which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow the use of unspent educational funds under the American Rescue Plan Act of 2021 to address pandemic learning loss through Child Opportunity Scholarships.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Raising Expectations with Child Opportunity Vouchers for Educational Recovery Act</short-title></quote> or the <quote><short-title>RECOVER Act</short-title></quote>.</text></section><section id="id4CCC5846D5D64D408ADF18E69126E5A2"><enum>2.</enum><header>Use of unobligated American Rescue Plan Act funds for Child Opportunity Scholarships</header><text display-inline="no-display-inline">Section 2001 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/20/3401">20 U.S.C. 3401</external-xref> note) is amended—</text><paragraph id="id589192CF95844FAE8EFDF74DF5864D58"><enum>(1)</enum><text>in subsection (e)(1)—</text><subparagraph id="id625B90316A2A4498B8E9DCD2EB76F302"><enum>(A)</enum><text>by striking <quote>through the implementation of</quote> and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id264C623A948C417E9D53251B9F7B5631" act-name=""><text>through—</text><subparagraph id="id26E5860F4005403AA306D28BDBA0174C"><enum>(A)</enum><text>the implementation of</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id5A9BCF0EE3EA42AFB35F8A39CBA6CB4B"><enum>(B)</enum><text>in subparagraph (A), as designated by subparagraph (A) of this paragraph, by striking <quote>; and</quote> and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id03E0FA2557D34AACA236516F224D01CB"><enum>(C)</enum><text>by inserting after subparagraph (A), as designated by subparagraph (A) of this paragraph, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB2A2D5BAAB5D434D85606273AC7C87CB"><subparagraph id="id293962C033C54B6DA76ABD1E728DA904"><enum>(B)</enum><text>the distribution of Child Opportunity Scholarships; and</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA3A30F8E508742049CC269B0ADEBD836"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (f)—</text><subparagraph id="id2BAD6AD4D7EB4152A1B279B934C4E27E"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id692369300AA240399B9C0248C55D7275"><enum>(B)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idEAF3F928FE9C4015B6D97299D8DD4C05"><enum>(C)</enum><text display-inline="yes-display-inline">by adding after paragraph (4) the following:</text><quoted-block id="idB51C42CD7B1A49C2A5CB1E266D4E37D6" style="OLC" act-name=""><paragraph id="id77AEC786BDBC4768A546E1C4AAFEEED0"><enum>(5)</enum><text>may use any remaining amounts to distribute Child Opportunity Scholarships.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id22CF5B47ABDD433DA0E82062840801D3"><enum>(3)</enum><text>in subsection (h)—</text><subparagraph id="idF1876D7CC26D41D388383D980895F3F7"><enum>(A)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (4) and (6), respectively;</text></subparagraph><subparagraph id="id706D693377A54E1B88AFA7AEC5CC817C"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAAA3C3D72125419B9FDA203C6A9DC17E"><paragraph id="id41B95F0C397E4A8BB4734D1B02955BA1"><enum>(2)</enum><text>the term <term>Child Opportunity Scholarship</term> means direct financial assistance to the parent or guardian of an eligible student for a qualified educational expense in an amount reasonably commensurate to the negative educational impact intended to be addressed;</text></paragraph><paragraph id="id17CC512112794CA0863960D33BA016E0"><enum>(3)</enum><text>the term <term>eligible student</term> means a child who is a member of a household with an income which is not greater than 300 percent of the Federal poverty level;</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="id133CB049B7624C5AB51B171ADF87B8F8"><enum>(C)</enum><text>in paragraph (4), as redesignated by subparagraph (A), by striking <quote>and</quote> after the semicolon; and</text></subparagraph><subparagraph id="id3F1E0A95C8AE41AF8E46DA7D735DAA35"><enum>(D)</enum><text>by inserting after paragraph (4), as redesignated by subparagraph (A), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9F1779BBBBD14349B6DDB39760480559"><paragraph id="idAA964F17FF5149C4A0BDBFC27EB89BD3"><enum>(5)</enum><text>the term <term>qualified educational expense</term> includes tutoring or educational classes outside the home, curriculum and curricular materials, books or instructional materials, technological education materials, online educational materials, private school tuition, testing fees, diagnostic tools, and educational therapies for students with disabilities; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
