Antideficiency.</toc-entry></toc></subsection></section><section id="id4a67a31477c54d6981a92ad51a0bda08"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="id78d62102c3af45c5a465831dbedecb4c"><enum>(1)</enum><text>to achieve a fair, equitable, and final settlement of claims to water rights in the State of California for—</text><subparagraph id="ida818e71acc014f8280dc47672f50bb67"><enum>(A)</enum><text>the Tule River Tribe; and</text></subparagraph><subparagraph id="id727a74059eb24186ac183415765d5ffb"><enum>(B)</enum><text>the United States, acting as trustee for the Tribe;</text></subparagraph></paragraph><paragraph id="id5ea9028b24ac4b28985fec8fe00b3e7b"><enum>(2)</enum><text>to authorize, ratify, and confirm the 2007 Agreement entered by the Tribe, the South Tule Independent Ditch Company, and the Tule River Association, to the extent that the 2007 Agreement is consistent with this Act;</text></paragraph><paragraph id="id416eec5d0f4b4cdf8349b136c07663d9"><enum>(3)</enum><text>to authorize and direct the Secretary—</text><subparagraph id="id278925cfa56c4c14af7e881b282b76fa"><enum>(A)</enum><text>to execute the 2007 Agreement; and</text></subparagraph><subparagraph id="id42227dd6649e459dbd1680a7d8f2a128"><enum>(B)</enum><text>to take any other actions necessary to carry out the 2007 Agreement in accordance with this Act; </text></subparagraph></paragraph><paragraph id="id507e97776fa445ef99d3d4dd248c019a"><enum>(4)</enum><text>to authorize funds necessary for the implementation of the 2007 Agreement and this Act; and</text></paragraph><paragraph id="id353864a1c14c4488a3ac2a523839e59d"><enum>(5)</enum><text>to authorize the transfer of certain lands to the Tribe, to be held in trust.</text></paragraph></section><section id="idfba1923747a24c6f89c61661f0f4abfe"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0f15a08d49bc4962830b55439312153b"><enum>(1)</enum><header>2007 Agreement</header><text>The term <term>2007 Agreement</term> means—</text><subparagraph id="idfb3bb00157504dca8d861a96a11f8ac3"><enum>(A)</enum><text>the agreement dated November 21, 2007, as amended on April 22, 2009, between the Tribe, the South Tule Independent Ditch Company, and the Tule River Association, and exhibits A–F attached thereto; and</text></subparagraph><subparagraph id="id8c8c476d919d4179a9adc7ee4ef67155"><enum>(B)</enum><text>any amendment to the Agreement referred to in subparagraph (A) (including an amendment to any exhibit) that is executed to ensure that the 2007 Agreement is consistent with this Act.</text></subparagraph></paragraph><paragraph id="idd8a03e4f4b3a4cf09fafd989fa706424"><enum>(2)</enum><header>Court</header><text>The term <term>Court</term> means the United States District Court for the Eastern District of California, unless otherwise specified herein.</text></paragraph><paragraph id="id0e633b2046b34c6dbbe25ab3c688a74b"><enum>(3)</enum><header>Divert; diversion</header><text>The terms <term>divert</term> and <term>diversion</term> mean to remove water from its natural course or location by means of a ditch, canal, flume, bypass, pipeline, conduit, well, pump, or other structure or device, or act of a person.</text></paragraph><paragraph id="idd1b44042b97241ba8b59ce83e60ad06f"><enum>(4)</enum><header>Downstream water users</header><text>The term <term>Downstream Water Users</term> means—</text><subparagraph id="id5607C881B0704DFB9530A7E2F9E6F820"><enum>(A)</enum><text>the Tule River Association and its successors and assigns; </text></subparagraph><subparagraph id="id1E6E01C35064482AA60C9649F32D460D"><enum>(B)</enum><text>the South Tule Independent Ditch Company and its successors and assigns; and </text></subparagraph><subparagraph id="id8A31FB642E1145C2AA014C02BC663031"><enum>(C)</enum><text>any and all other holders of water rights in the South Fork Tule River Basin.</text></subparagraph></paragraph><paragraph id="id16448d90315d4fc2affeed3801143b7d"><enum>(5)</enum><header>Enforceability date</header><text>The term <term>Enforceability Date</term> means the date described in section 11.</text></paragraph><paragraph id="id0a1f94a6df01452e93eb2f9c1d690fc4" commented="no"><enum>(6)</enum><header>OM&amp;R</header><subparagraph id="idA0E6F7B741664BACA7FA8C4B748BA921" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>OM&amp;R</term> means operation, maintenance, and replacement.</text></subparagraph><subparagraph id="id0AD79DE3389B48C5994CD00F5B8D6DB0" commented="no"><enum>(B)</enum><header>Inclusions</header><text>The term <term>OM&amp;R</term> includes—</text><clause id="id0381f3d76d754541835ccb4f3b0e2fa3" commented="no"><enum>(i)</enum><text>any recurring or ongoing activity relating to the day-to-day operation of a project;</text></clause><clause id="idA6D0957988EA4C8487458764641C0314" commented="no"><enum>(ii)</enum><text>any activity relating to scheduled or unscheduled maintenance of a project; and</text></clause><clause id="id2fbad73254fa476f9214ee1ccab28ccf" commented="no"><enum>(iii)</enum><text>any activity relating to repairing or replacing a feature of a project.</text></clause></subparagraph></paragraph><paragraph id="idb17c8b6a7f20419d9a713c30964aeed7"><enum>(7)</enum><header>Reservation; Tule River Reservation</header><text>The terms <term>Reservation</term> and <term>Tule River Reservation</term> mean the reservation of lands set aside for the Tribe by the Executive Orders of January 9, 1873, October 3, 1873, and August 3, 1878, including lands added to the Reservation pursuant to section 8.</text></paragraph><paragraph id="id66f9ed92a02c4b228db6bd16b97dabc2"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="idd3b8eca549f241e5986e7ab5af5e7b57"><enum>(9)</enum><header>South Tule Independent Ditch Company</header><text>The term <term>South Tule Independent Ditch Company</term> means the nonprofit mutual water company incorporated in 1895, which provides water diverted from the South Fork of the Tule River to its shareholders on lands downstream from the Tule River Reservation.</text></paragraph><paragraph id="id216a9e4b9ac44cc9949817ea69c5c0f0"><enum>(10)</enum><header>Tribal Water Right</header><text>The term <term>Tribal Water Right</term> means the water rights ratified, confirmed, and declared to be valid for the benefit of the Tribe as set forth and described in the 2007 Agreement and this Act.</text></paragraph><paragraph id="id786296a046a44c45a6a284550e3480fe"><enum>(11)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Tule River Indian Tribe of the Tule River Reservation, California, a federally recognized Indian Tribe.</text></paragraph><paragraph id="id19f218924d334dc39ff0c70ebef96fb3"><enum>(12)</enum><header>Trust Fund</header><text>The term <term>Trust Fund</term> means the Tule River Indian Tribe Settlement Trust Fund established under section 6(a).</text></paragraph><paragraph id="id3425159a5bf54438b91445a9315c7efe"><enum>(13)</enum><header>Tule River Association</header><subparagraph id="idF192F5105DDC43D8ABB3F7942ABD4537"><enum>(A)</enum><header>In general</header><text>The term <term>Tule River Association</term> means the association formed by agreement in 1965, the members of which are representatives of all pre-1914 appropriative and certain riparian water right holders of the Tule River at and below the Richard L. Schafer Dam and Reservoir. </text></subparagraph><subparagraph id="id6A596443F269494398F32B6AC97CA426"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Tule River Association</term> includes the Pioneer Water Company, the Vandalia Irrigation District, the Porterville Irrigation District, and the Lower Tule River Irrigation District.</text></subparagraph></paragraph><paragraph id="id598f50cfe8504557aca7541a0378c735"><enum>(14)</enum><header>Water development project</header><text>The term <term>Water Development Project</term> means a project for domestic, commercial, municipal, and industrial water supply, including but not limited to water treatment, storage, and distribution infrastructure, to be constructed, in whole or in part, using monies from the Trust Fund.</text></paragraph></section><section id="id3c6780b2195541088521392bfdbb6825"><enum>4.</enum><header>Ratification of 2007 Agreement</header><subsection id="idcc65280942804f3dad41694a4dbbeaba"><enum>(a)</enum><header>Ratification</header><paragraph id="id752d15d510a6469aabfe80b0de5fda30"><enum>(1)</enum><header>In general</header><text>Except as modified by this Act and to the extent that the 2007 Agreement does not conflict with this Act, the 2007 Agreement is authorized, ratified, and confirmed.</text></paragraph><paragraph id="id45448b82af384993bc65040794586e21"><enum>(2)</enum><header>Amendments</header><text>If an amendment to the 2007 Agreement, or to any exhibit attached to the 2007 Agreement requiring the signature of the Secretary, is executed in accordance with this Act to make the 2007 Agreement consistent with this Act, the amendment is authorized, ratified, and confirmed.</text></paragraph></subsection><subsection id="idd0c06ac7100b49209209f4b95c919de0"><enum>(b)</enum><header>Execution</header><paragraph id="ide62e55c8a3fd48ca80e3a90170810f16"><enum>(1)</enum><header>In general</header><text>To the extent the 2007 Agreement does not conflict with this Act, the Secretary shall execute the 2007 Agreement, including all exhibits to, or parts of, the 2007 Agreement requiring the signature of the Secretary.</text></paragraph><paragraph id="idcd5acb4fb9874922840df4099bc90235"><enum>(2)</enum><header>Modifications</header><text>Nothing in this Act prohibits the Secretary, after execution of the 2007 Agreement, from approving any modification to the 2007 Agreement, including any exhibit to the 2007 Agreement, that is consistent with this Act, to the extent that the modification does not otherwise require congressional approval under section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable provision of Federal law.</text></paragraph></subsection><subsection id="id29bc2232b68d44a4909b7ba3745eafb1"><enum>(c)</enum><header>Environmental compliance</header><paragraph id="id00607c28178242adb3159ca69816da08"><enum>(1)</enum><header>In general</header><text>In implementing the 2007 Agreement and this Act, the Secretary shall comply with all applicable provisions of—</text><subparagraph id="id695213bd785243c58eb8386d496f226a"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="ida671a93a58414518955fbec8f6541dce"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></subparagraph><subparagraph id="id7aa5786d991648eb9e0cc1b6f00e3717"><enum>(C)</enum><text>other applicable Federal environmental laws and regulations.</text></subparagraph></paragraph><paragraph id="id19b5f7f001014d4da6f83c271717ba17"><enum>(2)</enum><header>Compliance</header><subparagraph id="id32dc53ada3824f00998306de293f8635"><enum>(A)</enum><header>In general</header><text>In implementing the 2007 Agreement and this Act, the Tribe shall prepare any necessary environmental documents, consistent with all applicable provisions of—</text><clause id="idff3afd651d594f299aaddc9d4fea2bf0"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="idf55dcb1b2e9e430cb18e237a3f0c2de2"><enum>(ii)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4231">42 U.S.C. 4231 et seq.</external-xref>), including the implementing regulations of that Act; and</text></clause><clause id="idd1b37784e60f47f494442d8a858c7eaa"><enum>(iii)</enum><text>all other applicable Federal environmental laws and regulations.</text></clause></subparagraph><subparagraph id="id69e500611803419b994d3c262995f075"><enum>(B)</enum><header>Authorizations</header><text>The Secretary shall—</text><clause id="id23c12e4d58c9486eab1fc68502b6dcfc"><enum>(i)</enum><text>independently evaluate the documentation submitted under subparagraph (A); and</text></clause><clause id="id7bd555c1a46d4d1584659f85bc0a1213"><enum>(ii)</enum><text>be responsible for the accuracy, scope, and contents of that documentation.</text></clause></subparagraph></paragraph><paragraph id="id86bd3df3621e4def9954edd79fce62c5"><enum>(3)</enum><header>Effect of execution</header><text>The execution of the 2007 Agreement by the Secretary under this section shall not constitute a major Federal action for purposes of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="idd03848f9dde9430387b4e12bd08b855c"><enum>(4)</enum><header>Costs</header><text>Any costs associated with the performance of the compliance activities under this subsection shall be paid from funds deposited in the Trust Fund, subject to the condition that any costs associated with the performance of Federal approval or other review of such compliance work or costs associated with inherently Federal functions shall remain the responsibility of the Secretary.</text></paragraph></subsection></section><section id="id34b15007778e49aab90d2a646d775ed7"><enum>5.</enum><header>Tribal Water Right</header><subsection id="idfc97f2812a024e2592e9f93afa50f708"><enum>(a)</enum><header>Confirmation of Tribal Water Right</header><paragraph id="ida3e60dd32329477aa7773a90c41cfd7c"><enum>(1)</enum><header>In general</header><text>The Tribal Water Right is ratified, confirmed, and declared valid.</text></paragraph><paragraph id="id27b615d0bc85467cb13daaba3168bdda"><enum>(2)</enum><header>Quantification</header><text>The Tribal Water Right includes the right to divert and use or permit the diversion and use of up to 5,828 acre-feet per year of surface water from the South Fork Tule River, as described in the 2007 Agreement and as confirmed in the decree entered by the Court pursuant to subsections (b) and (c) of section 12.</text></paragraph><paragraph id="id325126a662f44c148f0f4afd4a802888"><enum>(3)</enum><header>Use</header><text>Any diversion, use, and place of use of the Tribal Water Right shall be subject to the terms and conditions of the 2007 Agreement and this Act.</text></paragraph></subsection><subsection id="id87f4808af26f47afb2455e9b92882b73"><enum>(b)</enum><header>Trust status of Tribal Water Right</header><text>The Tribal Water Right—</text><paragraph id="idee0beaba46324560b72da31e3181ee4a"><enum>(1)</enum><text>shall be held in trust by the United States for the use and benefit of the Tribe in accordance with this Act; and</text></paragraph><paragraph id="id926d255bbb114bc59f1dd49322b28814"><enum>(2)</enum><text>shall not be subject to loss through non-use, forfeiture, abandonment, or other operation of law.</text></paragraph></subsection><subsection id="idc5f1681e418442658d5a3539ab6af07f"><enum>(c)</enum><header>Authority of the Tule River Tribe</header><paragraph id="id1c756643dc2a44ea8011294a1917bafa"><enum>(1)</enum><header>In general</header><text>The Tule River Tribe shall have the authority to allocate and distribute the Tribal Water Right for use on the Reservation in accordance with the 2007 Agreement, this Act, and applicable Federal law.</text></paragraph></subsection><subsection id="id61c7c628e3d5465bb9e89ffb456c83bd"><enum>(d)</enum><header>Administration</header><paragraph id="id9383b77847944c8b80fb981c65a0c020"><enum>(1)</enum><header>No alienation</header><text>The Tribe shall not permanently alienate any portion of the Tribal Water Right.</text></paragraph><paragraph id="idef47cf9786ba4607af1604f65f38b36a"><enum>(2)</enum><header>Purchases or grants of land from indians</header><text>An authorization provided by this Act for the allocation, distribution, leasing, or other arrangement entered into pursuant to this Act shall be considered to satisfy any requirement for authorization of the action by treaty or convention imposed by section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>).</text></paragraph><paragraph id="id509e09858cca4c219fb267a1721b1aab"><enum>(3)</enum><header>Prohibition on forfeiture</header><text>The non-use of all or any portion of the Tribal Water Right by any water user shall not result in the forfeiture, abandonment, relinquishment, or other loss of all or any portion of the Tribal Water Right.</text></paragraph></subsection></section><section id="id68e5411e17494ddba2ad89766315ca1f"><enum>6.</enum><header>Tule River Tribe trust accounts</header><subsection id="id85e87f980f3f43aca135fb9969970791"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a trust fund, to be known as the <quote>Tule River Indian Tribe Settlement Trust Fund</quote>, to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the Trust Fund under subsection (c), together with any interest earned on those amounts, for the purpose of carrying out this Act.</text></subsection><subsection id="idac1e66b16a9d4674afc6676479bb4ba8"><enum>(b)</enum><header>Accounts</header><text>The Secretary shall establish in the Trust Fund the following Accounts:</text><paragraph id="id7aecbe3441474a41a6c8e06fea601350"><enum>(1)</enum><text>The Tule River Tribe Water Development Projects Account.</text></paragraph><paragraph id="idf9eef21bdd98465e99d442c9b1eba66b"><enum>(2)</enum><text>The Tule River Tribe OM&amp;R Account.</text></paragraph></subsection><subsection id="id1941e939caa14602bbf9aead8b4b54cd"><enum>(c)</enum><header>Deposits</header><text>The Secretary shall deposit—</text><paragraph id="ide955a8fcea8b40e9bf3c8e3994885043"><enum>(1)</enum><text>in the Tule River Tribe Water Development Projects Account established under subsection (b)(1), the amounts made available pursuant to section 7(a)(1); and</text></paragraph><paragraph id="id3c4abe163fe241e0ae88b341287fecad"><enum>(2)</enum><text>in the Tule River Tribe OM&amp;R Account established under subsection (b)(2), the amounts made available pursuant to section 7(a)(2).</text></paragraph></subsection><subsection id="id503247ba858d475e9063c575ae16a2a6"><enum>(d)</enum><header>Management and interest</header><paragraph id="id2087d14277ae4899ae87c5553151461b"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of funds into the accounts in the Trust Fund pursuant to subsection (c), the Secretary shall manage, invest, and distribute all amounts in the Trust Fund in accordance with the investment authority of the Secretary under—</text><subparagraph id="ide96009665fa74f2ea1744abf7af6fd9f"><enum>(A)</enum><text>the first section of the Act of June 24, 1938 (52 Stat. 1037, chapter 648; <external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text></subparagraph><subparagraph id="id07384d23e2e3408f860e4e2a018f7337"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id20fdc725f7b840e0be8e181315d07b9b"><enum>(C)</enum><text>this section.</text></subparagraph></paragraph><paragraph id="id3922b60333d84ac580c5bbf3a4aa8ae9"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the deposits under subsection (c), any investment earnings, including interest, credited to amounts held in the Trust Fund are authorized to be used in accordance with subsections (e) and (h).</text></paragraph></subsection><subsection id="id6c159ad821744722ac93a19d206115d5" commented="no"><enum>(e)</enum><header>Availability of amounts</header><text>Amounts appropriated to, and deposited in, the Trust Fund, including any investment earnings, including interest, shall be made available to the Tribe by the Secretary beginning on the Enforceability Date and subject to the requirements set forth in this section.</text></subsection><subsection id="id7183fd783eba48e882dd99fcbf4a6bec"><enum>(f)</enum><header>Withdrawals</header><paragraph id="id87e9a7139a01494e915f2fe0f346a898"><enum>(1)</enum><header>Withdrawals under the American Indian Trust Fund Management Reform Act of 1994</header><subparagraph id="id8c31de6179ce4098a343f584030b4fe4"><enum>(A)</enum><header>In general</header><text>The Tribe may withdraw any portion of the amounts in the Trust Fund on approval by the Secretary of a Tribal management plan submitted by the Tribe in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></subparagraph><subparagraph id="id8d34b0b11c914f21aad8bf0612da5f76"><enum>(B)</enum><header>Requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Tribal management plan under this paragraph shall require that the Tribe shall spend all amounts withdrawn from the Trust Fund, and any investment earnings accrued through the investments under the Tribal management plan, in accordance with this Act.</text></subparagraph><subparagraph id="ida863f5af04924ff68d8dc154f8da9a7a"><enum>(C)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce the Tribal management plan under this paragraph to ensure that amounts withdrawn by the Tribe from the Trust Fund under this paragraph are used in accordance with this Act. </text></subparagraph></paragraph><paragraph id="id19c67fee231c47caae09ab181abcea32"><enum>(2)</enum><header>Withdrawals under expenditure plan</header><subparagraph id="idaf8ddfab47aa4e158a17a08c5a91b203"><enum>(A)</enum><header>In general</header><text>The Tribe may submit to the Secretary a request to withdraw amounts from the Trust Fund pursuant to an approved expenditure plan.</text></subparagraph><subparagraph id="id3d9883c8711c44d98168bd3140327dce"><enum>(B)</enum><header>Requirements</header><text>To be eligible to withdraw amounts under an expenditure plan under this paragraph, the Tribe shall submit to the Secretary an expenditure plan for any portion of the Trust Fund that the Tribe elects to withdraw pursuant to this subparagraph, subject to the condition that the amounts shall be used for the purposes described in this Act.</text></subparagraph><subparagraph id="id05c869c6dfd24545a883db533406065d"><enum>(C)</enum><header>Inclusions</header><text>An expenditure plan under this paragraph shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Trust Fund will be used by the Tribe in accordance with subsections (e) and (h).</text></subparagraph><subparagraph id="id23a346fd11874389b9b3275d8df03d82"><enum>(D)</enum><header>Approval</header><text>The Secretary shall approve an expenditure plan submitted under this paragraph if the Secretary determines that the plan—</text><clause id="idefc3e5ff18a340549bbb6ec65dfe8806"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="id0024f6357caf4b939d553b2e9a671246"><enum>(ii)</enum><text>is consistent with, and will be used for, the purposes of this Act.</text></clause></subparagraph><subparagraph id="id6dbbcf65db0f48deaddd32d0594a384f"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce an expenditure plan to ensure that amounts disbursed under this paragraph are used in accordance with this Act.</text></subparagraph></paragraph></subsection><subsection id="id554cca4b667f46209dd482fd2e8f0e79"><enum>(g)</enum><header>Effect of section</header><text>Nothing in this section gives the Tribe the right to judicial review of a determination of the Secretary relating to whether to approve a Tribal management plan under subsection (f)(1) or an expenditure plan under subsection (f)(2) except under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subsection><subsection id="iddd9e2535e222471da038d1221d82e1ad"><enum>(h)</enum><header>Uses</header><text>Amounts from the Trust Fund may only be used by the Tribe for the following purposes:</text><paragraph id="id923230012dd14f5b8da0df10ff08e504"><enum>(1)</enum><text>The Tule River Tribe Water Development Projects Account may only be used to plan, design, and construct Water Development Projects on the Tule River Reservation, and for the conduct of related activities, including for environmental compliance in the development and construction of projects under this Act.</text></paragraph><paragraph id="idAD5BFA9FFFFC46F7B8F3A1BE8A03B740"><enum>(2)</enum><text>The Tule River Tribe OM&amp;R Account may only be used for the OM&amp;R of Water Development Projects.</text></paragraph></subsection><subsection id="idd564d8abe8d1464bbdafbfa6e64ce439"><enum>(i)</enum><header>Liability</header><text>The Secretary and the Secretary of the Treasury shall not be liable for the expenditure or investment of any amounts withdrawn from the Trust Fund by the Tribe under paragraphs (1) and (2) of subsection (f).</text></subsection><subsection id="idbe736f5f2fa042d38a3c48cf8be69c77"><enum>(j)</enum><header>Title to infrastructure</header><text>Title to, control over, and operation of any project constructed using funds from the Trust Fund shall remain in the Tribe.</text></subsection><subsection id="id2b23637763aa4c5190014b1984dda4b7"><enum>(k)</enum><header>Operation, maintenance, &amp; replacement</header><text>All OM&amp;R costs of any project constructed using funds from the Trust Fund shall be the responsibility of the Tribe.</text></subsection><subsection id="id6963e067c9ac4001bdc6117c5edc00ef"><enum>(l)</enum><header>No per capita distributions</header><text>No portion of the Trust Fund shall be distributed on a per capita basis to any member of the Tribe.</text></subsection><subsection id="idb72f514e23434ec39e237694e960aa6a"><enum>(m)</enum><header>Expenditure report</header><text>The Tule River Tribe shall annually submit to the Secretary an expenditure report describing accomplishments and amounts spent from use of withdrawals under a Tribal management plan or an expenditure plan under this Act.</text></subsection></section><section id="id28e57d0fd4a644e09d66defe0cb1794c"><enum>7.</enum><header>Funding</header><subsection id="idfe02225f4c5b47d2b36f763cee7bc553"><enum>(a)</enum><header>Funding</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary—</text><paragraph id="idf6b8afe850e44bd58ba7e58133cc4e72"><enum>(1)</enum><text>for deposit in the Tule River Tribe Water Development Projects Account $518,000,000, to be available until expended, withdrawn, or reverted to the general fund of the Treasury; and</text></paragraph><paragraph id="ida512a2bc81024b2688967e35d843c260"><enum>(2)</enum><text>for deposit in the Tule River Tribe OM&amp;R Account $50,000,000, to be available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></paragraph></subsection><subsection id="id0922b2565b6540a09f7d49d705af1c9a"><enum>(b)</enum><header>Fluctuation in costs</header><paragraph id="idb2322bac8bf749248c9300e05df80d5e"><enum>(1)</enum><header>In general</header><text>The amounts authorized to be appropriated under subsection (a) shall be increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs occurring after November 1, 2020, as indicated by the Bureau of Reclamation Construction Cost Index—Composite Trend.</text></paragraph><paragraph id="id5ab6949c105042bcbeb52b4fd33b1b68"><enum>(2)</enum><header>Construction costs adjustment</header><text>The amounts authorized to be appropriated under subsection (a) shall be adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></paragraph><paragraph id="id6d2aee6c2f744039974bc327c8fc998f"><enum>(3)</enum><header>Repetition</header><text>The adjustment process under this subsection shall be repeated for each subsequent amount appropriated until the amount authorized, as adjusted, has been appropriated.</text></paragraph><paragraph id="idb38317048d8f4618bb6681092dd7580d"><enum>(4)</enum><header>Period of indexing</header><text>The period of indexing adjustment under this subsection for any increment of funding shall end on the date on which the funds are deposited into the Trust Fund.</text></paragraph></subsection></section><section id="id00d5c26d2ca4456ab46d6cc114b6cbe5"><enum>8.</enum><header>Transfer of land into trust</header><subsection id="id21337e141f694ced9ffa1bd0985e1c3e"><enum>(a)</enum><header>Transfer of land to trust</header><paragraph id="id9ba8e8e39fee4f4aa7fa4cdb9c36a8ba"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights, and the requirements of this subsection, all right, title, and interest of the United States in and to the land described in paragraph (2) shall be held in trust by the United States for the benefit of the Tribe as part of the Reservation upon the Enforceability Date, provided that the Tribal fee land described in paragraph (2)(C)—</text><subparagraph id="ide2858848b83342c5b8d8b8ed4a550211"><enum>(A)</enum><text>is free from any liens, encumbrances, or other infirmities; and</text></subparagraph><subparagraph id="id32852aec10ca46d0a8f0ca5cca818fde"><enum>(B)</enum><text>has no existing evidence of any hazardous substances or other environmental liability.</text></subparagraph></paragraph><paragraph id="id1de2cf5c794b493fa1d733f31d607769"><enum>(2)</enum><header>Lands to be held in trust</header><text>The land referred to in paragraph (1) is the following:</text><subparagraph id="id1c456f5eb5f749458a060d7928d55469"><enum>(A)</enum><header>Bureau of Land Management lands</header><clause id="id9eca5f82b1294dcb9b44c72198085f8b" commented="no"><enum>(i)</enum><text>Approximately 26.15 acres of land located in T. 22 S., R. 29 E., sec. 35, Lot 9.</text></clause><clause id="id98bd465bb971462e9476fd8766ae1ed8" commented="no"><enum>(ii)</enum><text>Approximately 85.50 acres of land located in T. 22 S., R. 29 E., sec. 35, Lots 6 and 7.</text></clause><clause id="idc067226401364d4cb12e059c38496941" commented="no"><enum>(iii)</enum><text>Approximately 38.77 acres of land located in— </text><subclause commented="no" id="id627620F170594854BDB3824DD1585711"><enum>(I)</enum><text>T. 22 S., R. 30 E., sec. 30, Lot 1; 76.67 feet to the south line of State Route 190 as described in that Grant Deed to the State of California, recorded February 14, 1958, in Volume 2038, page 562, Tulare County Official Records; thence (4) north 0° 22’ 28” east, 73.59 feet to the north line of the SE<fraction>1/4</fraction> of the NW<fraction>1/4</fraction> of such sec. 3; thence (5) south 89° 37’ 32” east, along such north line, 89.77 feet to the center-north sixteenth corner of such sec. 3; thence (6) south 0° 49’ 43” west, along such east line of the NW<fraction>1/4</fraction> of such sec. 3, a distance of 222.06 feet to Divide distances by 0.999971 to convert to ground distances.</text></clause></subparagraph></paragraph></subsection><subsection id="idf898933e873f445ab6105c6f0cb6955e"><enum>(b)</enum><header>Terms and conditions</header><paragraph id="idc45f864d247840349cde154fb165d49b"><enum>(1)</enum><header>Existing authorizations</header><text>Any Federal land transferred under this section shall be conveyed and taken into trust subject to valid existing rights, contracts, leases, permits, and rights-of-way, unless the holder of the right, contract, lease, permit, or right-of-way requests an earlier termination in accordance with existing law. The Bureau of Indian Affairs shall assume all benefits and obligations of the previous land management agency under such existing rights, contracts, leases, permits, or rights-of-way, and shall disburse to the Tribe any amounts that accrue to the United States from such rights, contracts, leases, permits, or rights-of-ways after the date of transfer from any sale, bonus, royalty, or rental relating to that land in the same manner as amounts received from other land held by the Secretary in trust for the Tribe.</text></paragraph><paragraph id="id12b10c3e6b4145458a7c04a0a793821a"><enum>(2)</enum><header>Improvements</header><text>Any improvements constituting personal property, as defined by State law, belonging to the holder of a right, contract, lease, permit, or right-of-way on lands transferred under this section shall remain the property of the holder and shall be removed not later than 90 days after the date on which the right, contract, lease, permit, or right-of-way expires, unless the Tribe and the holder agree otherwise. Any such property remaining beyond the 90-day period shall become the property of the Tribe and shall be subject to removal and disposition at the Tribe’s discretion. The holder shall be liable for the costs the Tribe incurs in removing and disposing of the property.</text></paragraph></subsection><subsection id="id26c1736ef533458f84634df801e2c325"><enum>(c)</enum><header>Withdrawal of Federal lands</header><paragraph id="idf4578cf28a7144859f851c3a000b0861"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights, effective on the date of enactment of this Act, all Federal lands within the parcels described in subsection (a)(2) are withdrawn from all forms of—</text><subparagraph id="idf4ca9a3b27fc43b89479734b3de5117a"><enum>(A)</enum><text>entry, appropriation, or disposal under the public land laws;</text></subparagraph><subparagraph id="id041564b5b5974645b259521392a1f899"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="id48c5452349bf42689dec67557bb6bd9d"><enum>(C)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text></subparagraph></paragraph><paragraph id="id97a57e86e4434e279a523cef2580dcb3"><enum>(2)</enum><header>Expiration</header><text>The withdrawals pursuant to paragraph (1) shall terminate on the date that the Secretary takes the lands into trust for the benefit of the Tribe pursuant to subsection (a)(1).</text></paragraph></subsection><subsection id="iddd42cd3c2a1544a8bc7d0c40adf91b03"><enum>(d)</enum><header>Technical corrections</header><text>Notwithstanding the descriptions of the parcels of land in subsection (a)(2), the United States may, with the consent of the Tribe, make technical corrections to the legal land descriptions to more specifically identify the parcels to be exchanged.</text></subsection><subsection id="idc79c987a6f394b21bc6adaf9c2c28220"><enum>(e)</enum><header>Survey</header><paragraph id="ide739a9dc437d4674b1670296370d082d"><enum>(1)</enum><text>Unless the United States or the Tribe requests an additional survey for the transferred land or a technical correction is made under subsection (d), the description of land under this section shall be controlling.</text></paragraph><paragraph id="id3fd2565a70974fbb99de18ce94311329"><enum>(2)</enum><text>If the United States or the Tribe requests an additional survey, that survey shall control the total acreage to be transferred into trust under this section.</text></paragraph><paragraph id="id6baaa381a68c490fa0b6790ad05788f7"><enum>(3)</enum><text>The Secretary or the Secretary of Agriculture shall provide such assistance as may be appropriate—</text><subparagraph id="id8d1432e129b44ac8a78e53407e05d59f"><enum>(A)</enum><text>to conduct additional surveys of the transferred land; and</text></subparagraph><subparagraph id="id9a608798d74c4406a63196ead2d7550f"><enum>(B)</enum><text>to satisfy administrative requirements necessary to accomplish the land transfers under this section.</text></subparagraph></paragraph></subsection><subsection id="idbd05ed0320014b7d96dfc0499a123ab0"><enum>(f)</enum><header>Date of transfer</header><text>The Secretary shall issue trust deeds for all land transfers under this section by not later than 10 years after the Enforceability Date.</text></subsection><subsection id="id72273d4f965e4267acd90f3ccb44f488"><enum>(g)</enum><header>Restriction on gaming</header><text>Lands taken into trust pursuant to this section shall not be considered to have been taken into trust for, nor eligible for, class II gaming or class III gaming (as those terms are defined in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>)).</text></subsection><subsection id="idf9f968aff66b494ea61e172b828f1e3b" commented="no"><enum>(h)</enum><header>Status of water rights on transferred lands</header><text>Any water rights associated with lands transferred pursuant to subparagraphs (A) through (C) of subsection (a)(2) shall be held in trust for the Tribe but shall not be included in the Tribal Water Right.</text></subsection></section><section id="id3ee904ba17d245d18988a9be61a7092e"><enum>9.</enum><header>Satisfaction of claims</header><text display-inline="no-display-inline">The benefits provided under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of any claim of the Tribe against the United States that is waived and released by the Tribe under section 10(a).</text></section><section id="id48f278a75e9c4a359cf29056c74585ff"><enum>10.</enum><header>Waivers and releases of claims</header><subsection id="id54d7810d85994aafb5c6c7d4deea9ad0"><enum>(a)</enum><header>In general</header><paragraph id="id3a75dc7dfdbf4a32a3a80e55eb9c3794"><enum>(1)</enum><header>Waivers and releases of claims by the Tribe and the United States as trustee for the Tribe</header><text>Subject to the reservation of rights and retention of claims set forth in subsection (c), as consideration for recognition of the Tribe’s Tribal Water Right and other benefits described in the 2007 Agreement and this Act, the Tribe and the United States, acting as trustee for the Tribe, shall execute a waiver and release of all claims for the following:</text><subparagraph id="id12c182aa20c5477a8f581000f624b5b7"><enum>(A)</enum><text>All claims for water rights within the State of California based on any and all legal theories that the Tribe or the United States acting as trustee for the Tribe, asserted or could have asserted in any proceeding, including a general stream adjudication, on or before the Enforceability Date, except to the extent that such rights are recognized in the 2007 Agreement and this Act.</text></subparagraph><subparagraph id="ide9bb88f42bdb440aa32006fe69a7196d"><enum>(B)</enum><text>All claims for damages, losses, or injuries to water rights or claims of interference with, diversion, or taking of water rights (including claims for injury to lands resulting from such damages, losses, injuries, interference with, diversion, or taking of water rights) within California against the State, or any person, entity, corporation, or municipality, that accrued at any time up to and including the Enforceability Date.</text></subparagraph></paragraph><paragraph id="id9b5da1b6a025452e86e34e6c447b3f79"><enum>(2)</enum><header>Waiver and release of claims by the Tribe against the United States</header><text>Subject to the reservation of rights and retention of claims under subsection (c), the Tribe shall execute a waiver and release of all claims against the United States (including any agency or employee of the United States) for water rights within the State of California first arising before the Enforceability Date relating to—</text><subparagraph id="idf52fa2b13d7b4aabb3b81fa93b4304ae"><enum>(A)</enum><text>water rights within the State of California that the United States, acting as trustee for the Tribe, asserted or could have asserted in any proceeding, including a general stream adjudication, except to the extent that such rights are recognized as part of the Tribal Water Right under this Act;</text></subparagraph><subparagraph id="ide0f35cd701c544e59e591465a44fb37b"><enum>(B)</enum><text>foregone benefits from nontribal use of water, on and off the Reservation (including water from all sources and for all uses);</text></subparagraph><subparagraph id="id1fb4848798d7445685515b551581f0f5"><enum>(C)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to loss of water or water rights (including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights, due to loss of water or water rights, claims relating to interference with, diversion, or taking of water, or claims relating to a failure to protect, acquire, replace, or develop water, water rights, or water infrastructure) within the State of California;</text></subparagraph><subparagraph id="idfc9686ac05304c5dbd0b547b313a10b1"><enum>(D)</enum><text>a failure to establish or provide a municipal rural or industrial water delivery system on the Reservation;</text></subparagraph><subparagraph id="id27a76bc3a8c947d4b6dfec8b5f4039db"><enum>(E)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to construction, operation, and management of irrigation projects on the Reservation and other Federal land and facilities (including damages, losses, or injuries to fish habitat, wildlife, and wildlife habitat);</text></subparagraph><subparagraph id="id595000bb2ca94700bad76bafabf90be0"><enum>(F)</enum><text>failure to provide for operation, maintenance, or deferred maintenance for any irrigation system or irrigation project;</text></subparagraph><subparagraph id="idd05d12b5dbf24cea8b192b57f303bef1"><enum>(G)</enum><text>failure to provide a dam safety improvement to a dam on the Reservation;</text></subparagraph><subparagraph id="idcee445815e8b4525b45a0ffc31015bed"><enum>(H)</enum><text>the litigation of claims relating to any water rights of the Tribe within the State of California;</text></subparagraph><subparagraph id="id681a3983328c4e9d828465b47916002d"><enum>(I)</enum><text>the negotiation, execution, or adoption of the 2007 Agreement (including exhibits A–F) and this Act; </text></subparagraph><subparagraph id="idbc94f6caf28349c9a1528ff8347ce438"><enum>(J)</enum><text>the negotiation, execution, or adoption of operational rules referred to in Article 3.4 of the 2007 Agreement in connection with any reservoir locations, including any claims related to the resolution of operational rules pursuant to the dispute resolution processes set forth in the Article 8 of the 2007 Agreement, including claims arising after the Enforceability Date; and</text></subparagraph><subparagraph id="idad63dd60fffd46d6b1dda5ecdf1964c9"><enum>(K)</enum><text>claims related to the creation or reduction of the Reservation, including any claims relating to the failure to ratify any treaties and any claims that any particular lands were intended to be set aside as a permanent homeland for the Tribe but were not included as part of the present Reservation.</text></subparagraph></paragraph></subsection><subsection id="id06ff1f5df5c54df0815943108dbee1ee" commented="no"><enum>(b)</enum><header>Effectiveness</header><text>The waivers and releases under subsection (a) shall take effect on the Enforceability Date.</text></subsection><subsection id="id0842a15e88eb443e98cf610f827b69a3"><enum>(c)</enum><header>Reservation of rights and retention of claims</header><text>Notwithstanding the waivers and releases under subsection (a), the Tribe and the United States, acting as trustee for the Tribe, shall retain—</text><paragraph id="id4259092fcab34f19b5c2e7f64b7324b4"><enum>(1)</enum><text>all claims relating to the enforcement of, or claims accruing after the Enforceability Date relating to water rights recognized under the 2007 Agreement, any final court decree entered in the Federal District Court for the Eastern District of California, or this Act; </text></paragraph><paragraph id="id9a18271cb00a4582837f606195bc959f"><enum>(2)</enum><text>all claims relating to the right to use and protect water rights acquired after the date of enactment of this Act;</text></paragraph><paragraph id="id7f5066e2db13465fb5b6aa095b79a797"><enum>(3)</enum><text>claims regarding the quality of water under—</text><subparagraph id="idcab3e76b755d4a21b636d422bc90191e"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>), including claims for damages to natural resources;</text></subparagraph><subparagraph id="id0056d969191c4f95a1ca011ca9e6a4e6"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="ide41bf547124840df8a92626127d6b04d"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>); and</text></subparagraph><subparagraph id="id730c1be825c04380a20c7bc6a46da4ee"><enum>(D)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (C);</text></subparagraph></paragraph><paragraph id="idb67ebb6cfeb748809612c9651c0e0b64"><enum>(4)</enum><text>all claims for damage, loss, or injury to land or natural resources that are not due to loss of water or water rights, including hunting, fishing, gathering, or cultural rights; and</text></paragraph><paragraph id="id25c832d66bc74b9280f639ce4235057e"><enum>(5)</enum><text>all rights, remedies, privileges, immunities, and powers not specifically waived and released pursuant to this Act or the 2007 Agreement.</text></paragraph></subsection><subsection id="id9ba5de5187484c6f89deab80548512b0"><enum>(d)</enum><header>Effect of 2007 Agreement and Act</header><text>Nothing in the 2007 Agreement or this Act—</text><paragraph id="id08a4124b8c61416b8e4f53f7075290c6"><enum>(1)</enum><text>affects the authority of the Tribe to enforce the laws of the Tribe, including with respect to environmental protections or reduces or extends the sovereignty (including civil and criminal jurisdiction) of any government entity;</text></paragraph><paragraph id="idaca0aade7b964ee6bc046ab89dfed9ae"><enum>(2)</enum><text>affects the ability of the United States, acting as sovereign, to carry out any activity authorized by law, including—</text><subparagraph id="idaac8e273b48e45e9873319a1a17fa8c6"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></subparagraph><subparagraph id="id5897084763f24fadbd80467eb7e3a3fb"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="id5526fa53dbd6479b87708ef3713b6c8b"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); </text></subparagraph><subparagraph id="id7a781a9e227b45069ccbe6c1b960c3cc"><enum>(D)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id5872dc8d069b437e8f95ed6bc05552b3"><enum>(E)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (D);</text></subparagraph></paragraph><paragraph id="id854EC3575F1D4BD49AA3D1C9C363AFF6"><enum>(3)</enum><text>affects the ability of the United States to act as trustee for any other Indian Tribe or an allotee of any other Indian Tribe;</text></paragraph><paragraph id="id946937cb6efc436f83b62b2b6af0da46"><enum>(4)</enum><text>confers jurisdiction on any State court—</text><subparagraph id="id0fd9e59455a64b33aab5e70d6067fe0a"><enum>(A)</enum><text>to interpret Federal law relating to health, safety, or the environment;</text></subparagraph><subparagraph id="idabd815bd39af48dcacdc93c2a2d8660f"><enum>(B)</enum><text>to determine the duties of the United States or any other party under Federal law regarding health, safety, or the environment;</text></subparagraph><subparagraph id="id9d6971d4f21c42f5bc29f1b1f2c4611c"><enum>(C)</enum><text>to conduct judicial review of any Federal agency action; or</text></subparagraph><subparagraph id="idd97eafc2477042a4b6b2a7ecb8924198"><enum>(D)</enum><text>to interpret Tribal law; or</text></subparagraph></paragraph><paragraph id="idedc02e8a55454e1c9eb16addb177a15f"><enum>(5)</enum><text>waives any claim of a member of the Tribe in an individual capacity that does not derive from a right of the Tribe.</text></paragraph></subsection><subsection id="idfca46e172249486382a5ad7c317d3884"><enum>(e)</enum><header>Tolling of claims</header><paragraph id="id7fcda28d9f3141daa1d66afbcc622b28"><enum>(1)</enum><header>In general</header><text>Each applicable period of limitation and time-based equitable defense relating to a claim described in this section shall be tolled for the period beginning on the date of enactment of this Act and ending on the Enforceability Date.</text></paragraph><paragraph id="idc4c3f1ee5a834d87b7f9d94d2e72ef97"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection revives any claim or tolls any period of limitation or time-based equitable defense that expired before the date of enactment of this Act.</text></paragraph><paragraph id="id9049b1df075a452392a6f617d27b16fc"><enum>(3)</enum><header>Limitation</header><text>Nothing in this section precludes the tolling of any period of limitations or any time-based equitable defense under any other applicable law.</text></paragraph></subsection><subsection id="id7b3160a7150943a68273dceb14568877"><enum>(f)</enum><header>Expiration</header><paragraph id="id3413e6c070264a05ac00796f7fe5c0f4"><enum>(1)</enum><header>In general</header><text>This Act shall expire in any case in which the Secretary fails to publish a statement of findings under section 11 by not later than—</text><subparagraph id="ideb5229e163b44c6e879a882dbb47ed45"><enum>(A)</enum><text>8 years from the date of enactment of this Act; or</text></subparagraph><subparagraph id="id8afe71a65bfc4d159fbb08bb5db6eff6"><enum>(B)</enum><text>such alternative later date as is agreed to by the Tribe and the Secretary, after providing reasonable notice to the State of California.</text></subparagraph></paragraph><paragraph id="idd0b11b6994164493a57ab9022f9dfa7d"><enum>(2)</enum><header>Consequences</header><text>If this Act expires under paragraph (1)—</text><subparagraph id="id6903cfd12f484f1f95969372a19a8744"><enum>(A)</enum><text>the waivers and releases under subsection (a) shall—</text><clause id="idd017a57751b34ce8addc641efba1f6cf"><enum>(i)</enum><text>expire; and</text></clause><clause id="id1e89f1cc8d08414397ae54c99a23e9cd"><enum>(ii)</enum><text>have no further force or effect;</text></clause></subparagraph><subparagraph id="id2288ed37ba844558a507d96731efc3d4"><enum>(B)</enum><text>the authorization, ratification, confirmation, and execution of the 2007 Agreement under section 4 shall no longer be effective;</text></subparagraph><subparagraph id="idb8ea078cd7e24105917acc53a74fda84"><enum>(C)</enum><text>any action carried out by the Secretary, and any contract or agreement entered into pursuant to this Act, shall be void;</text></subparagraph><subparagraph id="id4a951be91e87496c9cbbc879d892dd76"><enum>(D)</enum><text>any unexpended Federal funds appropriated or made available to carry out the activities authorized by this Act, together with any interest earned on those funds, and any water rights or contracts to use water and title to other property acquired or constructed with Federal funds appropriated or made available to carry out the activities authorized by this Act shall be returned to the Federal Government, unless otherwise agreed to by the Tribe and the United States and approved by Congress; and</text></subparagraph><subparagraph id="id7cf5bbf1c3d64688b7a48b0eaf9c4282"><enum>(E)</enum><text>except for Federal funds used to acquire or construct property that is returned to the Federal Government under subparagraph (D), the United States shall be entitled to offset any Federal funds made available to carry out this Act that were expended or withdrawn, or any funds made available to carry out this Act from other Federal authorized sources, together with any interest accrued on those funds, against any claims against the United States—</text><clause id="id4e8825d406894b62ae1053dbdb055561"><enum>(i)</enum><text>relating to—</text><subclause id="id2090754018c04c12b930aacb861ed271"><enum>(I)</enum><text>water rights in the State of California asserted by—</text><item id="ida8bfe491b2af4ddc9896a72e8672d12a"><enum>(aa)</enum><text>the Tribe; or</text></item><item id="idcf9daf960b12490881e1ab07125ad031"><enum>(bb)</enum><text>any user of the Tribal Water Right; or</text></item></subclause><subclause id="id317868afb40445de87feaba8cc57b29c"><enum>(II)</enum><text>any other matter covered by subsection (a)(2); or</text></subclause></clause><clause id="id2e8c171921e04b6e9fe549e199bd3e5f"><enum>(ii)</enum><text>in any future settlement of water rights of the Tribe.</text></clause></subparagraph></paragraph></subsection></section><section id="id17b4d7a406534e27891e1df7f1bd22e0"><enum>11.</enum><header>Enforceability Date</header><text display-inline="no-display-inline">The Enforceability Date shall be the date on which the Secretary publishes in the Federal Register a statement of findings that—</text><paragraph id="id7162ef288701467ea66fb09237d5a657"><enum>(1)</enum><text>to the extent that the 2007 Agreement conflicts with the Act, the 2007 Agreement has been amended to conform with this Act;</text></paragraph><paragraph id="iddd7af3b66fae484c94ed7c9e3e24f6ad"><enum>(2)</enum><text>the 2007 Agreement, so revised, includes waivers and releases of claims set forth in section 10 and has been executed by the parties, including the United States;</text></paragraph><paragraph id="id816423dba15e402ba33b53e18d13665c"><enum>(3)</enum><text>a final judgment and decree approving the 2007 Agreement and binding all parties to the action has been entered by the Court, and all appeals have been exhausted;</text></paragraph><paragraph id="id966c2978d7cc4eab81194011ea2c1430"><enum>(4)</enum><text>all of the amounts authorized to be appropriated under section 7(a) have been appropriated and deposited in the designated accounts; and</text></paragraph><paragraph id="id5407aba14acc498bb41b280e91288d48"><enum>(5)</enum><text>the waivers and releases under section 10(a) have been executed by the Tribe and the Secretary.</text></paragraph></section><section id="id6d372048662d4afeaf637a22f0ebfb54"><enum>12.</enum><header>Binding effect; judicial approval; enforceability</header><subsection id="idcc9d6e5af0ca4eadb5113b0fc936c322"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the Secretary has executed the 2007 Agreement, the Attorney General of the United States shall file suit in the Court requesting the entry of a final judgement and decree approving the Tribal Water Right and the 2007 Agreement. The Tribe and the Downstream Water Users shall be named as parties to the suit.</text></subsection><subsection id="ida1111350b16c4c7b94e72713eafdf21d"><enum>(b)</enum><header>Judicial approval</header><text>The Court shall have exclusive jurisdiction to review and determine whether to approve the 2007 Agreement, and over any cause of action initiated by any party to the 2007 Agreement arising from a dispute over the interpretation of the Agreement or this legislation, and any cause of action initiated by any party to the 2007 Agreement for the enforcement of Agreement.</text></subsection><subsection id="iddd5efe69c68e4a8981501691db407447"><enum>(c)</enum><header>Operation rules</header><text>The Court shall have jurisdiction over any cause of action initiated by any party to the 2007 Agreement arising from the failure of the parties to reach agreement on operation rules for any reservoir and shall establish a procedure under which a mediator is appointed by the Court to assist the parties in resolving issues regarding operation rules for any reservoir. If the Court appointed mediation does not, after a reasonable amount of time as determined by the Court, result in an agreed set of reservoir operation rules, the Court shall determine which set of reservoir operation rules shall govern operation of the reservoir by determining which of the proffered set of operation rules, if implemented, would be the most effective by meeting the criteria set forth in section 8.2.B(3)(a) of the 2007 Agreement. Once the Court selects operation rules pursuant to the standard set forth above, such rules shall thereafter control and shall be implemented by the parties pursuant to the terms directed by the Court.</text></subsection></section><section id="idfacafe0dbe144826a594f1e0422f2c15"><enum>13.</enum><header>Miscellaneous provisions</header><subsection id="idad4df57ee75e431d9bcc748451348ba5"><enum>(a)</enum><header>Waiver of sovereign immunity by the United States</header><text>Nothing in this Act waives the sovereign immunity of the United States.</text></subsection><subsection id="ide6a0779bd501452ba5ded48156a468b2"><enum>(b)</enum><header>Other Tribes not adversely affected</header><text>Nothing in this Act quantifies or diminishes any land or water right, or any claim or entitlement to land or water, of an Indian Tribe, band, or community other than the Tribe.</text></subsection><subsection id="id35f48e4541934133b05749cb2f1a1760"><enum>(c)</enum><header>Effect on current law</header><text>Nothing in this Act affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.</text></subsection><subsection id="ide05a95a6782f474abe717774a6fd92fa"><enum>(d)</enum><header>Conflict</header><text>In the event of a conflict between the 2007 Agreement and this Act, this Act shall control. </text></subsection></section><section id="id5E69C7F1D76E4B98A35A376F35C1A717"><enum>14.</enum><header>Antideficiency</header><text display-inline="no-display-inline"> The United States shall not be liable for any failure to carry out any obligation or activity authorized by this Act, including any obligation or activity under the 2007 Agreement if adequate appropriations are not provided by Congress expressly to carry out the purposes of this Act. </text></section></legis-body></bill>
