which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To protect the rights of student athletes and to provide for transparency and accountability with respect to student athlete name, image, and likeness agreements, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Collegiate Athlete Compensation Rights Act</short-title></quote>.</text></section><section id="idfd9b4cb576154a2c9f3e2efbf4c72ae0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idf3b9fd3a98fe4b428f43c57cc409f816"><enum>(1)</enum><header>Athletic association</header><text>The term <term>athletic association</term> means any organization or other group that—</text><subparagraph id="idc1a8e00f8cba43c398197937ebc12743"><enum>(A)</enum><text>has 2 or more conferences as members; and</text></subparagraph><subparagraph id="idba5fd1b577e542c99baed5a74495dc0b"><enum>(B)</enum><text>arranges, sets rules for, or regulates varsity intercollegiate sports competition.</text></subparagraph></paragraph><paragraph id="id80b41aeaa5d34ad08f2ee19b971254ee"><enum>(2)</enum><header>Athletic department</header><text>The term <term>athletic department</term> means a department at an institution responsible for sponsoring 1 or more varsity intercollegiate athletic programs.</text></paragraph><paragraph id="id4939283E565341C89F27515025EDFFA9"><enum>(3)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id254470C825C64B468847F799D4572EC9"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate; and</text></subparagraph><subparagraph id="id666C66BB715548BF8D10FD6A3F1605BA"><enum>(B)</enum><text>the Committee on Energy and Commerce and the Committee on Education and Labor of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idc90b49424c294be282e3ecc731e10022"><enum>(4)</enum><header>Booster</header><text>With respect to an institution, the term <term>booster</term> means—</text><subparagraph id="id068E06700D734EA7B81D80CE1F11E9DF"><enum>(A)</enum><text>an individual or entity that, directly or indirectly, through any other individual or entity or in any other manner—</text><clause id="idcdfb487c53c84242b6c670d97938fdc4"><enum>(i)</enum><text>has provided a donation to obtain season tickets for any varsity intercollegiate athletic program at the institution that exceeds the annual amount determined by the Commission;</text></clause><clause id="id39c906deefd0455bb0762d059d33eb6d"><enum>(ii)</enum><text>has made a financial contribution directly to the athletic department or other athletics management organization of the institution in an amount that exceeds the annual amount determined by the Commission;</text></clause><clause id="id2cab5e4687a042aa809bc274ef995573"><enum>(iii)</enum><text>is party to any agreement for use of the trademarks of the institution in connection with any varsity intercollegiate athletic program under which the total payments exceed such amount;</text></clause><clause id="ide4879c92bc2d44d594f694a796a28284"><enum>(iv)</enum><text>has made any combination of such financial donations, contributions, expenditures, or payments in connection with an activity described in any of clauses (i) through (iii), that, in the aggregate, exceed such amount;</text></clause><clause id="id1547ab699c694284a51a715aa4f2f83d"><enum>(v)</enum><text>has arranged or provided employment for 1 or more student athletes; or</text></clause><clause id="id8e5313d62c5d4edb92767b1de5fec59d"><enum>(vi)</enum><text>has assisted, or been requested by an employee of the institution to assist, in the recruitment of a prospective student athlete; and</text></clause></subparagraph><subparagraph id="id1ecc676bba644207bfe54a39659a6609"><enum>(B)</enum><text>includes any entity, group or collective, including any tax-exempt or nonprofit entity, that is controlled by, or receives or has received 25 percent or more of its funding or assets from, 1 or more individuals or entities described in subparagraph (A) of the institution. </text></subparagraph></paragraph><paragraph id="id6d96ab19ee2a43a1a4541c2d91342897"><enum>(5)</enum><header>Certified agent</header><text>The term <term>certified agent</term> means an athlete agent (as defined in section 2 of the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref>)), a contract advisor, a financial advisor, a marketing representative, a brand manager, or a similarly employed individual who is certified by the Commission as being in full compliance with all requirements established by the Commission—</text><subparagraph id="idf8fa4d58e29e45e2956216700de9fa6d"><enum>(A)</enum><text>to represent a student athlete in a name, image, and likeness agreement;</text></subparagraph><subparagraph id="idae9165905012444f84a3aa9156e09af9"><enum>(B)</enum><text>to provide consulting services to a student athlete with respect to a name, image, and likeness agreement; or</text></subparagraph><subparagraph id="id681e7d701f424f07b33f29a750f1280a"><enum>(C)</enum><text>to recruit or solicit, directly or indirectly, a student athlete—</text><clause id="id36e2617782274419a39ae15f696f0b12"><enum>(i)</enum><text>to engage in an activity described in subparagraph (A) or (B); or</text></clause><clause id="idde8bce336ef4482b96f1dae02539f0bd"><enum>(ii)</enum><text>to represent or attempt to represent a student athlete for the purpose of marketing the name, image, or likeness of the student athlete.</text></clause></subparagraph></paragraph><paragraph id="idba40370db1364eff93bb5c80902527b0"><enum>(6)</enum><header>Chair</header><text>The term <term>Chair</term> means the Chair of the Federal Trade Commission.</text></paragraph><paragraph id="idcbf60d894247436b903de825d9b05b03"><enum>(7)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id54253baf2a674f9d9178a9a3781fe8e5"><enum>(8)</enum><header>Conference</header><text>The term <term>conference</term> means any organization that—</text><subparagraph id="id4CC38D6F13284F45BE7C0EA37EA70FDF"><enum>(A)</enum><text>is not an athletic association; </text></subparagraph><subparagraph id="id0b1bf9218e3549fa8b7647811ae05247"><enum>(B)</enum><text>has 2 or more institutions as members; and</text></subparagraph><subparagraph id="id4ad828844e23488f84b7d99b0654b23e"><enum>(C)</enum><text>arranges championships, sets rules for, or regulates varsity intercollegiate sports competition.</text></subparagraph></paragraph><paragraph id="id7697fdde91eb45e58c5f3bbae9779c73"><enum>(9)</enum><header>Cost of attendance</header><text>The term <term>cost of attendance</term>—</text><subparagraph id="idc0ca79c1f4554bb3a0cec07d6ae3e550"><enum>(A)</enum><text>has the meaning given the term in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>); and</text></subparagraph><subparagraph id="id234cf0fc2da64dfaa8675dc116a81387"><enum>(B)</enum><text>shall be calculated by the financial aid office of an institution by applying the same standards, policies, and procedures for all students at such institution.</text></subparagraph></paragraph><paragraph id="idc33b58a04899417f9656b663171d630a"><enum>(10)</enum><header>Covered compensation</header><subparagraph id="id359347030bb34363845561053d03da26"><enum>(A)</enum><header>In general</header><text>With respect to a name, image, and likeness agreement, the term <term>covered compensation</term> means any payment, remuneration, or benefit, including cash, awards, gifts, and in-kind contributions, that—</text><clause id="id01C733F376D046C0BDB5804E03E00F21"><enum>(i)</enum><text>is provided by a third party to a student athlete; </text></clause><clause id="id22D5BE9CCCF44966B6184C1A411BCE3D"><enum>(ii)</enum><text>is commensurate with the market value for the activity carried out under the name, image, and likeness agreement; and</text></clause><clause id="idB8572C4D22604AFFADFCFC0EC8F180F7"><enum>(iii)</enum><text>is not, or is not intended to be, a recruiting inducement or compensation for participation in a varsity intercollegiate sport.</text></clause></subparagraph><subparagraph id="id570dc04f79a848c8a503af9a3ef01783"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered compensation</term> does not include grant-in-aid.</text></subparagraph></paragraph><paragraph id="idb9b5ff5614744326a761bf57fb815a85"><enum>(11)</enum><header>Grant-in-aid</header><text>The term <term>grant-in-aid</term> means—</text><subparagraph id="id924b6830e1c644a5b6bb2a1b65048cee"><enum>(A)</enum><text>tuition, room, board, books, fees, and personal expenses paid or provided by an institution up to the full cost of attendance;</text></subparagraph><subparagraph id="id69c9d7837ed94f80ac74439e81b62d9b"><enum>(B)</enum><text>Federal Pell Grants and other State and Federal grants unrelated to, and not awarded with respect to, participation in varsity intercollegiate sports competition;</text></subparagraph><subparagraph id="id26ead4b726fa4895b162fc8b7e1f4f0d"><enum>(C)</enum><text>health insurance and the costs of health care wholly or partly self-funded by an athletic association, a conference, or an institution;</text></subparagraph><subparagraph id="id66e66c22643340f0a5203f1dd445a8de"><enum>(D)</enum><text>disability and loss of value insurance that is wholly or partly self-funded by an athletic association, a conference, or an institution;</text></subparagraph><subparagraph id="idb3a88bf375a6496ea2df4133dbfa8e02"><enum>(E)</enum><text>career counseling or job placement services available to all students at an institution; or</text></subparagraph><subparagraph id="id038ae73685854fa799879446e694a343"><enum>(F)</enum><text>payment of hourly wages and benefits for work actually performed (and not for participation in a varsity intercollegiate athletic program) at a rate commensurate with the prevailing rate in the locality of an institution for similar work.</text></subparagraph></paragraph><paragraph id="id8578d58a27ce40e084e5e2013b4c2a0a"><enum>(12)</enum><header>Image</header><text>The term <term>image</term>, with respect to a student athlete, means a photograph, video, or computer-generated representation that identifies, is linked to, or is reasonably linkable to the student athlete.</text></paragraph><paragraph id="idef84989c37d248ab932c471b15ab4fe6"><enum>(13)</enum><header>Institution</header><text>The term <term>institution</term> means an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></paragraph><paragraph id="ideb31e308d9b44666b250ad364a7229e4"><enum>(14)</enum><header>Likeness</header><text>The term <term>likeness</term>, with respect to a student athlete, means—</text><subparagraph id="idd5e7d12b1efd4b48b76b1120f85ce5d7"><enum>(A)</enum><text>with respect to a student athlete of a sport for which the student athlete has a jersey number, the jersey number associated with the student athlete and the sport in which the student athlete participates at a particular institution during the period of the participation of the student athlete in the sport at the institution, if the jersey number is accompanied by—</text><clause id="id9557169fbc80406791fa222d187e92a3"><enum>(i)</enum><text>a logo or color scheme that is clearly associated with the institution; or</text></clause><clause id="idd559c953c3ec4ce2a222c24af9aaa9e9"><enum>(ii)</enum><text>some other means by which the jersey number is associated with the particular student athlete; and</text></clause></subparagraph><subparagraph id="id35105165660e47e1927e6d8580ce2290"><enum>(B)</enum><text>with respect to any student athlete—</text><clause id="id82ed9a61dde44f399c42f7a09536d3de"><enum>(i)</enum><text>the uniquely identifiable voice, catch phrase, or nickname of the student athlete; or</text></clause><clause id="id2962a2895efe431f933be569b251fc58"><enum>(ii)</enum><text>any other mark that identifies or distinguishes the student athlete.</text></clause></subparagraph></paragraph><paragraph id="idfc7b0e6a6ea24f7fb208990228804c0c"><enum>(15)</enum><header>Loss of value insurance</header><text>The term <term>loss of value insurance</term> means insurance that protects the future contract value of a student athlete from decreasing below a predetermined amount due to significant injury or illness suffered by the student athlete during the designated coverage period of the insurance policy.</text></paragraph><paragraph id="id9c7509c923b8482994ab99e4b9c1868b"><enum>(16)</enum><header>Name</header><text>The term <term>name</term>, with respect to a student athlete, means the first or last name, the nickname, or the username on any internet platform of the student athlete when used in a context that reasonably identifies the student athlete with specificity or particularity.</text></paragraph><paragraph id="id15801341fc984867971499bf85bab1ab"><enum>(17)</enum><header>Name, image, and likeness agreement</header><text>The term <term>name, image, and likeness agreement</term> means a contract or similar arrangement between a student athlete and a third party regarding the commercial use of the name, image, or likeness of the student athlete in exchange for covered compensation.</text></paragraph><paragraph id="id9d8615ea1f1b4ba7b0bc4a477ff36a25"><enum>(18)</enum><header>Prospective student athlete</header><text>The term <term>prospective student athlete</term> means an individual attending an elementary school or a secondary school (as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) who participates in a sport program.</text></paragraph><paragraph id="id5a2e61e192e34567aeb8e4d623b01e88"><enum>(19)</enum><header>Publicity right</header><text>The term <term>publicity right</term>—</text><subparagraph id="idd2d9d1bfd8754009902b050c0b7f603f"><enum>(A)</enum><text>means a right that is recognized under a Federal or State law that permits an individual to control and profit from the commercial use of the name, image, or likeness of the individual; and</text></subparagraph><subparagraph id="id0f41d972d9b64852bb9a400285c9f292"><enum>(B)</enum><text>includes any right that is licensed under a name, image, and likeness agreement.</text></subparagraph></paragraph><paragraph id="id66f18d8ed96b404285c69b675f7792c7"><enum>(20)</enum><header>Student athlete</header><text>The term <term>student athlete</term> means any individual enrolled at an institution who participates as a team member or competitor in varsity intercollegiate sports competition sponsored by the institution.</text></paragraph><paragraph id="id1a782a99c18f4200acc6b45914fbd518"><enum>(21)</enum><header>Third party</header><text>The term <term>third party </term> means an individual or entity that is not—</text><subparagraph id="idF00F0DB6BA354AD9AB597BDB8E5771F8"><enum>(A)</enum><text>an institution; </text></subparagraph><subparagraph id="idD538713713E9429F87F3A12981F6F87D"><enum>(B)</enum><text>an athletic department;</text></subparagraph><subparagraph id="id61F5FCAAB1A0401E8689E42EBF7EFDCD"><enum>(C)</enum><text>an organization or a foundation that provides financial support to an institution or athletic department;</text></subparagraph><subparagraph id="id96B239DFB9AF4579A8AF43CC2793E650"><enum>(D)</enum><text>a conference; </text></subparagraph><subparagraph id="id543704AA4EA842919F4E00D0798FA3DF"><enum>(E)</enum><text>an athletic association;</text></subparagraph><subparagraph id="id457CB87D69C543C68058B2B1A85DA311"><enum>(F)</enum><text>a certified agent; or</text></subparagraph><subparagraph id="id3aa0d359905b4858a9e73aee1d1137d9"><enum>(G)</enum><text>an employee of any such individual or entity.</text></subparagraph></paragraph><paragraph id="id23535f5150e742e3b04c7fa49df30690"><enum>(22)</enum><header>Varsity intercollegiate athletic program</header><text>The term <term>varsity intercollegiate athletic program</term> means a sport played at the intercollegiate level, administered by an athletic department, for which eligibility requirements for participation by student athletes are established by an athletic association.</text></paragraph><paragraph id="idc3211c552b38451baa9754928cd9c8a3"><enum>(23)</enum><header>Varsity intercollegiate sports competition</header><text>The term <term>varsity intercollegiate sports competition</term> means a competition involving 2 or more varsity intercollegiate athletic programs sponsored by different institutions.</text></paragraph></section><section id="id2f0ec3ab98584fb587f568cb7d3fb13a"><enum>3.</enum><header>Student athlete name, image, and likeness rights and protections</header><subsection id="idbdf36e891b94407ea46a7cd7b5143052"><enum>(a)</enum><header>In general</header><text>Except as provided in section 4, an athletic association, a conference, or an institution, or any representative of such an entity, shall permit a student athlete or a group of student athletes—</text><paragraph id="id185fa02f703b4afca648c70e909b1eca"><enum>(1)</enum><text>to market, or to earn covered compensation for the value of, their name, image, or likeness; and</text></paragraph><paragraph id="id27f3897013574d0dafe9d24b63cacf83"><enum>(2)</enum><text>to obtain or retain a certified agent for any matter or activity relating to such covered compensation.</text></paragraph></subsection><subsection id="id51f21459b73a44a8b2d9dc5c1a699578"><enum>(b)</enum><header>Consent and compensation for group use</header><paragraph id="idfdea722861ae4c78808d0594db346882"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a third party may not use the name, image, or likeness of any group described in subsection (a) to sell or promote any product or service unless the third party obtains the written consent from each member of the group for that purpose.</text></paragraph><paragraph id="id08d3e9572e324ea387b3aa1262a89d5a"><enum>(2)</enum><header>Certain third party agreements with institutions, conferences, and athletic associations</header><subparagraph id="id13A3B39D3C0249919D99E0B9A59B4545"><enum>(A)</enum><header>In general</header><text>Paragraph (1) shall not apply to a third party that enters into an agreement with an institution, a conference, or an athletic association to produce or distribute live, archival, or delayed audiocast or videocast of a varsity intercollegiate sports competition of the institution, including—</text><clause id="idEAF6DDEE6B3D470CA5C891EF379DAF9F"><enum>(i)</enum><text>a commercial that promotes such a competition; and</text></clause><clause id="id0E695F2BF7AC42AA913330C4D585E9E8"><enum>(ii)</enum><text>audio or video distributions of such a competition.</text></clause></subparagraph><subparagraph id="idD534E741D91F4011AA0CA82C0C661E3A"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in this paragraph may be construed to require an institution, a conference, or an athletic associations to provide compensation or payment to any student athlete for appearing in an audiocast or videocast of a varsity intercollegiate sports competition of an institution.</text></subparagraph></paragraph></subsection><subsection id="id99795fea71cd4bf8b10d454578a2a7e1"><enum>(c)</enum><header>Rescission of agreements</header><text>In the case of a student athlete who no longer participates in a varsity intercollegiate athletic program, the student athlete may rescind a name, image, and likeness agreement with a remaining term of more than 1 year—</text><paragraph id="id9693cb1748434af5bf765d1cfc13b9f5"><enum>(1)</enum><text>without being held liable for breach; and</text></paragraph><paragraph id="id6b58f0e7a7724896a1455b0516536d00"><enum>(2)</enum><text>with no obligation to return payments received before giving notice of the rescission.</text></paragraph></subsection><subsection id="ida3c52ca587f84aeab5b5761f28f891b9"><enum>(d)</enum><header>Educational resources</header><text>The Commission shall make available on a publicly accessible internet website of the Commission educational resources for student athletes with respect to financial and contract literacy and earning covered compensation for the commercial use of the name, image, or likeness of the student athlete, which shall—</text><paragraph id="idf655a1649b4341ec92553aee28a316c4"><enum>(1)</enum><text>generally describe the legal and business concepts to be considered in licensing publicity rights; and</text></paragraph><paragraph id="id1b6102044e384d2396c4b3d785b798d0"><enum>(2)</enum><text>include information concerning the implications of contract provisions that may restrict a student athlete’s choice of institutions or bind the student athlete to long-term arrangements.</text></paragraph></subsection></section><section id="idc81e47271fbe447a80e92de3db242d52"><enum>4.</enum><header>Prohibitions on certain activities of institutions, boosters, and third parties</header><subsection id="id468d078c05db483cb275a22b174c0fcf"><enum>(a)</enum><header>Restrictions on earning covered compensation</header><text>Except as provided in a rule established in accordance with section 8, an athletic association, a conference, or an institution may not—</text><paragraph id="id23e6dd44b2104710babc8e536434edb0"><enum>(1)</enum><text>adopt or maintain a contract, rule, regulation, standard, or other requirement that prevents or unduly restricts a student athlete from earning covered compensation for the use of the name, image, or likeness of the student athlete;</text></paragraph><paragraph id="id3b0c9c0904ef4eae8316eb9626543b3e"><enum>(2)</enum><text>impose a speech restriction for student athletes that is more stringent than any speech restriction imposed on other students at the same institution;</text></paragraph><paragraph id="id826611ac9e254edc8af910da1d5d3328"><enum>(3)</enum><text>limit athletic opportunities for a student athlete solely on the basis of the student athlete’s commercial use of his or her name, image, or likeness; or</text></paragraph><paragraph id="idd6fa6066852e4e36a89322cf642b8a5f"><enum>(4)</enum><text>coordinate or cooperate with any other institution, conference, or athletic association to limit payment offered to a student athlete under a name, image, and likeness agreement.</text></paragraph></subsection><subsection id="id271df93a3b6b46709d345f040d8bf445"><enum>(b)</enum><header>Classification of student athletes</header><text>Notwithstanding any other provision of Federal or State law, a student athlete shall not be considered an employee of an athletic association, a conference, or an institution with respect to the participation of the student athlete in a varsity intercollegiate sports competition.</text></subsection><subsection id="idf9df8f85a1b0489d8f611f746c0feeae"><enum>(c)</enum><header>Scholarships</header><text>An institution, a conference, or an athletic association may not revoke, reduce, or impose a condition on an athletic scholarship of a student athlete based on the student athlete having earned covered compensation or having obtained a certified agent in accordance with this Act.</text></subsection><subsection id="ida2f0692565684e9f885937781875db96"><enum>(d)</enum><header>Preventing conflicts of interest</header><text>An institution, an athletic association, a conference, or a business partner of such an entity may not—</text><paragraph id="ida96097aec1584d0b93f69eb528040216"><enum>(1)</enum><text>represent a student athlete or prospective student athlete in a name, image, and likeness agreement;</text></paragraph><paragraph id="id93ef11c99b214a9688d252859e790064"><enum>(2)</enum><text>arrange a name, image, and likeness agreement on behalf of a student athlete or prospective student athlete;</text></paragraph><paragraph id="id42df04f1da59439cbef3337272dc0543"><enum>(3)</enum><text>enter into a name, image, and likeness agreement with a student athlete or prospective student athlete;</text></paragraph><paragraph id="id7ceec0696ffd48e0973dd48480c7a7b7"><enum>(4)</enum><text>regulate the representation of a student athlete or a group of student athletes or a prospective student athlete or group of prospective student athletes with respect to a name, image, and likeness agreement; or</text></paragraph><paragraph id="idf14f679fa1af445c97c3bedc397f885b"><enum>(5)</enum><text>engage in the certification or promotion of individuals for such representation.</text></paragraph></subsection><subsection id="id4E55A88F83304B1A821786E5BB4E05F0"><enum>(e)</enum><header>Certified agent restriction</header><paragraph id="id28314B2AFB7B41CCA5357663CB2E4A5C"><enum>(1)</enum><header>In general</header><text>A certified agent may not represent a prospective student athlete in a name, image, and likeness agreement if the prospective student athlete plans to enroll in an institution and participate in a varsity intercollegiate sports competition for such institution. </text></paragraph><paragraph id="idC85D251D4C77455AA338AB46D21D7F4F"><enum>(2)</enum><header>Exclusion</header><text>For purposes of this subsection, a family member of a prospective student athlete shall not be considered to be a certified agent with respect to representation of the prospective student athlete.</text></paragraph></subsection><subsection id="idd67e2f741f3f47c2b45edda0dca961d2"><enum>(f)</enum><header>Conflicts with contracts or rules of institution</header><paragraph id="idce72ca777f234d48b15a0114e5b12077"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a third party may not enter into, or offer to enter into, a name, image, and likeness agreement with a student athlete that provides covered compensation if a provision of the name, image, and likeness agreement conflicts with a provision of a contract, rule, regulation, standard, or other requirement of the applicable institution.</text></paragraph><paragraph id="idd953ddb9e60d44a98ecdbdb81d3fb611"><enum>(2)</enum><header>Exception</header><text>A third party may enter into, or offer to enter into, a name, image, and likeness agreement with a student athlete that conflicts with a provision of a contract, rule, regulation, standard, or other requirement of the applicable institution if—</text><subparagraph id="id87c5bbe907214405a90644f789c937de"><enum>(A)</enum><text>the institution consents, in writing, to the name, image, and likeness agreement; or</text></subparagraph><subparagraph id="id76f3c94f86b948a798b3c7a63e806c98"><enum>(B)</enum><text>the contract, rule, regulation, standard, or other requirement unduly restricts student athletes from earning covered compensation for the use of the name, image, or likeness of the student athlete, as determined by the Commission.</text></subparagraph></paragraph><paragraph id="idd7d1f46dd90345bd94a20514d853ea69"><enum>(3)</enum><header>Disclosures</header><subparagraph id="id0bf5ad648b7b4ef09ebff44e823bd3ea"><enum>(A)</enum><header>Conflicts</header><text>An institution asserting a conflict described in paragraph (1) shall disclose to the certified agent and the Commission each relevant term of the contract, rule, regulation, standard, or other requirement of the varsity intercollegiate athletic program.</text></subparagraph><subparagraph id="idedfae25043be4630bcf65ffe869b275a"><enum>(B)</enum><header>Restrictions</header><text>A certified agent asserting a restriction described in paragraph (2)(B) shall disclose to the Commission the nature of such restriction.</text></subparagraph></paragraph></subsection><subsection id="id68adc90cc7b54f5e89537f65b783bf36"><enum>(g)</enum><header>Agent activities</header><text>An individual may not carry out any agent activity or representation of a student athlete with respect to a student athlete name, image, and likeness agreement unless the individual is a certified agent.</text></subsection><subsection id="idd840d9527291451f8cc352473a805c97"><enum>(h)</enum><header>Prohibited agreements</header><text>An athletic association, a conference, or an institution may prohibit a student athlete from entering into a name, image, and likeness agreement with a third party for the promotion of gambling, tobacco, or alcohol products, or adult entertainment.</text></subsection></section><section id="id84b3cd85ee754449bcaf9d29ebe58cb0"><enum>5.</enum><header>Transparency and accountability relating to name, image, and likeness agreements and student athlete endorsements</header><subsection id="id8d41834c41ec49b6ba003a01902ce292"><enum>(a)</enum><header>Receipt of covered compensation</header><text> Not later than 5 days after the date on which a student athlete receives covered compensation under a name, image, and likeness agreement, the certified agent representing the student athlete shall report to the institution—</text><paragraph id="idfa7276c71c0547b4876a5ea4930b4b47"><enum>(1)</enum><text>the receipt and amount of such covered compensation; and</text></paragraph><paragraph id="id075b79007deb4cfabf77d331789a3398"><enum>(2)</enum><text>the terms and conditions of the name, image, and likeness agreement, including the name of each party to the agreement.</text></paragraph></subsection><subsection id="id382d2f3d93c0491999467c2a1cb2b3dc"><enum>(b)</enum><header>Written consent required</header><text>An institution may not publicly disclose any information with respect to a name, image, and likeness agreement between a student athlete and a third party without the express written consent of the student athlete. </text></subsection></section><section id="idb6a6dfdd76274531920258df1c059ecb"><enum>6.</enum><header>Limitation on transfer penalties; prohibition on inducements</header><subsection id="idd9d6c6352f6846bfa35a6c7bd108f089"><enum>(a)</enum><header>Limitation on transfer penalties</header><text>An institution, an athletic association, or a conference shall allow a student athlete to transfer from one institution to another not less than once without losing or delaying grant-in-aid opportunities or eligibility to participate in a varsity intercollegiate sports competition if—</text><paragraph id="id0b2bd5d72b934bffa592c66889fb97ab"><enum>(1)</enum><text>not less than 7 days before transferring, the student athlete provides to his or her institution notice of intent to transfer; and</text></paragraph><paragraph id="id2e02fd4296c743d7a08daea54ab47027"><enum>(2)</enum><text>the transfer does not occur during—</text><subparagraph id="id73571e1f0bf04e549de2b57dd87aa081"><enum>(A)</enum><text>the season of the varsity intercollegiate sports competition of the student athlete; or</text></subparagraph><subparagraph id="idef0da0bd965b495f8f924edd6d9a125f"><enum>(B)</enum><text>the 60-day period before the commencement of such season.</text></subparagraph></paragraph></subsection><subsection id="id2d45d361931247d3b9788eb1f301cdd4"><enum>(b)</enum><header>Prohibition on inducements</header><paragraph id="id9D4B267B16864BFF90A997BE7D6C5F24"><enum>(1)</enum><header>In general</header><text>An institution, an athletic association, a conference, a booster, a third party, or any agent of such an entity, may not offer or provide—</text><subparagraph id="id9E970C9AC8494F9EAEC738720323D4B5"><enum>(A)</enum><text>a student athlete with any compensation or benefit (other than grant-in-aid) that is—</text><clause id="id9839e1945de64fa99114046e48a6f539"><enum>(i)</enum><text>conditioned on the student athlete enrolling in, maintaining enrollment in, or transferring to a particular institution; or</text></clause><clause id="id6fd2d954fbb949ce9adfff9dc6f1452d"><enum>(ii)</enum><text>intended to induce the student athlete to enroll in, maintain enrollment in, or transfer to a particular institution; or</text></clause></subparagraph><subparagraph id="idAF8F332D677C4BC1AB0D17AE615BC928"><enum>(B)</enum><text>a prospective student athlete with any compensation or benefit (other than grant-in-aid) that is—</text><clause id="idf8a77ca4b34a487da479217b8402fd55"><enum>(i)</enum><text>conditioned on the prospective student athlete enrolling in a particular institution; or</text></clause><clause id="id4a1bae774a784cff9b93106025f8f384"><enum>(ii)</enum><text>intended to induce the prospective student athlete to enroll in a particular institution.</text></clause></subparagraph></paragraph><paragraph id="idc689a5f1094042c9b5942ab3fb8ab1cf"><enum>(2)</enum><header>Campus tours</header><text>Notwithstanding paragraph (1), an institution, an athletic association, or a conference may provide to a student athlete or a prospective student athlete reimbursement for expenses relating to campus tours or visits. </text></paragraph></subsection></section><section id="id44f92484322f43758f85dcc84f5d4427"><enum>7.</enum><header>Enforcement by the Commission</header><subsection id="id0411693121a642afa8c14e0418e3a6e1"><enum>(a)</enum><header>Office of Sport</header><paragraph id="id5a8c7eb0498b4ab7b21a1aa15da1cd87"><enum>(1)</enum><header>Establishment</header><text>Not later than 30 days after the date of the enactment of this Act, the Chair shall—</text><subparagraph id="id86803D5D37644DE2B22DB1CE88CA0C0F"><enum>(A)</enum><text>establish within the Commission the <quote>Office of Sport</quote> (in this section referred to as the <quote>Office</quote>); and</text></subparagraph><subparagraph id="id1E1CA518255148CE9C28230BABC0BEC3"><enum>(B)</enum><text>appoint a Director of the Office (in this section referred to as the <quote>Director</quote>).</text></subparagraph></paragraph><paragraph id="idcbcccd6b9c3c4a3cbe5f6b8c86be8daf"><enum>(2)</enum><header>Purpose</header><text>The purpose of the Office is to assist the Commission in protecting amateur, collegiate, and professional athletes from unfair methods of competition and unfair or deceptive acts or practices in or affecting commerce under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id5aad360e15f54be1bbe8bf7fb54ef082"><enum>(b)</enum><header>Duties</header><paragraph id="idaf3bda76d1da45cba01951054d235666"><enum>(1)</enum><header>In general</header><text>The Director shall engage in activities that include—</text><subparagraph id="idb56d4069477c4819b70a0daf758f98c1"><enum>(A)</enum><text>leading and coordinating the Commission’s work in furtherance of the purpose described in subsection (a)(2);</text></subparagraph><subparagraph id="id437652c83dfa479495d8f26b10b0be2d"><enum>(B)</enum><text>coordinating and consulting with the Bureau of Consumer Protection of the Commission and the Bureau of Competition of the Commission;</text></subparagraph><subparagraph id="id71ce2699646f4732be8c9b8c72bfdd04"><enum>(C)</enum><text>developing guidance and recommendations; and</text></subparagraph><subparagraph id="idfabcfb56a3514b38b308ce9ea00fec04"><enum>(D)</enum><text>organizing public workshops, issuing reports, and providing educational materials.</text></subparagraph></paragraph><paragraph id="id53e00ccbe59e41a9bd15f0110a824cdc"><enum>(2)</enum><header>Oversight of name, image, and likeness rights and protections</header><text>With respect to the implementation of this Act, the duties of the Office are as follows:</text><subparagraph id="idca98b7f5757541b78515ebfd2d945d75"><enum>(A)</enum><text>To establish a process for hearing, addressing, and resolving complaints, concerns, conflicts, and grievances from student athletes, institutions, conferences, athletic associations, certified agents, and third parties alleging violations of this Act or any rule or standard developed under this Act.</text></subparagraph><subparagraph id="ide63255cacdc4495a85abe1a1760d0076"><enum>(B)</enum><text>To establish a certification process and set and enforce standards for, and maintain a registry of, certified agents.</text></subparagraph><subparagraph id="id04d1a109ab794c15a3690e41e7aab838"><enum>(C)</enum><text>To determine the financial limits for boosters, as described in clauses (i) and (ii) of section 2(4)(A).</text></subparagraph><subparagraph id="id97a08c75583a40fabbb7b58a0d329826"><enum>(D)</enum><text>On an ongoing basis and as necessary, to gather and compile information relating to the development and status of the student athlete name, image, and likeness market.</text></subparagraph><subparagraph id="idb0b59f4009de4f5a960a321f03219a06"><enum>(E)</enum><text>To provide confidential guidance to student athletes.</text></subparagraph><subparagraph id="id673d0ed3947c4913a3e0c513f1e00586"><enum>(F)</enum><text>To develop rules to carry out the activities described in this paragraph.</text></subparagraph></paragraph></subsection><subsection id="id6a94f54a00f3485499b685444c177c28"><enum>(c)</enum><header>Enforcement authority</header><paragraph id="idd34ca289520140d1b353349df74a139a"><enum>(1)</enum><header>In general</header><text>A violation of this Act or any rule or standard developed pursuant to subsection (b)(2) shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id0e7ff2f7afe846c599ed4a041c6849be"><enum>(2)</enum><header>Powers of the Federal Trade Commission</header><text>The Commission shall enforce this Act and any rule or standard developed pursuant to subsection (b)(2) in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></paragraph><paragraph id="idd67b33a1fb474598be63e61a8f08e4e6"><enum>(3)</enum><header>Nonprofit organizations</header><text>Notwithstanding section 4 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>) or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act and any rule or standard developed pursuant to subsection (b)(2) in the same manner provided in paragraph (1), with respect to organizations not organized to carry on business for their own profit or that of their members.</text></paragraph><paragraph id="id253a31f83e6d4efd9648ddd502669157"><enum>(4)</enum><header>Penalties; privileges and immunities</header><text>Any person who violates this Act or any rule or standard developed pursuant to subsection (b)(2) shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph></subsection></section><section id="ide24f0bbff9d143e7beaa0d064917b768"><enum>8.</enum><header>Role of athletic associations and conferences</header><text display-inline="no-display-inline">Athletic associations and conferences may—</text><paragraph id="id7cdae70a97364d45ab2bcc21c4a6caff"><enum>(1)</enum><text>establish rules, consistent with this Act and any rule or standard developed under this Act;</text></paragraph><paragraph id="idbc971da9698647d3b896a6f042e4b18b"><enum>(2)</enum><text>establish rules that prohibit payments of compensation to prospective student athletes and student athletes by institutions, conferences, and athletic associations; and </text></paragraph><paragraph id="id5339914886ed490494371ebeb320cf4e" commented="no"><enum>(3)</enum><text>enforce the rules established under paragraphs (1) and (2) by declaring ineligible for a varsity intercollegiate sports competition a student athlete or a prospective student athlete who receives payments in violation of this Act or any rule or standard developed under this Act. </text></paragraph></section><section id="idfb08426868554a17a35a70395824b4f2"><enum>9.</enum><header>Comptroller General report on health, safety, and education needs</header><subsection id="id7b6b25d6d433411994f3414681025526"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the appropriate committees of Congress a report on the health, safety, and education needs of student athletes.</text></subsection><subsection id="id23b734ccc7c6450c947e1f59d2705961"><enum>(b)</enum><header>Contents of report</header><text>The report required by subsection (a) shall include the following:</text><paragraph id="id256c6dcca8bd4da78693d2a9f6a59599"><enum>(1)</enum><text>An analysis of the current state of student athlete health insurance coverage in the United States, including a comparison of amounts and types of coverage offered by institutions of varying sizes and resources.</text></paragraph><paragraph id="ida78ad4d953f64e3bab0c9f741c8d1bfa"><enum>(2)</enum><text>An analysis of the degree to which student athletes are not covered for injuries or conditions related to their participation in athletics.</text></paragraph><paragraph id="id02134a12fd3942789f90d55c442f6f7e"><enum>(3)</enum><text>An analysis of the additional cost to institutions of providing health insurance coverage to student athletes for each year, up to 5 years, after graduation.</text></paragraph><paragraph id="idfb921173d1d74da5b6ee60cc197e17cc"><enum>(4)</enum><text>An analysis of the need for health and safety standards for varsity intercollegiate athletic programs.</text></paragraph><paragraph id="id4d88aaeedc4140e6bc13d6db897cb8c2"><enum>(5)</enum><text>An analysis of the current authorities and activities of the Department of Health and Human Services to determine whether the Department of Health and Human Services possesses the appropriate authority or expertise to develop and enforce such health and safety standards.</text></paragraph><paragraph id="id8990712410c34583bb3b3f52c17fe7a7"><enum>(6)</enum><text>An analysis of the extent to which student athletes are unable to complete their degree due to losing scholarship support before graduation within 4 years.</text></paragraph><paragraph id="idb90c7fbebf1c429f9b887bc74317ebca"><enum>(7)</enum><text>An analysis of the additional cost to institutions of providing guaranteed scholarships for student athletes for each additional year, up to 5 years, after a typical 4-year enrollment. </text></paragraph></subsection></section><section id="id568234fff3c14fd1acf4a54b407f0f05"><enum>10.</enum><header>Limitation of liability</header><subsection id="id340a02646f21464989e6fe89e3f21056"><enum>(a)</enum><header>In general</header><text>An institution, a conference, and an athletic association shall comply with the requirements of this Act and with any rule or standard developed under this Act, but shall not be held liable under any provision of Federal or State law for prohibiting a student athlete or prospective student athlete from being paid by an institution, conference, or athletic association or for prohibiting a student athlete or prospective student athlete from being paid for the commercial use of the name, image, or likeness of the student athlete or prospective student athlete before the date of the enactment of this Act.</text></subsection><subsection id="id1990a7049d6d46e39179d044db30e186"><enum>(b)</enum><header>Rule of construction</header><text>Except as provided in subsection (a), nothing in this Act or the fact or circumstances of the enactment of this Act may be construed to or relied upon by any court—</text><paragraph id="id237bf6208e6545f0a4297c66c255adbe"><enum>(1)</enum><text>to alter the application of Federal or State antitrust law to intercollegiate athletics;</text></paragraph><paragraph id="id5d58ee23b48049eaa3615b9c5e6d8ce6"><enum>(2)</enum><text>to imply the creation of any cause of action not created expressly by this Act; or</text></paragraph><paragraph id="id6f0bb93e46544800910c78b2b0866ad8"><enum>(3)</enum><text>to retroactively create liability, or invalidate legal defenses, related to aspects of intercollegiate athletics not directly addressed by this Act.</text></paragraph></subsection></section><section id="idad7fd2b0570d4553b33af5918c2a086c"><enum>11.</enum><header>Relationship to State laws</header><subsection id="id87A74C21EBF94F09A0C7C35AFED86F47"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No State or political subdivision of a State may establish or continue in effect any law, regulation, rule, requirement, or standard that governs or regulates the compensation, publicity rights, employment status, or eligibility for competition of a student athlete or prospective student athlete, including any provision that governs or regulates the commercial use of the name, image, or likeness of a student athlete or prospective student athlete; </text></subsection><subsection id="idA5BC871D77214AF1B0914FFFEAEA38A1"><enum>(b)</enum><header>Unauthorized use by a third party</header><text display-inline="yes-display-inline">A State or political subdivision of a State may establish and enforce laws that prohibit the unauthorized use of the name, image, and likeness of a student athlete or prospective student athlete by a third party.</text></subsection></section><section id="id00244614e57f4462855b559304d66a0e"><enum>12.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Commission such sums as are necessary to carry out this Act. </text></section></legis-body></bill>
