which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles 10 and 38, United States Code, to improve benefits and services for surviving spouses, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Love Lives On Act of 2022</short-title></quote>.</text></section><section id="idF419414FE09A4A4AB2CCF00E84D721BB"><enum>2.</enum><header>Removal of expiration on entitlement to Marine Gunnery Sergeant John David Fry Scholarship for surviving spouses</header><text display-inline="no-display-inline">Section 3311(f) of title 38, United States Code, is amended—</text><paragraph id="idA18A538E839B4C1398193E5359C6B602"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (2);</text></paragraph><paragraph id="idA6BC20223D5440C79EE8D6C90C9994D5"><enum>(2)</enum><text>by redesignating paragraphs (3) through (5) as paragraphs (2) through (4), respectively;</text></paragraph><paragraph id="idE34B8DF88EF74F198A9C9FD4E86ABCFF"><enum>(3)</enum><text>in paragraph (2), as redesignated by paragraph (2) of this section, by striking <quote>in paragraph (4)</quote> and inserting <quote>in paragraph (3)</quote>; and</text></paragraph><paragraph id="idF4D5765D43574C73A105B046DFA9825D"><enum>(4)</enum><text>in paragraph (3)(A), as redesignated by paragraph (2) of this section, by striking <quote>under paragraph (3)</quote> and inserting <quote>under paragraph (2)</quote>.</text></paragraph></section><section id="id44E7D3FE6A2D462E9AE20372E62DBE29"><enum>3.</enum><header>Modification of entitlement to veterans dependency and indemnity compensation for surviving spouses who remarry</header><subsection id="id7D053DFE3EB54255A723C00430C49CC3"><enum>(a)</enum><header>In general</header><text>Section 103(d) of title 38, United States Code, is amended—</text><paragraph id="id104C13603A414259A3ADB31EBF01ECB1"><enum>(1)</enum><text>in paragraph (2)(B)—</text><subparagraph id="id7cf23b1c4db34efaba47d0e6d689f32f"><enum>(A)</enum><text>by inserting <quote>(i)</quote> before <quote>The remarriage</quote>;</text></subparagraph><subparagraph id="idc8b296e8cb244c968239879748cb9c2b"><enum>(B)</enum><text>in clause (i), as designated by subparagraph (A), by striking <quote>Notwithstanding the previous sentence</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id2DF2CFB6B10A4D498746B22ADE0A430A"><clause id="id0B395DB679A145209C9A0AE1C4DD1E3A"><enum>(ii)</enum><text>Notwithstanding clause (i)</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idA7FC9FB597314E19B7BC2D24E9F97DFD"><enum>(C)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB6848ADFDDEB420C9F401E618568FFB9"><clause id="id4697fe80d92d4a4498aee39872fa0144"><enum>(iii)</enum><text>Notwithstanding clause (ii), the remarriage of a surviving spouse shall not bar the furnishing of benefits under section 1311 of this title to the surviving spouse of a veteran.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idf6a414465098427594b7edc28b76535e"><enum>(2)</enum><text>in paragraph (5)—</text><subparagraph id="id6B41CB2AEF644D0BA4AC6D87DFC5FB96"><enum>(A)</enum><text>by striking subparagraph (A); and</text></subparagraph><subparagraph id="idD0E12A9AECBE42D1969B09E802644B65"><enum>(B)</enum><text>by renumbering subparagraphs (B) through (E) as subparagraphs (A) through (D), respectively.</text></subparagraph></paragraph></subsection><subsection id="id86802b6ef49c4088859045a1a6f4003f"><enum>(b)</enum><header>Resumption of payments to certain individuals previously denied dependency and indemnity compensation</header><text>Beginning on the first day of the first month after the date of the enactment of this Act, the Secretary shall resume payment of dependency and indemnity compensation under section 1311 of such title to each living individual who— </text><paragraph id="id6cc71307dbd346968b4aec47840de69c"><enum>(1)</enum><text>is the surviving spouse of a veteran; and</text></paragraph><paragraph id="id162abe8661654ef683c156cbda6a72f6"><enum>(2)</enum><text>remarried before—</text><subparagraph id="id4acae44139cb40d99a636ad66e565964"><enum>(A)</enum><text>reaching age 55; and</text></subparagraph><subparagraph id="id80c85cbd714648a3ad9edb5d166f4329"><enum>(B)</enum><text>the date of the enactment of this Act. </text></subparagraph></paragraph></subsection></section><section id="id59E5118305034FD2880FC686180BED4D"><enum>4.</enum><header>Continued eligibility for survivor benefit plan for certain surviving spouses who remarry</header><text display-inline="no-display-inline">Section 1450(b)(2) of title 10, United States Code, is amended—</text><paragraph id="id74ebcfc1e8144b9aa82f62ed057a7efa"><enum>(1)</enum><text>by striking <quote>An annuity</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3253C080FBA348C3B25F97A2FB31DDD6"><subparagraph id="id778B5FB8C7364B93BABF1F3B610C06D3"><enum>(A)</enum><header>In general</header><text>(A) Subject to subparagraph (B), an annuity</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id74588b515fcf46e5b7fe25119c1caf18"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id78c4b7869d7544c6882144faf757f402"><subparagraph id="ided775250d08247ba885d6d412cabe032"><enum>(B)</enum><header>Treatment of survivors of members who die on active duty</header><text>The Secretary may not terminate payment of an annuity for a surviving spouse described in subparagraph (A) or (B) of section 1448(d)(1) solely because that surviving spouse remarries. In the case of a surviving spouse who remarried before reaching age 55 and before the date of the enactment of <short-title>Love Lives On Act of 2022</short-title>, the Secretary shall resume payment of the annuity to that surviving spouse—</text><clause id="idCFF980303A47486F8676CF54B4305799"><enum>(i)</enum><text>except as provided by clause (ii), for each month that begins on or after the date that is one year after such date of enactment; or</text></clause><clause id="idB7DA1E468CAE477A85C21DBDA328849A"><enum>(ii)</enum><text>on January 1, 2023, in the case of a surviving spouse who elected to transfer payment of that annuity to a surviving child or children under the provisions of section 1448(d)(2)(B) of title 10, United States Code, as in effect on December 31, 2019.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idd2866d2c180141d597dbb3cb2a4617e9"><enum>5.</enum><header>Access to commissary and exchange privileges for remarried spouses</header><subsection id="ide70a35b4f8d04f0bbb662c12f55d3f11"><enum>(a)</enum><header>Benefits</header><text>Section 1062 of title 10, United States Code, is amended—</text><paragraph id="idaa397172abba439d8ba2c7eaea1b9128"><enum>(1)</enum><text>by striking <quote>The Secretary of Defense</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide738fd4c741e4c4d958dcb615b01ab1f"><subsection id="id5cd973673dd54b7e85412acb9e036252"><enum>(a)</enum><header>Certain unremarried former spouses</header><text>The Secretary of Defense</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idF1A983415598452EB7435F43B4E63087"><enum>(2)</enum><text>by striking <quote>commissary and exchange privileges</quote> and inserting <quote>use commissary stores and MWR retail facilities</quote>; </text></paragraph><paragraph id="idae6a5bb887b140019f52fa74d1297123"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd54f3b3168504e7dac60e8d07cce4edd"><subsection id="id6896cb9569bd45669757cef97d64be15"><enum>(b)</enum><header>Certain remarried surviving spouses</header><text>The Secretary of Defense shall prescribe such regulations as may be necessary to provide that a surviving spouse of a deceased member of the armed forces, regardless of the marital status of the surviving spouse, is entitled to use commissary stores and MWR retail facilities to the same extent and on the same basis as an unremarried surviving spouse of a member of the uniformed services.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id48e399f4ae44437c8f27850c1dd4d008"><enum>(4)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf55aa7dc0f2c40b09b8f115f033b3d74"><subsection id="ide826d7e72658485a90b7309729ac5a39"><enum>(c)</enum><header>MWR retail facilities defined</header><text>In this section, the term <term>MWR retail facilities</term> has the meaning given that term in section 1063(e) of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB5F95F9E69A64A969CBA69C023C47037"><enum>(b)</enum><header>Clerical amendments</header><paragraph id="HA529F9E5D0F747C1B11B3E3DB412396B"><enum>(1)</enum><header>Section heading</header><text display-inline="yes-display-inline">The heading of section 1062 of title 10, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H0B6AA3BAEAB643DEB060182B5F72150B" style="USC"><section id="H01C5D790225E4079BFD3E16EB2BE2BDE"><enum>1062.</enum><header>Certain former spouses and surviving spouses</header></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H556211410F1341C79C2ECCA063796DC7"><enum>(2)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/54">chapter 54</external-xref> of title 10, United States Code, is amended by striking the item relating to section 1062 and inserting the following new item:</text><quoted-block display-inline="no-display-inline" id="H91408B67241E4A83A77C2825CD185F39" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1062. Certain former spouses and surviving spouses.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id43004FE8A06B458A88D1765483D4BF64"><enum>6.</enum><header>Expansion of definition of dependent under TRICARE program to include a remarried widow or widower whose subsequent marriage has ended</header><text display-inline="no-display-inline">Section 1072(2) of title 10, United States Code, is amended—</text><paragraph id="id888170705D8440CFAEDACF48096F6F2B"><enum>(1)</enum><text>in subparagraph (H), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="id60515188211D4395B1DE67FF9B8F789D"><enum>(2)</enum><text>in subparagraph (I)(v), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id0A9612A5228B401C803CD58B87EF3486"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2BDCB1AF5ED14778A45A02AB52A0D58B"><subparagraph id="idD98F737C17584A27A0C19EB494D2842C"><enum>(J)</enum><text>a remarried widow or widower whose subsequent marriage has ended due to death, divorce, or annulment.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idFEEB19DBA69D4059AA8C676E4CE09171"><enum>7.</enum><header>Definition of surviving spouse for purposes of veterans benefits</header><text display-inline="no-display-inline">Paragraph (3) of section 101 of title 38, United States Code, is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEFACEA28ECE64C4CB3AD56B7F7BE97ED"><paragraph id="id51734f5abc604bd192c65668105fbc34"><enum>(3)</enum><text>The term <term>surviving spouse</term> means (except for purposes of chapter 19 of this title) a person who was the spouse of a veteran at the time of the veteran's death, and who lived with the veteran continuously from the date of marriage to the date of the veteran's death (except where there was a separation which was due to the misconduct of, or procured by, the veteran without the fault of the spouse) and who has not remarried. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
