which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for emergency acquisition authority in the event of armed attack against a United States ally or partner by a foreign adversary of the United States.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing American Acquisitions, Readiness, and Military Stockpiles Act of 2022</short-title></quote> or the <quote><short-title>Securing American ARMS Act of 2022</short-title></quote>.</text></section><section id="id758E1D56E0C2414AB52E1C247B30F17A"><enum>2.</enum><header>Emergency acquisition authority</header><text display-inline="no-display-inline">Section 3204 of title 10, United States Code, is amended—</text><paragraph id="id5095BE99DD3C426D8F8D5331EDC60A57"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id6E4E9ABD317C4591B00467F45762DB67"><enum>(A)</enum><text>in paragraph (6), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idB6C9C0AC5B9E4081A299DCE65E6375B2"><enum>(B)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id3830E8A86F0041CFA372E16B70FF8F58"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="idF3F5BA00EAFF42FC999D848C52D88EB1" style="OLC" act-name=""><paragraph id="id4ED81C60E4E04E38AB1F34B7F069D1A0"><enum>(8)</enum><text>the head of the agency—</text><subparagraph id="id43612987B196431B815F126025087C72"><enum>(A)</enum><text>determines that the use of procedures other than competitive procedures is necessary to—</text><clause id="id13FAE51B98124F52B45BCF8A5A5F33ED"><enum>(i)</enum><text>replenish United States stockpiles with like defense articles when those stockpiles are diminished as a result of the United States providing defense articles in response to an armed attack, by a foreign adversary of the United States (as that term is defined in section 8(c) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1607">47 U.S.C. 1607(c)</external-xref>)) against—</text><subclause id="idBF2433261B814A4EA7BA21BEC1E75514"><enum>(I)</enum><text>a United States ally (as that term is defined in section 201(d) of the Act of December 2, 1942, entitled, <quote>To provide benefits for the injury, disability, death, or enemy detention of employees of contractors with the United States, and for other purposes</quote> (56 Stat. 1028, chapter 668; <external-xref legal-doc="usc" parsable-cite="usc/42/1711">42 U.S.C. 1711(d)</external-xref>)); or</text></subclause><subclause id="idE6106851F9A94DDCAC814AD8702A5269"><enum>(II)</enum><text>a United States partner; or </text></subclause></clause><clause id="id1E8429987C444C6BA9AB55E8DE92004D"><enum>(ii)</enum><text>to contract for the movement or delivery of defense articles transferred to such ally or partner through the President's drawdown authorities in connection with such response; </text></clause><continuation-text continuation-text-level="subparagraph">provided that the United States is not a party to the hostilities; and</continuation-text></subparagraph><subparagraph id="id09EA7213ADC245428B2A8F76D62DF834"><enum>(B)</enum><text>submits to the congressional defense committees written notification of the use of such procedures within one week after such use.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id64DDA36809114AB2A996514A77B28805"><enum>(2)</enum><text>in subsection (e)(1), by striking <quote>and (7)</quote> and inserting <quote>(7), and (8)</quote>.</text></paragraph></section></legis-body></bill>
