which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for civil monetary penalties for violations of mental health parity requirements.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parity Enforcement Act of 2022</short-title></quote>.</text></section><section id="H23E5408A167F47AABCE401A14A2FB068"><enum>2.</enum><header>Civil monetary penalties for parity violations</header><subsection id="H0C799E5506F8475C82B35A41307B5CEC"><enum>(a)</enum><header>Civil monetary penalties relating to parity in mental health and substance use disorders</header><text display-inline="yes-display-inline">Section 502(c)(10) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1132">29 U.S.C. 1132(c)(10)(A)</external-xref>) is amended—</text><paragraph id="H2C5FD0D9089A49A09BA533AE04D0FDEC"><enum>(1)</enum><text> in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">use of genetic information</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">use of genetic information and parity in mental health and substance use disorder benefits</header-in-text></quote>; and</text></paragraph><paragraph id="H21239CF6C54A4D6BB7B43D52B2FB26A7"><enum>(2)</enum><text> in subparagraph (A)—</text><subparagraph id="H134A1E238CB24F76AE5A39D42EACA93B"><enum>(A)</enum><text>by striking <quote>any plan sponsor of a group health plan</quote> and inserting <quote>any plan sponsor or plan administrator of a group health plan</quote>; and</text></subparagraph><subparagraph id="HE1BCC486CF0846109C8C1FA2CB014A24"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>for any failure</quote> and all that follows through <quote>in connection with the plan.</quote> and inserting</text><quoted-block style="OLC" id="HEE9C9A09A3764C96A59CEAD839E25BB7" display-inline="yes-display-inline"><text>for any failure by such sponsor, administrator, or issuer, in connection with the plan—</text><clause id="HBC39889BF2424F49A57C32D5A6EEF6AC"><enum>(i)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a)(1)(F), (b)(3), (c), or (d) of section 702 or section 701 or 702(b)(1) with respect to genetic information; or</text></clause><clause id="H5226DD9E95DC428295B9A3A4C6937978"><enum>(ii)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a) of section 712 with respect to parity in mental health and substance use disorder benefits.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HB33849BD2A0047CE85D42DB7CC795818"><enum>(b)</enum><header>Exception to the general prohibition on enforcement</header><text>Section 502 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1132">29 U.S.C. 1132</external-xref>) is amended—</text><paragraph id="HD92FCF68BA0840E490ACDDF9D6F77D72"><enum>(1)</enum><text>in subsection (a)(6), by striking <quote>or (9)</quote> and inserting <quote>(9), or (10)</quote>; and</text></paragraph><paragraph id="H6ED9775C407947489A8BD67077AF2E7C"><enum>(2)</enum><text>in subsection (b)(3)—</text><subparagraph id="HC19091791BBE4D00B65136D0614EEFF7"><enum>(A)</enum><text>by striking <quote>subsections (c)(9) and (a)(6)</quote> and inserting <quote>subsections (c)(9), (c)(10), and (a)(6)</quote>;</text></subparagraph><subparagraph id="HB461E1065BE5452D979BE65D37C09C38"><enum>(B)</enum><text>by striking <quote>under subsection (c)(9))</quote> and inserting <quote>under subsections (c)(9) and (c)(10)), and except with respect to enforcement by the Secretary of section 712</quote>; and</text></subparagraph><subparagraph id="HBE86EE9D72614F38A4F3B4D5A7DCD1F3"><enum>(C)</enum><text>by striking <quote>706(a)(1)</quote> and inserting <quote>733(a)(1)</quote>.</text></subparagraph></paragraph></subsection><subsection id="H4A01A51AFCB94F20AE5B8C96B0247F51"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to group health plans, or any health insurance issuer offering health insurance coverage in connection with such plan, for plan years beginning after the date that is 1 year after the date of enactment of this Act. </text></subsection></section></legis-body></bill>
