which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Interior to prepare a programmatic environmental impact statement allowing for adaptive management of certain Federal land in Malheur County, Oregon, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Malheur Community Empowerment for the Owyhee Act</short-title></quote>.</text></section><section id="id22A32261B12549C589E7BE2AB7963910"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id2DA50BBDE36B432D8E48CB6673DCB009"><enum>(1)</enum><header>Active management</header><text>The term <term>active management</term> means those actions that are proposed or implemented—</text><subparagraph id="id23D4D6DB215748E489C076846A01FFE3"><enum>(A)</enum><text>to address degraded or non-functioning resource conditions that would not improve without on-the-ground treatments;</text></subparagraph><subparagraph id="id7D4B9145F3FC47F8AB32E1AAD75BEA1D"><enum>(B)</enum><text>to respond to specific, identified resource conditions described in subparagraph (A); and</text></subparagraph><subparagraph id="id8EF791E13CD54B879DEA9202A620C3B1"><enum>(C)</enum><text>to meet resource objectives and desired outcomes.</text></subparagraph></paragraph><paragraph id="id7B58660986524B878AE8A7A0D1E77BBD"><enum>(2)</enum><header>Adaptive management</header><text>The term <term>adaptive management</term> means management based on a relationship between research and management practices in which management practices are developed and modified based on a recurring evaluation of data, collected on a recurring basis by and for the Monitoring Network, for the purpose of allowing timely reactions to changing conditions on Federal land—</text><subparagraph id="idD6A2B32CDC7B4F3BB23DED78F9053969"><enum>(A)</enum><text>to achieve, retain, or improve the ecological health and functionality of the Federal land; and</text></subparagraph><subparagraph id="id7EC463FDD8C54031AAD91C3F4C638FB8"><enum>(B)</enum><text>to achieve desired future conditions on the Federal land.</text></subparagraph></paragraph><paragraph id="idA555FA5BE660481E86BFA3495A9B2F03"><enum>(3)</enum><header>Bureau</header><text>The term <term>Bureau</term> means the Bureau of Land Management.</text></paragraph><paragraph id="idB00A602D548241858DE0A5EDD4311862"><enum>(4)</enum><header>Center</header><text>The term <term>Center</term> means the Native Seed Center established under section 6(e)(1)(A).</text></paragraph><paragraph id="id8C52774BB83E4984BF5F786CEE8C0598"><enum>(5)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of Reclamation.</text></paragraph><paragraph id="id56D01C7A5791481EA8FA441F8ACEF97B"><enum>(6)</enum><header>County</header><text>The term <term>County</term> means Malheur County, Oregon.</text></paragraph><paragraph id="idA1A1F928EF0E4C17AC2B7BF9CEFAD867"><enum>(7)</enum><header>Cultural</header><text>The term <term>cultural</term> means relating to the sites, areas, or artifacts of, or traditional uses of land by, indigenous peoples.</text></paragraph><paragraph commented="no" id="id8DBE36A213A5488F94EF7D73F5873354"><enum>(8)</enum><header>Cultural resources</header><text>The term <term>cultural resources</term> means—</text><subparagraph commented="no" id="id15389C84C90848B1B626118DCB94017B"><enum>(A)</enum><text>the sites, areas, and artifacts of indigenous peoples; and</text></subparagraph><subparagraph commented="no" id="idEEDB9E9DFFC94A9FAA9482A054088887"><enum>(B)</enum><text>the existing uses of land by indigenous peoples.</text></subparagraph></paragraph><paragraph id="id418BBB1D73884C89B4DF009721E836EF"><enum>(9)</enum><header>Ecological health</header><text>The term <term>ecological health</term> means the ability of the ecological processes of an ecosystem to function in a manner that maintains the structure, composition, activity, and resilience of the ecosystem over time, including an ecologically appropriate diversity of plant communities, habitats, and conditions that are sustainable through successional processes.</text></paragraph><paragraph id="id6E06965EF31F4711B65AF8D4B588122F"><enum>(10)</enum><header>Federal land</header><subparagraph id="idC5F81D6C201242648F19AEB7E3CDC444"><enum>(A)</enum><header>In general</header><text>The term <term>Federal land</term> means all land in the County the title to which is held by the United States.</text></subparagraph><subparagraph id="id53D0E4A879C84BB2BAC10FAEE8D564C7"><enum>(B)</enum><header>Exclusions</header><text>The term <term>Federal land</term> does not include—</text><clause id="idD0AC4D30D62F43E189FC3E3A16258828"><enum>(i)</enum><text>any Forest Service land; or</text></clause><clause id="idA8212309A67345B394047432403A9992"><enum>(ii)</enum><text>any land held in trust by the Bureau of Indian Affairs.</text></clause></subparagraph></paragraph><paragraph id="idB5F83A0C60CF4416AD30FE6E5DBDC8F8"><enum>(11)</enum><header>Invasive species</header><text>The term <term>invasive species</term> means a species of nonnative aggressive plant with the potential to cause—</text><subparagraph id="id04E8839B846A41BEBFFE866650B72544"><enum>(A)</enum><text>significant damage to a native ecosystem; or</text></subparagraph><subparagraph id="idACCA1B7DA330474CA7174CF5B3258EC6"><enum>(B)</enum><text>significant economic losses.</text></subparagraph></paragraph><paragraph commented="no" id="id28a9cae6c5e74ca487205adfbc823ce4"><enum>(12)</enum><header>Loop road</header><subparagraph commented="no" id="id47185F12EF1940CAB7D04746493FAABB"><enum>(A)</enum><header>In general</header><text>The term <term>loop road</term> means a route determined by the Malheur CEO Group that is managed and maintained by the Bureau and the County for the purpose of providing directed tourism and educational opportunities in the County.</text></subparagraph><subparagraph commented="no" id="id795C630B3EEF494EA4CF5459189F3306"><enum>(B)</enum><header>Inclusion</header><text>The term <term>loop road</term> includes each of the roads described in paragraphs (2) through (5) of section 6(a).</text></subparagraph></paragraph><paragraph id="idB5231FA70C1443268F0CF6505158373D"><enum>(13)</enum><header>Malheur CEO Advisory Committee</header><text>The term <term>Malheur CEO Advisory Committee</term> means the Malheur Community Empowerment for Owyhee Group Advisory Committee established under section 4(c)(7)(A).</text></paragraph><paragraph id="id0D2E5106BF9347F4BCC301FC7B3FAE8C"><enum>(14)</enum><header>Malheur CEO Group</header><text>The term <term>Malheur CEO Group</term> means the Malheur Community Empowerment for Owyhee Group established under section 4(c)(1).</text></paragraph><paragraph id="idb93f654e7fbd4f6d979c3b6228595540"><enum>(15)</enum><header>Monitoring data</header><subparagraph id="id9CD55A673E4840CE99FC1529627FE9B0"><enum>(A)</enum><header>In general</header><text>The term <term>monitoring data</term> means data that is—</text><clause id="id728463D7D6944F0D857F9F4382F7E615"><enum>(i)</enum><text>collected through a memorandum of understanding entered into under section 4(e)(1); and</text></clause><clause id="id52A18446F95E48148312BCC0D780A519"><enum>(ii)</enum><text>provided to the Bureau at a frequency sufficient—</text><subclause id="id39CBC340724B494C94DE738A29D8CF6A"><enum>(I)</enum><text>to monitor the ecological functionality of Federal land subject to a programmatic environmental impact statement prepared under section 4(a)(1); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4EB1C444B59F4850A0FC27E0DF526D79"><enum>(II)</enum><text>to use for adaptive management of that Federal land.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id529970630D254CF1A5899882F0DF79C6"><enum>(B)</enum><header>Inclusion</header><text>The term <term>monitoring data</term> includes data in existence on the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id5232869bc1cf4066897e1d3b242b4643"><enum>(16)</enum><header>Monitoring Network</header><text>The term <term>Monitoring Network</term> means the network of monitoring partners and protocols established under section 4(e)(1), including the parties to, and protocols established under, each memorandum of understanding entered into under that section for the purpose of implementing adaptive management of the Federal land.</text></paragraph><paragraph id="id8270E44B658C4D9F800E113479101439"><enum>(17)</enum><header>Native Seed Center Establishment Group</header><text>The term <term>Native Seed Center Establishment Group</term> means the group established pursuant to the memorandum of understanding entered into under section 6(e)(1)(B).</text></paragraph><paragraph id="id8CC3DA46E0B743FB9FEF35950B4EA8CB"><enum>(18)</enum><header>Passive management</header><text>The term <term>passive management</term> means those actions that are proposed or implemented to address degraded or non-functioning resource conditions that are expected to improve without additional on-the-ground actions, such that resource objectives and desired outcomes are anticipated to be reached without additional human intervention.</text></paragraph><paragraph commented="no" id="id39a0f8a80922499ea1a8d3caae238f10"><enum>(19)</enum><header>Restoration area</header><text>The term <term>restoration area</term> means an area of Federal land in need of active or passive management—</text><subparagraph commented="no" id="id2824318173FD4952998B6D57524B9906"><enum>(A)</enum><text>to restore the ecological health of the area; or</text></subparagraph><subparagraph commented="no" id="id5E8CE64CA9434BDD850FCB99E2397B58"><enum>(B)</enum><text>to prevent the ecological degradation of the area from—</text><clause commented="no" id="id390DE9DF78BD485AA938CF23A3579F3C"><enum>(i)</enum><text>demonstrably encroaching invasive species; or</text></clause><clause commented="no" id="idC6BF1A94751C444790F098192E577578"><enum>(ii)</enum><text>other threats.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id125F8E4D0A434F928C9A70D6B8C8AE22"><enum>(20)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="id6b93dba8aec04980bfc7dcce69d5338a"><enum>3.</enum><header>Purpose and objectives</header><subsection id="idf1db4654d87f4989b9bbbb0852051295"><enum>(a)</enum><header>Purpose</header><text>The purpose of this Act is to promote the long-term ecological health of the Federal land to support communities and natural resources.</text></subsection><subsection id="id48b1b91afcaa43a7a7b1b0145e83ab0b"><enum>(b)</enum><header>Objectives</header><paragraph id="idAA673A82B8AB4722A9E9262EFD89250D"><enum>(1)</enum><header>In general</header><text>To further the purpose described in subsection (a), the Secretary shall manage the Federal land for the benefit of present and future generations—</text><subparagraph id="id3430d56ae734448682ac4af0899a813c"><enum>(A)</enum><text>to support and grow local communities and economies;</text></subparagraph><subparagraph id="idf377ed4d8396427288ffa806d296f098"><enum>(B)</enum><text>to protect the cultural resources and western traditions for which the Federal land is known;</text></subparagraph><subparagraph id="id5c544a64b4754a5996c9c64e1c2ab4b7"><enum>(C)</enum><text>to maintain grazing on the Federal land—</text><clause id="id1847D7B606754355BC187A4ACF790746"><enum>(i)</enum><text>for the economic well-being of the County; and</text></clause><clause id="id386D05B3AE5743678AF5AFBA8E4FA457"><enum>(ii)</enum><text>as a tool to improve the ecological health of the Federal land;</text></clause></subparagraph><subparagraph id="id4150cb05ecd942c5840b461c52b179b6"><enum>(D)</enum><text>to protect and enhance the cultural, ecological, and economic needs of the Burns Paiute Tribe;</text></subparagraph><subparagraph id="idc3ca487326e145fd90de09bf96f0ed5b"><enum>(E)</enum><text>to maintain and enhance the latest available science-based adaptive management of the Federal land;</text></subparagraph><subparagraph id="idc5eae165b15343a79fb6314af5e352f4"><enum>(F)</enum><text>to prevent invasive species encroachment and large fires through management practices that focus on restoration of the ecosystem;</text></subparagraph><subparagraph id="id2958c47d928442238e758ebad77b590f"><enum>(G)</enum><text>to ensure the conservation and improved management of the ecological, social, and economic environment, including geological, biological, wildlife, fish, riparian, and scenic resources;</text></subparagraph><subparagraph id="idc803492129b64bf696341932f12ad88a"><enum>(H)</enum><text>to address the management uncertainties on the Federal land to provide greater stability of natural resource management on the Federal land; and</text></subparagraph><subparagraph id="idcf2779833ae9432386510f0ab3d10b3a"><enum>(I)</enum><text>to promote and foster cooperation, communication, and understanding, and reduce conflict, among all users of the Federal land.</text></subparagraph></paragraph><paragraph id="idaf5156cb47fe4f129181624c7bed6cee"><enum>(2)</enum><header>Approach</header><text>The Secretary shall carry out the duties of the Secretary under this Act in a manner that—</text><subparagraph id="idFCC69A2CBADA47AC9C60E85E2E94E10A"><enum>(A)</enum><text>furthers the purpose described in subsection (a) and the objectives described in paragraph (1);</text></subparagraph><subparagraph id="idCFFE7DDF41934284A48D47E32FEB8259"><enum>(B)</enum><text>ensures the collection of relevant data to monitor and evaluate the ecological health of the Federal land;</text></subparagraph><subparagraph id="idFC6D0450E90B4BA787399FB868FC4189"><enum>(C)</enum><text>ensures that adaptive management actions improve the ecological health of the Federal land;</text></subparagraph><subparagraph id="idab9c446cf62342b2aa7a8b5fd053643f"><enum>(D)</enum><text>builds inclusivity in the County by promoting the involvement of local grazing allotment holders, institutions of higher education, volunteers, Federal agencies, and other interested parties in the Monitoring Network while standardizing data collection; and</text></subparagraph><subparagraph id="ide3eec9899af3462e99855b77960582c7"><enum>(E)</enum><text>promotes cooperation, communication, and understanding within the County to reduce conflict among all users of Federal land.</text></subparagraph></paragraph></subsection></section><section id="id18D9AFB13BFA4348BA036F681BE17050"><enum>4.</enum><header>Adaptive management of Federal land in the County</header><subsection id="idEAFB5C20AEEE43B084539E8CE84FB1C5"><enum>(a)</enum><header>Programmatic environmental impact statement</header><paragraph id="id9298CB40D8FA4A57A067D6D3D65CF6D2"><enum>(1)</enum><header>Preparation</header><subparagraph id="idA67738B3107D4CE9B1D1D08B688CB1F0"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and every 10 years thereafter, the Secretary, in consultation with the Commissioner and after obtaining input from the Malheur CEO Group, shall prepare a programmatic environmental impact statement in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for the Federal land using—</text><clause id="idE8CA4C292554442FB89C33D844C2E4F6"><enum>(i)</enum><text>existing and up-to-date planning documents, processes, and data; and</text></clause><clause id="id2CDE32E892CB4012907585C8315FAADC"><enum>(ii)</enum><text>in the case of the first programmatic environmental impact statement, any planning and data documentation that is in development on the date of enactment of this Act.</text></clause></subparagraph><subparagraph id="id9188CC2856624FF792F76D50CD3070F9"><enum>(B)</enum><header>Priorities</header><clause id="id38B9AFAC65F141E383ED46D551653D9A"><enum>(i)</enum><header>Priority actions for missing data</header><text>The Secretary shall give priority to the completion of any analysis relating to areas on the landscape for which planning or data are lacking during the year in which a programmatic environmental impact statement under subparagraph (A) is prepared.</text></clause><clause id="id3AFEEA7D04D240238A285ACA7C1DDD65"><enum>(ii)</enum><header>Baseline soil and vegetative health assessments</header><text>In carrying out subparagraph (A), the Secretary shall give priority to the completion of baseline soil and vegetative health assessments on the Federal land.</text></clause></subparagraph><subparagraph id="idC96CF35E447F4959BFE16AFF28BC5025"><enum>(C)</enum><header>Protection of the Federal land</header><text>In carrying out subparagraph (A), the Secretary shall include an analysis of the conditions and actions necessary to ensure that the adaptive management carried out under a programmatic environmental impact statement will not degrade the ecological health of the Federal land.</text></subparagraph><subparagraph id="id1955EC2A4129432986ECD2D8CF96E3CF"><enum>(D)</enum><header>Supplementation of existing grazing regulations</header><text>A programmatic environmental impact statement under subparagraph (A) shall supplement, and not supplant, existing grazing regulations, including part 4100 of subchapter D of chapter II of subtitle B of title 43, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph id="id21727D35BC3F44DA8240C39ED20B1BD5"><enum>(E)</enum><header>Consideration of other law</header><text>The Secretary shall ensure that each programmatic environmental impact statement under subparagraph (A) takes consideration of, and is consistent with—</text><clause id="id7B7EF8F54742450EB41C0166D0C08D5A"><enum>(i)</enum><text>the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>);</text></clause><clause id="id730A49A4CD1D4E589416A4E21847B0ED"><enum>(ii)</enum><text>the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>);</text></clause><clause id="idDD91DDCA7E05415BBE18D81E6A654ABE"><enum>(iii)</enum><text>division A of subtitle III of title 54, United States Code (formerly known as the <quote>National Historic Preservation Act</quote>); and<italic></italic></text></clause><clause id="idBE830E70C9994DF8B0711B98D4EC970E"><enum>(iv)</enum><text>Executive Order No. 13007 (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996</external-xref> note; relating to Indian sacred sites).</text></clause></subparagraph></paragraph><paragraph id="id86e7a83cdf714008810dc68345dd4652"><enum>(2)</enum><header>Adaptive management</header><text>Each programmatic environmental impact statement under paragraph (1)(A) shall—</text><subparagraph id="idE1E621105C6F42EB92B81280947A2282"><enum>(A)</enum><text>provide baseline information on the ecological health of the Federal land;</text></subparagraph><subparagraph id="idD68DF6E51E4B4E74A66ACA3DF3FA4E45"><enum>(B)</enum><text>define desired future ecological conditions and outcomes;</text></subparagraph><subparagraph id="id640F66E2861F4DF48BA0AB439ECB2295"><enum>(C)</enum><text>negate the need for project-specific environmental analysis for the management activities listed in clauses (i) through (ix) of subparagraph (D); and</text></subparagraph><subparagraph id="idB6BB9FC977AA4D749FC659EED7E7CB33"><enum>(D)</enum><text>to restore and improve the ecological health of the Federal land and related riparian areas, lead to or enhance the use of adaptive management of the Federal land for—</text><clause id="idB348629D8CDE4128935B0A8486355E1D"><enum>(i)</enum><text>the management of invasive species through the use, as the Secretary determines to be appropriate, of available tools, including—</text><subclause id="id5E2F2C5D2BD349259CC256EEDC886D7B"><enum>(I)</enum><text>mechanical tools;</text></subclause><subclause id="id7103FC7FE7534A2CAD493170AA139716"><enum>(II)</enum><text>hand tools;</text></subclause><subclause id="idBEE214ED23B549C09B7F54C53703F8DA"><enum>(III)</enum><text>chemical tools;</text></subclause><subclause id="idAD918891E9FC44538DCCF6CEB5F7E478"><enum>(IV)</enum><text>biological tools; and</text></subclause><subclause id="idFB1E9DC47DB64891BC15F50229A95FA1"><enum>(V)</enum><text>livestock for varied season use;</text></subclause></clause><clause id="id6713b78d0b4046da9610aed3bdff08ef"><enum>(ii)</enum><text>the maintenance of existing water infrastructure;</text></clause><clause id="id36c31ce9448b43ea8c4a9b95a121893a"><enum>(iii)</enum><text>the improvement, including movement, of existing water infrastructure, except in an area in which there are species listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="id1776AFE7586A4C688892A978EBD1CDCA"><enum>(iv)</enum><text>the culturally appropriate protection of areas for restoration of wildlife habitat through—</text><subclause id="id9A02B9D978274060B71530CDB72128DF"><enum>(I)</enum><text>offsite water developments;</text></subclause><subclause id="idCB2D91F0FD314BE58D5AD81578AA99BA"><enum>(II)</enum><text>wildlife-friendly fencing; and</text></subclause><subclause id="id8AA507614BC949A09AD6983EBD385617"><enum>(III)</enum><text>vegetation management to protect—</text><item id="idAFC6332012A84CC08D29C06F054266DF"><enum>(aa)</enum><text>the natural integrity of spring sites;</text></item><item id="id869F202FA093459AAD3125B94449EF95"><enum>(bb)</enum><text>native species diversity;</text></item><item id="id6789EC1FE2B8419CA9A90C131CEA465D"><enum>(cc)</enum><text>water quality; and</text></item><item id="idF5B05489D51C4BC695E1BFE3A48E71C6"><enum>(dd)</enum><text>soil heath;</text></item></subclause></clause><clause id="idCB785817E352442EAB7F0DA1C6ADB421"><enum>(v)</enum><text>the protection and use of existing water infrastructure, including—</text><subclause id="id8BCE0140471D4308A910FB323E2EE120"><enum>(I)</enum><text>the use of existing water infrastructure to distribute livestock and wildlife, including wild horses, for—</text><item id="id9062F131CAF54D039315342A11EF19A2"><enum>(aa)</enum><text>the protection of riparian areas, springs, wetlands, or other mesic sites; and</text></item><item id="id68E08C2BEA8F4A7FB1FFB1C81D026A43"><enum>(bb)</enum><text>the ecological improvement of rangeland by domestic species;</text></item></subclause><subclause id="id4D75E59AC373409AADD42E49CAEE3608"><enum>(II)</enum><text>the prevention of fragmentation of habitat;</text></subclause><subclause id="id114FCC4D7AA84768A048A618595D5DD3"><enum>(III)</enum><text>the preservation of existing water infrastructure that has not experienced invasion by an invasive species; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idEAF487FEF435458A95051D8F5FF760A8"><enum>(IV)</enum><text>the restoration of existing water infrastructure that has experienced degradation by an invasive species.</text></subclause></clause><clause id="id1c9f71e5cbb44d739cc4cacee68eff0b"><enum>(vi)</enum><text>the repair, removal, or construction of fences, as necessary, in response to land designations, in accordance with wildlife or domestic animal management needs;</text></clause><clause id="idc9e2045aba684d9dbb00b9cf82bb49a0"><enum>(vii)</enum><text>the maintenance of existing roads, if that maintenance does not constitute an improvement amounting to a new road category;</text></clause><clause id="idec7f16295a6d449eb2d9bc725f06ea90"><enum>(viii)</enum><text>the removal of juniper where ecologically appropriate for the benefit of improving or conserving ecological function; and</text></clause><clause id="id59AF4205EAD2466180D4A7E51EB9CDEB"><enum>(ix)</enum><text>the use of prescribed fire to reduce fuel loads where ecologically appropriate.</text></clause></subparagraph></paragraph><paragraph id="idb68d49719c284def8ee8b1a92374a963"><enum>(3)</enum><header>No effect on subsurface mineral rights</header><text>A programmatic environmental impact statement under paragraph (1)(A) shall not affect any subsurface mineral rights.</text></paragraph><paragraph id="id4BBBF14E05364647A73F3DCC224FF6E5"><enum>(4)</enum><header>Minimum requirements analyses</header><subparagraph id="id32A0B84009684E50B51C5624CBDAC0F6"><enum>(A)</enum><header>In general</header><text>Each programmatic environmental impact statement under paragraph (1)(A) shall include a minimum requirements analysis under appendix B of section 6340 of the Bureau of Land Management Manual (Management of Designated Wilderness Areas) (as in effect on the date of enactment of this Act) for the proposed management activities included in the programmatic environmental impact statement.</text></subparagraph><subparagraph id="idDB25BDDB3E754E45B1807F6DACFB0847"><enum>(B)</enum><header>Project-specific analyses</header><text>A project-specific minimum requirements analysis shall not be required for any site-specific activity that is covered under a programmatic environmental impact statement referred to in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id75cd06db795a4d12b0e2ccd411f42a14"><enum>(b)</enum><header>Planning and reporting requirements</header><paragraph id="id30d8c40c8b7c4272b3ff12515f5f9006"><enum>(1)</enum><header>Restoration area plan</header><subparagraph id="idE93BCA3A4D6B410C98BDA14BA575F872"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Malheur CEO Group and the Monitoring Network, shall develop a plan, using existing data and planning documents, for the restoration of areas that are ecologically degraded on the date of enactment of this Act.</text></subparagraph><subparagraph id="idC44957EDC7BE41D8A66A3DFE9F8F4A62"><enum>(B)</enum><header>Requirement</header><text>The plan under subparagraph (A) shall describe—</text><clause id="id0c8879fea003446ea454ebfdf5603ee5"><enum>(i)</enum><text>the restoration areas to be treated under the plan;</text></clause><clause id="idB18072229F864436861349F8F816B0D6"><enum>(ii)</enum><text>the restoration objectives and desired ecological outcomes for the restoration areas;</text></clause><clause id="id223c7ee1c73243bd85c21c5aeff9f918"><enum>(iii)</enum><text>the priority of restoration areas to be treated under the plan, including the reasons for such priority;</text></clause><clause id="ida9ec26508b8c440db6aa2d0ae76fd5f5"><enum>(iv)</enum><text>the prescribed treatments under the plan, including the use of newer and developing technologies;</text></clause><clause commented="no" id="idB82AF34CA42040AEB26F15E89F858BF3"><enum>(v)</enum><text>the timing of treatments under the plan; and</text></clause><clause commented="no" id="id7AA984FDEE6E4CE19D5C32B11E749510"><enum>(vi)</enum><text>the monitoring methods and techniques that will be used to measure and evaluate success relative to the restoration objectives and desired ecological outcomes described in clause (ii).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3c114d006e3d4d909cc362887b905372"><enum>(2)</enum><header>Report on areas most at risk of being ecologically degraded</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Malheur CEO Group and the Monitoring Network, shall develop a report and a plan that identifies the Federal land most at risk of being ecologically degraded, including an assessment of management options to keep the Federal land intact, including the option of no active management.</text></paragraph></subsection><subsection id="id0FE31E14FAF64014AF792AF1DC8217D5"><enum>(c)</enum><header>Malheur Community Empowerment for Owyhee Group</header><paragraph id="id2F2C865D8EBF4682BE57BFA6D5B98876"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a group, to be known as the <quote>Malheur Community Empowerment for Owyhee Group</quote>—</text><subparagraph id="id792562C0028741929057C60FA9ACCC8E"><enum>(A)</enum><text>to improve collaborative relationships among—</text><clause id="idF2F110B62E8A40408D7E9F934000D315"><enum>(i)</enum><text>the members of the Malheur CEO Group; and</text></clause><clause id="id1B02AAEB2000452CB24CF6728F6A5D62"><enum>(ii)</enum><text>the types of entities that those members represent; and</text></clause></subparagraph><subparagraph id="id1460C8D93427410FB56D2F5AFDCF3B90"><enum>(B)</enum><text>to provide advice and recommendations to the Secretary relating to the monitoring and management of the Federal Land, in accordance with the purpose and objectives described in section 3.</text></subparagraph></paragraph><paragraph id="id70B9CC819A4648F2891C130F1E55DC50"><enum>(2)</enum><header>Membership</header><subparagraph id="id7ED464A20A2646B59E64DFBCCA9E75EC"><enum>(A)</enum><header>In general</header><text>The Malheur CEO Group shall consist of 13 members, of whom—</text><clause id="idF3888DB5A810407DBFACE3E24D32C120"><enum>(i)</enum><text>6 shall be representatives of ranching businesses in the County;</text></clause><clause id="idE8A7D0AC47D645EDA987C5ED5B1BEDB3"><enum>(ii)</enum><text>6 shall be representatives of other businesses or conservation or recreation organizations, of whom 2 shall reside in the County; and</text></clause><clause id="idC01FC4FFD2504D4F9E74E34EA8F0CFFE"><enum>(iii)</enum><text>1 shall be a representative of the Burns Paiute Tribe.</text></clause></subparagraph><subparagraph id="id39B4F82246304B4A96539709872F9444"><enum>(B)</enum><header>Appointment</header><clause id="id5B74AF83E1F9474899A95ACA69E996E6"><enum>(i)</enum><header>In general</header><text>Members of the Malheur CEO Group shall be appointed by the Secretary, with advice from—</text><subclause id="id4A2A40FDE9AF464A9BEC4DD6A2A2C824"><enum>(I)</enum><text>the manager of the Vale District of the Bureau;</text></subclause><subclause id="id1519BFC2C1D540E2ABE4464D1E33BC23"><enum>(II)</enum><text>any Member of the House of Representatives who represents a district in which the Federal land is located; and</text></subclause><subclause id="id9691FEA8C7FD4CDEBA3DFE3D75D6B8E4"><enum>(III)</enum><text>the Governor of the State of Oregon.</text></subclause></clause><clause id="idF920325CB711449B98BA275C673E0544"><enum>(ii)</enum><header>Initial appointments</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall appoint the initial members of the Malheur CEO Group.</text></clause><clause id="id8996111CF20B4433BF1230384102DD7D"><enum>(iii)</enum><header>Terms</header><text>Each member of the Malheur CEO Group shall serve for a term of 3 years.</text></clause><clause id="id3ED6ACAFD3374AF5AE521F34B8AB5BB4"><enum>(iv)</enum><header>Reappointment</header><text>A member of the Malheur CEO Group may be reappointed for 1 or more additional 3-year terms.</text></clause><clause id="id75C6FAE37D964800896BE2FD60B618A8"><enum>(v)</enum><header>Vacancies</header><text>A vacancy on the Malheur CEO Group shall be filled—</text><subclause id="id64BA29D76B0D4BB4B005FD65D520FBD7"><enum>(I)</enum><text>as soon as practicable after the vacancy occurs; and</text></subclause><subclause id="id992C8B8BB3EE4354AA1466549C894CA2"><enum>(II)</enum><text>in the same manner as the original appointment.</text></subclause></clause></subparagraph><subparagraph id="id52322C4C4FB4494B9476F3170887752E"><enum>(C)</enum><header>Compensation and expenses</header><clause id="idE21430C8CC194A2FB36FFACF40321A89"><enum>(i)</enum><header>Compensation</header><text>Members of the Malheur CEO Group shall serve without compensation.</text></clause><clause id="id85DBFA1BFCB4442480F8CBC1F4ECBB60"><enum>(ii)</enum><header>Travel expenses</header><text>Each member of the Malheur CEO Group shall receive, from the Secretary, travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code.</text></clause></subparagraph><subparagraph id="id16B3D88B58DF496790F1E9009B5D8773"><enum>(D)</enum><header>Chairperson</header><text>A chairperson shall be elected by a majority of the members of the Malheur CEO Group.</text></subparagraph></paragraph><paragraph id="id3708F93020DB4838A10074746F2FA5D9"><enum>(3)</enum><header>Duties</header><subparagraph id="idB334803ACE9746DC95172B1D6DCBDA10"><enum>(A)</enum><header>In general</header><text>The Malheur CEO Group shall—</text><clause id="idd1e0810498f74673bb7ad7c8a5c4e1bc"><enum>(i)</enum><text>review each project proposed to the Bureau by members of the Malheur CEO Group, ranchers holding grazing permits on the Federal land, or other members of the public to be carried out using the analysis completed by a programmatic environmental impact statement prepared under subsection (a)(1);</text></clause><clause id="id331cc9d7e79743108312b8e82493a0c4"><enum>(ii)</enum><text>propose projects and funding to the Secretary under this Act;</text></clause><clause id="id7e45ed6a887343a9a958b3db30bc3522"><enum>(iii)</enum><text>provide early and continuous coordination with appropriate officials of land management agencies in the County in recommending projects consistent with purposes of this Act; and</text></clause><clause id="id8755949b46ae4bc2a6505926a2982583"><enum>(iv)</enum><text>provide frequent opportunities for citizens, organizations, Tribes, land management agencies, and other interested parties to participate openly and meaningfully in the project development process, including in the early stages of the process.</text></clause></subparagraph><subparagraph id="idF9BE550E264A4303A452FCC03F20CB4F"><enum>(B)</enum><header>Projects proposed to the Secretary</header><text>The Malheur CEO Group may propose a project to the Secretary if the project has been approved by a majority of the members voting at an official meeting of the Malheur CEO Group.</text></subparagraph></paragraph><paragraph id="idC20381E5FF824450B4034DC9C5395AB8"><enum>(4)</enum><header>Meetings</header><subparagraph id="id2E71E5D37D8F4862B4FB715331E5BCD5"><enum>(A)</enum><header>In general</header><text>A quorum is required for an official meeting of the Malheur CEO Group.</text></subparagraph><subparagraph id="id01433A35C0FF409EA1EBF7DC647CE452"><enum>(B)</enum><header>Quorum</header><text>A quorum shall consist of—</text><clause id="id16C9DB8044CF4C25897A885FFF4F9FD9"><enum>(i)</enum><text>a combination of members that—</text><subclause id="idD27998EA9F14421B9322156C8BB8E85A"><enum>(I)</enum><text>constitutes a majority of the members of the Malheur CEO Group; and</text></subclause><subclause id="idD25216C1BF35481AB1256611DFE1FD09"><enum>(II)</enum><text>consists of at least as many members described in clause (i) of paragraph (2)(A) as the total number of members described in clauses (ii) and (iii) of that paragraph; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3C9A4D10DC224CB4BB59A0836273F472"><enum>(ii)</enum><text>all of the members of the Malheur CEO Group.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6FEB60DA36CA4EBDA0FD97BF71697415"><enum>(C)</enum><header>Open meetings</header><text>Each meeting of the Malheur CEO Group shall—</text><clause commented="no" display-inline="no-display-inline" id="id3B97B7E1B0F54C60B0D05FA468BB2992"><enum>(i)</enum><text>be announced in a local newspaper of record, as determined by the Secretary, not less than 1 week in advance of the meeting; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5CC4A0A982CC4152980D529132B34C5F"><enum>(ii)</enum><text>be open to the public.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3098a6640f6f4636b7562d4f58f16edc"><enum>(D)</enum><header>Records</header><text>The Malheur CEO Group shall—</text><clause commented="no" display-inline="no-display-inline" id="idB174809814504AA0899B09A9418561BA"><enum>(i)</enum><text>maintain records of each meeting; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idA750013CC2A54A32BFAADB9067BB8330"><enum>(ii)</enum><text>make those records available for public inspection.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2CCAA5EAFCFC4A1098FA05622DF09062"><enum>(5)</enum><header>Bylaws</header><subparagraph commented="no" display-inline="no-display-inline" id="id784C5774B16442488005B860619226C5"><enum>(A)</enum><header>In general</header><text>The members of the Malheur CEO Group shall establish bylaws for the Malheur CEO Group.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id662F6B013EE74B6D9F8597A088C1BC8A"><enum>(B)</enum><header>Requirement</header><text>Bylaws may be established under subparagraph (A) on approval by—</text><clause commented="no" display-inline="no-display-inline" id="idF526D512EA314824A2AB77C33F9956B6"><enum>(i)</enum><text>a combination of members that—</text><subclause commented="no" display-inline="no-display-inline" id="id3C9524C0831947CB835FCE55008505F2"><enum>(I)</enum><text>constitutes a majority of the members of the Malheur CEO Group; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id82EB5F73266B40EBA9E59A91BAD10A01"><enum>(II)</enum><text>consists of at least as many members described in clause (i) of paragraph (2)(A) as the total number of members described in clauses (ii) and (iii) of that paragraph; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idF5DFDB4F5C6847F0924B963CD962EA83"><enum>(ii)</enum><text>all of the members of the Malheur CEO Group.</text></clause></subparagraph></paragraph><paragraph id="id089cd7ee0ade48ee84cf7eab5eae4f48"><enum>(6)</enum><header>Detail of Federal employees</header><subparagraph id="id33ae9db8ce5f43dfba202ae260b78780"><enum>(A)</enum><header>In general</header><text>On request of the Malheur CEO Group, the Secretary may detail, with or without reimbursement, any of the personnel of the Department of the Interior to assist the Malheur CEO Group in carrying out the duties described in paragraph (3).</text></subparagraph><subparagraph commented="no" id="id3352a91369974681a178bca0846b55e9"><enum>(B)</enum><header>Civil service status</header><text>Any detail of a Federal employee under subparagraph (A) shall not interrupt or otherwise affect the civil service status or privileges of the Federal employee detailed.</text></subparagraph></paragraph><paragraph id="idC3EBD716F8754AAD855F24C163637D86"><enum>(7)</enum><header>Malheur Community Empowerment for Owyhee Group Advisory Committee</header><subparagraph id="idC72BAFBA557B49189C9EC1DB26E55DD7"><enum>(A)</enum><header>Establishment</header><text>Not later than 60 days after the date on which the Malheur CEO Group is established under paragraph (1), the Malheur CEO Group shall establish an advisory committee, to be known as the <quote>Malheur Community Empowerment for Owyhee Group Advisory Committee</quote>, to provide input to the Malheur CEO Group, including scientific, cultural, historical, and other advice, as needed, regarding management of the Federal land—</text><clause id="id8BD0F2B4C87E4F9AB2AFC7EEAB5BB67F"><enum>(i)</enum><text>to ensure that the work of the Malheur CEO Group is well-informed and relevant to the Federal land; and</text></clause><clause id="id37BA53B944C346728CF4F105BC8FB1F6"><enum>(ii)</enum><text>to promote adaptive management of the Federal land in accordance with a programmatic environmental impact statement prepared under subsection (a)(1).</text></clause></subparagraph><subparagraph id="id31E16D6F5CF442DA8EAB55ABED017F30"><enum>(B)</enum><header>Membership</header><clause id="id6846F02FF48041DB8585C31C50E9F28E"><enum>(i)</enum><header>In general</header><text>The Malheur CEO Advisory Committee shall consist of—</text><subclause id="id8B9F7B5273E04B86BD6E2DACF1E41D85"><enum>(I)</enum><text>members of the Malheur CEO Group;</text></subclause><subclause id="idBC0829896A7346F0A7E68411ECFCEB80"><enum>(II)</enum><text>representatives of Indian tribes, including at least 1 representative of the Burns Paiute Tribe;</text></subclause><subclause id="id6DF8127ED6204E048E315F94A7C9B90E"><enum>(III)</enum><text>representatives of the scientific and research communities, including individuals with expertise in scientific matters relevant to the Federal land, as determined by the Malheur CEO Group; and</text></subclause><subclause id="id3D9DC2DEEF9E4563B5F957752AA02B53"><enum>(IV)</enum><text>representatives of any other entity or interest relevant to the Federal land, as determined by the Malheur CEO Group.</text></subclause></clause><clause id="id1C78CDB1D5054C02BE14488134F8BFC9"><enum>(ii)</enum><header>Appointment</header><subclause id="idFE13EA9DE60B4E4F936753727516B128"><enum>(I)</enum><header>In general</header><text>The Malheur CEO Group shall appoint the members of the Malheur CEO Advisory Committee.</text></subclause><subclause id="idD7DFE4C15DE4477290114D7167BDFD03"><enum>(II)</enum><header>Initial appointments</header><text>Not later than 60 days after the date on which the Malheur CEO Group is established under paragraph (1), the Malheur CEO Group shall appoint the initial members of the Malheur CEO Advisory Committee.</text></subclause><subclause id="id7A78B759D9E5414B9F8ACA03D90EE3DC"><enum>(III)</enum><header>Terms</header><text>Each member of the Malheur CEO Advisory Committee shall serve for such period as the Malheur CEO Group determines to be appropriate.</text></subclause><subclause id="id2FCD85A0E2BC4E199FD71614E88A2427"><enum>(IV)</enum><header>Reappointment</header><text>A member of the Malheur CEO Advisory Committee may be reappointed for 1 or more additional terms.</text></subclause><subclause id="id7805D684B9B4428A9CA64F2A2F7AF158"><enum>(V)</enum><header>Vacancies</header><text>A vacancy on the Malheur CEO Advisory Committee shall be filled—</text><item id="id78BD6E32824A493A99C8DC491ED3B4B5"><enum>(aa)</enum><text>as soon as practicable after the vacancy occurs; and</text></item><item commented="no" display-inline="no-display-inline" id="id48FC5FB8107242C4B0F7AB861B3C7F37"><enum>(bb)</enum><text>in the same manner as the original appointment.</text></item></subclause></clause><clause id="id754A7F8DB5CB463D8FB63D9537A15E34"><enum>(iii)</enum><header>Compensation and expenses</header><subclause id="id2C430EB5FEA24DABB4CADB7BB7B09480"><enum>(I)</enum><header>Compensation</header><text>Members of the Malheur CEO Advisory Committee shall serve without compensation.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD050928B213340A388F2B7E4522660EB"><enum>(II)</enum><header>Travel expenses</header><text>Each member of the Malheur CEO Advisory Committee shall receive, from the Secretary, travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc5f1e95ce97a4179bcbc1a0e1c84c6f4"><enum>(8)</enum><header>Inapplicability of Federal advisory committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Malheur CEO Group or the Malheur CEO Advisory Committee.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id305FD9FFD17F42B18DF29A11243B3B24"><enum>(d)</enum><header>Ongoing consultation</header><paragraph commented="no" display-inline="no-display-inline" id="idE7CB46189D9D4F65BBD62568D128BDF4"><enum>(1)</enum><header>In general</header><text>In carrying out adaptive management under a programmatic environmental impact statement prepared under subsection (a)(1) and monitoring under subsection (e), the Secretary shall consult with the Malheur CEO Group and work toward a consensus with respect to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE88F62799D344ADDAF08BE44D5AEAA1D"><enum>(A)</enum><text>the implementation of policies and practices;</text></subparagraph><subparagraph id="id02644044a3b34371840c3753bd63996b"><enum>(B)</enum><text>any lessons learned from that implementation; and</text></subparagraph><subparagraph id="id1900dfd555aa449aa4873aa5ab2d7f15"><enum>(C)</enum><text>the adaptation of those policies and practices—</text><clause id="id699F8E831AC54603AEF808A6D556B8E3"><enum>(i)</enum><text>to reflect any lessons learned from the implementation; and</text></clause><clause id="idA85D255411F84202878B84C5CB45FBBD"><enum>(ii)</enum><text>to incorporate the results of the monitoring carried out under subsection (e).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idED2D461FF3C54100A25B0389B5947436"><enum>(2)</enum><header>Frequency</header><text>The Secretary shall consult with the Malheur CEO Group not less frequently than once every 60 days for the 4-year period beginning on the date on which the Malheur CEO Group is established under subsection (c)(1), and as necessary thereafter.</text></paragraph></subsection><subsection id="id03e509b97bcb4e609ba564d156d71af3"><enum>(e)</enum><header>Monitoring</header><paragraph id="idDFF69DDAADC44667B34C67009A43729F"><enum>(1)</enum><header>Establishment of the Monitoring Network</header><subparagraph id="id23AB641794BB4DF1890C67CD9B5D1E4D"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall enter into a memorandum of understanding with the monitoring partners described in subparagraph (B) to establish a network, to be known as the <quote>Monitoring Network</quote>—</text><clause id="idC49D8177F9A341BBB8B1CE418633515C"><enum>(i)</enum><text>to monitor, in accordance with this subsection, all Federal land subject to a programmatic environmental impact statement prepared under subsection (a)(1)(A); and</text></clause><clause id="id70E3C5C0FA7B4978A888B2F246977E56"><enum>(ii)</enum><text>to carry out ecological research relating to that monitoring.</text></clause></subparagraph><subparagraph id="id32E701EAF1774E92AC778D1F4BA1D416"><enum>(B)</enum><header>Monitoring partners described</header><text>The monitoring partners referred to in subparagraph (A) are—</text><clause id="idAC383F7311AC46DDA6FDCECCEF9A4189"><enum>(i)</enum><text>the Director of the Bureau;</text></clause><clause id="id266ECEEC54974E9C89070B79C58A5FD1"><enum>(ii)</enum><text>the Director of the United States Fish and Wildlife Service;</text></clause><clause id="idB5E76D5A85F44835A8659C6011C13B70"><enum>(iii)</enum><text>the Chief of the Natural Resources Conservation Service;</text></clause><clause id="idE2AD9848A2194BA294E18FE4672D59EB"><enum>(iv)</enum><text>the Oregon Department of Fish and Wildlife;</text></clause><clause id="id4C58DED041E747DCA04F82F3DA8EC92B"><enum>(v)</enum><text>the Oregon Department of Environmental Quality;</text></clause><clause id="idD2B5C51463AD4C59BA887E91FF3CADB8"><enum>(vi)</enum><text>the County;</text></clause><clause id="id03E082FAC33E4BEA81868497221D6268"><enum>(vii)</enum><text>the Malheur County Soil and Water Conservation District;</text></clause><clause id="idC27908C0A44C4FD382C18264EDE32292"><enum>(viii)</enum><text>relevant watershed councils in the County, as determined by the Malheur CEO Group;</text></clause><clause id="id408F2CB5FA4A45678E3842345645E38F"><enum>(ix)</enum><text>the Burns Paiute Tribe;</text></clause><clause id="id8A91B0FA30F7422E9A1D6C0FE7828388"><enum>(x)</enum><text>Oregon State University;</text></clause><clause commented="no" display-inline="no-display-inline" id="idFC10162C765047BEAC25283F8FC38C4D"><enum>(xi)</enum><text>Treasure Valley Community College;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0D15BBA0D98648DFB6C7CFD4ACF431AB"><enum>(xii)</enum><text>existing holders or users of grazing permits on the Federal land;</text></clause><clause commented="no" display-inline="no-display-inline" id="id818D617DF87E4E4F9D86F353915DE9B8"><enum>(xiii)</enum><text>representatives of conservation, hunting, or fishing organizations; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3CD85A7DC6524B02A33B61526D028A43"><enum>(xiv)</enum><text>any other individual or entity that, in the determination of the Secretary, collects or holds data relevant to the monitoring, in accordance with this section, of the Federal land subject to a programmatic environmental impact statement prepared under subsection (a)(1).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4BA3BE7B56674E58A804367838269AC4"><enum>(2)</enum><header>Leadership of the Monitoring Network</header><text>The Chief of the Natural Resources Conservation Service and the Director of the Bureau shall lead the Monitoring Network unless the parties to the memorandum of understanding described in paragraph (1) choose another Federal official to lead the Monitoring Network.</text></paragraph><paragraph id="id5207d64092cb49d9b6ef84e81bfc0965"><enum>(3)</enum><header>Requirements</header><text>The Monitoring Network shall carry out monitoring and research—</text><subparagraph id="id56D073A90FC44BB2B099C788532DDB78"><enum>(A)</enum><text>using agreed upon protocols for the collection of data to inform the adaptive management actions necessary to achieve a desired range of future conditions;</text></subparagraph><subparagraph id="id2EBCADE1509748A297491AF5461A989C"><enum>(B)</enum><text>using the latest available science-based ecological framework to provide more frequent and timely data relating to the ecological functionality of the Federal land subject to a programmatic environmental impact statement prepared under subsection (a)(1) than the data that the Bureau was able to acquire before the date of enactment of this Act through—</text><clause id="idFCA2D318EB6A464988D9021B1A3E03FC"><enum>(i)</enum><text>the independent efforts of the Bureau; or</text></clause><clause id="id34D25402C544408E82C018DFB9D338D7"><enum>(ii)</enum><text>existing cooperative agreements;</text></clause></subparagraph><subparagraph id="id01506E978E3C4534A3226FDBC0FB1799"><enum>(C)</enum><text>that provides data that can be used by the Secretary in real-time, as baseline data and as data indicating changes in conditions, for adaptive management of the Federal land in accordance with a programmatic environmental impact statement prepared under subsection (a)(1); and</text></subparagraph><subparagraph id="id4668C4F919954508AF48B9480B118259"><enum>(D)</enum><text>that includes monitoring and research of ecological health, including the collection of data on—</text><clause id="idB23DE54BF0C7432FB51D51285439DDBC"><enum>(i)</enum><text>the relationship between invasive species and fires, including information regarding the frequency and severity of any fires, updated not less frequently than once each year;</text></clause><clause id="id7D2577E45C0E45A9BBD396B2D2500462"><enum>(ii)</enum><text>soils and vegetation, for the purpose of preparing a complete inventory of all soils and vegetation within the Federal land, updated not less frequently than once every 10 years;</text></clause><clause id="id8AC377A3F6C244198168BFFF61E980AE"><enum>(iii)</enum><text>wildlife, including migration corridors and the status of habitat fragmentation;</text></clause><clause id="idD46240FC49554409B4A36C8B6F849805"><enum>(iv)</enum><text>wild or feral horses or trespass livestock;</text></clause><clause id="idDFBA511CEBDA494180E176B4EBAD91A2"><enum>(v)</enum><text>the availability and management of water on the land, including the use of updated water infrastructure;</text></clause><clause id="idEE81FDE040294B9FBCF0A256A968C5CC"><enum>(vi)</enum><text>the effects of the removal of juniper;</text></clause><clause id="idA6477A568D8643D384B07116C5316CF1"><enum>(vii)</enum><text>invasive species;</text></clause><clause id="idF0CB70FDB8C84A28A641EF36343B3E61"><enum>(viii)</enum><text>sage brush steppe ecosystems;</text></clause><clause id="idEE6849BDF7F04C219291AE6150176A48"><enum>(ix)</enum><text>wetlands, riparian areas, springs, seeps, and other mesic sites; and</text></clause><clause id="id0047CA452C4845B4A07A8148A5509311"><enum>(x)</enum><text>recreation, including—</text><subclause id="id58F6EAA5463842EA89CDAE71F8B51F30"><enum>(I)</enum><text>recreation in any component of the National Wild and Scenic Rivers System;</text></subclause><subclause id="idC2D2300F529B4746B7B1CCBC1416B799"><enum>(II)</enum><text>recreation north and south of the Owyhee dam; and</text></subclause><subclause commented="no" id="id7C1D27939F914E5593DACA78998D0AB9"><enum>(III)</enum><text>recreation relating to loop roads, including—</text><item id="id04EC191D45644DD6BE9DEC4317635041"><enum>(aa)</enum><text>the use of the roads;</text></item><item id="id6BF970A486AD4F0E8157AA3F4276FC54"><enum>(bb)</enum><text>the economic impact of the roads;</text></item><item id="id3BE3620B9C044A348526E962E046C5D4"><enum>(cc)</enum><text>the effects of the roads on domestic and wild flora and fauna; and</text></item><item id="idC45545F32E2C4AA5AD2A03CD70E69B6D"><enum>(dd)</enum><text>the effects of the roads on—</text><subitem id="id6EF235823C824A22BA6587BE384BD4FA"><enum>(AA)</enum><text>cultural uses of the land; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="idEE5C24196D064B6B93B8C3138615140A"><enum>(BB)</enum><text>cultural artifacts.</text></subitem></item></subclause></clause></subparagraph></paragraph><paragraph id="id37a43af5563e4ae6b65e343fbd6cd92c"><enum>(4)</enum><header>Deadline for baseline data</header><text>Not later than 180 days after the date on which the Monitoring Network is established under paragraph (1), the Monitoring Network shall begin—</text><subparagraph id="id910E1541321D45C5ABBC65BFC19B1227"><enum>(A)</enum><text>compiling existing baseline data;</text></subparagraph><subparagraph id="idA61419B93E79466ABEA91B2613F8C5A5"><enum>(B)</enum><text>incorporating new baseline data as that data is acquired; and</text></subparagraph><subparagraph id="id1E56685A894142179C3CE7D90390DA0A"><enum>(C)</enum><text>making that baseline data available to the public.</text></subparagraph></paragraph><paragraph id="id81bba3c9bdbd4a249cc774a2e2cdb5e5"><enum>(5)</enum><header>Use of monitoring data</header><subparagraph id="id5443B01F7DF949FCA434DC605803729A"><enum>(A)</enum><header>In general</header><text>Monitoring data collected by the Monitoring Network shall inform management planning decisions relating to the actions covered by a programmatic environmental impact statement prepared under subsection (a)(1), as determined by the Secretary.</text></subparagraph><subparagraph id="idb0019d86b4314490bc38316ea36d839b"><enum>(B)</enum><header>Effect of violations</header><text>If monitoring data described in subparagraph (A) shows that a holder or user of a grazing permit is not in substantial compliance with the applicable management plan or any use of flexible management granted by a programmatic environmental impact statement prepared under subsection (a)(1), that holder or user shall not be permitted further access to any flexible management granted by the programmatic environmental impact statement until—</text><clause id="id3107FE7B37984D60890CD91BAADE11F1"><enum>(i)</enum><text>the holder or user takes corrective action; and</text></clause><clause id="id5BB5AA570DDD4FC39E44091896398924"><enum>(ii)</enum><text>monitoring data shows that the corrective action taken by the holder or user has improved the ecological health of the affected land, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="id75c6f8745b4a42118c2afe72ba9e5f56"><enum>(C)</enum><header>Effect of improvements</header><clause id="idD833B2FE2C8C47238B54086E87707E35"><enum>(i)</enum><header>Suspended animal unit months</header><text>The Secretary shall restore for use by a holder or user of a grazing permit any animal unit months held by that holder or user that were suspended, in a quantity commensurate with the carrying capacity of the relevant land, as determined by the Secretary, if—</text><subclause id="id6C4316908FA94D349BC1717E8BAE0B5C"><enum>(I)</enum><text>monitoring data shows that the holder or user is in substantial compliance with—</text><item id="idA9C239BD2F19471097771CA3159D0232"><enum>(aa)</enum><text>the applicable management plan; and</text></item><item id="idE6D90E3663E5456F864B0F5CD8694279"><enum>(bb)</enum><text>the use of flexible management granted by a programmatic environmental impact statement prepared under subsection (a)(1); and</text></item></subclause><subclause id="id771DAB8FD2614ADBB6834366C092C260"><enum>(II)</enum><text>the conditions of the allotments of that holder or user will support additional animal unit months beyond the animal unit months assigned to that holder or user.</text></subclause></clause><clause id="id304DE0EFD06B475EBFAC58F3F36422FC"><enum>(ii)</enum><header>Improved carrying capacity</header><text>The Secretary shall consider increasing the quantity of animal unit months held by a holder or user of a grazing permit if monitoring data shows an increased carrying capacity on the relevant land.</text></clause></subparagraph></paragraph><paragraph id="idAD42F9ADAC7840A1B075C98727D1AF9E"><enum>(6)</enum><header>Deployment and use of modern technology</header><text>To the maximum extent practicable, the Secretary shall deploy, use, and request the use of modern technology to carry out the monitoring referred to in paragraph (1), including—</text><subparagraph id="id3B6C4217AD1E426981FE4E508BE3451C"><enum>(A)</enum><text>unmanned aerial systems;</text></subparagraph><subparagraph id="id0D2E7B5D5F264D048FC3E0E5FA172CCD"><enum>(B)</enum><text>satellite imagery;</text></subparagraph><subparagraph id="idF7DF10B5D46041FFAA48993FA5A68675"><enum>(C)</enum><text>Global Positioning Systems and tablets;</text></subparagraph><subparagraph id="id7348B389049648FEA88A655BA6E707A3"><enum>(D)</enum><text>weather stations; and</text></subparagraph><subparagraph id="idE3CC6276A6FD45E08A1AD6C0757EF236"><enum>(E)</enum><text>stream gauges.</text></subparagraph></paragraph><paragraph id="idF4F586F894974728A976AB4D300AA6F8"><enum>(7)</enum><header>Soil and vegetation surveys</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall enter into a memorandum of understanding for internships and workforce development to carry out soil and vegetation surveys on the Federal land with—</text><subparagraph id="id08B93A5AD92244E2BF7721F2AE2E9919"><enum>(A)</enum><text>the Chief of the Natural Resources Conservation Service;</text></subparagraph><subparagraph id="id5CE26E07E77E4F3183A9646DF9305B36"><enum>(B)</enum><text>the American Conservation Experience;</text></subparagraph><subparagraph id="id8C708C6CA57745E0801493613A81648E"><enum>(C)</enum><text>Oregon State University;</text></subparagraph><subparagraph id="id93B53DD52AA6471D9E3923B293CC2CDF"><enum>(D)</enum><text>Treasure Valley Community College;</text></subparagraph><subparagraph id="id9E001016335F4473802112E45240E33E"><enum>(E)</enum><text>the Burns Paiute Tribe; and</text></subparagraph><subparagraph id="id92D92C19BCBB437D8C60CB1A7C0322F9"><enum>(F)</enum><text>local high schools in the County.</text></subparagraph></paragraph><paragraph id="idA4BE464315F448D397F5FC973F630610"><enum>(8)</enum><header>No effect on existing fees</header><text>Nothing in this subsection affects any Federal, State, Tribal, or local grazing or other fee generated in the County under existing law (including regulations).</text></paragraph></subsection><subsection id="id1ADC0241371E4A318A3D70042D16E677"><enum>(f)</enum><header>Enforcement</header><paragraph id="id88E87C9610FA426C8966BA75D9F3492F"><enum>(1)</enum><header>Direct enforcement by the Secretary</header><text>The Secretary shall enforce compliance with—</text><subparagraph id="idBE4B0CDAE8EB424C8763FD70350492F8"><enum>(A)</enum><text>any requirement relating to the monitoring of Federal land under subsection (e); and</text></subparagraph><subparagraph id="idB83F7D7B777F4FA5AA1878EE24407169"><enum>(B)</enum><text>any policy or practice implemented by the Secretary in response to that monitoring.</text></subparagraph></paragraph><paragraph id="id4B59AE69F1384571BB7B39FFA472937B"><enum>(2)</enum><header>Enforcement by the County</header><subparagraph id="idC766203BDE7341B4ACB94CCAA1FCE26E"><enum>(A)</enum><header>In general</header><text>The Secretary may make grants to County law enforcement agencies to assist in the enforcement of any requirement relating to the monitoring of county roads.</text></subparagraph><subparagraph id="idB949FB1682AE48018FF8E4A2834C912C"><enum>(B)</enum><header>Additional law enforcement officers and personnel</header><text>The County may use funds received through a grant under this paragraph to hire not more than 4 additional law enforcement officers or personnel.</text></subparagraph></paragraph><paragraph commented="no" id="idA3AF2A17469E48B38441E7B6B39F62DD"><enum>(3)</enum><header>Monitoring and enforcement by Indian Tribes</header><text>The Secretary shall make grants to Indian Tribes—</text><subparagraph commented="no" id="idE374C96A82B74D2FA276FF89DD0170CD"><enum>(A)</enum><text>to assist the Secretary in the monitoring required under subsection (e); and</text></subparagraph><subparagraph commented="no" id="id0813D2295CAD46AA90E3198C42DD086B"><enum>(B)</enum><text>to assist in the enforcement of—</text><clause commented="no" display-inline="no-display-inline" id="id1DDD19F4486144E399F79D9C327DB15A"><enum>(i)</enum><text>any requirement relating to the monitoring of Federal land under subsection (e); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idDAB45B356FBA4DB9B34C23643B92206E"><enum>(ii)</enum><text>any policy or practice implemented by the Secretary in response to that monitoring.</text></clause></subparagraph></paragraph></subsection><subsection id="id8DFACB2B301E476AA16A0DAC49C4F265"><enum>(g)</enum><header>Authorization of resources for increased workforce</header><paragraph id="id6A71FFDBDEC840B5AF56281FB5C38E46"><enum>(1)</enum><header>In general</header><text>To carry out this section, including any monitoring and enforcement under this section, the Secretary may hire additional employees for the Vale District of the Bureau.</text></paragraph><paragraph id="id3CFADDBA04434DBFA471DD73E5A0BBD8"><enum>(2)</enum><header>Soil and vegetative health survey workforce</header><subparagraph id="idDE210C9415FA4B44BF258F8E4AABDA38"><enum>(A)</enum><header>Initial completion of baseline soil and vegetative health survey</header><text>To complete the soil and vegetative health surveys under subsection (e)(7), the Secretary shall use existing protocols and hire, for the Vale District of the Bureau—</text><clause id="idDF35AE32C60B4B7683C85F14AAC4B893"><enum>(i)</enum><text>4 employees to survey 200,000 acres of Federal land each year until the survey of Federal land is completed; or</text></clause><clause id="idFF5DD6335884440EBA264DBA1176CAFB"><enum>(ii)</enum><text>to complete the survey of Federal land in 1 year, 40 employees for a period of 1 year.</text></clause></subparagraph><subparagraph id="idC2D99C553E974D41959EDBC70063AD9B"><enum>(B)</enum><header>Updates to the survey</header><text>To update the survey not less frequently than once every 10 years, the Secretary shall hire, for the Vale District of the Bureau, 6 employees to survey not less than 460,000 acres of Federal land each year on an ongoing basis.</text></subparagraph></paragraph></subsection><subsection id="id17D404D6E9474210B00465CC74951BF0"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="idEE40DA8AF59F4BA8B7E69B58F27AD96A"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary—</text><subparagraph id="idBBD5548B10CA4B188FE027D78D18773B"><enum>(A)</enum><text>to carry out monitoring and enforcement under this section, $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph id="id8C205D903B4A4B92AF5C6981945F105E"><enum>(B)</enum><text>to carry out soil and vegetation surveys under subsection (e)(7), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph id="idBB8DEFA628744A0A8BB3146B52DA90E2"><enum>(C)</enum><text>to make grants under subsection (f)(2) to County law enforcement agencies, $10,000,000 for each of fiscal years 2023 through 2033; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD70A12EC8661480BAE78C3333360E492"><enum>(D)</enum><text>to make grants under subsection (f)(3) for monitoring and enforcement by Indian Tribes, $7,000,000 for each of fiscal years 2023 through 2033.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5F69BC2A070C4B62843666D064C8FD83"><enum>(2)</enum><header>Increased APHIS funding</header><text>There is authorized to be appropriated to the Administrator of the Animal and Plant Health Inspection Service to support innovative technologies to reduce invasive species, including invasive weeds and invasive annual grasses on the Federal land, $1,000,000 for each of fiscal years 2023 through 2033.</text></paragraph></subsection></section><section id="idac1acc6255b444bb9741d9454d2e8c32"><enum>5.</enum><header>Land designations</header><subsection id="idF5C45C27894C49CA97072279AC79D4F0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7E6CBE80797244FEB5181DADB1272E99"><enum>(1)</enum><header>Covered segment</header><text>The term <quote>covered segment</quote> means the river segment designated by paragraph (231) of section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) (as added by subsection (d)(1)).</text></paragraph><paragraph id="idC6A61F9E4D09465AAB474B62B903557D"><enum>(2)</enum><header>Map</header><text>The term <quote>Map</quote> means the map entitled <quote>Proposed Wilderness Malheur County</quote> and dated November 6, 2019.</text></paragraph><paragraph id="idBA0BFD9F16F34A3EAFF9E42B8C7A25D8"><enum>(3)</enum><header>Wilderness area</header><text>The term <quote>wilderness area</quote> means a wilderness area designated by subsection (b)(1).</text></paragraph></subsection><subsection id="id3D65487537154599918B42CAB080656A"><enum>(b)</enum><header>Designation of wilderness areas</header><paragraph id="id94FDE556006D456086DE9B19772CF9F4"><enum>(1)</enum><header>In general</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following Federal land in the County comprising approximately 1,133,481 acres, as generally depicted on the Map, is designated as wilderness and as components of the National Wilderness Preservation System:</text><subparagraph id="id900626158e5140eabde57669fabad273"><enum>(A)</enum><header>Fifteenmile creek wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 58,599 acres, as generally depicted on the Map, which shall be known as the <quote>Fifteenmile Creek Wilderness</quote>.</text></subparagraph><subparagraph id="id13357802949e43a59269e823ef5ce7e7"><enum>(B)</enum><header>Oregon canyon mountains wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 57,891 acres, as generally depicted on the Map, which shall be known as the <quote>Oregon Canyon Mountains Wilderness</quote>.</text></subparagraph><subparagraph id="idac9f78f447be4678b85e9dd6f178ece4"><enum>(C)</enum><header>Twelvemile creek wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 37,779 acres, as generally depicted on the Map, which shall be known as the <quote>Twelvemile Creek Wilderness</quote>.</text></subparagraph><subparagraph id="idfb3867698c77499687b45aad9d7e6940"><enum>(D)</enum><header>Upper west little owyhee wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 93,159 acres, as generally depicted on the Map, which shall be known as the <quote>Upper West Little Owyhee Wilderness</quote>.</text></subparagraph><subparagraph id="id35918f61529f4b34a670c05a6f36a6fb"><enum>(E)</enum><header>Lookout butte wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 66,194 acres, as generally depicted on the Map, which shall be known as the <quote>Lookout Butte Wilderness</quote>.</text></subparagraph><subparagraph id="id64d3bad41fef43c1b127cb00df8fc55a"><enum>(F)</enum><header>Owyhee river canyon wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 223,586 acres, as generally depicted on the Map, which shall be known as the <quote>Mary Gautreaux Owyhee River Canyon Wilderness</quote>.</text></subparagraph><subparagraph id="id74aaba7cfaa949ab8cb7d0850e673156"><enum>(G)</enum><header>Twin butte wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 18,135 acres, as generally depicted on the Map, which shall be known as the <quote>Twin Butte Wilderness</quote>.</text></subparagraph><subparagraph id="id1a796a5e000445eb8b48a8b1c4ca1ebd"><enum>(H)</enum><header>Cairn <quote>c</quote> wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 8,946 acres, as generally depicted on the Map, which shall be known as the <quote>Cairn <quote>C</quote> Wilderness</quote>.</text></subparagraph><subparagraph id="ideb253553cad8469e9bb595ff26e90d93"><enum>(I)</enum><header>Oregon butte wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 32,010 acres, as generally depicted on the Map, which shall be known as the <quote>Oregon Butte Wilderness</quote>.</text></subparagraph><subparagraph id="id6bdf90a67d184ee0aa3764958b569e0c"><enum>(J)</enum><header>Deer flat wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 12,266 acres, as generally depicted on the Map, which shall be known as the <quote>Deer Flat Wilderness</quote>.</text></subparagraph><subparagraph id="id116b08d2de584ee6995d56a05a409eea"><enum>(K)</enum><header>Sacramento hill wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 9,568 acres, as generally depicted on the Map, which shall be known as the <quote>Sacramento Hill Wilderness</quote>.</text></subparagraph><subparagraph id="idc9909b98af59414387d1e1a95eaff50b"><enum>(L)</enum><header>Coyote wells wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 7,147 acres, as generally depicted on the Map, which shall be known as the <quote>Coyote Wells Wilderness</quote>.</text></subparagraph><subparagraph id="idbe1448f0662d4b63b3682b63872b7568"><enum>(CC)</enum><header>West fork bendire wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 10,519 acres, as generally depicted on the Map, which shall be known as the <quote>West Fork Bendire Wilderness</quote>.</text></subparagraph><subparagraph id="idb5e20119721441469704c625a1464df6"><enum>(DD)</enum><header>Beaver dam creek wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 19,080 acres, as generally depicted on the Map, which shall be known as the <quote>Beaver Dam Creek Wilderness</quote>.</text></subparagraph></paragraph><paragraph id="idB3E4CEF3C6214549BA2B722487E61CBA"><enum>(2)</enum><header>Maps and legal descriptions</header><subparagraph id="id471428D94C254816BE48F5FBAAB9EF99"><enum>(A)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare and submit to Congress a map and legal description of each wilderness area.</text></subparagraph><subparagraph commented="no" id="id9904582A26D945518ABD3E50EBB3E607"><enum>(B)</enum><header>Effect</header><text>Each map and legal description prepared under subparagraph (A) shall have the same force and effect as if included in this Act, except that the Secretary may correct clerical and typographical errors in the map or legal description.</text></subparagraph><subparagraph commented="no" id="id9C647CDF486146AB9EBF0146C9D31899"><enum>(C)</enum><header>Public availability</header><text>The maps and legal descriptions prepared under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the Bureau.</text></subparagraph></paragraph><paragraph id="id81941a35896d49bca06d9ea766eb82a7"><enum>(3)</enum><header>Management</header><subparagraph id="idb3ec26dfa2bd41658a9ab37efa31883c"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights, the wilderness areas shall be administered by the Secretary in accordance with—</text><clause id="id90501988175645A98E6BD83F29185495"><enum>(i)</enum><text>this subsection;</text></clause><clause id="id623DAA6A2649491985F5A36F5D342763"><enum>(ii)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text><subclause id="id231a14bec8944d50946399f4d0e70e3e"><enum>(I)</enum><text>any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</text></subclause><subclause id="ida8179ca14b534578b2c3bbffd30a011b"><enum>(II)</enum><text>any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary; and</text></subclause></clause><clause id="id8EDEA8C6AC2D421AB05BD57046294723"><enum>(iii)</enum><text>section 6340 of the Bureau of Land Management Manual (Management of Designated Wilderness Areas) (as in effect on the date of enactment of this Act).</text></clause></subparagraph><subparagraph id="id03da9e4b285f46d6ac639c4ded9b0eb2"><enum>(B)</enum><header>Grazing</header><text>The Secretary shall allow the continuation of the grazing of livestock in the wilderness areas, if established before the date of enactment of this Act, in accordance with—</text><clause id="idC1284CBD7AE145E7972E96F710EEAD0B"><enum>(i)</enum><text>this Act;</text></clause><clause id="id456ed975764e4dee90dfe705d8ec9ebc"><enum>(ii)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>);</text></clause><clause id="id0fc7619e0ad84f1eb2681dde34c1ae2d"><enum>(iii)</enum><text>the guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. 18 Rept. 101–405); and</text></clause><clause id="id9f9b912ebfff46e3814a020a1e5c8736"><enum>(iv)</enum><text>any other Federal law that applies to livestock grazing on Federal public land.</text></clause></subparagraph><subparagraph id="ida4012ab754404cf6a6f8421f78e97b34"><enum>(C)</enum><header>Fire management and related activities</header><clause id="id6186D760713B4CE1AF6E8D986F26F57A"><enum>(i)</enum><header>In general</header><text>The Secretary may carry out any activities in the wilderness areas that the Secretary determines to be necessary for the control of fire, insects, and diseases, in accordance with—</text><subclause id="id57711BDDD76948568E3FD7127B55F9E7"><enum>(I)</enum><text>this Act;</text></subclause><subclause id="id5859804E4A3149F0BD6C0EC42FAD9044"><enum>(II)</enum><text>section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>); and</text></subclause><subclause id="idBD74848939D84BABAA9C1DB64D34C546"><enum>(III)</enum><text>the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 1437 of the 98th Congress (House Report 98–40).</text></subclause></clause><clause id="id3DB20FB0A5E9473CAE9AA9CEC6E0CFDB"><enum>(ii)</enum><header>Inclusions</header><text>Authorized activities under clause (i) shall include the use of mechanical treatments in the wilderness areas by first responders.</text></clause></subparagraph><subparagraph id="id183d603a5d744f588fef2aaefa78d6d0"><enum>(D)</enum><header>Invasive species management and related activities</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the Secretary may carry out any activities in the wilderness areas that the Secretary determines to be necessary for the control and manipulation of invasive species, including—</text><clause id="id66E4490F15A6471C8D525A6790B4B7F7"><enum>(i)</enum><text>the use of nonnative species in areas in which native species cannot be grown to adequately compete with nonnative species; and</text></clause><clause id="id7C42C44C6F424CDDA511575E5B94A201"><enum>(ii)</enum><text>the manipulation of vegetation, including through chemical, biological, and mechanical means—</text><subclause id="idA2408D886D3A4861AF366EC11AE82688"><enum>(I)</enum><text>to control nonnative species; or</text></subclause><subclause id="id34C6ACAEDFF5419F89DF12C16EE86182"><enum>(II)</enum><text>as part of restoration activities, if natural processes alone cannot recover the ecological health of an area, as determined by the Secretary.</text></subclause></clause></subparagraph><subparagraph id="id036e9c8cace6469a84861c4f987b26ad"><enum>(E)</enum><header>Maintenance of livestock structures</header><text>The Secretary may carry out any activities in the wilderness areas that the Secretary determines to be necessary for the maintenance of structures and installations used for livestock management in existence on the date of enactment of this Act, in accordance with—</text><clause id="id3A274119C160489185E0F14D67CD60FE"><enum>(i)</enum><text>section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>); and</text></clause><clause id="idBA2825B0C65D46D1905F2A570E70B049"><enum>(ii)</enum><text>the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 1437 of the 98th Congress (House Report 98–40).</text></clause></subparagraph><subparagraph id="id67060b179b0b4ba5ba967d7815d4a5f4"><enum>(F)</enum><header>Setback for roads adjacent to wilderness areas</header><text>The Secretary may determine, in accordance with an applicable travel management plan for the Federal land adopted not later than 1 year after the date of enactment of this Act and section 6340 of the Bureau of Land Management Manual (Management of Designated Wilderness Areas) (as in effect on the date of enactment of this Act), that the boundary of a wilderness area adjacent to a road may be up to 300 feet from the centerline of a road if—</text><clause id="idD1DC23C6326E4F24AABC6750949DD3CC"><enum>(i)</enum><text>the setback is determined by the Secretary to be appropriate for the use of the Federal land; and</text></clause><clause id="id9104FA671F0C44F982D48DC78F996F5C"><enum>(ii)</enum><text>no existing boundary road will be closed.</text></clause></subparagraph></paragraph></subsection><subsection id="id0b178c75319f47afb6afc7075f6bf5f6"><enum>(c)</enum><header>Management of land under the multiple-Use mandate of the Bureau of Land Management</header><paragraph id="id144F4C4597F749CAB7F2E993614986C7"><enum>(1)</enum><header>Release of wilderness study area</header><subparagraph id="idD775A1FFC4F14874964615818B8C9232"><enum>(A)</enum><header>Finding</header><text>Congress finds that, for purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), any portion of the Federal land designated as a wilderness study area as of the date of enactment of this Act and identified as <quote>Proposed for Release from Protection under Wilderness Study Area (WSA) Designation or from Priority Protection of Lands with Wilderness Characteristics (LWC)</quote> on the Map that is not designated as wilderness by subsection (b)(1) has been adequately studied for wilderness designation.</text></subparagraph><subparagraph commented="no" id="id8ef02ffde4bd49c58a549418cea00682"><enum>(B)</enum><header>Release</header><text>Except as provided in paragraph (2), the land described in subparagraph (A)—</text><clause commented="no" id="id52583a0338e941eebe0af3be9389ac47"><enum>(i)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></clause><clause commented="no" id="ide18e48bb36d741c3a9db1a7282e784eb"><enum>(ii)</enum><text>shall be managed in accordance with—</text><subclause commented="no" id="id280BE1B7E4C24693B8A07BE5BACBEFC1"><enum>(I)</enum><text>this Act; and</text></subclause><subclause commented="no" id="id3DAFBBE2C5D9492DA9D5CEFFCEDB7E37"><enum>(II)</enum><text>the applicable land use plans adopted under section 202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="idC0F01257C9454CB39693BAC059818243"><enum>(2)</enum><header>Management of certain land with wilderness characteristics</header><text>Any portion of the Federal land described in paragraph (1)(A) that was previously found to be lands with wilderness characteristics, as determined by the Secretary, that is not designated as wilderness under this Act, shall be managed by the Secretary in accordance with the applicable land use plans adopted under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></paragraph></subsection><subsection id="ide301b498366a44bba755d2e646498f1c"><enum>(d)</enum><header>Wild and scenic river designations</header><paragraph id="idB3C97F4FABEB4866AA8A216473B530C3"><enum>(1)</enum><header>In general</header><text>Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida59ba6b40bd442c0a5bac532ed5b1d52"><paragraph id="id5c0f5e253ca8446f91c844b46740d574"><enum>(231)</enum><header>Owyhee river, oregon</header><text>The approximately 14.7-mile segment of the Owyhee River from the base of Owyhee Dam in sec. 18, T. 22 S., R. 45 E., downstream to W<fraction>1/4</fraction> SW<fraction>1/4</fraction> sec. 13, T. 21 S., R. 45 E., to be administered by the Secretary of the Interior as a recreational river.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idB2F5F5F032D34EB4B266063E1A56923E"><enum>(2)</enum><header>Management</header><subparagraph id="id532FFFBF30E145AD8BBCBD1FC4F1702A"><enum>(A)</enum><header>In general</header><text>The Secretary shall manage the covered segment in accordance with section 6400 of the Bureau of Land Management Manual (Wild and Scenic Rivers) (as in effect on the date of enactment of this Act).</text></subparagraph><subparagraph id="idFE5F58194FD344508E5C42F40A8161F6"><enum>(B)</enum><header>Livestock grazing</header><clause id="id1B18B0A8265F4B9898B5671BACF484D3"><enum>(i)</enum><header>In general</header><text>The Secretary shall manage domestic livestock grazing in the vicinity of the covered segment in a manner that protects the identified values of the covered segment, including maintaining existing structures used for livestock management.</text></clause><clause id="id779FEF16A807464499AB1F54F223E4C8"><enum>(ii)</enum><header>New structures</header><text>To maintain the identified values of the covered segment, the Secretary shall ensure that any structures constructed after the date of enactment of this Act to facilitate livestock management in the vicinity of the covered segment are unobtrusive, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="id40906239D12B4289962E5087032DE66A"><enum>(C)</enum><header>Invasive Species Management</header><clause id="id4465691CCC264961AD74893EC2FA9065"><enum>(i)</enum><header>In general</header><text>In administering the covered segment, the Secretary shall carry out any activities that the Secretary determines to be necessary to prevent or control the spread of terrestrial invasive species and aquatic invasive species, consistent with the applicable land use plan and applicable law, including using manual and chemical prevention and control methods, in accordance with—</text><subclause id="id1B23447FF6A44264A467B93981801E35"><enum>(I)</enum><text>the applicable land use plan;</text></subclause><subclause id="idE964A61601764FAEA716740D0EB97C03"><enum>(II)</enum><text>section 9011 of the Bureau of Land Management Manual (Chemical Pest Control) (as in effect on the date of enactment of this Act);</text></subclause><subclause id="idEEC87949A3ED46C39C952A687E559913"><enum>(III)</enum><text>section 9014 of the Bureau of Land Management Manual (Control Use of Biological Control Agents on Public Lands) (as in effect on the date of enactment of this Act);</text></subclause><subclause id="idE00DD260BE874BBC989DBDB38DC25F97"><enum>(IV)</enum><text>section 9015 of the Bureau of Land Management (Integrated Weed Management) (as in effect on the date of enactment of this Act);</text></subclause><subclause id="id609D798D218D4D51B9EDA38578EB8660"><enum>(V)</enum><text>section H–1740–2 of the Bureau of Land Management Handbook (as in effect on the date of enactment of this Act); and</text></subclause><subclause id="id2F150434643546CF8BB414330DFDB793"><enum>(VI)</enum><text>any applicable Federal law.</text></subclause></clause><clause id="id549F500B43764450A931630AC4435123"><enum>(ii)</enum><header>Required evaluation</header><text>Before using a chemical prevention or control method authorized under clause (i), the Secretary shall carefully evaluate the proposed use to ensure that the proposed use would not adversely affect water quality and the identified values of the covered segment.</text></clause></subparagraph></paragraph><paragraph id="id9a2025828ad1412f8aa1c719491cce27"><enum>(3)</enum><header>Withdrawal and use</header><subparagraph id="id0e7089c297964b25bee0e55331ca3e59"><enum>(A)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within a covered segment is withdrawn from—</text><clause id="idE50527FE20644A2C9CE35A404600DB89"><enum>(i)</enum><text>entry, appropriation, or disposal under the public land laws;</text></clause><clause id="idA2BCE3C23AC74EB085C02527FD948238"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="id1B1D48A74EEA4FF2847CF0FA4CDF1DE7"><enum>(iii)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text></clause></subparagraph><subparagraph id="idd6281b866a0d44eda90b4fdaa1ef02bf"><enum>(B)</enum><header>Water rights</header><text>Nothing in this subsection or an amendment made by this subsection affects—</text><clause id="idD066FF3D7F2247C397B4BAE17A6709D3"><enum>(i)</enum><text>valid existing water rights; or</text></clause><clause id="idAD64FE0D521E41E4B57368AA3A5E15C0"><enum>(ii)</enum><text>existing rights to access water from the river segment, if the access does not permanently impede the qualities for which the covered segment was designated.</text></clause></subparagraph><subparagraph id="id005E37BB46BA4D6BB44577B573C40ADA"><enum>(C)</enum><header>Water resources</header><text>The Secretary shall authorize the continued use and maintenance of diversions and water infrastructure in or adjacent to the covered segments as of the date of enactment of this Act, in accordance with section 6400 of the Bureau of Land Management Manual (Wild and Scenic Rivers–Policy and Program Direction for Identification, Evaluation, Planning, and Management) (as in effect on the date of enactment of this Act).</text></subparagraph></paragraph></subsection><subsection commented="no" id="id6c8195d5532e4b7ba86bd48d3d273b3e"><enum>(e)</enum><header>Mineral withdrawals</header><text>Subject to valid existing rights, the approximately 12,426.43 acres of Federal land known as the <quote>Leslie Gulch Area of Critical Environmental Concern</quote>, as described in the public land order entitled <quote>Public Land Order No. 7412; Withdrawal for Leslie Gulch Area of Critical Environmental Concern; Oregon</quote> (64 Fed. Reg. 51553 (September 23, 1999)), is permanently withdrawn from—</text><paragraph commented="no" id="id13A9FC00B79F4AAAABBAF3B695D73611"><enum>(1)</enum><text>entry, appropriation, and disposal under the public land laws;</text></paragraph><paragraph commented="no" id="id4f3e7335c1f54b1f9dbd661367c45205"><enum>(2)</enum><text>location, entry, and patent under mining laws; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e1a39297dea4c06864ad79f8d1c9a77"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection></section><section id="id9918bfa097004bb8a44a11aba2822a96"><enum>6.</enum><header>Economic development</header><subsection id="idCFCB6D1E2BA8427C9BBF0A97EEEC823F"><enum>(a)</enum><header>Loop roads requirements</header><paragraph id="id62D72D013B134B32B92374B5D38C6E26"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the County, shall work with Travel Oregon to establish requirements for the loop roads.</text></paragraph><paragraph id="id66271294E6394B7597370FE0662A4CA9"><enum>(2)</enum><header>Owyhee Dam Road</header><subparagraph id="idb5502c808bb8470785b8e28190985cb3"><enum>(A)</enum><header>Safety upgrades</header><clause id="idCE802282336143EBADF7BCBDCFE23ADF"><enum>(i)</enum><header>In general</header><text>The Secretary shall seek to enter into an arrangement with the County to fund safety upgrades, in accordance with County road standards, to the Owyhee Dam Road to ensure access to the recreational opportunities of the Owyhee Reservoir, including improved signage and surfacing.</text></clause><clause id="id4CE066D4A9E94B708FC5F5DFF65BAC56"><enum>(ii)</enum><header>Deadline for upgrades</header><text>Any upgrades carried out with funds provided under clause (i) shall be completed not later than 1 year after the date of enactment of this Act.</text></clause><clause id="idE8051D899DEB4F6A8EA19468004C2BC4"><enum>(iii)</enum><header>Compliance with standards</header><text>If the County receives any funds provided under this subparagraph, the County shall ensure that, not later than 1 year after the date of enactment of this Act, the Owyhee Dam Road is in compliance with County and County road district standards.</text></clause></subparagraph><subparagraph id="id2046461809634747AC8C17F6EC5E8767"><enum>(B)</enum><header>Fees and tolls</header><clause id="idA7BFCCFE80E94F5EBC1727FC3665B86B"><enum>(i)</enum><header>In general</header><text>As soon as practicable after the date on which requirements for the Owyhee Dam Road are established under paragraph (1) and notwithstanding the terms of the right-of-way easement between the County and the Bureau dated April 20, 1988, and recorded in the County deed records as instrument number 88–17855, the County may collect fees or tolls for the use of the road.</text></clause><clause id="idC04C86762E5A468E812F9C794CF00DB0"><enum>(ii)</enum><header>Use of fees or tolls</header><text>Any fees or tolls collected under clause (i) shall be used for road improvements by the County.</text></clause></subparagraph><subparagraph commented="no" id="id151e2b03cc3b4d8d92da8398917aa03a"><enum>(C)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under subsection (f)(1), there is authorized to be appropriated to the Secretary to carry out subparagraph (A) $6,000,000.</text></subparagraph></paragraph><paragraph commented="no" id="idE2D6DE90B8654D4AB04B0B71E9C4A991"><enum>(3)</enum><header>Succor Creek Scenic Loop</header><text>The Secretary shall work with the County on a plan to improve the Succor Creek Scenic Loop, as generally depicted on the map entitled <quote>Lake Owyhee, Succor Creek, Birch Creek, and Three Forks Scenic Loops</quote> and dated November 6, 2019, to accommodate visitors and residents.</text></paragraph><paragraph commented="no" id="idEAF6378903B146629A414CCC5E21FB50"><enum>(4)</enum><header>Birch Creek Scenic Loop</header><text>The Secretary shall work with the County on a plan to improve the Birch Creek Scenic Loop, as generally depicted on the map entitled <quote>Lake Owyhee, Succor Creek, Birch Creek, and Three Forks Scenic Loops</quote> and dated November 6, 2019, to accommodate visitors and residents.</text></paragraph><paragraph commented="no" id="id15E80298545B4001934D5AF348DC6613"><enum>(5)</enum><header>Three Forks Scenic Loop</header><text>The Secretary shall work with the County on a plan to improve the Three Forks Scenic Loop, as generally depicted on the map entitled <quote>Lake Owyhee, Succor Creek, Birch Creek, and Three Forks Scenic Loops</quote> and dated November 6, 2019—</text><subparagraph commented="no" id="idFA1E6533F566443F8343E1995BC8DB02"><enum>(A)</enum><text>to accommodate visitors and residents; and</text></subparagraph><subparagraph commented="no" id="idCC9467168C444680B0673AD39BCB5CAD"><enum>(B)</enum><text>to provide a connection to the Idaho Scenic Byway.</text></subparagraph></paragraph></subsection><subsection id="id0219FFBFE5FC46F3961108840CBB4A52"><enum>(b)</enum><header>Improvements to State parks and other amenities</header><text>Not later than 180 days after the date of enactment of this Act—</text><paragraph id="id6B6E411A7C294B29AA5486EDC2DC5AF8"><enum>(1)</enum><text>the Commissioner, in coordination with the Owyhee Irrigation District, shall work with Travel Oregon or the Oregon Parks and Recreation Department, as appropriate—</text><subparagraph id="id7EA5485B72BB478BB2EEAB56FCB07922"><enum>(A)</enum><text>to carry out a feasibility study relating to the establishment of not more than 2 marinas on the Owyhee Reservoir;</text></subparagraph><subparagraph id="ida88ded35914f443a89601f9116ec8435"><enum>(B)</enum><text>to carry out a feasibility study relating to the establishment of a paddle bar on the Owyhee Reservoir;</text></subparagraph><subparagraph id="ide5c48a9621314dbeb823709fdcd138df"><enum>(C)</enum><text>to carry out improvements to existing Oregon State Parks bordering the Owyhee Reservoir;</text></subparagraph><subparagraph id="id328fc6653b194ba89d39518bb4f0d51d"><enum>(D)</enum><text>to establish a network of hostelries in the County using former hotels and bunkhouses that are not in use;</text></subparagraph><subparagraph id="idfd42bd693b824f488edfc29d690f6bf2"><enum>(E)</enum><text>to carry out improvements to private camps on the shore of the Owyhee Reservoir; and</text></subparagraph><subparagraph id="idD0413B6DC7714C0CA3984C3C5AD4B948"><enum>(F)</enum><text>to establish a dude ranch at Birch Creek; and</text></subparagraph></paragraph><paragraph id="idCC1DBD5D319A47FC85234D6E04663B0E"><enum>(2)</enum><text>the Secretary shall work with the County to carry out a feasibility study on the rails-to-trails project known as <quote>Rails to Trails: The Oregon Eastern Branch/The Oregon and Northwestern Railroad</quote>.</text></paragraph></subsection><subsection id="idD2E3A2122851445DA05CB465040940BC"><enum>(c)</enum><header>Gateway to the Oregon Owyhee</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, in coordination with Travel Oregon, shall complete a feasibility study on how best to market communities or sections of the County as the <quote>Gateway to the Oregon Owyhee</quote>.</text></subsection><subsection id="idD7E0F566E5CD41F985A15987190E5967"><enum>(d)</enum><header>Jordan Valley Airstrip improvements To support firefighting efforts</header><paragraph id="id53133BAFAD6E46FA9D3730A44B581BFF"><enum>(1)</enum><header>In general</header><text>The Secretary shall work with firefighting entities in the County to determine—</text><subparagraph id="idE732F30DB9A045419258A3F5AC897D83"><enum>(A)</enum><text>the need for the use of the Jordan Valley Airstrip to support firefighting efforts; and</text></subparagraph><subparagraph id="id27A6A432B5B04E499EC935CDED0552F6"><enum>(B)</enum><text>the conditions under which the Jordan Valley Airstrip may be used to support firefighting efforts.</text></subparagraph></paragraph><paragraph id="idC1A5510E51E7409183CCD9373A59FBCD"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Malheur CEO Group a report on the need and conditions described in subparagraphs (A) and (B) of paragraph (1), including any ways in which to meet those conditions.</text></paragraph></subsection><subsection id="idF0B8028A4B4C48E2A5FEE15DDBF1CCAB"><enum>(e)</enum><header>Native Seed Center</header><paragraph id="idE6EC848B86574072BA500F069FF79640"><enum>(1)</enum><header>Establishment</header><subparagraph id="idAFC895B9914C43A490B75532D624A74F"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Native Seed Center Establishment Group shall establish a center, to be known as the <quote>Native Seed Center</quote>, to serve as the primary native seed repository of the Federal Government in the Western States.</text></subparagraph><subparagraph id="idB9E45D104E2343A5B1ACA80645767A04"><enum>(B)</enum><header>Native Seed Center Establishment Group</header><clause id="id089C3BBA3BC045698990DB674D66DCCB"><enum>(i)</enum><header>Establishment of group</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the Agricultural Resource Service shall enter into a memorandum of understanding with the partners described in clause (ii) to establish a group, to be known as the <quote>Native Seed Center Establishment Group</quote>, to establish and operate the Center.</text></clause><clause id="idFF87AA704F634164B265C795A2EFD133"><enum>(ii)</enum><header>Partners described</header><text>The partners referred to in clause (i) are—</text><subclause id="id61F955A156A74C068544991E16EBAB69"><enum>(I)</enum><text>the Administrator of the Farm Service Agency;</text></subclause><subclause id="id60E521405E074ACFBDEDBE893014F57B"><enum>(II)</enum><text>Oregon State University;</text></subclause><subclause id="idA8C613DE091346CF91A7A17BB62EB3BA"><enum>(III)</enum><text>Treasure Valley Community College;</text></subclause><subclause id="idF4FC24FF4061431699ACF4E1AE8931D9"><enum>(IV)</enum><text>the Malheur County Weeds Department Inspector; and</text></subclause><subclause id="idFACF9444217C45EDAE715BE111F7564E"><enum>(V)</enum><text>local agricultural producers in the County.</text></subclause></clause></subparagraph></paragraph><paragraph id="idC5004C622AFE4E6E8D4B201A771A05C3"><enum>(2)</enum><header>Purpose</header><text>The Center shall—</text><subparagraph id="idF067C6214C2143C28581C02C74348DBC"><enum>(A)</enum><text>serve as a repository of native seeds deposited with the Center;</text></subparagraph><subparagraph id="idB65A744D8E274A61A166EB44E1999B1A"><enum>(B)</enum><text>develop methods to improve the growth of native seeds;</text></subparagraph><subparagraph id="id457E7A00E2004BEE936FBEBE0CB0C84A"><enum>(C)</enum><text>give priority to the production of species of plants, as seeds and seedlings, that—</text><clause id="idBFA600982AD148BABFCD5F93A4E6C2E9"><enum>(i)</enum><text>are of heightened cultural significance to the Burns Paiute Tribe; and</text></clause><clause id="idA85FCD45F66A4E78A27DFC708A242051"><enum>(ii)</enum><text>are locally adapted; and</text></clause></subparagraph><subparagraph id="idD96FEA9A8A4845D7B807ABC3EEA7C018"><enum>(D)</enum><text>pursuant to the contract described in paragraph (3), provide native seeds for use on all rangeland managed by the Bureau.</text></subparagraph></paragraph><paragraph id="idB63C752EFD18451B8DDB36A4E13C4F58"><enum>(3)</enum><header>Contract</header><subparagraph id="id3ACDC04BF4914CB69A51D1B3078794E4"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the establishment of the Center under paragraph (1), the Center shall enter into a contract with the Bureau, seed growers, ranchers in the County, and the Burns Paiute Tribe to provide native seeds for use on all rangeland managed by the Bureau.</text></subparagraph><subparagraph id="idC5A7B309ACE343E99B4FD850F149A3DC"><enum>(B)</enum><header>Requirement</header><text>The contract under subparagraph (A) shall—</text><clause id="id81930F0AC9DA43B3AB9844D8D7453564"><enum>(i)</enum><text>include the use of technologies such as biochar to improve seed germination rates; and</text></clause><clause id="idF421CE532F664CCF81046281135F7717"><enum>(ii)</enum><text>guarantee prices and availability for ranchers and members of the Burns Paiute Tribe who use rangeland managed by the Bureau.</text></clause></subparagraph></paragraph></subsection><subsection id="idB6A659CA41AE4FAE83E856BA2446F3EA"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated—</text><paragraph id="id58C048A2D75D4521A37C2A7032A4AA20"><enum>(1)</enum><text>to the Secretary—</text><subparagraph id="id6FDD6894EDD84D57A8F550C158CB5938"><enum>(A)</enum><text>to carry out subsection (a), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3AE4E07B1D3643AE8A5F05BB5EF3ADD9"><enum>(B)</enum><text display-inline="yes-display-inline">to carry out subsection (b)(2), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph id="idF42CBDCDFF0B40DCAC17170F6C94E7D2"><enum>(C)</enum><text>to carry out subsection (c), $10,000,000 for each of fiscal years 2023 through 2033; and</text></subparagraph><subparagraph id="id20B88830288F4DB385883DF68BFD485D"><enum>(D)</enum><text>to carry out subsection (d), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph></paragraph><paragraph id="id509DDC00E2D24161BDAF1F864330B52A"><enum>(2)</enum><text>to the Commissioner—</text><subparagraph id="idA1D5B621D9344431914D679F4B14E89F"><enum>(A)</enum><text>to carry out subsection (b)(1)(A), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph id="idDA200A8E8061460EA71F4974B8E6EF5B"><enum>(B)</enum><text>to carry out subsection (b)(1)(B), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph id="idEE628D3BD29A48559C84451CE9F194EF"><enum>(C)</enum><text>to carry out subsection (b)(1)(C), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph id="id655B8E8B8BFE4F4284E457CED84657BA"><enum>(D)</enum><text>to carry out subsection (b)(1)(D), $10,000,000 for each of fiscal years 2023 through 2033;</text></subparagraph><subparagraph id="idC60B2D1142CB4905809261A2E332CBD0"><enum>(E)</enum><text>to carry out subsection (b)(1)(E), $10,000,000 for each of fiscal years 2023 through 2033; and</text></subparagraph><subparagraph id="id433B01638BA840BE8910A70C151D402E"><enum>(F)</enum><text>to carry out subsection (b)(1)(F), $10,000,000 for each of fiscal years 2023 through 2033; and</text></subparagraph></paragraph><paragraph id="id081C24DBDC374E2CA193A5FE79A2CA3E"><enum>(3)</enum><text>to the Administrator of the Agricultural Resource Service, for the establishment and operation of the Center, $10,000,000 for each of fiscal years 2023 through 2033.</text></paragraph></subsection></section><section id="id77e2ff0f939449668affc18d4369f6c2"><enum>7.</enum><header>Land conveyance to Burns Paiute Tribe</header><subsection id="idDB65600814FE436C87D530EB2174318F"><enum>(a)</enum><header>Conveyance and taking into trust</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall—</text><paragraph id="id7F59ED2D6DB54CAFA8063DDEE7986B02"><enum>(1)</enum><text display-inline="yes-display-inline">transfer to the Burns Paiute Tribe all right, title, and interest in and to the land in the State of Oregon described in subsection (b);
