<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 473</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210225">February 25, 2021</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> (for himself and <cosponsor name-id="S153">Mr. Grassley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the CARES Act to extend the sunset for the definition of a small business debtor, and for other purposes.</official-title></form><legis-body><section id="id058BF80C23254D4B9ED48E49E5B771F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Bankruptcy Relief Extension Act of 2021</short-title></quote>.</text></section><section id="id2BD099A7A19D46619FCBFC39D4E356A7" section-type="subsequent-section"><enum>2.</enum><header>Extensions</header><subsection id="idA4BFA8D716FB40488CDDF637E72F1293"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1113 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) is amended—</text><paragraph id="id4769B7A26CC447E4AE477C5E14E70918"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(5) (<external-xref legal-doc="usc" parsable-cite="usc/11/1182">11 U.S.C. 1182</external-xref> note), by striking <quote>1 year</quote> and inserting <quote>2 years</quote>; and</text></paragraph><paragraph id="id164A0247D4364B989C7C453DA115CEB7"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/11/101">11 U.S.C. 101</external-xref> note), by striking <quote>1 year</quote> and inserting <quote>2 years</quote>.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id9E6B8FA0F3744CD1B0C0EF1ECF0EAD49"><enum>(b)</enum><header>Modification of plan after confirmation</header><paragraph display-inline="no-display-inline" commented="no" id="idE2E567EEDBF3499482ECA11D7F26363D"><enum>(1)</enum><text>Section 1329(d)(1) of title 11, United States Code, is amended, in the matter preceding subparagraph (A), by striking <quote>this subsection</quote> and inserting <quote>the <short-title>COVID–19 Bankruptcy Relief Extension Act of 2021</short-title></quote>.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id94AF48453DA0414FA587DFF3BD1269BB"><enum>(2)</enum><text>Section 1113(b)(1)(D)(ii) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/11/1329">11 U.S.C. 1329</external-xref> note) is amended by striking <quote>this Act</quote> and inserting <quote>the <short-title>COVID–19 Bankruptcy Relief Extension Act of 2021</short-title></quote>. </text></paragraph></subsection><subsection id="id4BBC6CAA867F4A0EA2D20B1923D07B14"><enum>(c)</enum><header>Bankruptcy relief</header><text display-inline="yes-display-inline">Section 1001 of division FF of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) is amended by striking <quote>the date that is 1 year after the date of enactment of this Act</quote> each place the term appears and inserting <quote>March 27, 2022</quote>.</text></subsection></section></legis-body></bill>
