which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To create intergovernmental coordination on addressing perfluoroalkyl and polyfluoroalkyl substance contamination, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS Intergovernmental Coordination Act</short-title></quote>.</text></section><section id="id8001CD506E2D4A0A9D03FFD53DD1AA56"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id33974DABA60548419A66D21393BDE2F2"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id246A0657993C49D080AB8B6F9B5A7659"><enum>(A)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>; and</text></subparagraph><subparagraph id="idFE99256999F247ECB2611EF7C26694F9"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Oversight and Reform of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="idF8A64E4C3FF1404EBF73B8DF6ABD247D"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="id58F3DAA5D1EF4542A99ED60B6988B75A"><enum>(3)</enum><header>PFAS</header><text>The term <term>PFAS</term> means a perfluoroalkyl or polyfluoroalkyl substance that is man-made and has not fewer than 1 fully fluorinated carbon atom.</text></paragraph><paragraph id="idAEDBCBA7F3B24E4E915F6B323EF9C614"><enum>(4)</enum><header>Working group</header><text>The term <term>working group</term> means the working group established under section 3(a).</text></paragraph></section><section id="id84ed6bdc822c4fa792fadd48039235d5"><enum>3.</enum><header>Creation of working group</header><subsection id="id9D4666BD15D74BF39E9BCED50CC745C2"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Director shall establish a working group to facilitate more effective cooperation, coordination, and mutual accountability among every level of the Federal Government and State, local, and Tribal governments on a holistic response to PFAS contamination in communities across the United States.</text></subsection><subsection id="idB1435E9290F74DD7B7AE7F3CC15FF133"><enum>(b)</enum><header>Termination</header><paragraph id="idE52ECCEF80A94EEAB959BA79B678DE30"><enum>(1)</enum><header>Termination date</header><text>The working group shall terminate on the date that is 2 years after the date on which the working group is established.</text></paragraph><paragraph id="id356DDC6D268348DBB2D7E29F879F9CAF"><enum>(2)</enum><header>Extension</header><text>Based on the recommendation of the working group described in section 6(a)(2), the Director may extend the working group beyond the termination date.</text></paragraph></subsection></section><section id="id63c2979d888c46229186c2bf6f509cdd"><enum>4.</enum><header>Membership and meetings</header><subsection id="id9F674300353D47C681453E039B567A18"><enum>(a)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Director shall appoint to the working group representatives with expertise in PFAS from Federal agencies, State, local, and Tribal governments and academic research institutions, including—</text><paragraph id="ide2c7b355b18e40e5b6677ceeed762cc2"><enum>(1)</enum><text>not less than 1 representative from—</text><subparagraph id="id9EDA556B08BA43A786696CF21A3E4902"><enum>(A)</enum><text>the Environmental Protection Agency;</text></subparagraph><subparagraph id="id79fc628b94404629a55c7a1f6a13527e"><enum>(B)</enum><text>the Department of Defense;</text></subparagraph><subparagraph id="id850dd21535d748fa87427d2718883d1f"><enum>(C)</enum><text>the Council on Environmental Quality;</text></subparagraph><subparagraph id="id5af935a2d30541f0b5e72f134a0cb45c"><enum>(D)</enum><text>the Department of Veterans Affairs;</text></subparagraph><subparagraph id="idd2d9dd66f09342f1b1b46e2d82fd5c15"><enum>(E)</enum><text>the Department of Agriculture;</text></subparagraph><subparagraph id="id106d31e6e09245edb4fa69ea71023011"><enum>(F)</enum><text>the National Science Foundation;</text></subparagraph><subparagraph id="id01ba9228365e4288b7c93797e08fa919"><enum>(G)</enum><text>an institution of higher education engaged in PFAS contamination research; and</text></subparagraph><subparagraph id="id629c686a1c00407381a8a000bc4c427b"><enum>(H)</enum><text>any other relevant entity, as determined by the Director; </text></subparagraph></paragraph><paragraph id="id4D3109A0AEDD4D359D60929A000D2C59"><enum>(2)</enum><text>not less than 5 representatives from the Department of Health and Human Services, including not less than 1 representative from—</text><subparagraph id="id68D516E92BCC4029A9A1581DB41106FB"><enum>(A)</enum><text>the Centers for Disease Control and Prevention;</text></subparagraph><subparagraph id="id8A2726C1B4174FFCB16187F8045586CB"><enum>(B)</enum><text>the Agency for Toxic Substances and Disease Registry;</text></subparagraph><subparagraph id="idEF7305E313304819ACCB76075397F61F"><enum>(C)</enum><text>the National Institute for Occupation Safety and Health;</text></subparagraph><subparagraph id="id88BE689DD5F74BE9BAEAA579C3861018"><enum>(D)</enum><text>the National Institutes of Health; and </text></subparagraph><subparagraph id="idC9AE89A5B2444CE3AAB61A45004C7C62"><enum>(E)</enum><text>the Food and Drug Administration; and</text></subparagraph></paragraph><paragraph id="id2883FFDFEEBD413391A08E950216F736"><enum>(3)</enum><text> not less than 15 representatives from a diverse cross-section of State, local, and Tribal governments, including not less than 5 representatives from—</text><subparagraph id="id893a4a85204a43d784bae550fa422f37"><enum>(A)</enum><text>State governments;</text></subparagraph><subparagraph id="id91846d5b63dc42ea8493e76ea9022220"><enum>(B)</enum><text>local governments; and</text></subparagraph><subparagraph id="idC4B32AB304CE45A5916185FE56368B1F"><enum>(C)</enum><text>Tribal governments.</text></subparagraph></paragraph></subsection><subsection id="id1E9058B62FFD411C9715DA7D2960A1ED"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Director may consult relevant entities in selecting appointees to the working group. </text></subsection><subsection id="id1523977497B447AFBB95CA55B357B27B"><enum>(c)</enum><header>Chair</header><text display-inline="yes-display-inline">The Director may chair the working group or designate a chair. </text></subsection><subsection id="id1F0C85DEDC2A4F9CB4D8E18F1CB8DE1C"><enum>(d)</enum><header>Meetings</header><text>The working group shall convene on a quarterly basis.</text></subsection></section><section id="id992f5058094745149660d6c469b66fb7"><enum>5.</enum><header>Duties of the working group</header><text display-inline="no-display-inline">The duties of the working group shall include—</text><paragraph id="id0B00E7B96C904DD79CB4DD1281CC94BE"><enum>(1)</enum><text display-inline="yes-display-inline">considering the common challenges in addressing PFAS contamination across every level of the Federal Government and State, local, and Tribal governments;</text></paragraph><paragraph id="idC107A4BB410F47A1942735E14D926EB8"><enum>(2)</enum><text display-inline="yes-display-inline">facilitating more effective cooperation, coordination, and mutual accountability among every level of the Federal Government and State, local, and Tribal governments on a holistic response to PFAS contamination;</text></paragraph><paragraph id="id95B5E7340BEA412CAF2C332F9A7A3850"><enum>(3)</enum><text display-inline="yes-display-inline">incorporating the diverse perspectives of the working group to devise ways to—</text><subparagraph id="id529F89F81B624E55BAB0CE1A5D377E72"><enum>(A)</enum><text display-inline="yes-display-inline">improve the administration and coordination of responses to PFAS contamination; and</text></subparagraph><subparagraph id="idFE343CB0B7AF4C7BA967600F75D965ED"><enum>(B)</enum><text display-inline="yes-display-inline">mitigate future PFAS contamination;</text></subparagraph></paragraph><paragraph id="id002D4F0563684059A48DB8DB5615151A"><enum>(4)</enum><text display-inline="yes-display-inline">providing steps for more productive intergovernmental collaboration in the future, including enhanced communication protocols and recommendations and solutions that would fully address PFAS contamination across the Federal Government and State, local, and Tribal governments; and</text></paragraph><paragraph id="id0B528EDAF4AD499983E589E24D0480B4"><enum>(5)</enum><text display-inline="yes-display-inline">any other relevant duties as determined by the working group.</text></paragraph></section><section id="idff7cc1cb56364941b5ee64feb4de56d0"><enum>6.</enum><header>Report</header><subsection id="idBFD158A87196470A9B35A085CB276E7C"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Director shall submit to the appropriate congressional committees a report that—</text><paragraph id="id6440A97085B84B16AE8E68CB41775FE8"><enum>(1)</enum><text display-inline="yes-display-inline">describes any guidelines created in performing the duties under section 5; and</text></paragraph><paragraph id="idE641FC1EF4344AD3AB19239AC2AD1FD2"><enum>(2)</enum><text>makes a recommendation with respect to extending the authorization of the working group.</text></paragraph></subsection><subsection id="id35F530C3CBA0402483DDCAA204FE0F70"><enum>(b)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Director submits the report required under subsection (a), the Director shall brief the appropriate congressional committees on the implementation of any guidelines described in subsection (a)(1).</text></subsection><subsection id="idA942384AADF24793899B7EBA059C8B36"><enum>(c)</enum><header>Publishing</header><text display-inline="yes-display-inline">After Congress has been given the opportunity to review the report described in subsection (a) and has been briefed by the Director, and not later than 120 days after the date on which the Director submits such report, the Director shall make the report publicly available.</text></subsection></section></legis-body></bill>
