<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4795</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220907">September 7, 2022</action-date><action-desc><sponsor name-id="S284">Ms. Stabenow</sponsor> (for herself and <cosponsor name-id="S309">Mr. Casey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to authorize a program to recognize institutions of higher education that offer outstanding services and programs for foster and homeless youth, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H53F8804539AC4CDAAAFE786AC6396046"><section section-type="section-one" id="H9C26809F345147CBB14F5E95E7746DEB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fostering Postsecondary Success for Foster and Homeless Youth Act of 2022</short-title></quote>.</text></section><section id="HBB7A4C43D3054EB9A3EBE109FBC23338"><enum>2.</enum><header>Recognition of foster care youth- and homeless youth-friendly institutions of higher education</header><text display-inline="no-display-inline">Title VIII of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161a">20 U.S.C. 1161a et seq.</external-xref>) is amended by adding at the end the following new part:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF16A00BF9F2C4EAB94412EF17A575DE2"><part id="HBABC64D99E5848059B0488BB6FED2E7A"><enum>BB<?LEXA-Enum BB?></enum><header>Foster care youth- and homeless youth-friendly institutions</header><section id="H33982B1C7AB7424A81CF0F4F926BD171"><enum>899.</enum><header>Recognition of foster care youth- and homeless youth-friendly institutions of higher education</header><subsection id="H54F61B44F41A43369241ED1311207A56"><enum>(a)</enum><header>General authority</header><text display-inline="yes-display-inline">The Secretary shall recognize eligible institutions that offer outstanding support services and other programs tailored to the needs of foster care youth and homeless youth.</text></subsection><subsection id="H5DAE1E9C8A3A4C91A70B69B7602FD86D"><enum>(b)</enum><header>Designation</header><text>An eligible institution recognized by the Secretary under subsection (a) shall be designated as <quote>Foster and Homeless Youth Friendly</quote>.</text></subsection><subsection id="HCEDF1D8F59414CF4A8B6A51AD110FED8"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To be considered for recognition under subsection (a), an eligible institution shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require. At a minimum, each application shall include a detailed description of the programs and services available for, and that serve, foster care youth and homeless youth that are offered by the institution, which may include programs and services such as—</text><paragraph id="H22F56FCB5D834B10A7DAD5CF6D141EC6"><enum>(1)</enum><text display-inline="yes-display-inline">mentorship programs that formally match foster care youth and homeless youth with a peer or adult mentor;</text></paragraph><paragraph id="H233C8163CDF040FF9A72865E139E589E"><enum>(2)</enum><text display-inline="yes-display-inline">academic support services to supplement or complement the classroom instruction provided to foster care youth and homeless youth;</text></paragraph><paragraph id="H9E3CC540493A464AA64B85217611928C"><enum>(3)</enum><text display-inline="yes-display-inline">housing assistance programs under which the institution provides—</text><subparagraph id="H4D9337C9014B4D2BA624156E06DF04CB"><enum>(A)</enum><text>on-campus or off-campus housing directly to foster care youth and homeless youth; or</text></subparagraph><subparagraph id="H77EB483029EF4B1CAEC4BAB1822239E7"><enum>(B)</enum><text display-inline="yes-display-inline">financial support to cover the housing costs of foster care youth and homeless youth;</text></subparagraph></paragraph><paragraph id="H5AB4CE2EA6D64D53AF950B15905A163C"><enum>(4)</enum><text display-inline="yes-display-inline">life and workforce skills development programs that teach or enhance the skills that foster care youth and homeless youth may require to be successful in their personal and professional lives;</text></paragraph><paragraph id="HC5FF818067664913A3A0767EAA4C1EB3"><enum>(5)</enum><text display-inline="yes-display-inline">financial aid or scholarships available exclusively to foster care youth and homeless youth;</text></paragraph><paragraph id="H4D5774EA322A460691008A528043FEAE"><enum>(6)</enum><text display-inline="yes-display-inline">counseling or mental health services provided by a licensed professional with expertise in serving foster care youth and homeless youth;</text></paragraph><paragraph id="HB12FF0E8DC204B61B40F307D4284D8B7"><enum>(7)</enum><text display-inline="yes-display-inline">case management services and efforts to facilitate participation in other Federal assistance programs for which students may be eligible; </text></paragraph><paragraph id="idE29158148C084B60870626BA02DF88B7"><enum>(8)</enum><text>an institutional point of contact for such students; and </text></paragraph><paragraph id="H8B0FCF3CF0074A46A185B369FD7BFB0C"><enum>(9)</enum><text display-inline="yes-display-inline">such other programs and services as the Secretary determines to be appropriate in consultation with the individuals and entities described in subsection (e).</text></paragraph></subsection><subsection id="H329EE7D6BB864C69BFEB3B74E81858AA"><enum>(d)</enum><header>Selection process</header><paragraph display-inline="no-display-inline" id="HA779F63563B8469D800ACC6F42107439"><enum>(1)</enum><header>General requirements</header><subparagraph id="H4409191B44DE49E295A7E6810672A2B2"><enum>(A)</enum><header>Annual, merit-based selection</header><text>On an annual basis, the Secretary shall select eligible institutions for recognition under subsection (a) from among institutions that submit applications to the Secretary under subsection (c). The Secretary shall select such institutions on a competitive basis, based solely on merit.</text></subparagraph><subparagraph id="HB956D5E4C36E4546B01F7BD0AC524B86"><enum>(B)</enum><header>Geographic diversity not required</header><text display-inline="yes-display-inline">The Secretary shall not consider geographic diversity among the States as a factor in the selection of eligible institutions for recognition under subsection (a).</text></subparagraph></paragraph><paragraph id="H8388E5CF0E1C4259B1D8F1B1FEFA9F59"><enum>(2)</enum><header>Criteria and procedures</header><text>Consistent with paragraph (1), the Secretary shall issue guidelines setting forth criteria and procedures for the selection of institutions for recognition under subsection (a). The guidelines shall be developed and implemented as follows:</text><subparagraph id="H2E0F124BD0704898A6D92E081297EA1E"><enum>(A)</enum><header>Draft guidelines</header><text>Not later than 180 days after the date of the enactment of this section, the Secretary shall issue draft guidelines, which shall be made available for public comment for a period of not less than 90 days.</text></subparagraph><subparagraph id="HAD182859252B44009C482A1FE558041C"><enum>(B)</enum><header>Revised guidelines</header><text>Not later than 90 days after the end of the public comment period specified in subparagraph (A), the Secretary shall issue revised guidelines, which shall be made available for public comment for a period of not less than 30 days.</text></subparagraph><subparagraph id="H7B024E25B40143EAAB294A4711FFB9F7"><enum>(C)</enum><header>Final guidelines</header><text display-inline="yes-display-inline">Not later than 30 days after the end of the public comment period specified in subparagraph (B), the Secretary shall publish and implement the final guidelines.</text></subparagraph></paragraph></subsection><subsection id="H0BDD93C203D84A5F855468CE89E464FE"><enum>(e)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out the program under this section, the Secretary shall consult with appropriate individuals and entities outside the Department of Education, which may include—</text><paragraph id="HFF64ABEE25914A92AFFA0626148022DC"><enum>(1)</enum><text>other Federal agencies;</text></paragraph><paragraph id="H1C956625BF1749E584ABA2E49EF5C97E"><enum>(2)</enum><text>State agencies;</text></paragraph><paragraph id="H9AA9F910953D492985D66471D87C8205"><enum>(3)</enum><text>institutions of higher education;</text></paragraph><paragraph id="H860C876C7716486E886AA896C80DF5F2"><enum>(4)</enum><text>nonprofit and advocacy organizations;</text></paragraph><paragraph id="HFEE952BE44D84B6E892563A7686DBD94"><enum>(5)</enum><text display-inline="yes-display-inline">current and former foster care youth; and</text></paragraph><paragraph id="H7916AF266F84419A8056C07248DECD82"><enum>(6)</enum><text display-inline="yes-display-inline">students who have experienced homelessness.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="HA85BF00CA6824753A31D1ABF094D5D17"><enum>(f)</enum><header>Information sharing</header><text display-inline="yes-display-inline">On an annual basis, the Secretary shall publish, on a publicly accessible website of the Department of Education—</text><paragraph id="H03FBB76605A34933BE919E672C583CB3"><enum>(1)</enum><text display-inline="yes-display-inline">a profile of each institution recognized under subsection (a) in the most recent year; and</text></paragraph><paragraph commented="no" id="HE52388714DEF4520A1C116F9E12A99FA"><enum>(2)</enum><text display-inline="yes-display-inline">a comprehensive list of all institutions previously recognized under subsection (a).</text></paragraph></subsection><subsection commented="no" id="H4BDD07EFE4FD43DF8C59EE3450A05B6E"><enum>(g)</enum><header>Ensuring continuity of quality programs and services for foster and homeless youth</header><paragraph commented="no" id="HDAC234E829C14464A40FC02B463A16A7"><enum>(1)</enum><header>Institutional review</header><subparagraph commented="no" id="HC0848DA4C16E47CFA9396CC3DF26F835"><enum>(A)</enum><header>In general</header><text>Not less frequently than once every 5 years, the Secretary shall review each institution recognized under subsection (a) to determine whether the programs and services provided by the institution continue to meet the criteria required for such recognition.</text></subparagraph><subparagraph commented="no" id="HC983BC1EC6714D28871F91DEC4D0425C"><enum>(B)</enum><header>Notice</header><text>If the Secretary determines under subparagraph (A) that an institution no longer meets the criteria for recognition under subsection (a), the Secretary shall transmit written notice of such determination to the institution.</text></subparagraph><subparagraph commented="no" id="HC6435D280E4E4DD780402D3B153D9426"><enum>(C)</enum><header>Revocation</header><text>After transmitting the notice required under subparagraph (B), the Secretary shall—</text><clause commented="no" id="HA3E8C2A231664B12A4A512B9B9D0C700"><enum>(i)</enum><text>revoke the institution’s recognition under subsection (a); and</text></clause><clause commented="no" id="H33AF6CDA4F5C425E800B1B2B42A3E26A"><enum>(ii)</enum><text>remove the profile established for the institution under subsection (f)(1) from the website of the Department of Education.</text></clause></subparagraph><subparagraph id="H9422B5EC957B499EB7214ADF54D594EC"><enum>(D)</enum><header>Reapplication</header><text>An institution that loses recognition under subsection (a) may reapply for such recognition in a subsequent application year.</text></subparagraph></paragraph><paragraph commented="no" id="H0D2E29156BE64E02A79A39175DD3A682"><enum>(2)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this section, and not less frequently than once every 2 years thereafter, the Secretary shall provide to Congress a briefing that identifies—</text><subparagraph commented="no" id="H7957A8C007D6444C8D594FD8FA5F6684"><enum>(A)</enum><text>strategies used by institutions that proved effective in meeting the needs of foster care youth and homeless youth; and</text></subparagraph><subparagraph commented="no" id="H6A83EB51E9EB43E9AF1CB629433BB7C8"><enum>(B)</enum><text>recommendations on how to improve programs and services for foster care youth and homeless youth.</text></subparagraph></paragraph></subsection></section><section id="HDE0FBCF86FA7437ABA1A06EF22E1C6EC"><enum>899A.</enum><header>Training, evaluation, and information center</header><subsection id="H9119150DF2B6443C828618C21311D0D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Secretary shall establish a Center for Fostering Postsecondary Success for Foster and Homeless Youth (referred to in this section as the <quote>Center</quote>).</text></subsection><subsection id="HE1845F07C455420AA597DB84E87FDA39"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Center shall be to assist institutions of higher education in establishing and maintaining programs for foster care youth and homeless youth, including by—</text><paragraph id="HB5216BCC70E7418BBFB39FC9BC906A3E"><enum>(1)</enum><text>providing technical assistance;</text></paragraph><paragraph id="HF349323FE7AB4048A68526874028E1CA"><enum>(2)</enum><text>collecting, evaluating, and delivering information on best practices for such programs; and</text></paragraph><paragraph id="H618A4BE91D3147498BE18F77F4B135C7"><enum>(3)</enum><text>maintaining resources to help foster care youth and homeless youth navigate postsecondary education.</text></paragraph></subsection><subsection id="H872B9D18BF5E4480BBB7C4BF68954B36"><enum>(c)</enum><header>Cooperative agreement</header><text>For the purpose of carrying out this section, the Secretary may enter into cooperative agreements with one or more organizations with expertise in support services and other programs tailored to the needs of foster care youth and homeless youth, including—</text><paragraph id="H97696BB6BB3047F8B08A607FC82E6990"><enum>(1)</enum><text>nonprofit nongovernmental organizations;</text></paragraph><paragraph id="HD49504CEDE1742B18A57EEE56393974D"><enum>(2)</enum><text>Federal and State government agencies;</text></paragraph><paragraph id="H4CB2DA1F61CA4E74AE7BB7414076AC91"><enum>(3)</enum><text>institutions of higher education, including public, private, and land-grant colleges and universities, and minority-serving institutions; and</text></paragraph><paragraph id="HFC5AC5B059C44F5BA85E7EBDBDC8294B"><enum>(4)</enum><text>such other organizations as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="H6E0A1BC56D8C4125800130DF69A297D1"><enum>(d)</enum><header>Priority</header><text>In entering into agreements with organizations under subsection (c), Secretary shall give priority to organizations that—</text><paragraph id="H0C098F47511D4F449D1D19634BAD8A83"><enum>(1)</enum><text display-inline="yes-display-inline">are capable of engaging with foster care youth and homeless youth and programs that serve such youth and demonstrate expertise in understanding the unique needs of such youth;</text></paragraph><paragraph id="HD7A95FD4E2844678B4354029FA793AE9"><enum>(2)</enum><text>demonstrate the capacity to effectively implement outreach, training, and coordination functions;</text></paragraph><paragraph id="HD971FF9FFF844B32A4F4E9F38C01918F"><enum>(3)</enum><text>are capable of producing resources and materials that can easily be replicated and distributed to institutions of higher education in multiple formats;</text></paragraph><paragraph id="H83C010C2F224417B87776DAE616C412B"><enum>(4)</enum><text>have working partnerships with—</text><subparagraph id="H43F6C3845D704C558404716C21C4D0AB"><enum>(A)</enum><text>nonprofit and private sector organizations; and</text></subparagraph><subparagraph id="H84642974F2E84EE8936E0F39E817A536"><enum>(B)</enum><text>local, State, and Tribal governments;</text></subparagraph></paragraph><paragraph id="H6313B87FA5DA4B219B638214C76E453C"><enum>(5)</enum><text>have the ability to work in underserved communities; and</text></paragraph><paragraph id="H2C131CD11CC64191923BA1C6D790E860"><enum>(6)</enum><text>have an organizational mission aligned with goals of the program under this part.</text></paragraph></subsection><subsection id="H1A18FC964051482FADD05C43CFD7514B"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to provide the Center with the authority to issue mandates to, or impose requirements on, any institution of higher education.</text></subsection><subsection id="H6A28A1DD9467462BBA27FF135F24E800"><enum>(f)</enum><header>Limitation on use of funds</header><paragraph id="HBBB5EAB817474DE38B82D123FC35AF1C"><enum>(1)</enum><header>Limitation on use of funds for establishment</header><text display-inline="yes-display-inline">Of the funds made available to carry out this part for each of fiscal years 2022 and 2023, the Secretary may use not more than $2,000,000 in each fiscal year to establish the Center.</text></paragraph><paragraph id="H35FE2AFFFBD84AF38697C3A38F824C6A"><enum>(2)</enum><header>Limitation on use of funds for operation</header><text display-inline="yes-display-inline">Of the funds made available to carry out this part for each fiscal year beginning after fiscal year 2023, the Secretary may use not more than $1,000,000 in each fiscal year to support the operations of the Center.</text></paragraph></subsection></section><section id="HA404AD8EA90C4172804BA1B7FD206A61"><enum>899B.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph id="HD220FBBC28F84974904514D0047D93FF"><enum>(1)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means—</text><subparagraph id="H704937E6D5C3424B8426C66A3A77DA4D"><enum>(A)</enum><text display-inline="yes-display-inline">an institution of higher education (as defined in section 101); or</text></subparagraph><subparagraph id="HBB9106DEEA8D4D76806E3D98646447DF"><enum>(B)</enum><text display-inline="yes-display-inline">a postsecondary educational institution operated or controlled by the Bureau of Indian Education.</text></subparagraph></paragraph><paragraph commented="no" id="HCBE4F9F1A4C341C585BD56D27E0578B4"><enum>(2)</enum><header>Foster care youth</header><text display-inline="yes-display-inline">The term <term>foster care youth</term> means an individual whose care and placement is the responsibility of the State or Tribal agency that administers a State or Tribal plan under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621 et seq.</external-xref>; 670 et seq.), without regard to whether foster care maintenance payments are made under section 472 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/672">42 U.S.C. 672</external-xref>) on behalf of the individual, including any such individual who was in such care on or after attaining 13 years of age and without regard to the reason the individual left such care.</text></paragraph><paragraph id="HB48A6FD63AA94264BA924785CCC0FC17"><enum>(3)</enum><header>Homeless youth</header><text display-inline="yes-display-inline">The term <term>homeless youth</term> has the meaning given the term <term>homeless children and youths</term> in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>).</text></paragraph><paragraph id="id13C6E0B0CC8B4AA9ACC8339EB4C6D3CF"><enum>(4)</enum><header>Minority-serving institution</header><text display-inline="yes-display-inline">The term <term>minority-serving institution</term> means an eligible institution described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
