<official-title>To amend title 49, United States Code, to exempt employees in certain farm-related service industries and employees of State, local, and Tribal governments from entry-level driver training requirements for operating a commercial motor vehicle and allow States to issue restricted commercial driver’s licenses to owners and employees of certain small businesses, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trucking Regulations Unduly Constricting Known Service-providers Act of 2022</short-title></quote> or the <quote><short-title>TRUCKS Act of 2022</short-title></quote>.</text></section> <section id="id7157B4E9023A400B8A4FAC28F440003A"><enum>2.</enum><header>Entry-level driver training</header> <subsection id="id6CE363F63850470BA6502F042A58ABF4"><enum>(a)</enum><header>In general</header><text>Section 31305 of title 49, United States Code, is amended—</text>
<paragraph id="id9D6482D353BD464A85154BF7345D8D98" commented="no"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), in the first sentence, by inserting <quote>(referred to in this section as the <term>Secretary</term>)</quote> after <quote>Secretary of Transportation</quote>; and</text></paragraph> <paragraph id="id10A786F36A1244E1A5C4331152998E08"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id0576AE6EC79D49E08717FCBB45D04C78">
<subsection id="id77969EFFDED3402299A0593FF1AB9D5B"><enum>(e)</enum><header>Exemption from entry-Level training requirements</header>
<paragraph commented="no" display-inline="no-display-inline" id="idB242FD3E261549D29EE8093FE3A94EE9"><enum>(1)</enum><header>Definition of Tribal government</header><text>In this subsection, the term <term>Tribal government</term> means the governing body of an Indian Tribe (as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></paragraph> <paragraph id="id805C24F156E14C859853E357E7DFBB2A"><enum>(2)</enum><header>Exemption</header><text>A State may exempt from all entry-level training requirements established under subsection (c) any individual who is—</text>
<subparagraph id="id7BE5B9D1DF95400EBF6378B53063A7F4"><enum>(A)</enum><text>an employee of—</text> <clause id="id5241E31FC5954CAC847576A9866E0962"><enum>(i)</enum><text>an agri-chemical business;</text></clause>
<clause id="idDDC547F6F1954F26B514D834EF33FA83"><enum>(ii)</enum><text>a custom harvester;</text></clause> <clause id="id0A32DEF4DF1141A4B185DE31F7C2D6E4"><enum>(iii)</enum><text>a farm retail outlet or supplier;</text></clause>
<clause id="idFF771C7E95F84898B5C20999E232831E"><enum>(iv)</enum><text>a livestock feeder; or</text></clause> <clause id="id042C69DAFFFF4B47B24271198CBC6FEF"><enum>(v)</enum><text>any other farm-related service industry that the Secretary, by regulation, determines to be appropriate; or</text></clause></subparagraph>
<subparagraph id="idD9451A9AB1AF46049568E4762F0BFD3C"><enum>(B)</enum><text>an employee of—</text> <clause id="id39EC141C5A8247088D52C2F3AE83C3BD"><enum>(i)</enum><text>the State;</text></clause>
<clause id="id800568F0294C40F9B9F3A3443A2C82D9"><enum>(ii)</enum><text>any unit of local government in the State, including a county (or equivalent jurisdiction); or</text></clause> <clause id="id4862FAE94F9F4FEE80109F693B77C59D"><enum>(iii)</enum><text>a Tribal government.</text></clause></subparagraph></paragraph>
<paragraph display-inline="no-display-inline" commented="no" id="id49366F9AF99A4B3B9D275EF52C8F7398"><enum>(3)</enum><header>Application</header><text>An exemption under this subsection may be applied with respect to—</text> <subparagraph display-inline="no-display-inline" commented="no" id="idAE998C5F1B074CA2908603D6D09E4B7B"><enum>(A)</enum><text>obtaining or upgrading a commercial driver’s license with respect to any commercial motor vehicle group described in section 383.91(a) of title 49, Code of Federal Regulations (or a successor regulation); and</text></subparagraph>
<subparagraph display-inline="no-display-inline" commented="no" id="id1652B17210734AACA922F97885E4796B"><enum>(B)</enum><text>obtaining an endorsement to operate any type of commercial motor vehicle described in section 383.93(b) of that title (or a successor regulation).</text></subparagraph></paragraph></subsection> <subsection id="idcf7165a8945742b89f578d9f4b72b381"><enum>(f)</enum><header>Restricted CDLs for small businesses</header> <paragraph id="idC83873B95D01460796862713102E83CD"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="idEE540A68D1AD47F1BFAB3E2FC5432E23"><enum>(A)</enum><header>Endorsement</header><text>The term <term>endorsement</term> has the meaning given the term in section 383.5 of title 49, Code of Federal Regulations (or a successor regulation).</text></subparagraph> <subparagraph id="idA208EB5BF4174B17B6C4F470952195AB"><enum>(B)</enum><header>Good driving record</header> <clause id="idC5CCF96AFB9A4FC6861A8C86C23B87A3"><enum>(i)</enum><header>In general</header><text>The term <term>good driving record</term>, with respect to a driver, means that, for the applicable period described in clause (ii), the driver—</text>
<subclause id="idD705681D62084E66B30FAB1D06E8CEC4"><enum>(I)</enum><text>subject to clause (iii), has not held more than 1 driver’s license;</text></subclause> <subclause id="id6ECB5EEF622E485B973A8BDBC93CFB6C"><enum>(II)</enum><text>has not had a driver’s license suspended, revoked, or canceled;</text></subclause>
<subclause id="id58BB905A06554BEFB37B92D84615C9AC"><enum>(III)</enum><text>has not been convicted of any disqualifying offense described in section 383.51(b) of title 49, Code of Federal Regulations (or a successor regulation), with respect to any type of motor vehicle described in that section;</text></subclause> <subclause id="id5E947F19867C4BB39EFD3942BC9076B2"><enum>(IV)</enum><text>has not been convicted of any serious traffic violation with respect to any type of motor vehicle;</text></subclause>
<subclause id="id5B13564D6A074D25B2C2C5CD61C730DE"><enum>(V)</enum><text>has not been convicted of any violation of a State or local law relating to motor vehicle traffic control (other than a parking violation) arising in connection with any traffic accident; and</text></subclause> <subclause id="id0E04CADC6141463D93F2599076F4360E"><enum>(VI)</enum><text>has no record of an accident with respect to which the driver was at fault.</text></subclause></clause>
<clause id="id1F0F1CD4050D49FC8B78FE9B77974691"><enum>(ii)</enum><header>Period described</header><text>The period referred to in clause (i) is—</text> <subclause id="id43DCE060EFB64C4FB5B5E89AA33519CD"><enum>(I)</enum><text>for a driver with not less than 1 year, and not more than 2 years, of driving experience, the period constituting the entire driving history of the driver; and</text></subclause>
<subclause id="id104E3BDA00574B7EA1ED970259893823"><enum>(II)</enum><text>for a driver with more than 2 years of driving experience, the 2-year period ending on, as applicable—</text> <item id="id7B01A12CA587494B9110704FF6480624"><enum>(aa)</enum><text>the date on which the driver is issued a restricted driver’s license under this subsection; or</text></item>
<item id="idC0E7AF18C07D41CC8E7FBD89FF6B75AA"><enum>(bb)</enum><text>the date on which the applicable restricted driver’s license issued under this subsection is renewed.</text></item></subclause></clause> <clause id="id0B0EC1600E4E40DCAE51901E5015DFAB" commented="no"><enum>(iii)</enum><header>Number of driver’s licenses</header><text>Subject to any applicable regulations promulgated or guidance issued by the Secretary, a State may consider certain combinations of driver’s or operator’s licenses, such as a regular license and a school bus license or a regular license and a restricted commercial driver’s license issued pursuant to this subsection, to be a single license for purposes of clause (i)(I), as the State determines to be appropriate.</text></clause></subparagraph>
<subparagraph id="id667E61C7BA054DB190D93AD309CE14D7"><enum>(C)</enum><header>Qualified applicant</header><text>The term <term>qualified applicant</term> means an applicant for a restricted commercial driver’s license who—</text> <clause id="id0F9B945FD26041C0AB46AF8150D00537"><enum>(i)</enum><text>is an owner or employee of a business that employs not more than 9 employees who hold a commercial driver’s license as of the date on which the restricted commercial driver’s license is issued, regardless of the total number of employees employed by the business;</text></clause>
<clause id="idD9507B116E16475AA29656F8C1833188"><enum>(ii)</enum><text>has held a driver’s license for at least 1 year as of the date on which the restricted commercial driver’s license is issued; and</text></clause> <clause id="idF88799BB50664760BFFFA962DB371FBC" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>has a good driving record.</text></clause></subparagraph>
<subparagraph id="id3C694EB3D63F4ECABDBBFC005A880D80"><enum>(D)</enum><header>Restricted commercial driver’s license</header><text>The term <term>restricted commercial driver’s license</term> means a commercial driver’s license that complies with, and is issued in compliance with, this subsection.</text></subparagraph></paragraph> <paragraph id="idd79ce099d5e5468391817759fd6ca00f"><enum>(2)</enum><header>Issuance of restricted CDL</header> <subparagraph id="idADFDF81656944C278948F95B0C05D169"><enum>(A)</enum><header>In general</header><text>A State may issue a restricted commercial driver’s license pursuant to this subsection only to a qualified applicant.</text></subparagraph>
<subparagraph id="idbbead2532c0e48ba984dcc9d73f3a720"><enum>(B)</enum><header>Commercial motor vehicle groups</header><text>A State may issue a restricted commercial driver’s license pursuant to this subsection with respect to any commercial motor vehicle group, or any combination of commercial motor vehicle groups, described in section 383.91(a) of title 49, Code of Federal Regulations (or a successor regulation), as the State determines to be appropriate. </text></subparagraph> <subparagraph id="id0716570819ED42F18E28EA0804D5E52E"><enum>(C)</enum><header>Waiver of entry-level training requirements</header><text>With respect to the issuance of a restricted commercial driver’s license to a qualified applicant pursuant to this subsection, a State may waive all entry-level training requirements established under subsection (c).</text></subparagraph></paragraph>
<paragraph id="idF88806113CDE4BABA5C06AD379C6EF47"><enum>(3)</enum><header>Requirement</header>
<subparagraph id="idE58A858B63E14286A841BE2E674AD83D"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this subsection, a restricted commercial driver’s license issued pursuant to this subsection, and the issuance of that restricted commercial driver’s license by a State, shall comply with all applicable requirements of—</text> <clause id="id7636DB0A55314594B27F85D329CF5AE6" commented="no"><enum>(i)</enum><text> this chapter; and</text></clause>
<clause id="idF178CC5266BE46FD8E793B2C57720521"><enum>(ii)</enum><text>part 383 of title 49, Code of Federal Regulations (or successor regulations).</text></clause></subparagraph> <subparagraph id="id3C02CF010AD3402D9324F2021EF0AB73"><enum>(B)</enum><header>Nonapplication of certain regulations</header><text>Sections 383.131, 383.133, and 383.135 of title 49, Code of Federal Regulations (or successor regulations), shall not apply with respect to a restricted commercial driver’s license, or the issuance of a restricted commercial driver’s license, pursuant to this subsection.</text></subparagraph></paragraph>
<paragraph id="id0f6425bcfdae4a38a0d7dc4aa20a3e14"><enum>(4)</enum><header>Endorsements and privileges</header>
<subparagraph id="id01A2E089F5934ED5A09F44179007BAF8"><enum>(A)</enum><header>In general</header><text>A restricted commercial driver’s license issued pursuant to this subsection shall not be issued with any endorsements on the license document. </text></subparagraph> <subparagraph id="id81DF9A24121341E080D6A4C3CB00D3EC" commented="no"><enum>(B)</enum><header>Tank vehicles and hazardous materials privileges</header><text>Notwithstanding any other provision of law (including regulations), a State may provide that the holder of a restricted commercial driver’s license issued pursuant to this subsection may drive vehicles carrying placarded quantities of hazardous materials of the type and in the quantities described in section 383.3(f)(3)(v) of title 49, Code of Federal Regulations (or a successor regulation), or in such lesser quantities as the State determines to be appropriate.</text></subparagraph></paragraph>
<paragraph id="id81590d918ae543b2b376cecfd155ebe2"><enum>(5)</enum><header>Renewal</header>
<subparagraph id="id04EF0DA1A07946E3B8228B7462D2D964"><enum>(A)</enum><header>Renewal cycle</header><text>A restricted commercial driver’s license issued pursuant to this subsection shall have the same renewal cycle as an unrestricted commercial driver’s license issued by the same State.</text></subparagraph> <subparagraph id="id14BDBA2EA75E4FECAA6A1E55BF5299BC"><enum>(B)</enum><header>Good driving record</header><text>Prior to renewal of a restricted commercial driver’s license issued under this subsection, the State issuing the restricted commercial driver’s license shall confirm that the holder of the restricted commercial driver’s license has a good driving record.</text></subparagraph></paragraph>
<paragraph id="idECE4559E6EE94481AA4E213A6DB4968A"><enum>(6)</enum><header>Reciprocity</header><text>A restricted commercial driver’s license issued pursuant to this subsection shall be accorded the same reciprocity as a commercial driver’s license meeting all of the requirements of part 383 of title 49, Code of Federal Regulations (or successor regulations).</text></paragraph> <paragraph id="idE5FD25DAC0EC4967830E887192F803F5"><enum>(7)</enum><header>Limitation on additional restrictions</header><text>Any restrictions imposed on a restricted commercial driver’s license issued pursuant to this subsection, the holder of such a license, or the issuance of such a license by a State shall not—</text>
<subparagraph id="id2A73231FBE5B4CBEB565022965B88273"><enum>(A)</enum><text>limit the use by the holder of the restricted commercial driver’s license in a motor vehicle that is not a commercial motor vehicle; or</text></subparagraph> <subparagraph id="id5DCA180C78D640AD95EB8026B19C61EE"><enum>(B)</enum><text>affect the power of a State to administer the driver licensing program of the State for operators of vehicles that are not commercial motor vehicles.</text></subparagraph></paragraph>
<paragraph id="id7b87414f10f1432d951d318009808ea4"><enum>(8)</enum><header>Prohibition</header><text>An individual may not hold a restricted commercial driver’s license issued pursuant to this subsection and an unrestricted commercial driver’s license at the same time.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="idF44B8EADF9C44334BDE1EB2C8A51B562" commented="no"><enum>(b)</enum><header>Commercial driver's license uniform standards</header><text>Section 31308(1) of title 49, United States Code, is amended, in the matter preceding subparagraph (A), by inserting <quote>except as otherwise provided in subsections (d) through (f) of section 31305 or any other provision of Federal law (including regulations),</quote> before <quote>an individual issued</quote>.</text></subsection></section>
