which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for safe schools and safe communities.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Our Schools Act of 2022</short-title></quote>.</text></section><section id="id0b5bf725ac6b4ef7b2909fe30a00c3e3" commented="no"><enum>2.</enum><header>Nonprofit security grant program</header><text display-inline="no-display-inline">Section 2009 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609a">6 U.S.C. 609a</external-xref>) is amended—</text><paragraph id="id3b29ad953bb447e79d9f0f4a3a2ceaff" commented="no"><enum>(1)</enum><text>in subsection (e), by striking <quote>2020 through 2024</quote> and inserting <quote>2023 through 2030</quote>;</text></paragraph><paragraph id="id96fa80b594ca453eacbe2395ff60baf3" commented="no"><enum>(2)</enum><text>by redesignating subsection (f) as subsection (i);</text></paragraph><paragraph id="ide065107eb0c74d97995e51b3bc6d3f21" commented="no"><enum>(3)</enum><text>by inserting after subsection (e) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc12617fe12e94f438b4b11d6371cda28"><subsection id="id5e221373a14247ce901b6b9d4a0f711a" commented="no"><enum>(f)</enum><header>Feedback</header><paragraph id="id8d99a84b33cb416f99ffda7800a6e9d4" commented="no"><enum>(1)</enum><header>In general</header><text>If the Administrator denies an application for a grant under this section, not later than 120 days after the date of the denial, the Administrator shall—</text><subparagraph id="idfb2b766f27f341d4a20c6983ada15838" commented="no"><enum>(A)</enum><text>notify the applicant; and</text></subparagraph><subparagraph id="id9706cd75be0b4166a6b66bb6cca794b7" commented="no"><enum>(B)</enum><text>provide an explanation for the denial.</text></subparagraph></paragraph><paragraph id="id1e2b18cbfd504da4a30d82c62c9562b0" commented="no"><enum>(2)</enum><header>Explanation</header><text>An explanation described in paragraph (1)(B) shall include information identifying the reason for the denial of the application, including—</text><subparagraph id="idaeea981d324d480b9b2490298a59d2ae" commented="no"><enum>(A)</enum><text>any factors that led to a lower score or rank compared to other applicants; and</text></subparagraph><subparagraph id="id39335428d0d74978bbb82f8e3b604467" commented="no"><enum>(B)</enum><text>an identification of any deficiencies in the application.</text></subparagraph></paragraph></subsection><subsection id="id4b0a0003dbbd4d2f8029edb135ed085f" commented="no"><enum>(g)</enum><header>Administrative costs and technical assistance</header><text>A State through which the Administrator makes a grant to an eligible nonprofit organization under this section shall receive a 5-percent increase in the amount of the grant—</text><paragraph id="idfa94baa6a02e458fa9a99437d27ea00d" commented="no"><enum>(1)</enum><text>for administrative costs; and</text></paragraph><paragraph id="id721bf1864fb040c99210febd3d4f877b" commented="no"><enum>(2)</enum><text>to provide technical assistance to the eligible nonprofit organization.</text></paragraph></subsection><subsection id="id3b505011a70c41ad83dd0a34f31a4faa" commented="no"><enum>(h)</enum><header>Application update and improvements</header><paragraph id="id914a8df4673a4fe8b224745181325c4e" commented="no"><enum>(1)</enum><header>Public meeting</header><text>Not later than 90 days after the date of enactment of the <short-title>Securing Our Schools Act of 2022</short-title>, the Administrator shall hold a public meeting to solicit recommendations on updating the application process for a grant under this section.</text></paragraph><paragraph id="id942f139d18ac49ab9cbfaa39dc66806e" commented="no"><enum>(2)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of the <short-title>Securing Our Schools Act of 2022</short-title>, the Administrator shall—</text><subparagraph id="id76b4e13853484f459bf4e29e6e88b6a3" commented="no"><enum>(A)</enum><text>develop recommendations to modernize and update the application process for a grant under this section, which shall include considerations for—</text><clause id="id4578a72bc62742e0b46802ed45733d8c" commented="no"><enum>(i)</enum><text>establishing a more streamlined application process;</text></clause><clause id="idc400292c86eb42b08b141da5d8e3c92f" commented="no"><enum>(ii)</enum><text>establishing greater uniformity in the application process among all applicants and the guidance provided to States through which the Administrator makes grants to eligible nonprofit organizations under this section;</text></clause><clause id="idfe2775263a7a4d32841eafb0c3b1b8b8" commented="no"><enum>(iii)</enum><text>ensuring that the application template is compatible with the latest or most widely used version of software programs; and</text></clause><clause id="id43d3f740439949a2a87dd4039eede705" commented="no"><enum>(iv)</enum><text>coordinating with the Administrator of General Services to ensure that applications submitted under this section are compatible across online platforms of the Federal Government; and</text></clause></subparagraph><subparagraph id="idcf09795597d345a484a3c08096d1d36f" commented="no"><enum>(B)</enum><text>submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a report that includes—</text><clause id="ida0e1b6790ea9411382325adedb750d3b" commented="no"><enum>(i)</enum><text>the recommendations developed under subparagraph (A); and</text></clause><clause id="id66b115e8009c4c0992487c2d01445e0e" commented="no"><enum>(ii)</enum><text>a description of whether the recommendations developed under subparagraph (A) are consistent with feedback received at the public meeting required under paragraph (1).</text></clause></subparagraph></paragraph><paragraph id="idc7f4e48285364432bb21f4bba678e7b1" commented="no"><enum>(3)</enum><header>Implementation of recommendations</header><text>Not later than 270 days after the date of enactment of the <short-title>Securing Our Schools Act of 2022</short-title>, the Administrator shall implement the recommendations developed under paragraph (2)(A).</text></paragraph><paragraph id="id27a3509244064cbe8dd492ebe0d4b87b" commented="no"><enum>(4)</enum><header>Paperwork reduction act waiver</header><text>For the purpose of meeting the deadlines established under this subsection, the Secretary may waive the application of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, to the requirements of this subsection.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id6bd821c112864bccbd9b120f0a0a3714" commented="no"><enum>(4)</enum><text>in subsection (i), as so redesignated—</text><subparagraph id="id8f741166d32a4c159a224c86a4d7df87" commented="no"><enum>(A)</enum><text>in paragraph (1), by striking <quote>$75 million for each of fiscal years 2020 through 2024</quote> and inserting <quote>$540,000,000 for each of fiscal years 2023 through 2030</quote>;</text></subparagraph><subparagraph id="ide564efa7a4a34fd292f9b89210fced6a" commented="no"><enum>(B)</enum><text>by striking paragraph (2); and</text></subparagraph><subparagraph id="id73a9a1192af849d78dafc3cb102aa153" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideeafeb7107d841618ec234203988bd9d"><paragraph id="id26801e098cd24b5ea2e72e232842a948" commented="no"><enum>(2)</enum><header>High-risk urban areas</header><text>Of the amounts made available to carry out this section for each of fiscal years 2023 through 2030, not less than 0.35 percent shall be for grants to eligible recipients located in each high-risk urban area receiving grants under section 2003.</text></paragraph><paragraph id="id0c9832a35c054f629d8552504bc2090b" commented="no"><enum>(3)</enum><header>Salaries and expenses</header><text>Of the amounts made available to carry out this section in any fiscal year, the Administrator may transfer to another account of the Federal Emergency Management Agency not more than 3 percent for salaries and administrative expenses, including any necessary expenses to provide feedback or technical assistance to applicants for a grant under this section in accordance with subsection (g).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="ida2ecd97ff3594de4a95fb8f97e5546a2"><enum>3.</enum><header>Securing schools</header><subsection id="id312ab13cd2244bdeb7e5077e2f77b4af"><enum>(a)</enum><header>In general</header><paragraph id="ida1cb8e00907c4f5a98f97942e3983ba5"><enum>(1)</enum><header>Appropriation</header><text>There are authorized to be appropriated, and there are appropriated, to the Secretary of Education to carry out subpart 1 of part A of title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7111">20 U.S.C. 7111</external-xref>), $2,560,000,000 for fiscal years 2023 to 2032.</text></paragraph><paragraph id="iddf56f186bbd4432e8f6b42585c5954a3"><enum>(2)</enum><header>School security</header><text>The Secretary of Education shall use 50 percent of the funds appropriated under paragraph (1) to carry out clause (v) of section 4104(b)(3)(B) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(B)</external-xref>). </text></paragraph></subsection><subsection id="id05EF16534DED4955BAE83B879A373B58"><enum>(b)</enum><header>Elementary and Secondary Education Act of 1965</header><text display-inline="yes-display-inline">Section 4104 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114</external-xref>) is amended in subsection (b)(3)(B)—</text><paragraph id="id4c565924e52f43ac973f4495a52a541a"><enum>(1)</enum><text>in clause (iii), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph id="ida68fb593e3ed4898ae4b3ac4c9e5b74d"><enum>(2)</enum><text>by inserting after clause (iv) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9b36883d688045a0838eba2dcede67a5"><clause id="id15861edc0c1040169ee12efd4f0646ef"><enum>(v)</enum><text>improving school conditions for student learning, by enabling local educational agencies to use funds available under subsection (a)(3) for the purpose of planning and designing school buildings and facilities, installing infrastructure, and implementing technology or other measures, that strengthen security on school premises, which may include—</text><subclause id="iddbf1eca1da024f40a5faa53f371e9cce"><enum>(I)</enum><text>controlling access to school premises or facilities, through the use of metal detectors, or other measures, or technology, with evidence-based effectiveness (to the extent the State involved determines that such evidence is reasonably available), which may include—</text><item id="ided08761b9a3e44568477f1a270f37066"><enum>(aa)</enum><text>secured campus external gate or locked doors or check-in points;</text></item><item id="id81f274e33f434a01ad7eeef7de892ccc"><enum>(bb)</enum><text>active shooter alert systems;</text></item><item id="id21a7bf6d5fa5482e87689728d504a3ae"><enum>(cc)</enum><text>access control;</text></item><item id="idbaf79bba48574d1f908c0c44fc2465dc"><enum>(dd)</enum><text>internal door locks;</text></item><item id="id29fc508c0d614ab3962fe63bcac03dde"><enum>(ee)</enum><text>peepholes for classroom doors;</text></item><item id="ide82606d3dd6a4149bffd908a1d3d6aa4"><enum>(ff)</enum><text>school site alarm and protection systems;</text></item><item id="id19f5c3b8fc624a5b803fedc927fea0b9"><enum>(gg)</enum><text>metal detectors or x-ray machines (including portable);</text></item><item id="id1414838e70634613b66fe97adb6195ff"><enum>(hh)</enum><text>door locking mechanisms and access control doors;</text></item><item id="idc87e0bb96fe043288a5292ae951b79f1"><enum>(ii)</enum><text>increased lighting on school grounds;</text></item><item id="id11e934694efa48a2aa70a79d7a179585"><enum>(jj)</enum><text>emergency call boxes;</text></item><item id="id4abdc6c2c57c4a509f19c823191be9ca"><enum>(kk)</enum><text>two-way radios;</text></item><item id="id6da6e9db8ce74644a0551c04e2514f75"><enum>(ll)</enum><text>emergency alerts;</text></item><item id="id2750e6cded8043858694a29eab69a8f4"><enum>(mm)</enum><text>surveillance cameras or systems and infrastructure (such as poles and wiring);</text></item><item id="id31d90529888b4dec9f50305ee7e9e864"><enum>(nn)</enum><text>software costs and warranties;</text></item><item id="idb9c180665fd34ca29836c5d07d4c1b51"><enum>(oo)</enum><text>fencing and gating; and</text></item><item id="idda7a42a1eaf946b5968bb0a7c28a14fe"><enum>(pp)</enum><text>emergency generators to provide back-up power for phone systems, critical lighting, and essential outlets;</text></item></subclause><subclause id="id71ec476ace7541df95f600cc7a72b57d"><enum>(II)</enum><text>implementing any technology or measure, or installing any infrastructure, to cover and conceal students within the school during crisis situations;</text></subclause><subclause id="id05df85da9d6040cd809f524004c6e2c2"><enum>(III)</enum><text>implementing technology to provide coordination with law enforcement and notification to relevant law enforcement and first responders during such a situation, which shall include—</text><item id="idc94573827cc549d6b02e9b5b6833b0f8"><enum>(aa)</enum><text>emergency planning and preparation;</text></item><item id="id80287b98cf0b4f21b0dc1b33c932d231"><enum>(bb)</enum><text>emphasis on a school safety plan with buy in from all elements of the school community, including board members, employees, students, parents, law enforcers, government and business leaders, the media, and local residents;</text></item><item id="id456d3e62eacf43959c0933897f7a5bc0"><enum>(cc)</enum><text>school implementation of threat assessment programs;</text></item><item id="id6700b72530ee4d99aefd61b302f9461f"><enum>(dd)</enum><text>development of district-based mandatory incident reporting systems;</text></item><item id="ide9831652121b479da1ee3e80c4d9a860"><enum>(ee)</enum><text>establishment of local school safety advisory groups (including parents, families, judges, first responders, health and human service professionals, and mental health professionals);</text></item><item id="ida9c22b1320a6488b92348b9ed07489ab"><enum>(ff)</enum><text>evidence-based training for school resource officers, school personnel, and students to prevent student violence to enable them to recognize and quickly respond to warning signs;</text></item><item id="idcb06f63aae584fdbb1b02153c10bf1c5"><enum>(gg)</enum><text>development and operations of anonymous reporting systems;</text></item><item id="id350159a9f47c4bedb825f9a8d750f976"><enum>(hh)</enum><text>evidence-based school threat assessment and crisis intervention teams;</text></item><item id="id0d98a4db39cf40ceb7c2fd68fff89958"><enum>(ii)</enum><text>programs to facilitate coordination with local law enforcement;</text></item><item id="id6edc5c39e5504bfcaf6e9ceed30148dd"><enum>(jj)</enum><text>liability and insurance for school districts;</text></item><item id="id8003c3045d834a6e933ea0b4491b9c96"><enum>(kk)</enum><text>trauma-informed training for school staff on responses to active shooter situations; and</text></item><item id="id9891538d68af4959a3f57fb0a025a512"><enum>(ll)</enum><text>community engagement for planning and implementing safety policies and procedures;</text></item></subclause><subclause id="idc8995c4238904f35a188ed1c8b5c1d34"><enum>(IV)</enum><text>implementing any technology or measure, including hiring school security officers, or installing any infrastructure, with evidence-based effectiveness (to the extent the State involved determines that such evidence is reasonably available) to increase the safety of school students and staff;</text></subclause><subclause id="id97923b3338a84a07ae70f30e6ee22df6"><enum>(V)</enum><text>implementing any technology or measure, or installing any infrastructure, for school safety reinforcement, including bullet-resistant doors and windows; and</text></subclause><subclause id="id45c6eb38cf6842e4a87c2fb3c2e33dfa"><enum>(VI)</enum><text>implementing any technology or system that would reduce the time needed to disseminate official information to parents regarding the safety of their children during and immediately following a crisis;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idedf0434f29594041add55afb9f3783b0"><enum>4.</enum><header>Improving school security through the COPS ON THE BEAT program</header><text display-inline="no-display-inline">Section 1701(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381(b)</external-xref>) is amended—</text><paragraph id="idf2e90dc78121403197924d78c7d4c3d6"><enum>(1)</enum><text>in paragraph (22), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id0c30b60feddb4f24bbc9b8025e814d35"><enum>(2)</enum><text>in paragraph (23), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="id5537beccc60844a5ad58bf4c15440f5d"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7f257cfe408a4e8caf2fb8f81da5a3d8"><paragraph id="id3ea0be1460024493a65644c03c9ab398"><enum>(24)</enum><text>to pay salaries and expenses of school resource officers at public, charter, and private elementary schools and secondary schools (as such terms are defined under section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)); and</text></paragraph><paragraph id="idd89439e1e4d04683b9f8dc064002558e"><enum>(25)</enum><text>to improve physical school security at public, charter, and private elementary schools and secondary schools (as such terms are defined under section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) by obtaining security equipment to protect students in schools and equip law enforcement officers responding to school security issues and installing physical structure improvements, including—</text><subparagraph id="ideb0b1b45570c40949099c4ec5e8acbe6"><enum>(A)</enum><text>fencing, external gates, door locks, and check-in points, to establish a secured campus;</text></subparagraph><subparagraph id="id061407ff4ac74eef96e7ba9b19ae5684"><enum>(B)</enum><text>active shooter alert systems;</text></subparagraph><subparagraph id="id841a55c14b584b01bb47a4ff54ce7942"><enum>(C)</enum><text>access controls;</text></subparagraph><subparagraph id="id771446e18b99462da77fe81a14866313"><enum>(D)</enum><text>internal door locks;</text></subparagraph><subparagraph id="idd3c37ba5e5c94ab98c27dfcf329278f9"><enum>(E)</enum><text>school site alarm and protection systems;</text></subparagraph><subparagraph id="id36c5aaff4aed4677846fda694435780d"><enum>(F)</enum><text>metal detector or x-ray machines (including portable machines);</text></subparagraph><subparagraph id="id4f7bd09074de42d1ba603b0bae5b12c4"><enum>(G)</enum><text>ballistic safety equipment for schools and responding law enforcement officers;</text></subparagraph><subparagraph id="id92875406606c4d28b423257e8d40e3bb"><enum>(H)</enum><text>increased lighting on school grounds;</text></subparagraph><subparagraph id="id465d367497d146f3b8129020bfe94b19"><enum>(I)</enum><text>emergency call boxes;</text></subparagraph><subparagraph id="id45c1fd36ad4e4bb2a26f3f4d2c307d2d"><enum>(J)</enum><text>two-way radios;</text></subparagraph><subparagraph id="id90557539274a4fd9b3affe96f641d6e8"><enum>(K)</enum><text>emergency alert systems;</text></subparagraph><subparagraph id="idb051a01d74ab426eb89421da010e2275"><enum>(L)</enum><text>surveillance cameras or systems, including infrastructure for such systems such as poles and wiring;</text></subparagraph><subparagraph id="ida53c8c04d9d545b89bbe28b090b206ac"><enum>(M)</enum><text>software costs and warranties; and</text></subparagraph><subparagraph id="id09a16e62e72646449a0ce7f8b8806f0a"><enum>(N)</enum><text>emergency generators to provide back-up power for phone systems, critical lighting, and essential outlets.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id849532cc15764bfbaa96d8bf91c8e05e"><enum>5.</enum><header>Student mental health</header><subsection id="id10A6F3CD91D3406C9BF88EE6D2C92FFB"><enum>(a)</enum><header>Student access to mental health program fund</header><paragraph id="id69fb0b48fa71460b81cf88fda545614e"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id126ad04be51f4ac0af28874012940cac"><enum>(A)</enum><header>Eligible school</header><text>The term <term>eligible school</term> means a school in which the lowest grade at the school is not lower than grade 6 and the highest grade at the school is not higher than grade 12.</text></subparagraph><subparagraph id="ide032e03f858a4ceab170eee8658827b2"><enum>(B)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></subparagraph></paragraph><paragraph id="id8a61600281834882b32cf05f329049bc"><enum>(2)</enum><header>Student access to mental health program fund</header><subparagraph id="id0bcc8e018924489abf682e1641547d91"><enum>(A)</enum><header>In general</header><text>From the funds made available to carry out section 2001 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/20/3401">20 U.S.C. 3401</external-xref> note), $10,000,000,000 shall be transferred to establish the <quote>Student Access to Mental Health Program Fund</quote>, to remain available through September 30, 2031. The Secretary shall use amounts available in such Fund to award grants to States, from allocations under subparagraph (B), to enable the States to support the salary of a mental health professional in eligible schools located in the State.</text></subparagraph><subparagraph id="id91736007099b4037ba582bff1874df92"><enum>(B)</enum><header>Allocation</header><text>From the amounts available in the Fund established under subparagraph (A), the Secretary shall make an allocation to each State in the same proportion as the number of eligible schools located in the State.</text></subparagraph><subparagraph id="id943e6451d89f41209596150dd9257844"><enum>(C)</enum><header>Partnership</header><clause id="id1d150845930f4d989b30af25f0204010"><enum>(i)</enum><header>In general</header><text>A State awarded a grant under this subsection shall comply with the following:</text><subclause id="id823c318848784aabb3767d981441673c"><enum>(I)</enum><text>The State shall use the grant funds to cover the cost of the salary, which shall be not more than $55,000, for 10 years for a mental health professional to serve eligible schools located in the State. Such mental health professional shall serve not more than 5 eligible schools in any school year by rotating among the schools for not less than 1 day a week at each such school.</text></subclause><subclause id="idf5820e5058a74b5babf84b25cd245c65"><enum>(II)</enum><text>The State shall expend non-Federal funds to pay for the other costs of recruitment, training, and benefits for each such mental health professional, and any other expenses related to such employment.</text></subclause></clause><clause id="id3fb2aa94b5d54f3fb86821e123b6c4bd"><enum>(ii)</enum><header>Conditions of grants</header><text>A State awarded a grant under this subsection shall require that each eligible school served by the grant—</text><subclause id="idf4ae5c4de7b14cb7b02559b3163685cc"><enum>(I)</enum><text>provide to the parents of any student enrolled in the school who has not reached age 19 who meets with a mental health professional employed at the school with all counseling records and mental health assessments for such student;</text></subclause><subclause id="id2b245b7d8b284b97945b64bc64356674"><enum>(II)</enum><text>not teach Critical Race Theory or include Critical Race Theory in any school program; and</text></subclause><subclause id="ide47f649e2c2344f0aed6efc9f4aa251a"><enum>(III)</enum><text>not advocate for abortion or abortion services in any form.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id499376b35e604d89b1a45d01d455a476"><enum>(b)</enum><header>Funds for programs</header><text display-inline="yes-display-inline">The unobligated balance of funds made available to carry out sections 2021 and 6002 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) shall be transferred to, and evenly divided among, the following programs:</text><paragraph id="id73269806f4714cacacb70d153ebda921"><enum>(1)</enum><text>Project AWARE State Educational Agency Grant Program carried out by the Secretary of Health and Human Services.</text></paragraph><paragraph id="id0bc4d55f885145daa18a4a70c09a4cdf"><enum>(2)</enum><text>Student Support and Academic Enrichment Grant Program carried out by the Secretary of Education.</text></paragraph><paragraph id="id1cb5570d461a4453a7f19f976686e41b"><enum>(3)</enum><text>Community Mental Health Services Block Grant Program carried out by the Secretary of Health and Human Services.</text></paragraph><paragraph id="id8d0d28151df64cd9a50bdb9310325c03"><enum>(4)</enum><text>Children’s Mental Health Initiative of the Substance Abuse and Mental Health Services Administration.</text></paragraph></subsection><subsection id="idacb1ef6ef51a4f9a97c4ea8ea5d5bf33"><enum>(c)</enum><header>Best practices</header><paragraph id="idc91aa66b224c47d4852ee62a88513788"><enum>(1)</enum><header>ESEA definitions</header><text>In this subsection, the terms <quote>elementary school</quote> and <quote>secondary school</quote> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="id7840354c18ff4210af2c9e9139e6de15"><enum>(2)</enum><header>Development and dissemination of best practices</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the Substance Abuse and Mental Health Services Administration, the Secretary of Health and Human Services, and the Secretary of Education shall work in consultation to—</text><subparagraph id="id7ae8eddc568f4c438cb2e7b9ff33a4b0"><enum>(A)</enum><text>develop best practices for identifying warning signs of mental health problems with students and identify warning signs for teachers and administrator that a student is at high-risk for violence, specifically for a mass shooting;</text></subparagraph><subparagraph id="ida2ab8f951bb74cb0aeae71ec6805dd35"><enum>(B)</enum><text>develop best practices for identifying warning signs of mental health problems with children and identify warning signs for individuals who work at a social service agency that a child under the age of 18 is at high-risk for violence, specifically for a mass shooting; and</text></subparagraph><subparagraph id="ide21a2aecea914bb0817b9e538769c795"><enum>(C)</enum><text>disseminate the best practices developed under subparagraphs (A) and (B) to each elementary school and secondary school in the United States, and publish the best practices on a publicly accessible website of the Department of Education and the Substance Abuse and Mental Health Services Administration.</text></subparagraph></paragraph></subsection><subsection id="id71b7337ea4c045acb3543a7b154f777b"><enum>(d)</enum><header>GAO study</header><paragraph id="id6cf2acba5bd848ad8566792bd6e03bfc"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study on how many elementary schools and secondary schools in the United States have a mental health provider for students, how many students take advantage of the mental health services, the main causes for students to access the services.</text></paragraph><paragraph id="id74c5b90c40c04603b20627d739b83cea" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>ESEA definitions</header><text>In this subsection, the terms <quote>elementary school</quote> and <quote>secondary school</quote> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph></subsection></section><section id="idf1b4ca9ca6154954bdac13dc7711e422"><enum>6.</enum><header>Authorization and appropriations of funds</header><text display-inline="no-display-inline">The unobligated balance of funds made available to carry out section 18003 of division B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 565), section 313 of the Coronavirus Response and Relief Supplemental Appropriations Act, 2021 (division M of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 1929), and section 2001 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/20/3401">20 U.S.C. 3401</external-xref> note) shall be transferred to the Secretary of Education to be used to carry out this Act in an amount not to exceed $38,000,000,000. </text></section><section id="id611a104b5b1e4e478599ee0e514b7714"><enum>7.</enum><header>No Federal funding for abortions</header><subsection id="id89ddae0975684528a6ad0fbabbd34caf"><enum>(a)</enum><header>In general</header><text>No funds authorized or appropriated by this Act, or an amendment made by this Act, shall be expended for any abortion or counseling that results in encouraging, facilitating, or referral for an abortion.</text></subsection><subsection id="id9f5402e8580343f3bfa8ea748d0fe00c"><enum>(b)</enum><header>Health benefits coverage</header><text>No funds authorized or appropriated by this Act, or an amendment made by this Act, shall be expended for health benefits coverage that includes coverage of abortion.</text></subsection><subsection id="idbc75441e6b4d4685b2c9ebdf8ff6eb66"><enum>(c)</enum><header>Exceptions</header><text>The limitations established in paragraphs (a) and (b) shall not apply to an abortion—</text><paragraph id="id77ba29fecbd74701a1fd7fe16d87a987"><enum>(1)</enum><text>if the pregnancy is the result of an act of rape or incest; or</text></paragraph><paragraph id="idca493ed1762e4aea92038d8f5c4c6e8e"><enum>(2)</enum><text>in the case where a woman suffers from a physical disorder, physical injury, or physical illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would, as certified by a physician, place the woman in danger of death unless an abortion is performed. </text></paragraph></subsection></section></legis-body></bill>
