which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act with respect to opioid overdose reversal medication access, education, and co-prescribing grant programs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Naloxone Education and Access Act</short-title></quote>.</text></section><section id="id580B91CC3B444050A8EC70AF2A79E32F"><enum>2.</enum><header>Opioid overdose reversal medication access, education, and co-prescribing grant programs</header><text display-inline="no-display-inline">Section 545 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee">42 U.S.C. 290ee</external-xref>) is amended—</text><paragraph id="idC4F8C575DDA54447BD1C517F96EF7F7F"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text style="OLC" level="section">access and education</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">access, education, and co-prescribing</header-in-text></quote>;</text></paragraph><paragraph id="idF11F1B8D2C404FED9C18C54AF4425DA4"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="idED6F1DED775B4349AC287E2D5E95C626"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="section">to States</header-in-text></quote>;</text></subparagraph><subparagraph id="idDF54F3DEC551479687F7604EC558E8A2"><enum>(B)</enum><text>in the matter preceding paragraph (1), by striking <quote>States</quote> and inserting <quote>eligible entities</quote>;</text></subparagraph><subparagraph id="id5E106B5E2A144DCA9AD6F2ACF3A6BAA1"><enum>(C)</enum><text>in paragraph (1), by striking <quote>for pharmacists to dispense a drug or device approved or cleared</quote> and inserting <quote>that increase access to drugs and devices approved, cleared, or otherwise legally marketed</quote>;</text></subparagraph><subparagraph id="idC9E6BF68C88F472CA9F7645244D5C9DA"><enum>(D)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (5) and (6), respectively;</text></subparagraph><subparagraph id="id6B7BC293D7034567BE8623E793A18B4F"><enum>(E)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEBDF8C9FC2BE47DDB0BFB16BB3F57E2E"><paragraph id="id993609dbbdbd429f98f744496e00b9fb"><enum>(3)</enum><text>encourage health care providers to co-prescribe, as appropriate, drugs or devices approved, cleared, or otherwise legally marketed under the Federal Food, Drug, and Cosmetic Act for emergency treatment of known or suspected opioid overdose;</text></paragraph><paragraph id="ida4fdaf63b0be4e4a8c37be3287aae1df"><enum>(4)</enum><text>support innovative community-based distribution programs of drugs or devices approved, cleared, or otherwise legally marketed under the Federal Food, Drug, and Cosmetic Act for emergency treatment of known or suspected opioid overdose;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id6E371B26C22C45DC96E10ACAB1E3269B"><enum>(F)</enum><text>in paragraphs (5) and (6), as so redesignated, by striking <quote>approved or cleared</quote> each place it appears and inserting <quote>approved, cleared, or otherwise legally marketed</quote>;</text></subparagraph></paragraph><paragraph id="idEFC0C34C42CE45EF9666A81B89B158B7"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="idE3C4D4B50A83495093C55B094AEEFD55"><enum>(A)</enum><text>by striking <quote>State</quote> and inserting <quote>eligible entity</quote>; and</text></subparagraph><subparagraph id="id3EFE7DD21B9D4D3A870CACFC77249C0C"><enum>(B)</enum><text>by striking <quote>approved or cleared</quote> and inserting <quote>approved, cleared, or otherwise legally marketed</quote>;</text></subparagraph></paragraph><paragraph id="id072FC40FD6994FC9B79712B64D715C82"><enum>(4)</enum><text>in subsection (c)—</text><subparagraph id="idC1A875ACDB6A4BCD80F9EF98B14B7B96"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>States</quote> and inserting <quote>eligible entities</quote>; and</text></subparagraph><subparagraph id="idB631FCA04D3C44BAA3D1C2707BBE19C5"><enum>(B)</enum><text>by striking <quote>approved or cleared</quote> each place it appears and inserting <quote>approved, cleared, or otherwise legally marketed</quote>;</text></subparagraph></paragraph><paragraph id="id5DF8A486EEA14F3BB5F66DADF84B5407"><enum>(5)</enum><text>in subsection (d)—</text><subparagraph id="idBB02F0BBF2334F4C89C9800C7713BE9F"><enum>(A)</enum><text>in paragraph (1), by striking <quote>A State</quote> and inserting <quote>An eligible entity</quote>;</text></subparagraph><subparagraph id="id57C62865A93C458D8AF68FE419EF9630"><enum>(B)</enum><text>in paragraph (2), by striking <quote>3</quote> and inserting <quote>5</quote>; and</text></subparagraph><subparagraph id="id1050A9E67A284168A7D2CC50A2D2EBDA"><enum>(C)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD912DC8976D5499B93D9C086F6F5AC8B"><paragraph id="idB87D2A75D544444683CD5D95414CD93F"><enum>(3)</enum><header>Limitation</header><text>An eligible entity may use—</text><subparagraph id="idB770D627D9E9475AABD8239F9FBCA8DB"><enum>(A)</enum><text>not more than 10 percent of a grant under this section for educating the public pursuant to subsection (a)(6); and</text></subparagraph><subparagraph id="id459FED5417D446B6B2571A812F1631B3"><enum>(B)</enum><text>not less than 20 percent of a grant under this section to offset cost-sharing for distribution and dispensing of drugs or devices approved, cleared, or otherwise legally marketed under the Federal Food, Drug, and Cosmetic Act for emergency treatment of known or suspected opioid overdose.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id9CF99EB52DE4473A96BA83C7C598464F"><enum>(6)</enum><text>in subsection (e), by striking <quote>a State</quote> and inserting <quote>an eligible entity</quote>;</text></paragraph><paragraph id="id9EA73D03F0364A1F9409D4C5BC0B397E"><enum>(7)</enum><text>in subsection (f)—</text><subparagraph id="id53B51D9BFE1C4FC893C1744AD7701AA4"><enum>(A)</enum><text>by striking <quote>A State</quote> and inserting <quote>An eligible entity</quote>;</text></subparagraph><subparagraph id="id7F897A1B128F4487BE14E329108B7327"><enum>(B)</enum><text>by striking <quote>in the State</quote> and inserting <quote>in the jurisdiction of the eligible entity</quote>; and</text></subparagraph><subparagraph id="id69636B8E1CBE40189CFE472BC8117877"><enum>(C)</enum><text>by striking <quote>approved or cleared</quote> and inserting <quote>approved, cleared, or otherwise legally marketed</quote>;</text></subparagraph></paragraph><paragraph id="id0B8039A7460C4DF0AFF433D33AB3A946"><enum>(8)</enum><text>by amending subsection (g) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1C301C2590F94521B5D87FB95A9CE6EA"><subsection id="id16A73D5855424CECAD122AE5317B9AF1"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idD42D0299CA8A43BBA5AECBE7F2BD551D"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State, locality, Indian Tribe, Tribal organization, or Urban Indian organization.</text></paragraph><paragraph id="id5B0B8ADC5CC14A38AD685D3A63E80362" commented="no"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act.</text></paragraph><paragraph id="idB02B58D818F3416FAD4EA6FD87D52D4C"><enum>(3)</enum><header>Standing order</header><text>The term <term>standing order</term> means a document prepared by a person authorized to prescribe medication that permits another person to acquire, dispense, or administer medication without a person-specific prescription.</text></paragraph><paragraph id="id36F597508D52494DB807D93B00EA4A64"><enum>(4)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act.</text></paragraph><paragraph id="id8EE41371C52D4222AA614B51E24FE042"><enum>(5)</enum><header>Urban Indian organization</header><text>The term <term>Urban Indian organization</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idE9786E990B364DE69F9C47418DB8BD4F"><enum>(9)</enum><text>in subsection (h)(1)—</text><subparagraph id="idD7A7BFD45EB942D7A0716AA908A7D9D8"><enum>(A)</enum><text>by striking <quote>$5,000,000</quote> and inserting <quote>$10,000,000</quote>; and</text></subparagraph><subparagraph id="id5721B452A2984013B3B5A947F5A2A16B"><enum>(B)</enum><text>by striking <quote>2017 through 2019</quote> and inserting <quote>2023 through 2027</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
