Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the establishment of a grazing management program on Federal land in Malheur County, Oregon, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Malheur Community Empowerment for the Owyhee Act</short-title></quote>.</text></section><section id="idcb32945fdf3b4fdb960071a76d0021a1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id75170e5dde9d437da37a476b86d37669"><enum>(1)</enum><header>Bureau</header><text>The term <term>Bureau</term> means the Bureau of Land Management.</text></paragraph><paragraph id="id5779b0f591d34884bc295733d5271875"><enum>(2)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of Reclamation.</text></paragraph><paragraph id="idde7b68365f504693ba6dc784fc20b719"><enum>(3)</enum><header>County</header><text>The term <term>County</term> means Malheur County, Oregon.</text></paragraph><paragraph id="idf698d0134d274c9fa0d7cf4226b8cde0"><enum>(4)</enum><header>Federal land</header><text>The term <term>Federal land</term> means land in the County managed by the Bureau.</text></paragraph><paragraph id="id30b9691effba42cdbdeb79136fdb1af0"><enum>(5)</enum><header>Long-term ecological health</header><text>The term <term>long-term ecological health</term>, with respect to an ecosystem, means the ability of the ecological processes of the ecosystem to function in a manner that maintains the composition, structure, activity, and resilience of the ecosystem over time, including an ecologically appropriate diversity of plant and animal communities, habitats, and conditions that are sustainable through successional processes. </text></paragraph><paragraph id="id1ee6f23ce99e44bf9a6fa5206f6f9c22"><enum>(6)</enum><header>Loop road</header><subparagraph id="id9d4a62ac09fd47e395b296981bf22a2b"><enum>(A)</enum><header>In general</header><text>The term <term>loop road</term> means a route managed and maintained by the Bureau or the County, as applicable, for the purpose of providing directed tourism and educational opportunities in the County.</text></subparagraph><subparagraph id="idfa80276d64714b5eac1464acb25ddb97"><enum>(B)</enum><header>Inclusion</header><text>The term <term>loop road</term> includes each of the roads described in paragraphs (2) through (5) of section 6(b).</text></subparagraph></paragraph><paragraph id="idce537a0455484a008c34ea94ed2f7eac"><enum>(7)</enum><header>Malheur CEO group</header><text>The term <term>Malheur CEO Group</term> means the Malheur Community Empowerment for Owyhee Group established under section 4(a).</text></paragraph><paragraph id="id1ca980b497bb4e2a8e37ebb6c4817e00"><enum>(8)</enum><header>Operational flexibility</header><text>The term <term>operational flexibility</term>, with respect to grazing on the Federal land, means any approved seasonal adjustments of livestock positioning for the purposes of that grazing pursuant to a flexible grazing use authorized under the program.</text></paragraph><paragraph id="id0204C1D2F42C4240A60CD54C66A24DAE"><enum>(9)</enum><header>Program</header><text>The term <quote>program</quote> means the Malheur County Grazing Management Program authorized under section 3(a).</text></paragraph><paragraph id="id2b5f9447af534fa68620f4e86d1f664b"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id230E2F27B4F44A5D89E133A48179937C"><enum>(11)</enum><header>State</header><text>The term <quote>State</quote> means the State of Oregon.</text></paragraph></section><section id="id7b253fb2390d4785a52a4b8f8463adda"><enum>3.</enum><header>Malheur County Grazing Management Program</header><subsection id="id8f0447e42bef4e8da8b4ff1b5267578d"><enum>(a)</enum><header>In general</header><text>The Secretary may carry out a grazing management program on the Federal land, to be known as the <quote>Malheur County Grazing Management Program</quote>, in accordance with the memorandum entitled <quote>Bureau of Land Management Instruction Memorandum 2018–109</quote>, to provide to authorized grazing permittees and lessees increased operational flexibility to improve the long-term ecological health of the Federal land.</text></subsection><subsection id="idbcb659761e754663a9bc27940104b96e"><enum>(b)</enum><header>Permit operational flexibility</header><paragraph id="id8dbc3b4d5c4243008e5c4aefd7ae8ce6"><enum>(1)</enum><header>Flexible grazing use alternative for a grazing permit or lease</header><text>For purposes of renewing a grazing permit or lease under the program, pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Secretary shall develop and analyze at least 1 alternative to provide operational flexibility in livestock grazing use to account for changing conditions.</text></paragraph><paragraph id="id7ec8a8713be04e8e97feffe68cd0ff03"><enum>(2)</enum><header>Interim flexible grazing use for a grazing permit or lease</header><text>For purposes of using operational flexibility pending the renewal of a grazing permit or lease under the program, the Bureau may authorize temporary changes in livestock grazing use in accordance with applicable laws (including regulations) after providing notice to the applicable individuals and entities described in paragraph (3). </text></paragraph><paragraph id="id3f021697b4654131bf90fdd7d4c83306"><enum>(3)</enum><header>Consultation</header><text>The Secretary shall develop alternatives under paragraph (1) in consultation with—</text><subparagraph id="idA56B1FC0622848BC9635A81AF252BDC5"><enum>(A)</enum><text>the applicable grazing permittee or lessee;</text></subparagraph><subparagraph id="idD69FC62AC36F497C80060E7C2D125954"><enum>(B)</enum><text>affected Federal and State agencies;</text></subparagraph><subparagraph id="id9AD55F00062F4992AAEAC4F72EC499A3"><enum>(C)</enum><text>the Malheur CEO Group;</text></subparagraph><subparagraph id="id22DBB144AC9C496BB1FFEA907227A1A2"><enum>(D)</enum><text>other landowners in the affected allotment; and</text></subparagraph><subparagraph id="id9D762CE812F84879A4B72B21D8C00D9C"><enum>(E)</enum><text>interested members of the public.</text></subparagraph></paragraph><paragraph id="idf873239f37e543b38c3cd68d109f2112"><enum>(4)</enum><header>Monitoring plans</header><subparagraph id="idd69819896cd84c1f93131b351d0de9cf"><enum>(A)</enum><header>In general</header><text>The Secretary shall develop cooperative rangeland monitoring plans and rangeland health objectives to apply to actions taken under paragraph (1) or (2) and to improve the long-term ecological health of the Federal land under the program, in consultation with grazing permittees or lessees and other individuals and entities described in paragraph (3).</text></subparagraph><subparagraph id="idf433c59a8cd14a3eb7e44117b43f4f14"><enum>(B)</enum><header>Requirements</header><text>A monitoring plan developed under subparagraph (A) shall—</text><clause id="id01557aa79c014e3eaee2c0afc9e6a385"><enum>(i)</enum><text>identify situations in which providing operational flexibility in grazing permit or lease uses is appropriate to improve long-term ecological health of the Federal land; </text></clause><clause id="id1E1450FB5D8D4C36950DCCE87028AF97"><enum>(ii)</enum><text>identify ways in which progress would be measured toward long-term ecological health of the Federal land; </text></clause><clause id="id51E9E5A0A4AC4E3D81319F5ED39334D5"><enum>(iii)</enum><text>include—</text><subclause id="id1024f03289124a96a1ed1da97a502878"><enum>(I)</enum><text>a description of the condition standards for which the monitoring is tracking, including baseline conditions and desired outcome conditions; </text></subclause><subclause id="id7a76fa6e85594ac7b20540e6dee661e5"><enum>(II)</enum><text>a description of monitoring methods and protocols;</text></subclause><subclause id="id90bb1cff88e744f1a2f7731fb9c68886"><enum>(III)</enum><text>a schedule for collecting data;</text></subclause><subclause id="id0e79ea437440414cb8b2525d715648f0"><enum>(IV)</enum><text>an identification of the responsible party for data collection and storage;</text></subclause><subclause id="idf4db87745a3a45668937a22d23ed6091"><enum>(V)</enum><text>an evaluation schedule;</text></subclause><subclause id="ida36771d9620a4ec3836156e2540c68d3"><enum>(VI)</enum><text>a description of the anticipated use of the data;</text></subclause><subclause id="idc9a4421456774c3db28693e49e01831b"><enum>(VII)</enum><text>provisions for adjusting any components of the monitoring plan; and</text></subclause><subclause id="id2bf7b812a8f74f999b6e9424d8f27a10"><enum>(VIII)</enum><text>a description of the method to communicate the criteria for adjusting livestock grazing use; and</text></subclause></clause><clause id="id07c4140707c24b7690a280615b04f286"><enum>(iv)</enum><text>provide for annual reports on the effects of operational flexibility in grazing permit or lease uses under the program.</text></clause></subparagraph></paragraph><paragraph id="id3f2047c369174861a07633bf6deb66d8"><enum>(5)</enum><header>Terms and conditions</header><subparagraph id="idb85f182c565d423eb5bacb27051cd37f"><enum>(A)</enum><header>Preferred alternative</header><text>If the Secretary determines that an alternative considered under the program that provides operational flexibility is the preferred alternative, the Secretary shall incorporate the alternative, including applicable monitoring plans developed under paragraph (4), into the terms and conditions of the applicable grazing permit or lease.</text></subparagraph><subparagraph id="idef1a1bb877c242e5a5cd7a2835233627"><enum>(B)</enum><header>Adjustments</header><text>Before implementing any measure for purposes of operational flexibility with respect to a grazing use authorized under the terms and conditions of a permit or lease with respect to which an alternative has been incorporated under subparagraph (A), the grazing permittee or lessee shall notify the Secretary in writing of the proposed adjustment.</text></subparagraph><subparagraph id="idbe97fe42bd384a4bb66da3179df7807f"><enum>(C)</enum><header>Additional requirements</header><text>The Secretary may include any other requirements in a permit or lease with respect to which an alternative has been incorporated under subparagraph (A) that the Secretary determines to be necessary.</text></subparagraph></paragraph></subsection><subsection id="id9fd1523c5ec54fafac48fdc7b7ca76ec"><enum>(c)</enum><header>Review; termination</header><paragraph id="idD2ECF5F6E32C415D81B1C359A05CC2F9"><enum>(1)</enum><header>Review</header><subparagraph id="ideafc347ae6c14403b7f25a73feb02d05"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), not earlier than the date that is 8 years after the date of enactment of this Act, the Secretary shall conduct a review of the program to determine whether the objectives of the program are being met. </text></subparagraph><subparagraph id="id3902b652bcd1430b934cdb0771066bb5"><enum>(B)</enum><header>No effect on program permits and leases</header><text>The review of the program under subparagraph (A) shall not affect the existence, renewal, or termination of a grazing permit or lease entered into under the program.</text></subparagraph></paragraph><paragraph id="id5aabcae2eac943cf9cf6d2689867ebb9"><enum>(2)</enum><header>Termination</header><text>If, based on the review conducted under paragraph (1), the Secretary determines that the objectives of the program are not being met, the Secretary shall, on the date that is 10 years after the date of enactment of this Act—</text><subparagraph id="id73EF123CE7A24ED9BD7131B882731D15"><enum>(A)</enum><text>modify the program in a manner to ensure that the objectives of the program would be met; or</text></subparagraph><subparagraph id="id2F1F794189A84D178AD15E6659EF4C19"><enum>(B)</enum><text>terminate the program.</text></subparagraph></paragraph></subsection><subsection id="id9b72b6b1f7c04b418adc2783d36f8316"><enum>(d)</enum><header>No effect on grazing rights or privileges</header><text>Nothing in this Act—</text><paragraph id="id29BFBC9A8F69412A8AE42B618BFA9559"><enum>(1)</enum><text>affects the rights or privileges provided under the Act of 10 June 28, 1934 (commonly known as the <quote>Taylor Grazing Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/43/315">43 U.S.C. 315 et seq.</external-xref>); or </text></paragraph><paragraph id="idC1EBA1ED39964A87B3D265D62EF3AB72"><enum>(2)</enum><text>requires the Secretary to consider modifying or terminating the classification of any existing grazing district on the Federal land in any subsequent plan or decision of the Secretary. </text></paragraph></subsection></section><section id="ida2790a5db3054692bab1b89a1ab99a7e"><enum>4.</enum><header>Malheur Community Empowerment for Owyhee Group</header><subsection id="idb82b462132064610b24e3a22f8ceaac2"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish an advisory group, to be known as the <quote>Malheur Community Empowerment for Owyhee Group</quote>—</text><paragraph id="ide95d289d989d4521a226cdd10b0e0888"><enum>(1)</enum><text>to provide to the Secretary advice and recommendations relating to the implementation of actions proposed to be carried out under this Act, including monitoring and operational flexibility of grazing use of the Federal land;</text></paragraph><paragraph id="idbb9568951e654baa9909b985ee23a45b"><enum>(2)</enum><text>to be listed as an interested party for pending Bureau management decisions on the Federal land under this Act; and</text></paragraph><paragraph id="id9d2bfea2d86b4cba8422f9489fcdd34f"><enum>(3)</enum><text>to provide advice and recommendations to the State and the County commissioners on economic development issues relating to the Federal land under this Act.</text></paragraph></subsection><subsection id="idacdc2d4c4f6648dd934c4e782056fbbe"><enum>(b)</enum><header>Membership</header><paragraph id="id162a7bdeb7494d879435069cfc8ccdf7"><enum>(1)</enum><header>In general</header><text>The Malheur CEO Group shall consist of—</text><subparagraph id="id13F81DE2398C4B05BBE395D684A4C035"><enum>(A)</enum><text>8 voting members, to be appointed by the Secretary, based on recommendations from the Vale District Bureau manager and the County commissioners, of whom—</text><clause id="id38a5096a47e349d3b6de9c1e3a142bbe"><enum>(i)</enum><text>3 shall be representatives of grazing permittees and lessees in the County;</text></clause><clause id="idf45f49a07e474479ae52f6050615a511"><enum>(ii)</enum><text>3 shall be representatives of other businesses or conservation or recreation organizations in the County, of whom at least 2 shall reside in the County; </text></clause><clause id="idad8be885a260400093d475604db09550"><enum>(iii)</enum><text>1 shall be a representative of the Burns Paiute Tribe; and</text></clause><clause id="ida87d06a65e9a480caf77cca52d37317a"><enum>(iv)</enum><text>1 shall be a representative of the Fort McDermott Tribe; and</text></clause></subparagraph><subparagraph id="id735101dd358c406691b4dcd809176101"><enum>(B)</enum><text> 4 nonvoting members, to be appointed by the Secretary, based on recommendations from the Vale District Bureau manager and the County commissioners, of whom—</text><clause id="id6DE96E7863204F638AD8FA7A5B71BE96"><enum>(i)</enum><text>1 shall be a representative of the Bureau Vale District;</text></clause><clause id="id79B7C641B3E744A58B569CA3F5667965"><enum>(ii)</enum><text>1 shall be a representative of the United States Fish and Wildlife Service;</text></clause><clause id="id11D2A526D1234EEDA37D987785D8D2FB"><enum>(iii)</enum><text>1 shall be a representative of the State; and</text></clause><clause id="id7B174E8BD28549359FD3602477AE0B2E"><enum>(iv)</enum><text>1 shall be a representative of the County.</text></clause></subparagraph></paragraph><paragraph id="id8b34ba90f4fc49ada5496de736649d1f"><enum>(2)</enum><header>Appointment</header><subparagraph id="id568847b1e34549adbb4dc85cb6713c6e"><enum>(A)</enum><header>Initial appointments</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall appoint the initial members of the Malheur CEO Group.</text></subparagraph><subparagraph id="idafb025b3189a44ed9ea6b5951baa3fd6"><enum>(B)</enum><header>Terms</header><text>Each member of the Malheur CEO Group shall serve for a term of 3 years.</text></subparagraph><subparagraph id="ida4024231779849f7b567f61a84964430"><enum>(C)</enum><header>Reappointment</header><text>A member of the Malheur CEO Group may be reappointed for 1 or more additional 3-year terms.</text></subparagraph><subparagraph id="id8349f025aca3416d9a80f0dcb4248524"><enum>(D)</enum><header>Vacancies</header><text>A vacancy on the Malheur CEO Group shall be filled—</text><clause id="id494908eb5eab41598c8a3b1f8a28cc31"><enum>(i)</enum><text>as soon as practicable after the vacancy occurs; and</text></clause><clause id="id375deddc1c7846e9bf70bc42befe61a8"><enum>(ii)</enum><text>in the same manner as the original appointment.</text></clause></subparagraph></paragraph><paragraph id="idbb8fbeca79894f84a76613533830f669"><enum>(3)</enum><header>Compensation and expenses</header><subparagraph id="idba6a4824eca6433b99cc2ff242b829ae"><enum>(A)</enum><header>Compensation</header><text>Members of the Malheur CEO Group shall serve without compensation.</text></subparagraph><subparagraph id="id6b7a82b5d7aa451eabb8418a51b715c1"><enum>(B)</enum><header>Travel expenses</header><text>Each member of the Malheur CEO Group shall receive from the Secretary travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="id4c642f2f16fa4172866aa8d4a0c79a74"><enum>(4)</enum><header>Chairperson</header><text>A chairperson shall be elected by a majority of the voting members of the Malheur CEO Group.</text></paragraph><paragraph id="id1121D1B42BE14F9D8C74FC14098FACCB"><enum>(5)</enum><header>Secretary</header><text>The representative from the Bureau Vale District appointed under paragraph (1)(B)(i) shall be—</text><subparagraph id="id22AA8226986540AB973C3A343934F58A"><enum>(A)</enum><text>the secretary and recordkeeper for the Malheur CEO Group; and </text></subparagraph><subparagraph id="idC01FD3E599C3435D96C6EEF3CEF04B8F"><enum>(B)</enum><text>responsible for convening meetings of the Malheur CEO Group.</text></subparagraph></paragraph></subsection><subsection id="id618591dea0054f40a9842bedeb3de632"><enum>(c)</enum><header>Duties</header><paragraph id="id961fc45431dc418e90368743bf03a016"><enum>(1)</enum><header>In general</header><text>The Malheur CEO Group shall—</text><subparagraph id="idfa907a5180c64f8b8b39f5685e9de9ad"><enum>(A)</enum><text>review any program project proposed to the Bureau by—</text><clause id="id4DF85AED0C7144B88DAE64B0FC8A3FD3"><enum>(i)</enum><text>a member of the Malheur CEO Group;</text></clause><clause id="idA87D2300CBE84FB8841805DC54DED76F"><enum>(ii)</enum><text>a grazing permittee or lessee on the Federal land; or </text></clause><clause id="idE6F434DE20F94301A87567C2E6D7AD8E"><enum>(iii)</enum><text>any other member of the public;</text></clause></subparagraph><subparagraph id="ide197ab187f7c4f36b70be3a4f4bc42a4"><enum>(B)</enum><text>subject to paragraph (2), propose program projects and funding recommendations to the Secretary under this section;</text></subparagraph><subparagraph id="id3bab5bcabc334e8bb1e035267038f9ee"><enum>(C)</enum><text>cooperate with appropriate officials of land management agencies in the County in recommending program projects consistent with purposes of this section; </text></subparagraph><subparagraph id="idb8f61653c8874fb59af3d6400de8aff8"><enum>(D)</enum><text>review program monitoring data and, in accordance with this subsection, recommend program project modifications, if appropriate; and </text></subparagraph><subparagraph id="id7c9b02823ea84519a081dc8191c69447"><enum>(E)</enum><text>provide frequent opportunities for citizens, organizations, Indian Tribes, land management agencies, and other interested parties to participate openly and meaningfully in program project development and implementation.</text></subparagraph></paragraph><paragraph id="id704a1e18d4854da685a71b0586f1ef4f"><enum>(2)</enum><header>Projects proposed to secretary</header><text>The Malheur CEO Group may propose a program project to the Secretary if the program project has been approved by a majority of the members voting at an official meeting of the Malheur CEO Group.</text></paragraph></subsection><subsection id="id659dcc0b3d214790ac28474c7911c234"><enum>(d)</enum><header>Meetings</header><paragraph id="id8ab182b030054844b472939f4dbf444c"><enum>(1)</enum><header>In general</header><text>A quorum is required for an official meeting of the Malheur CEO Group.</text></paragraph><paragraph id="idB1D2F7FBD54B42FBB65578D93768279A"><enum>(2)</enum><header>Biannual meetings</header><text>The Malheur CEO Group shall hold official meetings not less frequently than biannually.</text></paragraph><paragraph id="id1550F65DFC5645F19FF14B25F60D2F01"><enum>(3)</enum><header>Virtual meetings</header><text>An official meeting of the Malheur CEO Group may be held virtually.</text></paragraph><paragraph id="idd3be652f2e0f47bf85e2a85823e0d01a"><enum>(4)</enum><header>Quorum</header><text>A quorum of the Malheur CEO Group shall consist of a majority of the members of the Malheur CEO Group participating in person or virtually.</text></paragraph><paragraph id="id6b940006b635457293c5c19dbed34b66"><enum>(5)</enum><header>Open meetings</header><text>Each meeting of the Malheur CEO Group shall—</text><subparagraph id="idf959abbdabb248629d4a77e6a31099c0"><enum>(A)</enum><text>not later than the date that is 1 week before the date of the meeting, be announced—</text><clause id="id6116BC96FA824C548A3480A0B3ABE91A"><enum>(i)</enum><text>on the public website of the Bureau; and</text></clause><clause id="id5739D7357345494BA8DDFAF366B18A9E"><enum>(ii)</enum><text>in a local newspaper of record, as determined by the Secretary; and</text></clause></subparagraph><subparagraph id="idddb502924e7342ab87ac0e82b43baa86"><enum>(B)</enum><text>be held open to the public.</text></subparagraph></paragraph><paragraph id="id1542e7c43519471096fa89f8d62502c6"><enum>(6)</enum><header>Records</header><text>The secretary of the Malheur CEO Group described in subsection (b)(5) shall—</text><subparagraph id="id7d9514e3542b49b9b24d872e9e931f70"><enum>(A)</enum><text>maintain records of each official meeting of the Malheur CEO Group; and</text></subparagraph><subparagraph id="idfeb61194db2e4ea79462ea686622ed97"><enum>(B)</enum><text>make the records maintained under subparagraph (A) available for public inspection.</text></subparagraph></paragraph></subsection><subsection id="id7fb2acfe35fe422f9c5b57e8fea9505e"><enum>(e)</enum><header>Bylaws</header><paragraph id="id011d993c9b0d4b01bd1efd3ffbb31e3d"><enum>(1)</enum><header>In general</header><text>The members of the Malheur CEO Group shall establish bylaws for the Malheur CEO Group.</text></paragraph><paragraph id="id19b5048a89f34178bd6133918bab6e2d"><enum>(2)</enum><header>Requirement</header><text>Bylaws may be established under paragraph (1) on approval by a majority of the members of the Malheur CEO Group.</text></paragraph></subsection><subsection id="idf54d3c884ea942eea35f7f74b05a60b9"><enum>(f)</enum><header>Consultation</header><text>During any period in which the program and the Malheur CEO Group are in existence, the Secretary shall consult with the Malheur CEO Group—</text><paragraph id="id7ebc351aa90142339e9d05dde0fcc3ed"><enum>(1)</enum><text>not less frequently than once every 60 days; or</text></paragraph><paragraph id="iddddd1f55a1414ce6a97fb9cf316ee9fc"><enum>(2)</enum><text>as otherwise agreed to by—</text><subparagraph id="id350a47d88bdf42b5a57a5cf6529aa3da"><enum>(A)</enum><text>the Secretary; and</text></subparagraph><subparagraph id="idE53AD5E5C7444ED3AA0598682D8AC460"><enum>(B)</enum><text>the Malheur CEO Group.</text></subparagraph></paragraph></subsection><subsection id="id412e3b1bad6a4ddf8f82b6ebb4d4fa91"><enum>(g)</enum><header>FACA applicability</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Malheur CEO Group.</text></subsection><subsection id="ide1d277b4b2cf492e9cbcef712c247c02"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="id4150F26E8D4E4891911D120DCD511F22"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out this section $51,000 for each of fiscal years 2023 through 2027.</text></paragraph><paragraph id="idd034e34244824c8d82f09fa07d2ab90a"><enum>(2)</enum><header>Administrative costs</header><text>Of the amounts made available under paragraph (1), not more than 10 percent may be used for administrative costs relating to the Malheur CEO Group. </text></paragraph></subsection></section><section id="idd30019a5fc3a4d8bb148b39463699584"><enum>5.</enum><header>Land designations</header><subsection id="ide41a160eefb447a6bd53f2c190bda0ce"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id3f2ebcd9764c442d83521d887c192782"><enum>(1)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Proposed Wilderness Malheur County</quote> and dated November 6, 2019.</text></paragraph><paragraph id="id48ece8b0b55146a9b8d89befdb76feb8"><enum>(2)</enum><header>Wilderness area</header><text>The term <term>wilderness area</term> means a wilderness area designated by subsection (b)(1).</text></paragraph></subsection><subsection id="idd5e760d5c51a45f59429cb03e16f9ffb"><enum>(b)</enum><header>Designation of wilderness areas</header><paragraph id="id55a7ae3773fe4edba49655b58160501a"><enum>(1)</enum><header>In general</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following Federal land in the County comprising approximately 1,133,841 acres, as generally depicted on the Map, is designated as wilderness and as components of the National Wilderness Preservation System:</text><subparagraph id="id9e6e8e4a17554563b8a334624bd7ee9d"><enum>(A)</enum><header>Fifteenmile creek wilderness</header><text>Certain Federal land, comprising approximately 58,599 acres, as generally depicted on the Map, which shall be known as the <quote>Fifteenmile Creek Wilderness</quote>.</text></subparagraph><subparagraph id="id23b790165dde4279868086c9b6ab3edb"><enum>(B)</enum><header>Oregon canyon mountains wilderness</header><text>Certain Federal land, comprising approximately 57,891 acres, as generally depicted on the Map, which shall be known as the <quote>Oregon Canyon Mountains Wilderness</quote>.</text></subparagraph><subparagraph id="id84f38eb898444aa38265d72883631021"><enum>(C)</enum><header>Twelvemile creek wilderness</header><text>Certain Federal land, comprising approximately 37,779 acres, as generally depicted on the Map, which shall be known as the <quote>Twelvemile Creek Wilderness</quote>.</text></subparagraph><subparagraph id="id94710393476c483c84f00d594c0e706e"><enum>(D)</enum><header>Upper west little owyhee wilderness</header><text>Certain Federal land, comprising approximately 93,159 acres, as generally depicted on the Map, which shall be known as the <quote>Upper West Little Owyhee Wilderness</quote>.</text></subparagraph><subparagraph id="idd8baada3c81344648e43fba700e8e019"><enum>(E)</enum><header>Lookout butte wilderness</header><text>Certain Federal land, comprising approximately 66,194 acres, as generally depicted on the Map, which shall be known as the <quote>Lookout Butte Wilderness</quote>.</text></subparagraph><subparagraph id="id5d5f6befb2aa46e189d57de2ab5cdeb8"><enum>(F)</enum><header>Mary Gautreaux Owyhee River Canyon Wilderness</header><text>Certain Federal land, comprising approximately 223,586 acres, as generally depicted on the Map, which shall be known as the <quote>Mary Gautreaux Owyhee River Canyon Wilderness</quote>.</text></subparagraph><subparagraph wilderness</header><text>Certain Federal, comprising approximately 9,568 acres, as generally depicted on the Map, which shall be known as the <quote>Sacramento Hill Wilderness</quote>.</text></subparagraph><subparagraph id="id4373d7f33a2d4e4a942b72722e470e1a"><enum>(L)</enum><header>Coyote wells wilderness</header><text>Certain Federal land, comprising approximately 7,147 acres, as generally depicted on the Map, which shall be known as the <quote>Coyote Wells Wilderness</quote>.</text></subparagraph><subparagraph id="id32db6c9b854240dd80d32b322289d71d"><enum>(M)</enum><header>Big grassey wilderness</header><text>Certain Federal land, comprising approximately 45,192 acres, as generally depicted on the Map, wilderness</header><text>Certain Federal land, comprising approximately 18,381 acres, as generally depicted on the Map, which shall be known as the <quote>Wild Horse Basin Wilderness</quote>.</text></subparagraph><subparagraph id="idc051127fe69c422fb384d781e3932374"><enum>(X)</enum><header>Quartz mountain wilderness</header><text>Certain Federal land, comprising wilderness</header><text>Certain Federal land, comprising approximately 10,519 acres, as generally depicted on the Map, which shall be known as the <quote>West Fork Bendire Wilderness</quote>.</text></subparagraph><subparagraph id="id584f414c06c1403cbd9d61cf9b8f5935"><enum>(DD)</enum><header>Beaver dam creek wilderness</header><text>Certain Federal land, comprising approximately 19,080 acres, as generally depicted on the Map, which shall be known as the <quote>Beaver Dam Creek Wilderness</quote>.</text></subparagraph></paragraph><paragraph id="iddc4f743a6e9f40c89390269e14fa1bae"><enum>(2)</enum><header>Maps and legal descriptions</header><subparagraph id="idf405ef6541754cd9972000900393d0fd"><enum>(A)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare and submit to Congress a map and legal description of each wilderness area.</text></subparagraph><subparagraph id="id041123e5614e40b9bf7a36a9116ecee9"><enum>(B)</enum><header>Effect</header><text>Each map and legal description prepared under subparagraph (A) shall have the same force and effect as if included in this Act, except that the Secretary may correct clerical and typographical errors in the map or legal description.</text></subparagraph><subparagraph id="id61335a55c5d74709be07bf1fc4ef0755"><enum>(C)</enum><header>Public availability</header><text>The maps and legal descriptions prepared under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the Bureau.</text></subparagraph></paragraph><paragraph id="idc9c3f1eaadc041e4a67fce9c342d2837"><enum>(3)</enum><header>Management</header><subparagraph id="id140fe513370a4029bf0fc1cb4f2e9493"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights, the wilderness areas shall be administered by the Secretary in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text><clause id="id897f125993a54663a53797f5d6f1a8d5"><enum>(i)</enum><text>any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</text></clause><clause id="idb0afcda49618407c90d03d830a51c74f"><enum>(ii)</enum><text>any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</text></clause></subparagraph><subparagraph id="id4271e58d90eb48e3af8fcc2efc2f0b13" commented="no"><enum>(B)</enum><header>Grazing</header><text>The Secretary shall allow the continuation of the grazing of livestock, including the maintenance, construction, or replacement of authorized supporting facilities, in the wilderness areas, if established before the date of enactment of this Act, in accordance with— </text><clause id="idcfcf16f8faf7407aa846009dbaa49886" commented="no"><enum>(i)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></clause><clause id="id839e06b1afd841949b5c70fe28dc12d3" commented="no"><enum>(ii)</enum><text>the guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></clause></subparagraph><subparagraph id="id29f63a0d710246e09b40fa860d4c1350"><enum>(C)</enum><header>Fire management and related activities</header><text>The Secretary may carry out any activities in the wilderness areas that the Secretary determines to be necessary for the control of fire, insects, and diseases, in accordance with—</text><clause id="id098e6837488042f3b95f1416cb181c08"><enum>(i)</enum><text>section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>); and</text></clause><clause id="id673aeb12c36549a08bcb30996601a086"><enum>(ii)</enum><text>the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 1437 of the 98th Congress (House Report 98–40).</text></clause></subparagraph><subparagraph id="id4b528cb7c1b743fa8624a9ec15b0afcf"><enum>(D)</enum><header>Roads adjacent to wilderness areas</header><text>Nothing in this Act requires the closure of any adjacent road outside the boundary of a wilderness area.</text></subparagraph></paragraph></subsection><subsection id="id4abac38413114803a2b5a4bc9e71b015"><enum>(c)</enum><header>Management of land not designated as wilderness</header><paragraph id="id37382cf56b59421792f513fd0b2f806c"><enum>(1)</enum><header>Release of wilderness study area</header><subparagraph id="idf7654fc6e800475f9cd34edaded6e47c"><enum>(A)</enum><header>Finding</header><text>Congress finds that, for purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), any portion of the Federal land designated as a wilderness study area, as depicted on the Map, on the date of enactment of this Act that is not designated as wilderness by subsection (b)(1) has been adequately studied for wilderness designation.</text></subparagraph><subparagraph id="idb51bc75f9ac448f0b0cc2bf030af2584"><enum>(B)</enum><header>Release</header><text>Except as provided in paragraph (2), the land described in subparagraph (A)—</text><clause id="idcc8a5bdb5fda4bf18b8b0d222e6c0fea"><enum>(i)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></clause><clause id="id941fe9212ef440ea9e22f6f36e2d7273"><enum>(ii)</enum><text>shall be managed in accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), including any applicable land use plan adopted under section 202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="idb2cc5433e12e4f1195dfc07f905c45c9"><enum>(2)</enum><header>Management of certain land with wilderness characteristics</header><text>Any portion of the Federal land that was previously determined by the Secretary to be land with wilderness characteristics that is not designated as wilderness by subsection (b)(1) shall be managed by the Secretary in accordance with the applicable land use plans adopted under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></paragraph></subsection></section><section id="id56d6a552c5ce4a07bf1ffa825ad35c2a"><enum>6.</enum><header>Economic development</header><subsection id="id2BADB5865EC14D83A51470DFFCF5522F"><enum>(a)</enum><header>Definition of map</header><text>In this section, the term <term>Map</term> means the map entitled <quote>Lake Owyhee, Succor Creek, Birch Creek, and Three Forks Scenic Loops</quote> and dated November 6, 2019. </text></subsection><subsection id="id9a0c9afee10d410397c4af372de5cacf"><enum>(b)</enum><header>Loop roads requirements</header><paragraph id="idc37bc434cb594a6b8861080d9f1cc997"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the County, shall work with Travel Oregon to establish the loop roads.</text></paragraph><paragraph id="id6ead2787533f47e4b3f5a3f9b8b3d995"><enum>(2)</enum><header>Owyhee dam road</header><subparagraph id="idfaf1f36f84084c27bbabbcc0f032300a"><enum>(A)</enum><header>Safety upgrades</header><clause id="id33c4c0220cbf46c797c44187dc7659f6"><enum>(i)</enum><header>In general</header><text>The Secretary shall seek to enter into an arrangement with the County to fund safety upgrades, in accordance with County road standards, to the Owyhee Dam Road to ensure access to the recreational opportunities of the Owyhee Reservoir, including improved signage and surfacing.</text></clause><clause id="idb97d98ba6f9f4ce6b8eff07dcbf4ec06"><enum>(ii)</enum><header>Deadline for upgrades</header><text>Any upgrades carried out with funds provided under clause (i) shall be completed not later than 1 year after the date of enactment of this Act, weather permitting.</text></clause><clause id="id42bd3eac98ac42299ad8814179f287fa"><enum>(iii)</enum><header>Compliance with standards</header><text>If the County receives any funds under this subparagraph, the County shall ensure that, not later than 1 year after the date of enactment of this Act, weather permitting, the Owyhee Dam Road is in compliance with the applicable standards of—</text><subclause id="idE5E34EF758A34FE09182D1B5943D5B99" commented="no"><enum>(I) </enum><text>the State;</text></subclause><subclause id="idFCC1DFB47C1441129DC71C6EB38A499F"><enum>(II)</enum><text>the County; and </text></subclause><subclause id="idD85074C81923420A9ABB14E579FBB07A"><enum>(III)</enum><text>each affected County road district.</text></subclause></clause></subparagraph><subparagraph id="id0737b39f074f4558ab9652887af2ad15"><enum>(B)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under subsection (f)(1), there is authorized to be appropriated to the Secretary to carry out subparagraph (A) $6,000,000.</text></subparagraph></paragraph><paragraph id="idc92c7c98458040afa958ab66533c9db3"><enum>(3)</enum><header>Succor creek scenic loop</header><text>The Secretary shall work with the County on a plan to improve the Succor Creek Scenic Loop, as generally depicted on the Map, to accommodate visitors and residents.</text></paragraph><paragraph id="idd60991f21d08470697442d32326d1650"><enum>(4)</enum><header>Birch creek scenic loop</header><text>The Secretary shall work with the County on a plan to improve the Birch Creek Scenic Loop, as generally depicted on the Map, to accommodate visitors and residents.</text></paragraph><paragraph id="idd319ba77958646bd9fb8aa580fd29a40"><enum>(5)</enum><header>Three forks scenic loop</header><text>The Secretary shall work with the County on a plan to improve the Three Forks Scenic Loop, as generally depicted on the Map—</text><subparagraph id="id56b673ad14964400821e625d641fcf1a"><enum>(A)</enum><text>to accommodate visitors and residents; and</text></subparagraph><subparagraph id="id310b72498c5b4996962ad3683eb1164d"><enum>(B)</enum><text>to provide a connection to the Idaho Scenic Byway.</text></subparagraph></paragraph></subsection><subsection id="idc680d85418084b7caa021d3b988a8468"><enum>(c)</enum><header>Improvements to state parks and other amenities</header><text>Not later than 180 days after the date of enactment of this Act—</text><paragraph id="id0ea9fbc8773443998d9403290242d58e"><enum>(1)</enum><text>the Commissioner, in coordination with the Owyhee Irrigation District, shall work with Travel Oregon or the Oregon Parks and Recreation Department, as appropriate, to carry out a feasibility study regarding each of— </text><subparagraph id="idc00d716e0c8e4317a1adc9ddb4148611" commented="no"><enum>(A)</enum><text>the establishment of not more than 2 marinas on the Owyhee Reservoir;</text></subparagraph><subparagraph id="id108d77294cf14dbda56a477b44a8740b" commented="no"><enum>(B)</enum><text>improvements to existing Oregon State Parks bordering the Owyhee Reservoir;</text></subparagraph><subparagraph id="idd0e3dbc4f6ae48198203087d5d1170a3" commented="no"><enum>(C)</enum><text>the establishment of a network of hostelries in the County using former hotels and bunkhouses that are not currently in use;</text></subparagraph><subparagraph id="idf523c23f313e467293fbcdaeca43b155"><enum>(D)</enum><text>improvements to private camps on the shore of the Owyhee Reservoir;</text></subparagraph><subparagraph id="ide58fa2ccaf384648bdbe7def848ef5e4"><enum>(E)</enum><text>the establishment of a dude ranch at Birch Creek; and</text></subparagraph><subparagraph id="id97342bd8e38f44cb9de453730ccc2daf"><enum>(F)</enum><text>any other economic development proposals for the Owyhee Reservoir or the County; and</text></subparagraph></paragraph><paragraph id="idb47e772a339b4c1c803c94aa540e0fa8"><enum>(2)</enum><text>the Secretary shall work with the County to carry out a feasibility study regarding the rails-to-trails project known as <quote>Rails to Trails: The Oregon Eastern Branch/The Oregon and Northwestern Railroad</quote>.</text></paragraph></subsection><subsection id="idd3ddfd15d8734b088c986d700ddc23ec"><enum>(d)</enum><header>Gateway to the oregon owyhee</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, in coordination with Travel Oregon, shall complete a feasibility study on how best to market communities or sections of the County as the <quote>Gateway to the Oregon Owyhee</quote>.</text></subsection><subsection id="id377aae3a47ca4fc694cf017f4ec6a402"><enum>(e)</enum><header>Jordan valley airstrip improvements To support firefighting efforts</header><paragraph id="idb00a3d38e16a45a1968a4e521a191888"><enum>(1)</enum><header>In general</header><text>The Secretary shall work with firefighting entities in the County to determine—</text><subparagraph id="id2eb769e2dbfc4b9a8fa41f1f8e0b93cd"><enum>(A)</enum><text>the need for the use of the Jordan Valley Airstrip to support firefighting efforts; and</text></subparagraph><subparagraph id="id8393590f54fd4d62b485b54119e3b66c"><enum>(B)</enum><text>the conditions under which the Jordan Valley Airstrip may be used to support firefighting efforts.</text></subparagraph></paragraph><paragraph id="ide6429bdde468455497540f409c5305f4"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Malheur CEO Group a report describing the need and conditions described in subparagraphs (A) and (B) of paragraph (1), including methods by which to meet those conditions.</text></paragraph></subsection><subsection id="id31c7c1864d0e4c808edc5323b4a100aa"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for fiscal year 2023—</text><paragraph id="idb2ce14879c8340298a2f8fc5aeb6e079"><enum>(1)</enum><text>to the Secretary—</text><subparagraph id="id361101fe4d5a4cc8b8444274bf471cdd"><enum>(A)</enum><text>to carry out subsection (b), $2,000,000;</text></subparagraph><subparagraph id="id1b48a6632f0746cfae54720c3dd7d656"><enum>(B)</enum><text>to carry out subsection (c)(2), $2,000,000;</text></subparagraph><subparagraph id="id263cf5d6cca6427a8f45a85cd7957fca"><enum>(C)</enum><text>to carry out subsection (d), $500,000; and</text></subparagraph><subparagraph id="id8246597abbae4c2382b4d493a3177d02"><enum>(D)</enum><text>to carry out subsection (e), $500,000; and</text></subparagraph></paragraph><paragraph id="id223ece8dd8344e02a7ee1af133cf0fd5"><enum>(2)</enum><text>to the Commissioner to carry out subsection (c)(1), $1,000,000.</text></paragraph></subsection></section><section id="ide7066f7ce7544270bc3b76c8e8f049bf"><enum>7.</enum><header>Land conveyance to Burns Paiute Tribe</header><subsection id="id30aa045f1a95490b808d9d9f774085aa"><enum>(a)</enum><header>Conveyance and taking into Trust</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall—</text><paragraph id="id548885da1b58449fbf96302f400d7b1f"><enum>(1)</enum><text>transfer to the Burns Paiute Tribe all right, title, and interest in and to the land in the State described in subsection (b) for the purpose of protecting and conserving cultural and natural values and to be part of the reservation of the Burns Paiute Tribe; and</text></paragraph><paragraph id="id165f511686fe45439b9257b78faaf938"><enum>(2)</enum><text>take the land transferred under paragraph (1) into trust for the benefit of the Burns Paiute Tribe.</text></paragraph></subsection><subsection id="id5bdf068ab93d47c0946a821026e2c7bb"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a)(1) is the following, as depicted on the map entitled <quote>Malheur Reservation Paiute Indian Tribe Grant, Malheur, and Harney Counties, Oregon</quote> and dated March 15, 1958:</text><paragraph id="idde65d1ff9922436d9753bfb2d3b65555"><enum>(1)</enum><header>Jonesboro Ranch</header><text>The parcel commonly known as <quote>Jonesboro Ranch</quote>, located approximately 6 miles east of Juntura, Oregon, consisting of 21,548 acres of Federal land, 6,686 acres of certain private land associated with the Jonesboro Ranch containing the pastures referred to as <quote>Saddle Horse</quote> and <quote>Trail Horse</quote>, <quote>Indian Creek</quote>, <quote>Sperry Creek</quote>, <quote>Antelope Swales</quote>, <quote>Horse Camp</quote>, <quote>Dinner Creek</quote>, <quote>Upper Hunter Creek</quote>, and <quote>Tim’s Peak</quote>, and more particularly described as follows: </text><subparagraph id="id4a37d6eda22c4608906a9ed16e787792"><enum>(A)</enum><text>T. 20 S., R. 38 E., secs. 25 and 36.</text></subparagraph><subparagraph id="id9c9b9eda2d2f4e4aac928b2ebc87bbe5"><enum>(B)</enum><text>T. 20 S., R. 39 E., secs. 25–36.</text></subparagraph><subparagraph id="id1347e30291354dfb9fee9c8ab1cfcba9"><enum>(C)</enum><text>T. 20 S., R. 40 E., secs. 30, 31, and 32.</text></subparagraph><subparagraph id="id1bd577cc2b9c4d349d6f8861db4d5204"><enum>(D)</enum><text>T. 21 S., R. 39 E., secs. 1–18, 20–29, and 32–36.</text></subparagraph><subparagraph id="idc7aa51946b99482185bae947daae1623"><enum>(E)</enum><text>T. 21 S., R. 40 E., secs. 5–8, 17–19, 30, and 31.</text></subparagraph><subparagraph id="idba0871e0af4b4167beeb4010679c9aa9"><enum>(F)</enum><text>T. 22 S., R. 39 E., secs. 1–5, 8, and 9. </text></subparagraph></paragraph><paragraph id="idB9BD78EE1DAF411B9EADE39964CDE413"><enum>(2)</enum><header>Road Gulch; Black Canyon</header><text>The approximately 4,137 acres of State land containing the pastures referred to as “Road Gulch” and “Black Canyon” and more particularly described as follows:</text><subparagraph id="id55553e6201394629b9ccd8de2655a952"><enum>(A)</enum><text>T. 20 S., R. 39 E., secs. 10, 11, 15, 14, 13, 21–28, and 36.</text></subparagraph><subparagraph id="idbf8923e4e1364be59c19cc57c1a7779a"><enum>(B)</enum><text>T 20 S., R. 40 E., secs. 19, 30, 31, and 32. </text></subparagraph></paragraph></subsection><subsection id="id0C42D9648C0A4DDFA8E1C0FDA55FDA1A"><enum>(c)</enum><header>Applicable law</header><text>Land taken into trust under subsection (a)(2) shall be administered in accordance with the laws (including regulations) generally applicable to property held in trust by the United States for the benefit of an Indian Tribe. </text></subsection><subsection id="idD869027D4F754C4595117C37C02A7AE2"><enum>(d)</enum><header>Map of trust land</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a map depicting the land taken into trust under subsection (a)(2).</text></subsection><subsection id="ided71504ed8ee4383b90a230fc2858635"><enum>(e)</enum><header>Land exchange</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall seek to enter into an agreement with the State under which the Secretary would exchange Federal land for the portions of the area described in subsection (b)(2) that are owned by the State. </text></subsection><subsection id="idae8d19502a03473b97ed65241e15da12"><enum>(f)</enum><header>Payment in lieu of taxes program</header><text>Any land taken into trust under subsection (a)(2) shall be eligible for payments under the payment in lieu of taxes program established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">chapter 69</external-xref> of title 31, United States Code. </text></subsection><subsection id="idB495B0D9F68D4162B02546DD5EE86DCC"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section.</text></subsection></section><section id="idD2475F473AD3453F88E9A5327480DBAD"><enum>8.</enum><header>Effect on Tribal rights and certain existing uses</header><text display-inline="no-display-inline">Nothing in this Act, including any designation or nondesignation of land transferred into trust to be held by the United States for the benefit of the Burns Paiute Tribe under section 7—</text><paragraph id="id239AEA3EFD7B43A794C59A5F6897B0AF"><enum>(1)</enum><text display-inline="yes-display-inline">alters, modifies, enlarges, diminishes, or abrogates rights secured by a treaty, statute, Executive order, or other Federal law of any Indian Tribe, including off-reservation reserved rights; or</text></paragraph><paragraph id="id946468ECEC0D4536B37C308543B35819"><enum>(2)</enum><text> affects—</text><subparagraph id="id4C91D949528E4737B45C8D01E9DFC80B"><enum>(A)</enum><text>existing rights-of-way; or</text></subparagraph><subparagraph id="idEA0EF587E6BB4A9D9A9DA0F51C8F4B38"><enum>(B)</enum><text>preexisting grazing uses and existing water rights or mining claims, except as specifically negotiated between any applicable Indian Tribe and the Secretary.</text></subparagraph></paragraph></section></legis-body></bill>
