which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow COVID–19 relief funds to be used for disaster assistance, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prioritizing Disaster Relief Act</short-title></quote>.</text></section><section id="idB97CDC2F05F9434B8FE0EF2716002B7A"><enum>2.</enum><header>Use of COVID–19 relief funds for disaster relief</header><subsection id="id7E0C4FF33AA946E5878352413C5F38D1"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idD44D4B4E70514E44BDF9197FBC1F08CF"><enum>(1)</enum><header>COVID–19 relief funds</header><text>The term <term>COVID–19 relief funds</term> means amounts appropriated under the following Acts related to COVID–19 relief:</text><subparagraph id="idA6D36C32CFCA4A448394102ECD2311CC"><enum>(A)</enum><text>The CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 281).</text></subparagraph><subparagraph id="id95F6867A3FCF410C9FA05DDC528E4D03"><enum>(B)</enum><text>The American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 4).</text></subparagraph><subparagraph id="idB5A1B624635D4401AE66FB33B503D541"><enum>(C)</enum><text>The Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/23">Public Law 116–23</external-xref>; 134 Stat. 146).</text></subparagraph><subparagraph id="idD71537C941774EB799FB2ADE5E0F867E"><enum>(D)</enum><text>The Emergency Aid for Returning Americans Affected by Coronavirus Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/148">Public Law 116–148</external-xref>; 134 Stat. 661).</text></subparagraph><subparagraph id="id292eb19109c845c2869573a3a7152c6e"><enum>(E)</enum><text>The Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>; 134 Stat. 178).</text></subparagraph><subparagraph id="idC75CB289D95E42A2A3CFFDE6748FE833"><enum>(F)</enum><text>The Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>; 134 Stat. 620).</text></subparagraph><subparagraph id="id22cd7a23eb0749b1b36b0fe7a54b5532"><enum>(G)</enum><text>The Coronavirus Response and Relief Supplemental Appropriations Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 1182).</text></subparagraph><subparagraph id="id1cdb8e2aaa73401882455bfc935675a6"><enum>(H)</enum><text>The Continuing Appropriations Act, 2021 and Other Extensions Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/159">Public Law 116–159</external-xref>; 134 Stat. 709).</text></subparagraph><subparagraph id="id2763d81b76ed4d86b44c6e02551630b1"><enum>(I)</enum><text>The Extending Government Funding and Delivering Emergency Assistance Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/43">Public Law 117–43</external-xref>; 134 Stat. 344).</text></subparagraph></paragraph><paragraph id="id108546943F934E68923F3F61AE1D0423"><enum>(2)</enum><header>Indian Tribe; Tribal organization</header><text>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given those terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id7148EE7D22814D48937E63B1AB8B97F2"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means each State of the United States, the District of Columbia, and any territory or possession of the United States.</text></paragraph></subsection><subsection id="idBF811FD9891548FD88C52BA9D2573CA2"><enum>(b)</enum><header>Use of funds for disaster relief</header><paragraph id="id88D68C0CE89045E39C807B227156FBF0"><enum>(1)</enum><header>In general</header><text>Notwithstanding any limitation on the use of COVID–19 relief funds under any other provision of law, a State, unit of local government, Indian Tribe, or Tribal organization may use COVID–19 relief funds for expenses related to assisting communities, individuals, and businesses affected by and located within the designated area of a major disaster or emergency declared under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) before, on, or after the date of enactment of this Act.</text></paragraph><paragraph id="id1B76992BA1194D6F89BDFF0811AEA16E"><enum>(2)</enum><header>Supplement, not supplant</header><text>COVID–19 relief funds used in accordance with paragraph (1) shall supplement and not supplant any other Federal disaster assistance made available to a community, individual, or business.</text></paragraph></subsection></section></legis-body></bill>
