>) in collection and distribution of fees and charges described by section 4(a)(1) of the National Suicide Hotline Designation Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/172">Public Law 116–172</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
