<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4846</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220914">September 14, 2022</action-date><action-desc><sponsor name-id="S362">Mr. Kaine</sponsor> (for himself, <cosponsor name-id="S354">Ms. Baldwin</cosponsor>, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, and <cosponsor name-id="S361">Ms. Hirono</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to require institutions of higher education to have an independent advocate for campus sexual assault prevention and response. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Survivor Outreach and Support Campus Act</short-title></quote> or the <quote><short-title>SOS Campus Act</short-title></quote>.</text></section><section id="id350E30D5A2B4464FA55C4F6C1A5F0F88"><enum>2.</enum><header>Independent advocate for campus sexual assault prevention and response</header><text display-inline="no-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0F118D7D2871480AB678073FE23171E0"><section id="id8E092ED1CE4F43C8AACF49117067BA83"><enum>124.</enum><header>Independent advocate for campus sexual assault prevention and response</header><subsection id="idAA3C8FBD13644ABA8A2956CE0F9D2C72"><enum>(a)</enum><header>Advocate</header><paragraph id="id1e926cb727874bc2b39caeece5a2c90f"><enum>(1)</enum><header>In general</header><subparagraph id="id07de6210f327428589a64b1153e19a14"><enum>(A)</enum><header>Designation</header><text>Each institution of higher education that receives Federal financial assistance under title IV shall designate an independent advocate for campus sexual assault prevention and response (referred to in this section as the <quote>Advocate</quote>) who shall be appointed based on experience and a demonstrated ability of the individual to effectively provide sexual assault victim services.</text></subparagraph><subparagraph id="id83a8b33d2468425aa6dd97401f339a63"><enum>(B)</enum><header>Notification of existence of and information for the advocate</header><text>Each employee of an institution described in subparagraph (A) who receives a report of sexual assault shall notify the victim of the existence of, contact information for, and services provided by the Advocate of the institution.</text></subparagraph><subparagraph id="id2116aaa3fd0d499eb735f1d273fc80cc"><enum>(C)</enum><header>Appointment</header><text>Not later than 180 days after the date of enactment of the <short-title>Survivor Outreach and Support Campus Act</short-title>, the Secretary shall prescribe regulations for institutions to follow in appointing Advocates under this section. At a minimum, each Advocate shall—</text><clause id="id14B824C9090D4BBBA08D5BA301D0585A"><enum>(i)</enum><text>report to an individual outside the body responsible for investigating and adjudicating sexual assault complaints at the institution; and</text></clause><clause id="idA66624BDF6EB4865A87FC4F80E9C6D71"><enum>(ii)</enum><text>submit to such individual an annual report summarizing how the resources supplied to the Advocate were used, including the number of male and female sexual assault victims assisted.</text></clause></subparagraph></paragraph><paragraph id="idf56a926c8f9e4dd0acdf35f3fbceba7e"><enum>(2)</enum><header>Role of the advocate</header><text>In carrying out the responsibilities described in this section, the Advocate shall represent the interests of the student victim even when in conflict with the interests of the institution. The Advocate may not be disciplined, penalized, or otherwise retaliated against by the institution for representing the interest of the victim, in the event of a conflict of interest with the institution.</text></paragraph></subsection><subsection id="id2d00bb44284345a8b1cdc1a2953431d3"><enum>(b)</enum><header>Sexual assault</header><text>In this section, the term <term>sexual assault</term> means an offense classified as a forcible or nonforcible sex offense under the uniform crime reporting system of the Federal Bureau of Investigation. </text></subsection><subsection id="ide4e53333ff21414085ca966f08577c1c"><enum>(c)</enum><header>Responsibilities of the advocate</header><text>Each Advocate shall carry out the following, regardless of whether the victim wishes the victim's report to remain confidential:</text><paragraph id="idf2644b55f46d4345a3f8eb35bfde15d5"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD2B4EFEEAC184ED3A16B54F1344F6A95"><enum>(A)</enum><text>Ensure that victims of sexual assault at the institution receive, with the victim’s consent, the following sexual assault victim’s assistance services available 24 hours a day:</text><clause id="id1d5cbe30804b40eaa4ee996a707d3c29" indent="up1"><enum>(i)</enum><text>Information on how to report a campus sexual assault to law enforcement.</text></clause><clause id="idfab381e5e18e422c9d9b79f226075f8c" indent="up1"><enum>(ii)</enum><text>Emergency medical care, including follow up medical care as requested.</text></clause><clause id="id77321d3c03ab4dacb3aefe25823558c6" indent="up1"><enum>(iii)</enum><text>Medical forensic or evidentiary examinations.</text></clause></subparagraph><subparagraph id="ide0b45bf99d124186bafec0b099bc4628" indent="up1"><enum>(B)</enum><text>Ensure that victims of sexual assault at the institution receive, with the victim’s consent, the following sexual assault victim’s assistance services:</text><clause id="id9bf9f68c90f549e894fd778962a49161"><enum>(i)</enum><text>Crisis intervention counseling and ongoing counseling.</text></clause><clause id="idf91974b936a040008a1fa057a6b0676f"><enum>(ii)</enum><text>Information on the victim’s rights and referrals to additional support services.</text></clause><clause id="id490844b80ef141b999d7d84d0e85f05b"><enum>(iii)</enum><text>Information on legal services.</text></clause></subparagraph><subparagraph id="id8b23cbb532da432f9ab18a7c900941ef" indent="up1"><enum>(C)</enum><text>Provide the services described in subparagraphs (A) and (B) either—</text><clause id="ide0f9c6afb9c44bed95e9d268262d8d55"><enum>(i)</enum><text>pursuant to a memorandum of understanding (that includes transportation services) at a rape crisis center, legal organization, or other community-based organization located within a reasonable distance from the institution; or</text></clause><clause id="idc8d17b32b02545968e17c7d486a88adc"><enum>(ii)</enum><text>on the campus of the institution in consultation with a rape crisis center, legal organization, or other community-based organization.</text></clause></subparagraph><subparagraph id="ide5fdd4720dfd4180957cee9001c89f36" indent="up1"><enum>(D)</enum><text>Ensure that a victim of sexual assault may not be disciplined, penalized, or otherwise retaliated against for reporting such assault to the Advocate.</text></subparagraph></paragraph><paragraph id="id3529531266ea4f8c9b658fa286ebb389"><enum>(2)</enum><text>Guide victims of sexual assault who request assistance through the reporting, counseling, administrative, medical and health, academic accommodations, or legal processes of the institution or local law enforcement.</text></paragraph><paragraph id="iddc74d86e065c4fcbb58495261bb8fbf4"><enum>(3)</enum><text>Attend, at the request of the victim of sexual assault, any administrative or institution-based adjudication proceeding related to such assault as an advocate for the victim.</text></paragraph><paragraph id="id2eeef320c3db412dba7e83fc563daa3c"><enum>(4)</enum><text>Maintain the privacy and confidentiality of the victim and any witness of such sexual assault, and shall not notify the institution or any other authority of the identity of the victim or any such witness or the alleged circumstances surrounding the reported sexual assault, unless otherwise required by the applicable laws in the State where such institution is located.</text></paragraph><paragraph id="id470efdd594514f6397420680000becec"><enum>(5)</enum><text>Conduct a public information campaign to inform the students enrolled at the institution of the existence of, contact information for, and services provided by the Advocate, including—</text><subparagraph id="id1fc6ad8ffb0144848eaf24051ac57a80"><enum>(A)</enum><text>posting information—</text><clause id="id9b13530710af46e19975bf63e1c1acc8"><enum>(i)</enum><text>on the website of the institution;</text></clause><clause id="id2e4c2363bb9246daababf3709d8d7102"><enum>(ii)</enum><text>in student orientation materials; and</text></clause><clause id="ide551d0ea86514417b540b37f6b303108"><enum>(iii)</enum><text>on posters displayed in dormitories, cafeterias, sports arenas, locker rooms, entertainment facilities, and classrooms; and</text></clause></subparagraph><subparagraph id="id3931a48b3e644e81a9497c5e117e6ea9"><enum>(B)</enum><text>training coaches, faculty, school administrators, resident advisors, and other staff to provide information on the existence of, contact information for, and services provided by the Advocate.</text></subparagraph></paragraph></subsection><subsection id="idBF7EEC3B4EC94BA9B1EE261DA64731B1"><enum>(d)</enum><header>Clery Act and title IX</header><text>Nothing in this section shall alter or amend the rights, duties, and responsibilities under section 485(f) or title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) (also known as the <quote>Patsy Takemoto Mink Equal Opportunity in Education Act</quote>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
