which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To strengthen the requirements relating to advance electronic information for cargo, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Uniform Postal Data Acquisition for Transparency and Early Detection within the United States Postal Service Act</short-title></quote> or the <quote><short-title>UPDATED USPS Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idB0CBC12DD7584C81A8DB889D154FB94A"><enum>2.</enum><header>Modification of requirements relating to advance electronic information for cargo</header><subsection id="idF3CAED0EF17746259B8B1CDE754AA005"><enum>(a)</enum><header>Elimination of restriction on use of advance electronic information for commercial enforcement</header><text>Section 343(a)(3)(F) of the Customs Border Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/1415">19 U.S.C. 1415(a)(3)(F)</external-xref>) is amended by striking <quote>, and shall</quote> and all that follows through <quote>thereunder</quote>.</text></subsection><subsection id="id2142A7501DA147E3844FCFB0CA850B04"><enum>(b)</enum><header>Elimination of waivers of requirement To transmit advance electronic information for countries</header><paragraph id="id22B144C7AB91441A81C01B6C8CBADC4E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 343(a)(3)(K)(vi) of the Customs Border Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/1415">19 U.S.C. 1415(a)(3)(K)(vi)</external-xref>) is amended—</text><subparagraph id="idDD543BCB1E09469692FF555BC68F5E17"><enum>(A)</enum><text>by striking subclauses (II), (III), and (IV); and</text></subparagraph><subparagraph id="idF26CC90B479B4B939835E1B8450386FB"><enum>(B)</enum><text>by striking <quote>(I) Notwithstanding</quote> and inserting <quote>Notwithstanding</quote>.</text></subparagraph></paragraph><paragraph id="idF3A97A0086E14C6FADB9225099CC0AAB"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) take effect on the date that is 180 days after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="id68E43C09B41F4414A83E0B0481CEE9BF"><enum>(c)</enum><header>Requirement To refuse shipments for which advance electronic information is not transmitted</header><text>Section 343(a)(3)(K)(vii) of the Customs Border Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/1415">19 U.S.C. 1415(a)(3)(K)(vii)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2D6BA81E9C2C4666891EDB52005153FD"><clause commented="no" display-inline="no-display-inline" id="H6B87A39690C547AFBBE4920DB1A852F7" indent="up1"><enum>(vii)</enum><text>The Commissioner shall refuse entry for any international mail shipments described in clause (i) received after December 31, 2022, for which the information described in paragraphs (1) and (2) is not transmitted as required under this subparagraph.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBB4D32DDB9CB44BD99097D603BF1AC89"><enum>(d)</enum><header>Inclusion of letter class mail; publication of number of shipments for which advance electronic information not transmitted</header><text>Section 343(a)(3)(K) of the Customs Border Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/1415">19 U.S.C. 1415(a)(3)(K)</external-xref>) is amended—</text><paragraph id="id6F32556C788042668A9BFFA9C8AADE51"><enum>(1)</enum><text>by redesignating clauses (viii) and (ix) as clauses (x) and (xi), respectively; and</text></paragraph><paragraph id="idD961D8990A734B9DA7BD59954684332E"><enum>(2)</enum><text>by inserting after clause (vii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBFB3BADA9870419490029839CF5F1798"><clause id="id6F2AD575FA0647C28D74D599ED6A6192" indent="up1"><enum>(viii)</enum><text>Not later than December 31, 2022, the Postal Service shall arrange for the transmission to the Commissioner of the information described in paragraphs (1) and (2) for all international mail shipments.</text></clause><clause indent="up1" id="id16D9FF7DE5A14C709CCC802E57C23F76"><enum>(ix)</enum><text>Not less frequently than every 30 days, the Postal Service shall publish on a publicly accessible internet website the number of international mail shipments for which the information described in paragraphs (1) and (2) was not transmitted to the Commissioner under this subparagraph during the preceding 30-day period.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id480FDFDB162846BD83416B481519143C"><enum>(e)</enum><header>Monthly report</header><text>Section 343(a) of the Customs Border Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/1415">19 U.S.C. 1415(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE91AD7F2E6E24BD08696D0B288DCA189"><paragraph id="id58003AD70F26455BA425E7CAE5BFCD14"><enum>(6)</enum><header>Monthly report</header><text>Not later than 90 days after the date of the enactment of the <short-title>UPDATED USPS Act</short-title>, and every 30 days thereafter, the Secretary shall publish, for the preceding 30-day period, the following information:</text><subparagraph id="id21F997B4DA3F45C1A27B0F6D12633E86"><enum>(A)</enum><text>The total volume of international mail shipments and other cargo received by the Postal Service and private sector importers for which advance electronic information is submitted under this section.</text></subparagraph><subparagraph id="ideeffa4f7e53942cfb5439c8aa32059ac"><enum>(B)</enum><text>The number of packages included in such shipments and cargo that U.S. Customs and Border Protection requested to screen and the number of packages provided for such screening by the Postal Service and private sector importers.</text></subparagraph><subparagraph id="id70bb46fbab6c47aebaa35b6fe0f5f27b"><enum>(C)</enum><text>An assessment of the results of inspections by U.S. Customs and Border Protection of international mail facilities and private sector importers, including the number of goods inspected and seized.</text></subparagraph><subparagraph id="idb80c1b05798c4ef198268a19726e1226"><enum>(D)</enum><text>The volume of Inbound Express Mail Service items entered under section 13031(b)(9)(D) of the Consolidated Omnibus Budget Reconciliation Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/19/58c">19 U.S.C. 58c(b)(9)(D)</external-xref>). </text></subparagraph><subparagraph id="id1bffedbf7b16453ebf091ee959a11ed9"><enum>(E)</enum><text>The total amount of fees paid to U.S. Customs and Border Protection by the Postal Service and private sector importers under that section.</text></subparagraph><subparagraph id="id14abe2a17872456e9246b5b927cbe3ac"><enum>(F)</enum><text>The number of international mail shipments, disaggregated by letters and packages, received from each foreign country.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0EFF96D0E1DD48D2A61CEEF5EE748085"><enum>(f)</enum><header>Technical amendments</header><text>Section 343 of the Customs Border Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/1415">19 U.S.C. 1415</external-xref>) is amended—</text><paragraph id="id2522EA00715041368193A9640924B12A"><enum>(1)</enum><text>in subsection (a)(3)(G), by striking the second period at the end;</text></paragraph><paragraph id="id73FFC17238064FD59A19AD1267C989C6"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id740BE21F0D4646ED93F4240F999397E1"><subsection id="idA9E7591A6C83492ABA39467DEF4ACEFF"><enum>(c)</enum><header>Secretary defined</header><text>In this section, the term <term>Secretary</term> means the Secretary of the Treasury and the Secretary of Homeland Security acting jointly.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idA980C746400F4B26BE6FA6AC633EA94B"><enum>(3)</enum><text>by striking <quote>the Customs Service</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>.</text></paragraph></subsection></section></legis-body></bill>
