which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Credit Act of 1978 to waive the cost share requirement under the emergency forest restoration program for land damaged by the Hermit's Peak/Calf Canyon Fire.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hermit's Peak/Calf Canyon Fire Forest Restoration Program Relief Act</short-title></quote>.</text></section><section id="id4c11774521b64ae2a97aeb4faf923c97"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id8427e93dd799436197df6f33a52c3541"><enum>(1)</enum><text>on April 6, 2022, the Forest Service initiated the Las Dispensas-Gallinas prescribed burn on Federal land in the Santa Fe National Forest in San Miguel County, New Mexico, when erratic winds were prevalent in the area, which was also suffering from severe drought after many years of insufficient precipitation;</text></paragraph><paragraph id="id40138c4347cb49dba7aae5ea0a5ee408"><enum>(2)</enum><text>on April 6, 2022, the prescribed burn, which became known as the <quote>Hermit’s Peak Fire</quote>, exceeded the containment capabilities of the Forest Service, was declared a wildfire, and spread to other Federal and non-Federal land;</text></paragraph><paragraph id="idda98eb38bc5142e49f0b9eeda7971fd3"><enum>(3)</enum><text>on April 19, 2022, the Calf Canyon Fire, also in San Miguel County, New Mexico, began burning on Federal land and was later identified as the result of a pile burn in January 2022 that remained dormant under the surface before reemerging;</text></paragraph><paragraph id="id3799a04ba0d141e7a8c943a74403cca5"><enum>(4)</enum><text>on April 27, 2022, the Hermit’s Peak Fire and the Calf Canyon Fire merged, and both fires were reported as the <quote>Hermit’s Peak Fire</quote> or the <quote>Hermit’s Peak/Calf Canyon Fire</quote>;</text></paragraph><paragraph id="idbbbd514fc87c4f96b3b615404d8afb86"><enum>(5)</enum><text>by May 2, 2022, the fire had grown in size and caused evacuations in multiple villages and communities in San Miguel County and Mora County, including at the San Miguel county jail, the State’s psychiatric hospital, the United World College, and New Mexico Highlands University;</text></paragraph><paragraph id="id78ef5377075b4824a550dd4e2097f571"><enum>(6)</enum><text>on May 4, 2022, the President issued a major disaster declaration for the counties of Colfax, Mora, and San Miguel, New Mexico;</text></paragraph><paragraph id="ida5d44fc2e3d643f4b1e5f7a32a28ffc5"><enum>(7)</enum><text>on May 20, 2022, Chief of the Forest Service Randy Moore ordered a 90-day review of prescribed burn policies to reduce the risk of wildfires and ensure the safety of the communities involved;</text></paragraph><paragraph id="ide84109e445ff4e039fe6db8c84cc0a3c"><enum>(8)</enum><text>the Forest Service has assumed responsibility for the Hermit’s Peak/Calf Canyon Fire;</text></paragraph><paragraph id="id414fd0061dc9488daee98d948fa10a39"><enum>(9)</enum><text>the fire resulted in the loss of Federal, State, local, Tribal, and private property; and</text></paragraph><paragraph id="id8e40937bc1ed4c0786450cf43b8b1ec9"><enum>(10)</enum><text>the United States should compensate the victims of the Hermit’s Peak/Calf Canyon Fire.</text></paragraph></section><section id="id7efb9827cc1342b589cb7895a55f85b0"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure that victims of the Hermit’s Peak/Calf Canyon Fire are eligible to receive 100 percent funding for the cost of carrying out emergency measures under the emergency forest restoration program under section 407 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206</external-xref>).</text></section><section id="id934dcd11db954270adb25884b7df8b23"><enum>4.</enum><header>Definition of Hermit’s Peak/Calf Canyon Fire</header><text display-inline="no-display-inline">In this Act, the term <term>Hermit’s Peak/Calf Canyon Fire</term> means—</text><paragraph id="idfbea9bdec03d4173a342202134d9c0fc"><enum>(1)</enum><text>the fire resulting from the initiation by the Forest Service of a prescribed burn in the Santa Fe National Forest in San Miguel County, New Mexico, on April 6, 2022;</text></paragraph><paragraph id="id57818623083a4c2ba2324a4028894bf1"><enum>(2)</enum><text>the pile burn holdover resulting from a prescribed burn by the Forest Service in January 2022, which reemerged on April 19, 2022; and</text></paragraph><paragraph id="idadc34a7bf461483a9a7ab65c20751052" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>the merger of the fires described in paragraphs (1) and (2), reported as the <quote>Hermit’s Peak Fire</quote> or the <quote>Hermit’s Peak/Calf Canyon Fire</quote>. </text></paragraph></section><section id="id3552ad9181004a1ba8857484e14a31b1"><enum>5.</enum><header>Waiver of cost share requirement for land damaged by Hermit's Peak/Calf Canyon Fire</header><text display-inline="no-display-inline">The Secretary of Agriculture shall waive the cost share requirement under subsection (d) of section 407 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206</external-xref>) with respect to a payment provided under that section for restoration of land damaged by the Hermit's Peak/Calf Canyon Fire.</text></section></legis-body></bill>
