which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20221117">November 17, 2022</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To provide consistent leadership, purpose, and administrative support for the primary governmentwide executive councils, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Governmentwide Executive Councils Administration and Performance Improvement Act</short-title></quote>.</text></section><section id="id98E857083BE44CB6A6C0043EF514F1A4" changed="deleted" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline"> In this Act:</text><paragraph id="idec565b6f08e548b5bf4437f37d28353d"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="idBB745E5D5DFB4BEC953374BEFCE9A6C7"><enum>(2)</enum><header>Associate Administrator</header><text>The term <term>Associate Administrator</term> means the head of the Office of Executive Councils established pursuant to section 4.</text></paragraph><paragraph id="id177ae05ded4a4e2bbf14b07ffe376a09"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="id36246eba562e47758801444400fea2c7"><enum>(4)</enum><header>Governmentwide executive council</header><text>The term <term>governmentwide executive council</term> means—</text><subparagraph id="id6edcc974e9eb480193b22585f71b4a2c"><enum>(A)</enum><text>the Chief Acquisition Officers Council, established pursuant to Section 1311 of title 41, United States Code;</text></subparagraph><subparagraph id="id12ac47f5f65f4b19bae69f0d02939636"><enum>(B)</enum><text>the Chief Data Officer Council, established pursuant to Section 3520A of title 44, United States Code;</text></subparagraph><subparagraph id="id7642b9f722954058887a551859372b28"><enum>(C)</enum><text>the Chief Financial Officers Council, established pursuant to Section 302 of the Chief Financial Officers Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/31/901">31 U.S.C. 901</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/576">Public Law 101–576</external-xref>); </text></subparagraph><subparagraph id="id56a208c8ae35425f824c2cf5c5cbfc24"><enum>(D)</enum><text>the Chief Human Capital Officers Council, established pursuant to Section 1303 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/5/1401">5 U.S.C. 1401</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>);</text></subparagraph><subparagraph id="idf2392d516abb4af69584deb4b0a7d9b9"><enum>(E)</enum><text>the Chief Information Officers Council, established pursuant to Section 3603 of title 44, United States Code;</text></subparagraph><subparagraph id="idabdf108e1dad4daa88bc0275da31feb7"><enum>(F)</enum><text>the Performance Improvement Council, established pursuant to Section 1124(b) of title 31, United States Code; and</text></subparagraph><subparagraph id="id0d0c7934c9e2424e896b72ed56fc45f7"><enum>(G)</enum><text>any other council designated as a governmentwide executive council, pursuant to section 6 of this Act.</text></subparagraph></paragraph></section><section id="id9a2e7c6c16be4d7ea5c1f1b0f2702a17" changed="deleted" reported-display-style="strikethrough"><enum>3.</enum><header>Responsibilities of governmentwide executive councils</header><subsection id="id610885C23081419DAECA5BAE89B64998"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any authority provided to a governmentwide executive council elsewhere in law, each governmentwide executive council shall—</text><paragraph id="id52523711909947649cfde345649c9f33"><enum>(1)</enum><text>maintain a publicly accessible website that includes information relating to the mission, purpose, priorities, and membership of the governmentwide executive council;</text></paragraph><paragraph id="id27d2a5307d3e4d8eac7c86c92a5ee715"><enum>(2)</enum><text>develop and publish on the website described in paragraph (1) a charter outlining the roles of members, responsibilities, procedures, and other relevant information concerning the governmentwide executive council;</text></paragraph><paragraph id="id7b2624e91a6d4f8aa6f4a36ad6eeed66"><enum>(3)</enum><text>provide legislative, policy, project funding, or shared services recommendations to the Director and the Administrator related to the specific area of expertise of the governmentwide executive council; and</text></paragraph><paragraph id="ide27c373e38d24071aec751e7724661c8"><enum>(4)</enum><text>serve as a primary advisory body to the Director on the development and execution of—</text><subparagraph id="ide4fcf1901b824ff58710223784676739"><enum>(A)</enum><text>the Federal Government performance plan under section 1115(a) of title 31, United States Code; and</text></subparagraph><subparagraph id="id45f6186a80754b35a7ca6e96cc9b02df"><enum>(B)</enum><text>the Federal Government priority goals under section 1120(a) of title 31, United States Code.</text></subparagraph></paragraph></subsection><subsection id="id74796550227f4e9fb8368344864e3362"><enum>(b)</enum><header>Strategic plan</header><paragraph id="idBCF490F1B399425E86403ADAB345B40A"><enum>(1)</enum><header>In general</header><text>Not more than 90 days after the date of enactment of this Act, each governmentwide executive council, after receiving input and recommendations from all members, shall publish a strategic plan for the governmentwide executive council that identifies the goals, priorities, and expectations of the governmentwide executive council.</text></paragraph><paragraph id="idb8bf0a941c9d4947aaaf867b7ccee8d4"><enum>(2)</enum><header>Updates</header><text>The leadership of each governmentwide executive council shall update and affirm the strategic plan required under paragraph (1) not less frequently than once every 2 years.</text></paragraph><paragraph id="idc6799fce233a42fb85da9a51a31258fe"><enum>(3)</enum><header>Submission to Congress</header><text>Each governmentwide executive council shall promptly submit the strategic plan published under paragraph (1), or updated under paragraph (2), to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Reform of the House of Representatives</committee-name>.</text></paragraph></subsection></section><section id="idf387fc7f64cd4ec2a1d948bac53c4dbf" changed="deleted" reported-display-style="strikethrough"><enum>4.</enum><header>Harmonizing administrative support for governmentwide executive councils</header><subsection id="id1ca85589b5bd432c841b067b84f63699"><enum>(a)</enum><header>Office of Executive Councils</header><text>There is established in the General Services Administration the Office of Executive Councils.</text></subsection><subsection id="ide897f823a7154f21a91569f0a7f5ff19"><enum>(b)</enum><header>Duties</header><text>The Office of Executive Councils shall—</text><paragraph id="id5b78c03e18534b2e87e9c95a3c445dd6"><enum>(1)</enum><text>in consultation with the Director, provide administrative, project management, and other support to the governmentwide executive councils;</text></paragraph><paragraph id="id072bfdcebe8b457889a568d45aa5d419"><enum>(2)</enum><text>detail employees to 1 or more governmentwide executive council, as needed, to support the operations and functions of each governmentwide executive council;</text></paragraph><paragraph id="ideb8590f66ca84938b84c322954063017"><enum>(3)</enum><text>collect and transfer funds to support the priorities of the governmentwide executive councils, as provided in appropriations acts; and</text></paragraph><paragraph id="id2713123d8c8e42949a1b6831ad6854f0"><enum>(4)</enum><text>subject to approval of the leadership of a governmentwide executive council, submit any reports, provide any information, or respond to any requests required by Congress.</text></paragraph></subsection><subsection id="id00b299dedb5a4e448dfe19db28bb48ee"><enum>(c)</enum><header>Functional Independence</header><text>The Office of Executive Councils shall by headed by an Associate Administrator who shall—</text><paragraph id="id2298ed1d109e49209d43817505e0fcda"><enum>(1)</enum><text>be appointed by the President;</text></paragraph><paragraph id="idE96FD2D0A0A641A886B83E4E1E64C1F5"><enum>(2)</enum><text>carry out additional duties and functions the Director and Administrator jointly request; and</text></paragraph><paragraph id="id61b5f4bd9b4a4d8a98a65ddb36764b16"><enum>(3)</enum><text>represent the collective viewpoints and priorities of the governmentwide executive councils and their membership.</text></paragraph></subsection><subsection id="idb726596f964145e8a459a74eafec11e7" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Prohibition</header><text>The Office of Executive Councils may not provide any administrative or project management services to an entity unless the entity is approved by Congress. </text></subsection></section><section id="id112a4db9299f4aa08cfe59c9531749cb" changed="deleted" reported-display-style="strikethrough"><enum>5.</enum><header>Harmonizing governmentwide executive council leadership roles</header><subsection id="id98D2590683EC4DE0A9C9549E1A984594"><enum>(a)</enum><header>Title 41</header><text display-inline="yes-display-inline">Section 1311 of title 41, United States Code, is amended—</text><paragraph id="id974cf4e132fc47c5bb85e93bce5478b7"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idB89BA08D5C05481FB05CACED049792E9"><enum>(A)</enum><text>by striking paragraph (1); and </text></subparagraph><subparagraph id="idF758A5D0F74D437DA0A087F46D2D794A"><enum>(B)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (1) through (4); and</text></subparagraph></paragraph><paragraph id="id033cc1d989804e16bdef67a367f9f654"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idaf27858ffce54c489e1afe103ebdd0da"><enum>(A)</enum><text>in paragraph (1), by striking <quote>Deputy Director for Management of the Office of Management and Budget</quote> and inserting <quote>Administrator</quote>;</text></subparagraph><subparagraph id="id6cdbe0b2c703413e94e06ea9b481112c"><enum>(B)</enum><text>by striking paragraph (3); and</text></subparagraph><subparagraph id="id923282F653764921B8B829DA4431E867"><enum>(C)</enum><text>by redesignating paragraph (4) as paragraph (3).</text></subparagraph></paragraph></subsection><subsection id="id7718d4234a5946f5aa187be73c1872af"><enum>(b)</enum><header>Title 44</header><text>Title 44, United States Code, is amended—</text><paragraph id="id7612CA33259B4296A34FA3DB4BC905EB"><enum>(1)</enum><text>in section 3520A—</text><subparagraph id="id2d0f55eb57c74b1081aadc707926c5cb"><enum>(A)</enum><text>in subsection (a), by striking <quote>Office of Management and Budget</quote> and inserting <quote>executive branch</quote>;</text></subparagraph><subparagraph id="id67d6ad982cac49178af0caaa77de5f2f"><enum>(B)</enum><text>in subsection (c) by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8eca03f37d404c8786ff554d5823c55d" changed="deleted" reported-display-style="strikethrough"><paragraph id="id3e33ae756af748ed8375335af9c2208b"><enum>(2)</enum><header>Chair</header><text>The Chair of the Council shall be the Administrator of the Office of Electronic Government.</text></paragraph><paragraph id="id31957b5f13de41b9b5444d918eed3b41"><enum>(3)</enum><header>Vice chair</header><text>The Council shall select from among its members a Vice Chair of the Council.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="iddf2abfa0b89e40f98e41168fdcf38e61"><enum>(C)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f); and</text></subparagraph><subparagraph id="id58B2A889F1FB44F38C358CCBF99CD4C4"><enum>(D)</enum><text>by inserting before subsection (e), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4e0cb904370c4a77900f07fea70b585f" changed="deleted" reported-display-style="strikethrough"><subsection id="idffb4b0cd0c824537bc742e582ac8fed8"><enum>(d)</enum><header>Support</header><text>The Administrator of General Services shall provide administrative and other support for the Council.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA065CF7F6F0849EAAB95077AAF6DC14F"><enum>(2)</enum><text>in section 3603—</text><subparagraph id="idEA702097E91E4F8B8EED04C5F8B79F8B"><enum>(A)</enum><text>in subsection (b)—</text><clause id="id2E37157C73CB45BB8DE550142620775B"><enum>(i)</enum><text>by striking paragraphs (1) and (3);</text></clause><clause id="idD42C4FF384754E12B814F2F4EF6F457C"><enum>(ii)</enum><text>by redesignating paragraphs (2) and (4) through (7) as paragraphs (1) through (5), respectively; and</text></clause><clause id="idFD92753516C14C769D123479BB72C876"><enum>(iii)</enum><text>in paragraph (1), as so redesignated, by inserting before the period <quote>, who shall serve as Chair of the Council</quote>; and</text></clause></subparagraph><subparagraph id="idA0D29564B05B4279864C3AC3F0D05C08"><enum>(B)</enum><text>in subsection (c)(1), by striking <quote>on behalf of the Deputy Director for Management</quote>.</text></subparagraph></paragraph></subsection><subsection id="id6c436651868b4259a04749dc175bde07"><enum>(c)</enum><header>Chief Financial Officers Act of 1990</header><text>Section 302 of the Chief Financial Officers Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/31/901">31 U.S.C. 901</external-xref> note) is amended—</text><paragraph id="idd8c3fb0ce1d74f8b83c3468ccd675492"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id6e5a83811cdb4139a0a8d1ea8e46a020"><enum>(A)</enum><text>by striking paragraph (1);</text></subparagraph><subparagraph id="id1F5440386BA9453D85C1061C21F7C1B5"><enum>(B)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (1), (2), and (3), respectively;</text></subparagraph><subparagraph id="id833eb666d53f46bfa29a95f2cd8f7766"><enum>(C)</enum><text>in paragraph (1), as so redesignated, by inserting <quote>, who shall serve as chair of the council</quote> after <quote>Management and Budget</quote>; and</text></subparagraph><subparagraph id="ide1463b420fe14c2a9e93316c4d44744e"><enum>(D)</enum><text>in paragraph (2), as so redesignated, by inserting <quote>, who shall serve as vice chair of the council</quote> after <quote>Secretary of Treasury</quote>; and</text></subparagraph></paragraph><paragraph id="id4e5574c43a4f4bb287f403022fc47160"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id378bbeadce1d4d42a3d707cb1a9ecf14" changed="deleted" reported-display-style="strikethrough"><subsection id="idc894ec0376b34816a9ae102839963b0a"><enum>(c)</enum><header>Support</header><text>The Administrator of General Services shall provide administrative and other support for the council.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id486abbc28137438394c96f560e9a5c6b"><enum>(d)</enum><header>Homeland Security Act of 2002</header><text>Section 1303 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/5/1401">5 U.S.C. 1401</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id253c4afa4fec4810b22af4f98c81891c" changed="deleted" reported-display-style="strikethrough"><subsection id="idd946205bc22142749fd77ff6037e7fd0"><enum>(e)</enum><header>Support</header><text>The Administrator of General Services shall provide administrative and other support for the Council.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id31341421dd204e5fba7f0245507be017"><enum>(e)</enum><header>Title 31</header><text>Section 1124(b) of title 31, United States Code, is amended—</text><paragraph id="id8fdda8127ecc4fab8f4e5896f8c2ecd2"><enum>(1)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9AB192DC55141789E6C79607493577E" changed="deleted" reported-display-style="strikethrough"><paragraph id="idA20941267E4447D4A73BBB48EF1597A6"><enum>(1)</enum><header>Establishment</header><text>There is established in the executive branch a Performance Improvement Council.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id1F2BC6239CC44591B4E301DC3A537B87"><enum>(2)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (4) and (5); and</text></paragraph><paragraph id="idC8BFAB3B375B419BA808AB60E2B6F72B"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id35c520a9300f4f3cac69896a68650698" changed="deleted" reported-display-style="strikethrough"><paragraph id="id40c503c3d6a1429fbaee3da69274cb26"><enum>(2)</enum><header>Membership</header><text>The Performance Improvement Council shall consist of —</text><subparagraph id="id964295ef912b4bc8b68add25cbb00fc6"><enum>(A)</enum><text>a designee of the Director of the Office of Management and Budget;</text></subparagraph><subparagraph id="idfbba34bca7b5433f977d2c2514355150"><enum>(B)</enum><text>the Performance Improvement Officer from each agency defined in section 901(b) of this title;</text></subparagraph><subparagraph id="idbfe048c6eedf4f419e105d4c6087d0be"><enum>(C)</enum><text>other Performance Improvement Officers as determined appropriate by the chairperson; and</text></subparagraph><subparagraph id="id273af5a26492481fab52e8543e22e86b"><enum>(D)</enum><text>other individuals as determined appropriate by the chairperson.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block><quoted-block style="OLC" display-inline="no-display-inline" id="id6a9384635d6246a793615787e5ae862a" changed="deleted" reported-display-style="strikethrough"><paragraph id="ida306e6f39e7e4981afb03978113d88d3"><enum>(3)</enum><header>Chairperson and vice chairperson</header><subparagraph id="idd03a9c909e8f4b0881be8473527c213f"><enum>(A)</enum><header>Chairperson</header><text>The chairperson of the Performance Improvement Council shall be a designee of the Deputy Director of Management of the Office of Management and Budget.</text></subparagraph><subparagraph id="id4c4fcd1df8c44374aadcedaabe9298e1"><enum>(B)</enum><header>Vice chairperson</header><text>The Performance Improvement Council shall select from among its members a Performance Improvement Officer to serve as vice chairperson.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id92e4939720ad45e7a951c7f35e669e5f" changed="deleted" reported-display-style="strikethrough"><enum>6.</enum><header>Annual report; Process for inclusion of additional governmentwide executive councils</header><subsection id="idacef6894359d4e96b282740ff4897fa5"><enum>(a)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Associate Administrator shall submit to the <committee-name committee-id="SSGA00">Committees on Homeland Security and Governmental Affairs and Appropriations of the Senate</committee-name> and the <committee-name committee-id="">Committees on Oversight and Reform and Appropriations of the House of Representatives</committee-name> a report on the activities of the Office of Executive Councils.</text></subsection><subsection id="idc8c3a48c993748c9b9117e9d1074abc4"><enum>(b)</enum><header>Contents</header><text>The reports required under subsection (a) shall include—</text><paragraph id="id78fe065535b3448a97f1561de1ccacf1"><enum>(1)</enum><text>a description of the activities of the Office of Executive Councils during the year period ending on the date on which the report is submitted, including detailed summaries of the projects and services provided by the Office of Executive Councils, organized by governmentwide executive council;</text></paragraph><paragraph id="idBAF6034CD0D04921B4777F2B13CF7C17"><enum>(2)</enum><text>a detailed accounting of—</text><subparagraph id="idE5761969BA6344A1A9ABEE2F14798028"><enum>(A)</enum><text>the costs associated with the activities of the Office of Executive Councils, organized by governmentwide executive council; and </text></subparagraph><subparagraph id="id8ED05CE0A0654D2C99286EFE8449900D"><enum>(B)</enum><text>any administrative costs associated with the operations of the Office of Executive Councils;</text></subparagraph></paragraph><paragraph id="idf4850c4be2984f1fb338c34be2884e63"><enum>(3)</enum><text>a detailed accounting of all projects, services, or other programs approved by and executed on behalf of each governmentwide executive council, including any outcomes or highlights of such projects, services, or other programs; and</text></paragraph><paragraph id="id8cf882bdeb8940e0918e0658031b62cf"><enum>(4)</enum><text>any recommendations for the designation of other councils or entities as governmentwide executive councils.</text></paragraph></subsection><subsection id="id6FACDCE10DCA44E281C3A7DB72E071E4"><enum>(c)</enum><header>Designation</header><paragraph id="idA5A862BAA02246DDA07B9588B1564392"><enum>(1)</enum><header>Request</header><text>Not earlier than the date that is 30 days after the submission of each report required under subsection (a), and only if such report includes a recommendation for the designation of 1 or more councils or entities as governmentwide executive councils, the Director may submit to the <committee-name committee-id="SSGA00">Committees on Homeland Security and Governmental Affairs and Appropriations of the Senate</committee-name> and the <committee-name committee-id="">Committees on Oversight and Reform and Appropriations of the House of Representatives</committee-name> a request for those recommended councils or entities to be designated as governmentwide executive councils. </text></paragraph><paragraph id="idF83E09C5B79C4ECB84EF75BE94C0CAC6"><enum>(2)</enum><header>Contents</header><text>A request under paragraph (1) shall include—</text><subparagraph id="id22a6ab43d293445aa7c7b6abe8c276fe"><enum>(A)</enum><text>the name of the council;</text></subparagraph><subparagraph id="id3468830a3a0247d1bae8892bb5f4b1de"><enum>(B)</enum><text>the names of the chair and vice chair of the council;</text></subparagraph><subparagraph id="idd5dbea070a65498ea4bf4c994a4b007c"><enum>(C)</enum><text>the agencies that will be members of the council;</text></subparagraph><subparagraph id="idb9d7ed058da643b9b1d85a5ded466b8b"><enum>(D)</enum><text>the expected goals, functions, and priorities of the council;</text></subparagraph><subparagraph id="id87fd362dbfdf41819efccc5f1fa9f5a2"><enum>(E)</enum><text>the expected annual costs to support the functions of the council; and</text></subparagraph><subparagraph id="id4C20771BFF834559B6F49054376F1390"><enum>(F)</enum><text>any other information the Director determines to be necessary regarding the designation of the council to be a governmentwide executive council.</text></subparagraph></paragraph></subsection><subsection id="idc4311ad50f7f46849fbd847e26c1dd42"><enum>(d)</enum><header>Requirements</header><text>Any new governmentwide executive council designated after the date of enactment of this Act shall be subject to the requirements under section 3.</text></subsection></section><section id="id3bf4bcee85fa437faf265fb3668fab65" changed="deleted" reported-display-style="strikethrough"><enum>7.</enum><header>Technical Amendments</header><subsection id="id2B3AB7FF71F84943950041498236B699"><enum>(a)</enum><header>Title 31</header><text display-inline="yes-display-inline">Section 503 of title 31, United States Code, is amended—</text><paragraph id="id7428049074FF4AF0BC67DC81FD45A90B"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id2D47B4C618A4423A849211DD759F24FD"><enum>(A)</enum><text>by striking paragraph (12); and</text></paragraph><paragraph id="id27C02D2EA18C4A63999FAB857F4D0D60"><enum>(2)</enum><text>by redesignating paragraphs (8) through (17) as paragraphs (7) through (16).</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id27af873e-3909-4434-8964-560d166447de" section-type="section-one" changed="added" reported-display-style="italic"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Governmentwide Executive Councils Administration and Performance Improvement Act</short-title></quote>.</text></section><section id="idaeb78685-98b6-4390-beef-13f44857ede6" changed="added" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline"> In this Act:</text><paragraph id="id089b2b4d-c235-42b0-8581-616bc18a3987"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="idc57360ee-c639-401a-ae2f-3c2fc670707e"><enum>(2)</enum><header>Associate Administrator</header><text>The term <term>Associate Administrator</term> means the head of the Office of Executive Councils established pursuant to section 4.</text></paragraph><paragraph id="idb7c39143-1cb6-482d-8e46-255ae5833dff"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="id53bfa0d7-b13d-4915-8b7e-3d28f716198d"><enum>(4)</enum><header>Governmentwide executive council</header><text>The term <term>governmentwide executive council</term> means—</text><subparagraph id="id0834d63b-2d06-4c7a-8dd3-334cfddc42a0"><enum>(A)</enum><text>the Chief Acquisition Officers Council, established pursuant to Section 1311 of title 41, United States Code;</text></subparagraph><subparagraph id="id9cb5ffe2-8ee8-484a-8f9a-474436edbb3d"><enum>(B)</enum><text>the Chief Data Officer Council, established pursuant to Section 3520A of title 44, United States Code;</text></subparagraph><subparagraph id="id321fd408-e201-47d7-b3ac-026428eef764"><enum>(C)</enum><text>the Chief Financial Officers Council, established pursuant to Section 302 of the Chief Financial Officers Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/31/901">31 U.S.C. 901</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/576">Public Law 101–576</external-xref>); </text></subparagraph><subparagraph id="id976a293f-efa1-4bd0-90bb-d200523f4e2a"><enum>(D)</enum><text>the Chief Human Capital Officers Council, established pursuant to Section 1303 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/5/1401">5 U.S.C. 1401</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>);</text></subparagraph><subparagraph id="id32b62c7c-3811-4b97-8e55-e2cc81445d27"><enum>(E)</enum><text>the Chief Information Officers Council, established pursuant to Section 3603 of title 44, United States Code;</text></subparagraph><subparagraph id="id8d545605-abf2-4128-81bd-833c8262c2ea"><enum>(F)</enum><text>the Performance Improvement Council, established pursuant to Section 1124(b) of title 31, United States Code; and</text></subparagraph><subparagraph id="id58f17179-af73-4b9f-8cce-ab1327b1b136"><enum>(G)</enum><text>any other council designated as a governmentwide executive council, pursuant to section 6 of this Act.</text></subparagraph></paragraph></section><section id="idc364cfb9-13d3-4b56-9029-c13e98a9d528" changed="added" reported-display-style="italic"><enum>3.</enum><header>Responsibilities of governmentwide executive councils</header><subsection id="idac8c4f83-7374-4170-84ec-5c898b4372df"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any authority provided to a governmentwide executive council elsewhere in law, each governmentwide executive council shall—</text><paragraph id="idbbe1b15b-fcfb-4994-bdd7-e65b20398d26"><enum>(1)</enum><text>maintain a publicly accessible website that includes information relating to the mission, purpose, priorities, and membership of the governmentwide executive council;</text></paragraph><paragraph id="id154344ac-65a6-4283-8e84-6a19569dde28"><enum>(2)</enum><text>develop and publish on the website described in paragraph (1) a charter outlining the roles of members, responsibilities, procedures, and other relevant information concerning the governmentwide executive council;</text></paragraph><paragraph id="id3baafcb8-cf25-41d4-85df-63d71e2348d2"><enum>(3)</enum><text>provide legislative, policy, project funding, or shared services recommendations to the Director and the Administrator related to the specific area of expertise of the governmentwide executive council; and</text></paragraph><paragraph id="idf0121860-df4d-4db3-923c-5227e309e56d"><enum>(4)</enum><text>serve as a primary advisory body to the Director on the development and execution of—</text><subparagraph id="idedb863df-2db4-413e-89ea-6740c47ff5a7"><enum>(A)</enum><text>the Federal Government performance plan under section 1115(a) of title 31, United States Code; and</text></subparagraph><subparagraph id="id49bfbabf-ea96-4876-9d93-aa5f01d528cf"><enum>(B)</enum><text>the Federal Government priority goals under section 1120(a) of title 31, United States Code.</text></subparagraph></paragraph></subsection><subsection id="id57149f16-6922-4b2b-897f-fe9dea87b423"><enum>(b)</enum><header>Strategic plan</header><paragraph id="id9eef620b-5d57-4d26-b779-fb51d530f16c"><enum>(1)</enum><header>In general</header><text>Not more than 90 days after the date of enactment of this Act, each governmentwide executive council, after receiving input and recommendations from all members, shall publish a strategic plan for the governmentwide executive council that identifies the goals, priorities, and expectations of the governmentwide executive council.</text></paragraph><paragraph id="id4334b866-2fea-45f3-97f0-d594f66759e2"><enum>(2)</enum><header>Updates</header><text>The leadership of each governmentwide executive council shall update and affirm the strategic plan required under paragraph (1) not less frequently than once every 2 years.</text></paragraph><paragraph id="id4e3562ae-9c80-4b95-bf71-15cd9a562242"><enum>(3)</enum><header>Submission to Congress</header><text>Each governmentwide executive council shall promptly submit the strategic plan published under paragraph (1), or updated under paragraph (2), to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Reform of the House of Representatives</committee-name>.</text></paragraph></subsection></section><section id="idfb03b830-2967-43d4-8ba0-7482f2f33d7b" changed="added" reported-display-style="italic"><enum>4.</enum><header>Harmonizing administrative support for governmentwide executive councils</header><subsection id="id09ba4a6d-d4aa-4a4e-9e52-677d6890b2fa"><enum>(a)</enum><header>Office of Executive Councils</header><text>There is established in the General Services Administration the Office of Executive Councils.</text></subsection><subsection id="id04dfd2aa-80af-4e34-bd9f-833c4b3a74db"><enum>(b)</enum><header>Duties</header><text>The Office of Executive Councils shall—</text><paragraph id="id09c96a6f-1745-4e67-926c-02fc554e978f"><enum>(1)</enum><text>in consultation with the Director, provide administrative and project management support to the governmentwide executive councils;</text></paragraph><paragraph id="idaf7df445-411d-4747-8816-ebba487cd6be"><enum>(2)</enum><text>detail employees to 1 or more governmentwide executive council, as needed, to support the operations and functions of each governmentwide executive council;</text></paragraph><paragraph id="id7e833069-e165-45ea-a933-99cf3d801034"><enum>(3)</enum><text>collect and transfer funds to support the priorities of the governmentwide executive councils, as provided in appropriations acts; and</text></paragraph><paragraph id="idd3d6980e-4193-4975-bf4f-17f20c47c4ed"><enum>(4)</enum><text>submit any reports, provide any information, or respond to any requests required by Congress.</text></paragraph></subsection><subsection id="id4ae83a51-011f-4ddd-a75e-cb16bba672d8"><enum>(c)</enum><header>Functional Independence</header><text>The Office of Executive Councils shall by headed by an Associate Administrator who shall—</text><paragraph id="id0ac351a4-c393-4d4a-9bf8-41c94ac37e63"><enum>(1)</enum><text>be appointed by the President;</text></paragraph><paragraph id="id0fd3e6a8-54c6-431c-a58f-d68e16a565ea"><enum>(2)</enum><text>carry out additional duties and functions the Director and Administrator jointly request; and</text></paragraph><paragraph id="id3739d437-74c7-44f3-9dac-fe7a4be06911"><enum>(3)</enum><text>represent the collective viewpoints and priorities of the governmentwide executive councils and their membership.</text></paragraph></subsection><subsection id="id703e6775-e79e-4f71-a7fa-305856f9612c" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Prohibition</header><text>The Office of Executive Councils may not provide any administrative or project management services to a governmentwide executive council unless the council is authorized by Congress. </text></subsection><subsection id="idB6F8FE7482D940B6BA18EC8728509C48"><enum>(e)</enum><header>Sunset</header><text>The Office of Executive Councils shall terminate on the date that is 6 years after the date of enactment of this Act.</text></subsection></section><section id="id9f982ebe-fd1a-4404-85cc-027910f04ede" changed="added" reported-display-style="italic"><enum>5.</enum><header>Harmonizing governmentwide executive council leadership roles</header><subsection id="id145ea02d-5ea3-4f61-8553-c036b0a5a1a6"><enum>(a)</enum><header>Title 41</header><text display-inline="yes-display-inline">Section 1311 of title 41, United States Code, is amended—</text><paragraph id="id2d83d13d-4ab6-4d99-b429-c4cd2bdb96ee"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id1a7d6c47-316d-400d-9453-e7944525aad1"><enum>(A)</enum><text>by striking paragraph (1); and </text></subparagraph><subparagraph id="idac1c09d8-3426-400b-a15e-fab27949208e"><enum>(B)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (1) through (4); and</text></subparagraph></paragraph><paragraph id="id19f0bd78-e3f9-4644-8065-87f694191c58"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idb4558440-b1fa-407c-b59a-c2a3db93aa61"><enum>(A)</enum><text>in paragraph (1), by striking <quote>Deputy Director for Management of the Office of Management and Budget</quote> and inserting <quote>Administrator</quote>;</text></subparagraph><subparagraph id="ide908b176-30b1-4178-b3cd-2ee20f7201f9"><enum>(B)</enum><text>by striking paragraph (3); and</text></subparagraph><subparagraph id="id7d2c9229-d9e2-4ff7-b8ad-fe291cfdb592"><enum>(C)</enum><text>by redesignating paragraph (4) as paragraph (3).</text></subparagraph></paragraph></subsection><subsection id="id2bda69c2-9a4c-4761-8f70-7db0b5a014fa"><enum>(b)</enum><header>Title 44</header><text>Title 44, United States Code, is amended—</text><paragraph id="idf742aaa1-fe59-439e-b7fc-cf015efda9b4"><enum>(1)</enum><text>in section 3520A—</text><subparagraph id="idbab49d1e-da58-4cfc-8f60-51501e8546fb"><enum>(A)</enum><text>in subsection (a), by striking <quote>Office of Management and Budget</quote> and inserting <quote>executive branch</quote>;</text></subparagraph><subparagraph id="idf58ffccc-109a-4314-8d09-9abc990d511c"><enum>(B)</enum><text>in subsection (c) by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide32081e3-f3c7-4c12-a885-e5f7b9b2599b" changed="added" reported-display-style="italic"><paragraph id="id7cd08b66-558d-487e-94de-dc59193af471"><enum>(2)</enum><header>Chair</header><text>The Chair of the Council shall be the Administrator of the Office of Electronic Government.</text></paragraph><paragraph id="id3a788186-6170-4bec-801d-4e85478bef0e"><enum>(3)</enum><header>Vice chair</header><text>The Council shall select from among its members a Vice Chair of the Council.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idb2b24c6d-9add-4482-aabe-ecee68376a73"><enum>(C)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f); and</text></subparagraph><subparagraph id="id722fd59c-fc53-4537-8063-3bb9cf89d763"><enum>(D)</enum><text>by inserting before subsection (e), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id72abc4bf-834c-4f31-828e-72206b90188e" changed="added" reported-display-style="italic"><subsection id="id97af1e67-c1ae-4bfe-9e49-df8ecaa9e37d"><enum>(d)</enum><header>Support</header><text>The Administrator of General Services shall provide administrative support for the Council.</text></subsection><after-quoted-block>; and</text></clause></subparagraph><subparagraph id="idff1562ab-be81-4d12-974a-563e913ffd8a"><enum>(B)</enum><text>in subsection (c)(1), by striking <quote>on behalf of the Deputy Director for Management</quote>.</text></subparagraph></paragraph></subsection><subsection id="idd4359e01-739d-4e8f-8dac-1300e3e39ab9"><enum>(c)</enum><header>Chief Financial Officers Act of 1990</header><text>Section 302 of the Chief Financial Officers Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/31/901">31 U.S.C. 901</external-xref> note) is amended—</text><paragraph id="ide5d1ed9a-d56e-4b63-ba65-8c367dd4fde3"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idc26222f6-c0a4-496d-8fde-a017911a173b"><enum>(A)</enum><text>by striking paragraph (1);</text></subparagraph><subparagraph id="idee743f4a-67b5-441a-9381-0af0ac247f23"><enum>(B)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (1), (2), and (3), respectively;</text></subparagraph><subparagraph id="id0f456a4a-7092-475e-ac92-b140105cc198"><enum>(C)</enum><text>in paragraph (1), as so redesignated, by inserting <quote>, who shall serve as chair of the council</quote> after <quote>Management and Budget</quote>; and</text></subparagraph></paragraph><paragraph id="id05844aea-0203-484c-9401-57ea287fc821"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2f9ab8e6-68cc-4d14-bce1-716711b3e981" changed="added" reported-display-style="italic"><subsection id="id4aa15e32-a1eb-406e-bc36-b7f48aec26e0"><enum>(c)</enum><header>Support</header><text>The Administrator of General Services shall provide administrative support for the council.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7801cd84-64ef-42a9-b4d5-7fceb422e714"><enum>(d)</enum><header>Homeland Security Act of 2002</header><text>Section 1303 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/5/1401">5 U.S.C. 1401</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id80b519f6-c693-4559-b886-304361ff6c39" changed="added" reported-display-style="italic"><subsection id="id45f15dc5-a16e-441a-bc0f-ffd78f826c42"><enum>(e)</enum><header>Support</header><text>The Administrator of General Services shall provide administrative support for the Council.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idd171988a-d9c2-4e60-9d45-ed493f6cc325"><enum>(e)</enum><header>Title 31</header><text>Section 1124(b) of title 31, United States Code, is amended—</text><paragraph id="idf7f516e3-5f5c-4c25-9824-5c3a88d1a4c0"><enum>(1)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaeb5343b-4e1a-4467-b070-16d1379f8e54" changed="added" reported-display-style="italic"><paragraph id="id2e88cb38-9b82-46f4-a3ee-3c09c767fbf5"><enum>(1)</enum><header>Establishment</header><text>There is established in the executive branch a Performance Improvement Council.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id76575332-3183-4622-ba0b-53bc1ba97ad4"><enum>(2)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (4) and (5); and</text></paragraph><paragraph id="idc59b4b6e-d787-4b15-b792-69198234ca79"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id73163b06-f360-4db9-acce-f52ade3f6732" changed="added" reported-display-style="italic"><paragraph id="id8dd7ada0-02ce-42fc-b9f2-b248a2b335de"><enum>(2)</enum><header>Membership</header><text>The Performance Improvement Council shall consist of —</text><subparagraph id="ide0c84c34-8e09-49ed-8161-7f1bebdc8100"><enum>(A)</enum><text>a designee of the Director of the Office of Management and Budget, who shall have experience in the areas of strategic and performance planning, measurement, and analysis, including the use of performance information to improve the results of an agency; and </text></subparagraph><subparagraph id="idf8641097-a1c3-4d0e-a39d-3871b0797afa"><enum>(B)</enum><text>the Performance Improvement Officer from each agency defined in section 901(b) of this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block><quoted-block style="OLC" display-inline="no-display-inline" id="id001569a9-38e2-4ef4-9bcf-a0f6fe8a67cf" changed="added" reported-display-style="italic"><paragraph id="id9afac46c-ea01-4774-b3a5-4cac65b2c1dd"><enum>(3)</enum><header>Chairperson and vice chairperson</header><subparagraph id="id37fd4007-a1f6-4b50-9c1f-d2ab8fcf0f8e"><enum>(A)</enum><header>Chairperson</header><text>The chairperson of the Performance Improvement Council shall be the designee of the Director of Management of the Office of Management and Budget, as described in paragraph (2)(A).</text></subparagraph><subparagraph id="id5eb4452e-58bd-4290-9c55-666a6518512d"><enum>(B)</enum><header>Vice chairperson</header><text>The Performance Improvement Council shall select from among its members a Performance Improvement Officer to serve as vice chairperson.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id150ccbf3-3e7f-4767-8833-5a7eac942c01" changed="added" reported-display-style="italic"><enum>6.</enum><header>Annual report; Process for inclusion of additional governmentwide executive councils</header><subsection id="id2f1893fa-03a1-497e-8725-541e51cb3869"><enum>(a)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Associate Administrator shall submit to the <committee-name committee-id="SSGA00">Committees on Homeland Security and Governmental Affairs and Appropriations of the Senate</committee-name> and the <committee-name committee-id="">Committees on Oversight and Reform and Appropriations of the House of Representatives</committee-name> a report on the activities of the Office of Executive Councils.</text></subsection><subsection id="idb86bc256-017f-4ce4-b318-f2bf89a031b8"><enum>(b)</enum><header>Contents</header><text>The reports required under subsection (a) shall include—</text><paragraph id="idfd2fbaf8-1d68-4f39-b5ec-2087ef88f24d"><enum>(1)</enum><text>a description of the activities of the Office of Executive Councils during the year period ending on the date on which the report is submitted, including detailed summaries of the projects and services provided by the Office of Executive Councils, organized by governmentwide executive council;</text></paragraph><paragraph id="id394657d0-f9c5-49e9-9163-cf41e8f7ad75"><enum>(2)</enum><text>a detailed accounting of—</text><subparagraph id="id28e9cbc1-1096-410f-a7bc-625ff9e153de"><enum>(A)</enum><text>the costs associated with the activities of the Office of Executive Councils, organized by governmentwide executive council; and </text></subparagraph><subparagraph id="id538977c4-fe2a-45e4-8bc9-3161713b4efe"><enum>(B)</enum><text>any administrative costs associated with the operations of the Office of Executive Councils;</text></subparagraph></paragraph><paragraph id="id35e4ac2d-4e76-416f-955d-3514c9019d2a"><enum>(3)</enum><text>a detailed accounting of all projects, services, or other programs approved by and executed on behalf of each governmentwide executive council, including any outcomes or highlights of such projects, services, or other programs; and</text></paragraph><paragraph id="idc055fc94-c5fc-4702-a0d3-a92367b8c073"><enum>(4)</enum><text>any recommendations for the designation of other councils or entities as governmentwide executive councils.</text></paragraph></subsection><subsection id="idb17f6f75-1ae5-4918-8aab-69f9f604f8c8"><enum>(c)</enum><header>Designation</header><paragraph id="idcea6cb09-ba40-4c67-a405-1eaf068a5cc2"><enum>(1)</enum><header>Request</header><text>Not earlier than the date that is 30 days after the submission of each report required under subsection (a), and only if such report includes a recommendation for the designation of 1 or more councils or entities as governmentwide executive councils, the Director may submit to the <committee-name committee-id="SSGA00">Committees on Homeland Security and Governmental Affairs and Appropriations of the Senate</committee-name> and the <committee-name committee-id="">Committees on Oversight and Reform and Appropriations of the House of Representatives</committee-name> a request for those recommended councils or entities to be designated as governmentwide executive councils. </text></paragraph><paragraph id="id0c7983c3-02ac-418e-a66f-da4a1cf991b7"><enum>(2)</enum><header>Contents</header><text>A request under paragraph (1) shall include—</text><subparagraph id="id5325725a-a5b6-4f14-9aae-ed2a7bc5062e"><enum>(A)</enum><text>the name of the council;</text></subparagraph><subparagraph id="id086cbeb8-c645-489a-8541-888bf81e7e76"><enum>(B)</enum><text>the names of the chair and vice chair of the council;</text></subparagraph><subparagraph id="idca887eb3-7ff1-4787-a61d-2439eecd76c0"><enum>(C)</enum><text>the agencies that will be members of the council;</text></subparagraph><subparagraph id="id4c81e175-2e12-4ab3-a114-dbefb5bb42d2"><enum>(D)</enum><text>the expected goals, functions, and priorities of the council;</text></subparagraph><subparagraph id="ide47f3fd9-51d4-49a3-9ccb-69bf9da9b132"><enum>(E)</enum><text>the expected annual costs to support the functions of the council; and</text></subparagraph><subparagraph id="id74611796-da8f-4b6c-937a-a5d3701659cf"><enum>(F)</enum><text>any other information the Director determines to be necessary regarding the designation of the council to be a governmentwide executive council.</text></subparagraph></paragraph></subsection><subsection id="ideaa03d12-85d3-4d45-b03a-154e6aa56767"><enum>(d)</enum><header>Requirements</header><text>Any new governmentwide executive council designated after the date of enactment of this Act shall be subject to the requirements under section 3.</text></subsection></section><section id="id11405ac3-8e3e-43d0-b9ae-12c85941cd83" changed="added" reported-display-style="italic"><enum>7.</enum><header>Technical Amendments</header><subsection id="id19d153ca-766e-4040-80f5-45049762dd3d"><enum>(a)</enum><header>Title 31</header><text display-inline="yes-display-inline">Section 503 of title 31, United States Code, is amended—</text><paragraph id="id270c208f-5c27-429e-ab43-418667d4eaed"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id03544261-5936-4b9f-baa9-c05961fa057a"><enum>(A)</enum><text>by striking paragraph (12); and</text></subparagraph><subparagraph id="idbf23f291-6fba-4328-92f7-cab8fa5ac338"><enum>(B)</enum><text>by redesignating paragraphs (13) and (14) as paragraphs (12) and (13); and</text></subparagraph></paragraph><paragraph id="id8a64c61c-12a1-40b9-88a6-561844a3bb19"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="idc3fd9add-dabc-46f7-9e41-8c513541cefb"><enum>(A)</enum><text>by striking paragraph (5); and</text></subparagraph><subparagraph id="id3288736b-ceb3-474e-810f-0fedea7de2b7"><enum>(B)</enum><text>by redesignating paragraphs (6) through (10) as paragraphs (5) through (9).</text></subparagraph></paragraph></subsection><subsection id="idac35d1ff-b5df-4668-b86c-ae0aef613e4d"><enum>(b)</enum><header>Title 44</header><text>Section 3602(f) of title 44, United States Code, is amended—</text><paragraph id="ida59b622b-7ea0-478a-9fc4-44677e0c1a5e"><enum>(1)</enum><text>by striking paragraph (7);
