which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to require electronic communication service providers and remote computing services to report to the Attorney General the unlawful sale and distribution of controlled substances.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cooper Davis Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id6DAA9A927C004223A86F2F80CA8A3395"><enum>2.</enum><header>Reporting requirements of electronic communication service providers and remote computing services for the unlawful sale and distribution of controlled substances</header><subsection id="id59AD770CEB6242B38AAF68ED26F0DB93"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part E of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/871">21 U.S.C. 871 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id719B435AB2EB4945A966F3928903392D"><section id="idE2170E95CD654DE1918E2F6CE486CFF5"><enum>521.</enum><header>Reporting requirements of electronic communication service providers and remote computing services for the unlawful sale and distribution of controlled substances</header><subsection id="idc1fa9b21a57b4452ae8015a0f62fe60e"><enum>(a)</enum><header>Definitions</header><text>In this section, the terms <term>electronic communication service</term>, <term>electronic mail address</term>, <term>provider</term>, <term>remote computing service</term>, and <term>website</term> have the meanings given those terms in section 2258E of title 18, United States Code.</text></subsection><subsection id="idFD860323DF1248ECBBF067922341F2DD"><enum>(b)</enum><header>Duty To report</header><paragraph id="id22bf8c5be7234e00ba3dc65df2207dc0"><enum>(1)</enum><header>In general</header><subparagraph id="id60f1830c41aa4f3a9b30cf5f3ae05aea"><enum>(A)</enum><header>Duty</header><text>In order to reduce the proliferation of the unlawful sale or distribution of controlled substances, a provider—</text><clause id="idbb02115ac8ce403aad4c1a153b6dd234"><enum>(i)</enum><text>shall, as soon as reasonably possible after obtaining actual knowledge of any facts or circumstances described in paragraph (2)(A), take the actions described in subparagraph (B); and</text></clause><clause id="id831c46654ff7483b9b34ae5b3af6396d"><enum>(ii)</enum><text>may, after obtaining actual knowledge of any facts or circumstances described in paragraph (2)(B), take the actions described in subparagraph (B).</text></clause></subparagraph><subparagraph id="id7a016e2b028b4a588097a1391ea35735"><enum>(B)</enum><header>Actions described</header><text>The actions described in this subparagraph are—</text><clause id="id8b260c6b64e8413b94ae964fff534a49" commented="no"><enum>(i)</enum><text>providing to the Drug Enforcement Administration the mailing address, telephone number, facsimile number, and electronic mailing address of, and individual point of contact for, such provider; and</text></clause><clause id="id15d04a0b2d484185bf27c84406f7f290" commented="no"><enum>(ii)</enum><text>making a report of such facts or circumstances to the Drug Enforcement Administration.</text></clause></subparagraph></paragraph><paragraph id="id2fc49ff9bd804a139f6f8c8c57574ce1"><enum>(2)</enum><header>Facts and circumstances</header><subparagraph id="id0ede465c56934175b4567b54f0a9ec95"><enum>(A)</enum><header>Apparent violations</header><text>The facts or circumstances described in this subparagraph are any facts or circumstances from which there is an apparent violation of section 401, 402, 403, or 406. </text></subparagraph><subparagraph id="idcbae83a26e9b466286dff890341b3d18"><enum>(B)</enum><header>Imminent violations</header><text>The facts or circumstances described in this subparagraph are any facts or circumstances that indicate that a violation described in subparagraph (A) may be planned or imminent.</text></subparagraph></paragraph></subsection><subsection id="idbfdb57b106ae4f59bdec1c7e94ede09e"><enum>(c)</enum><header>Contents of report</header><text>In an effort to prevent future violations of the sections described in subsection (b)(2)(A), and to the extent the information is within the custody or control of a provider, the facts and circumstances included in each report under subsection (b)(1) shall, at the sole discretion of the provider, include the following information:</text><paragraph id="idb290a4c97a3146dfa46d151f02eddafb"><enum>(1)</enum><header>Information about the involved individual</header><text>Information relating to the identity of any individual who appears to have violated or plans to violate the sections described in subsection (b)(2)(A), which may, to the extent reasonably practicable, include the electronic mail address, Internet Protocol address, uniform resource locator, payment information (excluding personally identifiable information), screen names or monikers for the account used or any other accounts associated with the individual, or any other identifying information, including self-reported identifying information. </text></paragraph><paragraph id="id2cd687b0633d423794bcec277bf905f9"><enum>(2)</enum><header>Historical reference</header><text>Information relating to when and how a customer or subscriber of a provider uploaded, transmitted, or received content relating to the report or when and how content relating to the report was reported to or discovered by the provider, including a date and time stamp and time zone.</text></paragraph><paragraph id="id313ad34e08a1483abf6bf901aefd5f99"><enum>(3)</enum><header>Geographic location information</header><text>Information relating to the geographic location of the involved individual or website, which may include the Internet Protocol address or verified address, or, if not reasonably available, at least one form of geographic identifying information, including area code or zip code, provided by the customer or subscriber, or stored or obtained by the provider, and any information as to whether a virtual private network was used. </text></paragraph><paragraph id="id54C12873751141F3A46CB16C16001ABF"><enum>(4)</enum><header>Data relating to the sale of controlled substances</header><text>Any data, including symbols, photos, video, icons, or direct messages, relating to apparent activity involving the unlawful sale or distribution of a controlled substance or other content relating to the incident such report is regarding. </text></paragraph><paragraph id="id3b3756b0e0a8445e98663b7fc3bff74e"><enum>(5)</enum><header>Complete communication</header><text>The complete communication containing the intent to unlawfully sell or distribute a controlled substance, including—</text><subparagraph id="id568e6b09d23d473c825f0dda7f3d53b9"><enum>(A)</enum><text>any data or information regarding the transmission of the communication; and</text></subparagraph><subparagraph id="id6c16cd3e04c34dc2ae886f87cf8eca2b"><enum>(B)</enum><text>any data or other digital files contained in, or attached to, the communication.</text></subparagraph></paragraph></subsection><subsection id="ide52ef93a16d74da8af9d2a0497b310e7"><enum>(d)</enum><header>Forwarding of report to other Federal law enforcement agencies, State and local law enforcement agencies, and foreign law enforcement agencies</header><text>The Drug Enforcement Administration shall make available each report made under subsection (b)(1) to other Federal law enforcement agencies, State and local law enforcement agencies, and foreign law enforcement agencies involved in the investigation of violations described in subsection (b)(2)(A).</text></subsection><subsection id="id4717663ed989490898c086df503dd43d"><enum>(e)</enum><header>Attorney general responsibilities</header><paragraph id="idd68781de8fa3458d839a00e227abe3f9"><enum>(1)</enum><header>In general</header><text>The Attorney General shall enforce this section.</text></paragraph><paragraph id="id26a460353a484db1a1040b2e1163bcec" commented="no"><enum>(2)</enum><header>Designation of federal agencies</header><text>The Attorney General may designate a Federal law enforcement agency or agencies to which the Drug Enforcement Administration shall forward a report under subsection (d).</text></paragraph><paragraph id="id3dd39b3588ac43cbbda11056574f64a1"><enum>(3)</enum><header>Designation of foreign agencies</header><text>The Attorney General may—</text><subparagraph id="id905bef449ff44df394dfd585648a57b8"><enum>(A)</enum><text>in consultation with the Secretary of State, designate foreign law enforcement agencies to which a report may be forwarded under subsection (d);</text></subparagraph><subparagraph id="id1e8ffe4695f6419c91cb0f99f8e9688e"><enum>(B)</enum><text>establish the conditions under which such a report may be forwarded to such agencies; and</text></subparagraph><subparagraph id="id9a9f0e92cc2e430fad87cb1730cb2bf6"><enum>(C)</enum><text>develop a process for foreign law enforcement agencies to request assistance from Federal law enforcement agencies in obtaining evidence related to a report referred under subsection (d).</text></subparagraph></paragraph><paragraph id="id2a318166701d4f48b713dc3df2e2c8c3"><enum>(4)</enum><header>Reporting designated foreign agencies</header><text>The Attorney General may maintain and make available to the Department of State, providers, the Committee on the Judiciary of the Senate, and the Committee on the Judiciary of the House of Representatives a list of the foreign law enforcement agencies designated under paragraph (3).</text></paragraph><paragraph id="id7329ee15f5e74a93ab98cbb9094df1b3"><enum>(5)</enum><header>Notification to providers</header><subparagraph id="id977643c402464c26b7070f9d1c3b98b6"><enum>(A)</enum><header>In general</header><text>The Drug Enforcement Administration may notify a provider of the information described in subparagraph (B), if— </text><clause id="ida75de354456e492b833c84257fb1448c"><enum>(i)</enum><text>a provider notifies the Drug Enforcement Administration that the provider is making a report under this section as the result of a request by a foreign law enforcement agency; and</text></clause><clause id="id549a416a9b5f48e98bf73671614e2677"><enum>(ii)</enum><text>the Drug Enforcement Administration forwards the report described in clause (i) to—</text><subclause id="id36ba4d5e6f5143f48d3fc3a8fe6be096"><enum>(I)</enum><text>the requesting foreign law enforcement agency; or</text></subclause><subclause id="id32920ac6276a4044917d5912a751cc47"><enum>(II)</enum><text>another agency in the same country designated by the Attorney General under paragraph (3).</text></subclause></clause></subparagraph><subparagraph id="id700052311b204a00b96de0d48126f2e3"><enum>(B)</enum><header>Information described</header><text>The information described in this subparagraph is—</text><clause id="id39a0ab9c9d914f9b835d985e61507fed"><enum>(i)</enum><text>the identity of the foreign law enforcement agency to which the report was forwarded; and</text></clause><clause id="id7bd763bd1b924334a2f3e4f9eb3df355"><enum>(ii)</enum><text>the date on which the report was forwarded.</text></clause></subparagraph><subparagraph id="id74594b84a81c4d7b9be65935bd83f954"><enum>(C)</enum><header>Notification of inability to forward report</header><text>If a provider notifies the Drug Enforcement Administration that the provider is making a report under this section as the result of a request by a foreign law enforcement agency and the Drug Enforcement Administration is unable to forward the report as described in subparagraph (A)(ii), the Drug Enforcement Administration shall notify the provider that the Drug Enforcement Administration was unable to forward the report.</text></subparagraph></paragraph></subsection><subsection id="idc58681dc7fa64a49be5f43292237cc3a"><enum>(f)</enum><header>Failure To report</header><text>A provider that knowingly and willfully fails to make a report required under subsection (b)(1) shall be fined—</text><paragraph id="idb4d280df0c9c481486cc9bc98768436c"><enum>(1)</enum><text>in the case of an initial knowing and willful failure to make a report, not more than $150,000; and</text></paragraph><paragraph id="id582ce96de2854bf282c4a5272ba6f7e9"><enum>(2)</enum><text>in the case of any second or subsequent knowing and willful failure to make a report, not more than $300,000.</text></paragraph></subsection><subsection id="iddb72c996429c4d60b42569814168f141"><enum>(g)</enum><header>Protection of privacy</header><text>Nothing in this section shall be construed to require a provider to—</text><paragraph id="id636357967ddb45adbb0e557a529d9fc0"><enum>(1)</enum><text>monitor any user, subscriber, or customer of that provider;</text></paragraph><paragraph id="id12d6797841d5484f8eb323cd1ea64c77"><enum>(2)</enum><text>monitor the content of any communication of any person described in paragraph (1); or</text></paragraph><paragraph id="id83058c3d22ca4ff4b8eb99a7b99d859d"><enum>(3)</enum><text>affirmatively search, screen, or scan for facts or circumstances described in subsections (b) and (c).</text></paragraph></subsection><subsection id="id41e019809fcb4080ad717169f0eb04be"><enum>(h)</enum><header>Conditions of disclosure of information contained within report</header><paragraph id="idf41c41e399dc4e1c818ac42bb2072afb"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a law enforcement agency that receives a report under subsection (d) shall not disclose any information contained in that report.</text></paragraph><paragraph id="idc6f873e22e5c4b169c5095615ca6895d"><enum>(2)</enum><header>Permitted disclosures by law enforcement</header><text>A law enforcement agency may disclose information in a report received under subsection (d)—</text><subparagraph id="id3e75647482154d6d995bec40eacc1731"><enum>(A)</enum><text>to an attorney for the government for use in the performance of the official duties of that attorney;</text></subparagraph><subparagraph id="id2e94808b6b7f4e95a4b58edb3bf495f4"><enum>(B)</enum><text>to such officers and employees of that law enforcement agency, as may be necessary in the performance of their investigative and recordkeeping functions;</text></subparagraph><subparagraph id="idde2d4aaf64764c16a76752e67d6d8e42"><enum>(C)</enum><text>to such other government personnel (including personnel of a State or subdivision of a State) as are determined to be necessary by an attorney for the government to assist the attorney in the performance of the official duties of the attorney in enforcing Federal criminal law;</text></subparagraph><subparagraph id="id5f77fe87919f43a5a7bf50db912f60c2"><enum>(D)</enum><text>if the report discloses a violation of State criminal law, to an appropriate official of a State or subdivision of a State for the purpose of enforcing such State law;</text></subparagraph><subparagraph id="id6c5c195826064946bd2a1f418d3faaa9"><enum>(E)</enum><text>to a defendant in a criminal case or the attorney for that defendant to the extent the information relates to a criminal charge pending against that defendant;</text></subparagraph><subparagraph id="id1E241537643944239F97C619F12140E0"><enum>(F)</enum><text>to a provider if necessary to facilitate response to legal process issued in connection to a criminal investigation, prosecution, or post-conviction remedy relating to that report; and</text></subparagraph><subparagraph id="ide7b8560ae1ed4980980880443fd1fdc1"><enum>(G)</enum><text>as ordered by a court upon a showing of good cause and pursuant to any protective orders or other conditions that the court may impose.</text></subparagraph></paragraph></subsection><subsection id="id8b7a5f74e9ec4e86a4aa6d22775ef854"><enum>(i)</enum><header>Preservation</header><paragraph id="idaf1d44bbbd3140f08a45693d49a4c2c9"><enum>(1)</enum><header>In general</header><subparagraph id="idFB404B83D5C9455A8D9DBC4F2DB6FAE1"><enum>(A)</enum><header>Request to preserve contents</header><text>For the purposes of this section, a completed submission by a provider of a report to the Drug Enforcement Administration under subsection (b)(1) shall be treated as a request to preserve the contents provided in the report for 90 days after the submission to the Drug Enforcement Administration. </text></subparagraph><subparagraph id="id68F08DC8811E4C1C8F38F5FA514F41E5"><enum>(B)</enum><header>Notification to user</header><text>A provider may not notify a user, subscriber, or customer of the provider of a preservation request described in subparagraph (A) unless—</text><clause id="id99E9FE1863924C328B3AD69CAE5AF91A"><enum>(i)</enum><text>the provider has notified the Drug Enforcement Administration of its intent to provide that notice;</text></clause><clause id="id37CD3980BB2746C98620041E808DB93C"><enum>(ii)</enum><text>5 business days have elapsed since the notification under clause (i); and </text></clause><clause id="idE877933A6D6F40A69F0423BB9A6152B8"><enum>(iii)</enum><text>the Drug Enforcement Administration has not obtained a court order for nondisclosure.</text></clause></subparagraph></paragraph><paragraph id="id89ef61710b60443983a5f5d574a75e82"><enum>(2)</enum><header>Preservation of commingled content</header><text>Pursuant to paragraph (1)(A), a provider shall preserve any data or other digital files that are reasonably accessible and may provide context or additional information about the reported material or person.</text></paragraph><paragraph id="id54b2ba8dea074221be7c9f5800947b6d"><enum>(3)</enum><header>Protection of preserved materials</header><text>A provider preserving materials under this section shall maintain the materials in a secure location and take appropriate steps to limit access to the materials by agents or employees of the service to that access necessary to comply with the requirements of this subsection.</text></paragraph><paragraph id="id81cfc394a51b44f49b445ebc82f42bd3"><enum>(4)</enum><header>Authorities and duties not affected</header><text>Nothing in this section shall be construed as replacing, amending, or otherwise interfering with the authorities and duties under section 2703 of title 18, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8FE0571E20C647A3BD50E3095DCAFA01"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents for the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended by inserting after the item relating to section 520 the following:</text><quoted-block style="USC" id="id4eec73d6-02bc-4750-8d1e-3339f47f4692"><toc><toc-entry level="section" bold="off">Sec. 521.
