which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To combat illegal, unreported, and unregulated fishing at its sources globally.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fighting Foreign Illegal Seafood Harvests Act of 2022</short-title></quote> or the <quote><short-title>FISH Act of 2022</short-title></quote>.</text></section><section id="idC6D1925001084529AD395204AFAFD510"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="idC2EC2A599C2448F18CE8B56175CF0C15"><enum>(1)</enum><header>Administrator</header><text>Unless otherwise provided, the term <term>Administrator</term> means the Administrator of the National Oceanic and Atmospheric Administration. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PH40573885227B472F96FABC6CBFA08BEA"><enum>(2)</enum><header display-inline="yes-display-inline">Exclusive economic zone</header><text>The term <term>exclusive economic zone</term> means the zone established by Presidential Proclamation Number 5030, dated March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note; relating to the exclusive economic zone of the United States of America).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PHD2A93332A0E9400FB2755DB15A31A3E5"><enum>(3)</enum><header display-inline="yes-display-inline">IUU fishing</header><text display-inline="yes-display-inline">The term <term>IUU fishing</term> means illegal fishing, unreported fishing, and unregulated fishing (as such terms are defined in paragraph 3 of the International Plan of Action to Prevent, Deter, and Eliminate Illegal, Unreported and Unregulated Fishing, adopted at the 24th Session of the Committee on Fisheries in Rome on March 2, 2001). </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idF9C8D84888C44417B8291CD22D51C70A"><enum>(4)</enum><header>Regional fisheries management organization</header><text>The terms <term>regional fisheries management organization</term> and <term>RFMO</term> have the meaning given the terms in section 303 of the Port State Measures Agreement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/16/7402">16 U.S.C. 7402</external-xref>).</text></paragraph></section><section id="id47432845f8ea425c99102b4ce42e7546"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to partner, consult, and coordinate with foreign governments (at the national and subnational levels), civil society, international organizations, international financial institutions, subnational coastal communities, commercial and recreational fishing industry leaders, communities that engage in artisanal or subsistence fishing, and the private sector, in a concerted effort—</text><paragraph id="id81BE5C4E010B427CAEA1AEF40E31F377" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">to continue the broad effort across the Federal Government to counter IUU fishing and related threats to maritime security, as outlined in sections 3533 and 3534 of the Maritime SAFE Act (16 U.S.C. 8002 and 8003); and </text></paragraph><paragraph id="id45C0511B055847809C62E3A38323DAFF"><enum>(2)</enum><text display-inline="yes-display-inline">to, additionally—</text><subparagraph id="id6BE2F5F16BB84B229F8D735BF8540C19"><enum>(A)</enum><text>prioritize efforts to prevent IUU fishing at its sources; and</text></subparagraph><subparagraph id="id0959CCE106CE4B52AB6970985A3B4700"><enum>(B)</enum><text>support continued implementation of the Central Arctic Ocean Fisheries agreement, as well as joint research and follow-on actions that ensure sustainability of fish stocks in Arctic international waters. </text></subparagraph></paragraph></section><section id="idf16137139617421aa1c26354b6039f93"><enum>4.</enum><header>Black list</header><subsection id="idE5047F21EA10483DB34CC9E3780F35A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish, publish, and put vessels on a United States black list that denies port privileges, certain travel through, delivery of supplies, delivery of services, or transshipment in the exclusive economic zone for vessels that have conducted IUU fishing and vessels that have the same owner as a vessel on the black list.</text></subsection><subsection id="idE811402DEE6B4B56BFEAF75A3D9E37A1" commented="no"><enum>(b)</enum><header>Standards</header><text>The Administrator shall set standards for establishing, maintaining, and publishing the black list. </text></subsection><subsection id="idB88B2EE2C71A4FE281020E9AAD58B675"><enum>(c)</enum><header>Basis To be put on black list</header><text>The Administrator shall put a vessel on the black list if it is any of the following:</text><paragraph id="idf8a773ced6584627926098703c690b0b"><enum>(1)</enum><text>A vessel listed on an IUU fishing list of a regional fisheries management organization.</text></paragraph><paragraph id="ide55d261c0c6841e79e047b6e6c5b4d6f"><enum>(2)</enum><text>A vessel taking part in fishing outside RFMO quota arrangements on the high seas.</text></paragraph><paragraph id="idec219b2257fc4fc88a367930b9d87b59"><enum>(3)</enum><text>A vessel on the high seas identified and reported by United States authorities to be conducting IUU fishing.</text></paragraph><paragraph id="ide442279a740f4273960d219bfa94a3b0"><enum>(4)</enum><text>A vessel that provides services (excluding emergency or enforcement services) to a vessel that is on the black list, including transshipment, resupply, refueling, or pilotage.</text></paragraph><paragraph id="idfcf6466b5c904feabb7c3a5ad767c475"><enum>(5)</enum><text>A foreign fishing vessel engaged in commercial fishing in the exclusive economic zone without a permit issued under title II of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1821">16 U.S.C. 1821 et seq.</external-xref>).</text></paragraph><paragraph id="id25bbec1e15ac40f6bb6bf68cadb8d6af"><enum>(6)</enum><text>A vessel found by Customs and Border Protection to have had a withhold release order in contravention of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), provided that the withhold release order has not been subsequently revoked.</text></paragraph><paragraph id="id0A1D45A4F2934F9C9A43D134CDCED1F1"><enum>(7)</enum><text>A vessel that has the same owner as a vessel on the black list.</text></paragraph><paragraph id="id030c19a1f2184530a8182f31886b0e14"><enum>(8)</enum><text>A vessel subject to economic sanctions administered by the Department of Treasury Office of Foreign Assets Control for IUU fishing under Executive Order 13581 (76 Fed. Reg. 44757, 84 Fed. Reg. 10255; relating to blocking property of transnational criminal organizations), or any other economic sanctions program. </text></paragraph></subsection><subsection id="id8f7487f906d04472a6c24bf55a366d5a"><enum>(d)</enum><header>Nominations To be put on black list</header><paragraph id="id3845F199DD7C4763B3C3A6D18E60AAA7"><enum>(1)</enum><header>In general</header><text>The Administrator may accept nominations for placing a vessel on the black list from—</text><subparagraph id="id7a9ec76000204c8f9cabd9be69b4049f"><enum>(A)</enum><text>the head of an executive branch agency that is a member of the Interagency Working Group on IUU Fishing established under section 3551 of the Maritime SAFE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8031">16 U.S.C. 8031</external-xref>); or </text></subparagraph><subparagraph id="id0a661011f6a24e6381442ca14114035e"><enum>(B)</enum><text>a country that is a member of the Combined Maritime Forces. </text></subparagraph></paragraph><paragraph id="id9E53F08B5BFB49A8BD50FD18581ECD2A"><enum>(2)</enum><header>Due process</header><text>The Administrator may accept nominations for placing a vessel on the black list only after due process, including notification to the vessel’s owner and a review of any information that the owner provides. </text></paragraph></subsection><subsection id="idF1E2F867757F4545A17EED3C0B50E45A"><enum>(e)</enum><header>Public Information</header><text>The Administrator shall publish the black list and include the following information for each vessel on the list:</text><paragraph id="id72DA6FE817994101B34C5C019A561E4D"><enum>(1)</enum><text>The name of the vessel.</text></paragraph><paragraph id="idFEE0FECA280C499FB797BEA6844EDD91"><enum>(2)</enum><text>The International Maritime Organization (IMO) number of the vessel.</text></paragraph><paragraph id="id662FF07D0A7E49A19B22844A71F5B164"><enum>(3)</enum><text>The call sign of the vessel.</text></paragraph><paragraph id="id081C7B7CB2DA455195D241CD4B7A10AC"><enum>(4)</enum><text>Each beneficial owner and owner's address of the vessel.</text></paragraph><paragraph id="id6C3C1BB4ECB44DA4998AA4DE06536452"><enum>(5)</enum><text>The registry/flag state of the vessel.</text></paragraph><paragraph id="id9798E1AD017545BBB54A5DBECAFF4BE1"><enum>(6)</enum><text>The date of inclusion on the black list of the vessel.</text></paragraph><paragraph id="id13B3B5D832404A9086133AE6C0C68B7E"><enum>(7)</enum><text>Any other identifying information on the vessel, as determined appropriate by the Administrator.</text></paragraph></subsection><subsection id="id5F12112FE88A4FF48A59B47FCDF3B297"><enum>(f)</enum><header>Consequences of being black listed</header><paragraph id="id2A0D27C858524990B610BC06DD2D67F3"><enum>(1)</enum><header>In general</header><text>Except for the purposes of inspection and enforcement or in case of force majeure, a vessel on the black list is prohibited from—</text><subparagraph id="id8731FA6005714F0AAB608FAB3E2BD8A1"><enum>(A)</enum><text>accessing United States ports; </text></subparagraph><subparagraph id="id3ba32f97fceb4ce8952e754091b7cdee"><enum>(B)</enum><text>traveling through the United States exclusive economic zone unless it is conducting innocent passage; and</text></subparagraph><subparagraph id="idD0B003F5A37E417E8D9727DC9D8C5E51"><enum>(C)</enum><text>delivering supplies, delivering services, or transshipment in the United States exclusive economic zone. </text></subparagraph></paragraph><paragraph id="id2DC4003A5D87428EB403F24E297DF822"><enum>(2)</enum><header>Servicing prohibited</header><text>No vessel of the United States (defined in section 116 of title 46, United States Code) may service a vessel that is on the black list, except for emergency and enforcement services.</text></paragraph></subsection><subsection id="id31A0F36AF01B4A56987BE234AAD3DD87"><enum>(g)</enum><header>Enforcement of black list</header><text>A vessel on the black list and the cargo of such vessel shall be subject to section 70052 of title 46, United States Code. </text></subsection><subsection id="idC66909527ECD42A690E7221A8DFB87D4"><enum>(h)</enum><header>Permanency of black list</header><paragraph id="id29AE6FDA9FB143DD9DF6993456E4B4F1"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2) and (3), a vessel that is put on the black list shall remain on the black list.</text></paragraph><paragraph id="idB0BFBDB8C3AF4CAAAA9052EC4C695F03"><enum>(2)</enum><header>Revocation of WRO</header><text>The Administrator shall remove a vessel from the black list if the vessel was added to the black list because it was found by Customs and Border Protection to have had a withhold release order in contravention of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>) and the withhold release order was subsequently revoked.</text></paragraph><paragraph id="idB8DCE98C2C3F41108DEC02B062214BDD"><enum>(3)</enum><header>Potential Reinstatement</header><text>In coordination with the Secretary of State, the Administrator may remove a vessel from the black list if the owner of the vessel submits an application for removal or an appeal to the Administrator. In considering the application, the Administrator shall consider all relevant information, including whether the vessel or vessel owner has engaged in IUU fishing during the 5-year period preceding the application.</text></paragraph></subsection><subsection id="idB770CAD8DA7C4C828661876836DF56AD"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Department of Commerce to carry out this section $20,000,000 for each of fiscal years 2023 through 2028.</text></subsection></section><section id="id6115A351FB054AAF94B6D3770026529D"><enum>5.</enum><header>Imposition of sanctions with respect to beneficial owners of vessels on black list</header><subsection id="idF532035BF1A54D39917E0B1E53EBEDFC"><enum>(a)</enum><header>In general</header><text>The President shall impose the sanctions described in subsection (b) with respect to each foreign person that the President determines, on or after the date of the enactment of this Act, is the beneficial owner of a vessel on the black list under section 4.</text></subsection><subsection id="id05eb212977454680af3bb2c18ce50906"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions to be imposed under subsection (a) are the following:</text><paragraph id="id2a0a0b2c94754fa1aa5f583453b22905"><enum>(1)</enum><header>Blocking of property</header><text>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of a foreign person described in subsection (a), including the vessel of which the person is the beneficial owner, if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="id9389ebe76b9f4d9bbc962e9da21b81eb"><enum>(2)</enum><header>Ineligibility for visas, admission, or parole</header><subparagraph id="id79f63d6d88664a3b80413480f1dd9035"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien described in subsection (a) is—</text><clause id="id5695cf5cbbf842948c96fe292798e97f"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="id8433b16e77344036a7840932e1c92bbb"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="id9152451e30e5450d931f2c55eab1adca"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="ide8bdc26a8c91455db5d03ed2a1cf3d15"><enum>(B)</enum><header>Current visas revoked</header><clause id="id56b95e5b2d6d4056bff2f7b539c4b171"><enum>(i)</enum><header>In general</header><text>The visa or other entry documentation of an alien described in subsection (a) shall be revoked, regardless of when such visa or other entry documentation is or was issued.</text></clause><clause id="id2ac2cae66a9a4aa793ad1203c6ef6b79"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="id97b330e1a5fb4434b4b7affed71973fe"><enum>(I)</enum><text>take effect immediately; and</text></subclause><subclause id="id8fcfeb08b78c4f0a90fdd115ab466e8f"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id1cfc3e7e2729410e8b3b289969858ef1"><enum>(c)</enum><header>Implementation; penalties</header><paragraph id="idf2818adc43be443e86163401d3af6842"><enum>(1)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section.</text></paragraph><paragraph id="ide8df3001201041bfb50985ab16c71365"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section. </text></paragraph></subsection><subsection id="idb64ba2b3badc49e9a665ad7044ed85d1"><enum>(d)</enum><header>National interest waiver</header><text>The President may waive the imposition of sanctions under this section with respect to a person if the President—</text><paragraph id="idbf98d7e5ae2f4d6da246aee0405063d9"><enum>(1)</enum><text>determines that such a waiver is in the national interests of the United States; and</text></paragraph><paragraph id="id395c509bc03a4f99b7564678cadae602"><enum>(2)</enum><text>submits to Congress a notification on the waiver and the reasons for the waiver.</text></paragraph></subsection><subsection id="id9bed3b3bbe2048d38e5dce86f4e1fbc6"><enum>(e)</enum><header>Exceptions</header><paragraph id="idaf7ec1560a77473c90c5d07b5faf8cc3"><enum>(1)</enum><header>Exceptions for authorized intelligence and law enforcement activities</header><text>This section shall not apply with respect to activities subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence or law enforcement activities of the United States.</text></paragraph><paragraph id="id21f245c8d90c44c597c09de73f9dbcb5"><enum>(2)</enum><header>Exception to comply with international agreements</header><text>Sanctions under subsection (b)(2) shall not apply with respect to the admission of an alien to the United States if such admission is necessary to comply with the obligations of the United States under the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967, or other international obligations.</text></paragraph><paragraph id="id0b3f9158929e450698db07585dffb258"><enum>(3)</enum><header>Exception relating to importation of goods</header><subparagraph id="id27ab0fdf061247fb811b3554d75b0d45"><enum>(A)</enum><header>In general</header><text>The requirement to impose sanctions under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="id66d32b61578d4cda93a1e030ee126963"><enum>(B)</enum><header>Good defined</header><text>In this paragraph, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data. </text></subparagraph></paragraph></subsection><subsection id="id1C13AB4747DE4D1082E9A0CCDBDBCE42"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id84684064d2394a4caf2e8266ed0bdef2"><enum>(1)</enum><header>Admission; admitted; alien; lawfully admitted for permanent residence</header><text>The terms <quote>admission</quote>, <quote>admitted</quote>, <quote>alien</quote>, and <quote>lawfully admitted for permanent residence</quote> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>). </text></paragraph><paragraph id="id9684590e15ae468b996028cda872c78b" commented="no"><enum>(2)</enum><header>Beneficial owner</header><text>The term <term>beneficial owner</term> means, with respect to a vessel, a person that, directly or indirectly, through any contract, arrangement, understanding, relationship, or otherwise—</text><subparagraph id="id21dca724847442cc817ae3a9158876d9" commented="no"><enum>(A)</enum><text>exercises substantial control over the vessel; or</text></subparagraph><subparagraph id="id220616be1ef142f9b855fedc9b73cf28" commented="no"><enum>(B)</enum><text>owns or controls not less than 25 percent of the ownership interests in the vessel. </text></subparagraph></paragraph><paragraph id="id14b809ae59114629a1ce656ca4f478c5"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person. </text></paragraph><paragraph id="id422112e0db4840ecb971aa5652c84ffc"><enum>(4)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="idfdebfe2827694d93b6aeaea6adb2a040"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="id317bc3f081b24325a742b80c69c795d2"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="id7a8102950e154b84a545707caab4fa22" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>any person in the United States. </text></subparagraph></paragraph></subsection></section><section id="id84565adb0d08408fa9058c9af1a7d0df"><enum>6.</enum><header>Agreements</header><subsection id="idB6DAF6BFCFBA43FF9423CF512BB1ADD1"><enum>(a)</enum><header>Presidential negotiation</header><text display-inline="yes-display-inline">In negotiating any relevant agreement with a foreign nation or nations after the date of enactment of this Act, the President shall consider the impacts on or to IUU fishing and strive to ensure that the agreement strengthens efforts to combat IUU fishing.</text></subsection><subsection id="id89c7add81e7849fd9938c6b99ccb3cd0"><enum>(b)</enum><header>Secretary of State encouragement</header><text>Together with other partners if appropriate, the Secretary of State shall encourage other nations to ratify treaties and agreements that address IUU fishing to which the United States is a party, including the UN Fish Stocks Agreement, the Port State Measures Agreement, and other applicable agreements.</text></subsection></section><section id="idc28598515ad74518a98825f3a994c4c4"><enum>7.</enum><header>Definition of illegal, unreported, and unregulated fishing</header><subsection id="id2375082FED9E4D5B9693B767304BC06B"><enum>(a)</enum><header>Definition of illegal, unreported, and unregulated fishing in the high seas driftnet fishing moratorium protection Act</header><text display-inline="yes-display-inline">Section 609(e) of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j(e)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id70440F6D2C9542A28AC64FBC7F3AA969"><subsection id="id7DCE212263884E588986CE8BC2630272" commented="no"><enum>(e)</enum><header>Illegal, unreported, or unregulated fishing defined</header><text display-inline="yes-display-inline">In this title, the terms <term>illegal, unreported, and unregulated fishing</term> and <term>illegal, unreported, or unregulated fishing</term> mean any activity set out in paragraph 3 of the International Plan of Action to Prevent, Deter, and Eliminate Illegal, Unreported and Unregulated Fishing, adopted at the 24th Session of the Committee on Fisheries in Rome on March 2, 2001.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idCDEFB2B1F9C84360BA7BDDE20B32B1E6" commented="no"><enum>(b)</enum><header>Definition of illegal, unreported, or unregulated fishing in the Magnuson-Stevens fishery conservation and management Act</header><text display-inline="yes-display-inline">Section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBEBE6210D16345E086D3E886E657238C"><paragraph id="id54DDF1E4FE414423BEE9EF4792F5E21E"><enum>(51)</enum><header>Illegal, unreported, or unregulated fishing</header><text>The terms <term>illegal, unreported, or unregulated fishing</term>, <term>illegal, unreported, and unregulated fishing</term>, and <term>illegal, unreported and unregulated fishing</term> mean any activity set out in paragraph 3 of the International Plan of Action to Prevent, Deter, and Eliminate Illegal, Unreported and Unregulated Fishing, adopted at the 24th Session of the Committee on Fisheries in Rome on March 2, 2001.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id36dc9de2ef4145f6ab4a4a6e1600dd0d"><enum>8.</enum><header>Coast guard provisions</header><subsection id="idE341534579094DF88398FE041AFC72C6"><enum>(a)</enum><header>Increase boarding of vessels suspected of IUU fishing</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard shall, in accordance with the UN Fish Stocks Agreement, increase, from year to year, its observation and boarding of vessels on the high seas that are suspected of IUU fishing, to the greatest extent practicable.</text></subsection><subsection id="idD0AB1B14DF6C4CFCBEE395AAD631700D"><enum>(b)</enum><header>Follow up</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard shall coordinate regularly with regional fisheries management organizations to determine what corrective measures each nation has taken after its vessels have been boarded for suspected IUU fishing.</text></subsection><subsection id="id5D184C484E6A4DBEAF817254F5BCB691"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commandant of the Coast Guard shall submit a report to Congress on—</text><paragraph id="id43E44860102C4D0AAD1433AE404F2547"><enum>(1)</enum><text display-inline="yes-display-inline">the total number of bilateral agreements that contain an IUU fishing nexus or authorities, and what the Coast Guard is doing to increase this percentage;</text></paragraph><paragraph id="idF148DCC1465849BFB0D9573502D3CF56"><enum>(2)</enum><text display-inline="yes-display-inline">violations observed under the Coast Guard high seas boarding program, how the violations are tracked after referral to the respective flag state, and what actions are taken to document or otherwise act on the enforcement, or lack thereof, taken by a flag state;</text></paragraph><paragraph id="id3B73082B8D6D40EBA65B32A18CBB7263"><enum>(3)</enum><text display-inline="yes-display-inline">the flag state and status of vessels interdicted or observed to be engaged in IUU fishing on the high seas by the Coast Guard;</text></paragraph><paragraph id="id02318D1A2351412FB0194F7D2AF7ECDD"><enum>(4)</enum><text display-inline="yes-display-inline">the flag state and status and incident details on vessels observed to violate international laws on the high seas, such as refusal to allow boarding, and what action was taken; and</text></paragraph><paragraph id="idC49A74B94B29448BA1211AAB9F325840"><enum>(5)</enum><text display-inline="yes-display-inline">any other potential enforcement actions that could decrease IUU fishing on the high seas.</text></paragraph></subsection></section><section id="id7195F67398984DD490F515911AF6A8F0"><enum>9.</enum><header>Improved management at the regional fisheries management organizations</header><subsection id="idD2F7C7E8C551453F9DEF215375514F47"><enum>(a)</enum><header>Interagency Working Group on IUU fishing</header><text display-inline="yes-display-inline">Section 3551(c) of the Maritime SAFE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8031">16 U.S.C. 8031(c)</external-xref>) is amended—</text><paragraph id="idA9037062F8F64260AB2362D5D7974225"><enum>(1)</enum><text>in paragraph (12), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="id954568FFEB7541BA8083888B3659016C"><enum>(2)</enum><text>in paragraph (13), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="id6E9342897B8B46B18D423BF67AFDBB5B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5F9C99508CDD4F90BF4F2D345046D83E"><paragraph id="id04E808D5DB2A43A891605F034CA3D6FC"><enum>(14)</enum><text>developing a strategy for leveraging enforcement capacity against IUU fishing, particularly focusing on nations identified under section 609(a) or 610(a) of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j(a)</external-xref> and 1826k(a)); and </text></paragraph><paragraph id="id4f96ca4c362341e6942e03eebb53ff71"><enum>(15)</enum><text>developing a strategy for leveraging enforcement capacity against IUU fishing and increasing enforcement and other actions across relevant import control and assessment programs, including—</text><subparagraph id="id04700efc4e0a4468bec0c852f3cf9aff"><enum>(A)</enum><text>the List of Goods Produced by Child Labor or Forced Labor produced pursuant to section 105 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/22/7112">22 U.S.C. 7112</external-xref>);</text></subparagraph><subparagraph id="id4b9e2ebc6b304658b1836fffb408391b"><enum>(B)</enum><text>the Trafficking in Persons Report required under section 110 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107</external-xref>); and</text></subparagraph><subparagraph id="idcf43866c9ced4dbd92b0bfd09b054e07"><enum>(C)</enum><text>United States Customs and Border Protection’s Forced Labor Division and enforcement activities and regulations authorized under section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2225561A45FF4630B1676D1DFDC689F9"><enum>(b)</enum><header>Secretary of State identification</header><text display-inline="yes-display-inline">The Secretary of State, in coordination with the Commandant of the Coast Guard, shall—</text><paragraph id="idFC7B9DEF6CEB4E99860A4CAA700AAA5D"><enum>(1)</enum><text display-inline="yes-display-inline">identify regional fisheries management organizations that the United States is party to that do not have a high seas boarding program; and</text></paragraph><paragraph id="idE167C0F51F6549E0BD17FEE966819BF4"><enum>(2)</enum><text display-inline="yes-display-inline">identify obstacles, needed authorities, or existing efforts to increase implementation of these programs, and take action as appropriate.</text></paragraph></subsection></section><section id="id83408b03d05c4c9bba9b02e4779242b1"><enum>10.</enum><header>Strategies to optimize data collection, sharing, and analysis</header><text display-inline="no-display-inline">Section 3552 of the Maritime SAFE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8032">16 U.S.C. 8032</external-xref>) is amended by adding at the end:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide443d527b38a466e8497c6391dd15b1c"><subsection id="id965a21ec08634dee9538b23e9f5579cc"><enum>(c)</enum><header>Strategies To optimize data collection, sharing, and analysis</header><text>Not later than 2 years after the publication of the strategic plan submitted under subsection (a), the Working Group shall identify information and resources to prevent seafood products from IUU fishing from entering United States commerce without increasing burden or trade barriers on seafood not produced from IUU fishing. The report shall include the following:</text><paragraph id="id8b79f41a40554bcd9354fc6867c4f871"><enum>(1)</enum><text>Identification of relevant data streams collected by Working Group members.</text></paragraph><paragraph id="id3fdf0a333fc24f7e9160a7167993407c"><enum>(2)</enum><text>Identification of legal, jurisdictional, or other barriers to the sharing of such data.</text></paragraph><paragraph id="idea7b98ee04fa41caaa0d4ec48d65abb1"><enum>(3)</enum><text>In consultation with the Secretary of Defense, recommendations for joint enforcement protocols, collaboration, and information sharing between Federal agencies and States.</text></paragraph><paragraph id="id9c12df62c1a045da8e4c87699f581f2e"><enum>(4)</enum><text>Recommendations for sharing and developing forensic resources between Federal agencies and States.</text></paragraph><paragraph id="idf8becd7b018249a3be7a7c9055626bef"><enum>(5)</enum><text>Recommendations for enhancing capacity for United States Customs and Border Protection and National Oceanic and Atmospheric Administration to conduct more effective field investigations and enforcement efforts with State enforcement officials.</text></paragraph><paragraph id="idad7144362e1844f5b487ded4d2ca9abb"><enum>(6)</enum><text>Recommendations for the dissemination of IUU fishing analysis and information to those entities that could use it for action and awareness, with the aim to establish an IUU fishing information sharing center. </text></paragraph><paragraph id="id4663fc46f0b84cb09bfd31d0728457cb"><enum>(7)</enum><text>Recommendations for an implementation strategy, including measures for ensuring that trade in seafood not linked to IUU fishing is not impeded.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id54AF00247E6A4116BA721FCFBAAA6118"><enum>11.</enum><header>Investment and technical assistance in the fisheries sector</header><subsection id="id32181AA8C55249718AF2BD1583510238"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State and the Administrator of the United States Agency for International Development, in consultation with the heads of relevant agencies, the Millennium Challenge Corporation, and multilateral institutions such as the World Bank, shall increase support to programs that provide technical assistance and investment to nations’ fisheries sectors for sustainable fisheries management and combating IUU fishing. The focus of such support shall be on priority regions and priority flag states identified under section 3552(b) of the Maritime SAFE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8032">16 U.S.C. 8032(b)</external-xref>). </text></subsection><subsection id="id124554294dc7420f8dff87ceb98442fb"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Department of State and the United States Agency for International Development to carry out subsection (a) $10,000,000 for each such agency for each of fiscal years 2023 through 2028. </text></subsection></section><section id="id16427DF9260548D7A126C7DB869C8E20"><enum>12.</enum><header>Preventing importation of seafood and seafood products from foreign vessels using forced labor</header><subsection id="id96af0e41d6294a73b22b60e9308bf374"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idff1ce64b6513427d981f0237108c0b9b"><enum>(1)</enum><header>Forced labor</header><text>The term <term>forced labor</term> has the meaning given that term in section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>).</text></paragraph><paragraph id="idb352d4f465d24506a44318c8a425a52a"><enum>(2)</enum><header>Seafood</header><text>The term <term>seafood</term> means fish, shellfish, processed fish, fish meal, shellfish products, and all other forms of marine animal and plant life other than marine mammals and birds.</text></paragraph><paragraph id="id538f74afbbf84a71bd875c4447627ac6"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph></subsection><subsection id="idbaaa8fe4b389411787da029dd66662d4"><enum>(b)</enum><header>Forced labor on foreign fishing vessels</header><paragraph id="idf80693f5257d42339651a5e899a127fe"><enum>(1)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act, the Commissioner of U.S. Customs and Border Protection, in coordination with the Secretary, shall issue regulations regarding the verification of seafood imports to ensure that no seafood or seafood product harvested on foreign vessels using forced labor is entered into the United States in violation of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>).</text></paragraph><paragraph id="idae720989aba947028b0aca6479ad7d45"><enum>(2)</enum><header>Strategy</header><text>The Commissioner of U.S. Customs and Border Protection, in coordination with the Secretary and the Secretary of the department in which the Coast Guard is operating, shall—</text><subparagraph id="id15879752963c4d0ab50734ba6be8d208"><enum>(A)</enum><text>develop a strategy for utilizing relevant U.S. Government data to identify imports of seafood or seafood products harvested on foreign vessels using forced labor; and</text></subparagraph><subparagraph id="id4b4d04c5b20c48548c07ff599e5020ff"><enum>(B)</enum><text>publish information regarding the strategy developed under subparagraph (A) on the website of U.S. Customs and Border Protection. </text></subparagraph></paragraph></subsection></section><section id="id690b5864df6441d49204e36a0d92e6e1"><enum>13.</enum><header>Reports</header><subsection id="idE0A759A159914B049457328960241529"><enum>(a)</enum><header>Impact of new technology</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator, in coordination with the Working Group established under section 3551 of the Maritime SAFE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8031">16 U.S.C. 8031</external-xref>), shall conduct a study to assess the impact of new technology (such as remote observing, the use of drones, development of risk assessment tools and data-sharing software, immediate containerization of fish on fishing vessels, and other technology-enhanced new fishing practices) on IUU fishing and propose ways to integrate these technologies into global fisheries enforcement and management.</text></subsection><subsection id="idACDE99AFECF94D7591CD8E6418990431"><enum>(b)</enum><header>Russian and chinese fishing industries’ influence on each other and on the united states seafood and fishing industry</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary of State, with support from the Secretary of Commerce and the Office of the United States Trade Representative, shall—</text><paragraph id="id5BF594DFFE4E4EE7A23B6683AF78541E"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study on the collaboration between the Russian and Chinese fishing industries and on the role of seafood reprocessing in China (including that of raw materials originating in Russia) in global seafood markets and its impact on United States seafood importers, processors, and consumers; and</text></paragraph><paragraph id="idBB9C089A9F4E4942B0E4F14726133C77"><enum>(2)</enum><text display-inline="yes-display-inline">complete a report on the study that includes classified and unclassified portions, as the Secretary of State determines necessary. </text></paragraph></subsection><subsection id="id7CF9FE6645E749ADBC3B399D25375283" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Fishermen conducting unlawful fishing in the economic exclusion zone</header><text display-inline="yes-display-inline">Section 3551 of the Maritime SAFE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8031">16 U.S.C. 8031</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id43134A2F254749FE81D0D3E2D1CF6C97"><subsection commented="no" display-inline="no-display-inline" id="id35C136CDB41A4C74ABAD6FA022AB3E46"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Fighting Foreign Illegal Seafood Harvests Act of 2022</short-title>, the chair of the Working Group in coordination with members of the Working Group, shall submit a report to Congress on foreign fishermen who were detained or arrested in the exclusive economic zone, how many were referred to prosecution and the outcome of the cases, and what authorities, or obstacles to overcome, are needed to increase the prosecution referral rate.</text></subsection><subsection id="id1300df62b229458fac7e9c3b538c27c3"><enum>(e)</enum><header>The impacts of IUU fishing</header><text>The Administrator, in consultation with relevant members of the Working Group, shall seek to enter into an arrangement with the National Academies of Sciences, Engineering, and Medicine under which the National Academies will undertake a multifaceted study that includes the following:</text><paragraph id="id3802D9630DD647909491DB4C34C4AEEF"><enum>(1)</enum><text>An analysis that quantifies the occurrence and extent of IUU fishing among flag states. </text></paragraph><paragraph id="idf0a1dae054f84017a4cd026c90bc8001"><enum>(2)</enum><text>An evaluation of the costs to the United States economy of IUU fishing.</text></paragraph><paragraph id="idc618c42c5fb94b1a8893b2609bf16959"><enum>(3)</enum><text>An assessment of the costs to the global economy of IUU fishing.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idf196a79abd6143faa4cb87fbbf5fc2dc"><enum>(d)</enum><header>Report</header><text>Not later than 24 months after the date of the enactment of this Act, the Administrator shall submit to Congress a report on the study conducted under subsection (e) of section 3551 of the Maritime SAFE Act that includes—</text><paragraph id="id8af5590ce61649d1808741824556970a"><enum>(1)</enum><text>the findings of the National Academies; and</text></paragraph><paragraph id="id01ceacfa969b47acb18358346681e1bf"><enum>(2)</enum><text>recommendations on knowledge gaps that warrant further scientific inquiry.</text></paragraph></subsection></section></legis-body></bill>
