which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to increase the amount paid by the Secretary of Veterans Affairs to veterans for improvements and structural alterations furnished as part of home health services.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H35ACD5CA48C24CDD93D612908923AB97"><section section-type="section-one" id="H07C6131C749E4924848E439756A0CEDB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Autonomy for Disabled Veterans Act</short-title></quote>.</text></section><section id="H359A382457B84ADDA159ED2CC37DEF76"><enum>2.</enum><header>Increase in amount available to disabled veterans for improvements and structural alterations furnished as part of home health services</header><subsection id="HC789C5B092D04AB7926ECE786F136577"><enum>(a)</enum><header>Increase</header><paragraph id="id3D22FEDD83624B2AA781AA946C5F2B30"><enum>(1)</enum><header>In general</header><text>Paragraph (2) of section 1717(a) of title 38, United States Code, is amended—</text><subparagraph id="H28A896AB0AEC4B589871CF43DE2C8C3B"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id5992961CD7F34F5296DCC3079888202A"><enum>(i)</enum><text>in clause (i), by striking <quote>; or</quote> and inserting a semicolon;</text></clause><clause id="id6DFFB4E58CFD4F7CB43923CB3A7A0264"><enum>(ii)</enum><text>in clause (ii)—</text><subclause id="id6434DA69714B4992B3A8D227DD857160"><enum>(I)</enum><text>by inserting <quote>and before the date of the enactment of the <short-title>Autonomy for Disabled Veterans Act</short-title></quote> after <quote>May 5, 2010,</quote>; and</text></subclause><subclause id="id4C6E9F2B488E4F889ECB5B22FFE8710B"><enum>(II)</enum><text>by striking <quote>; and</quote> and inserting <quote>; or</quote>; and</text></subclause></clause><clause id="idD9D9819F31F54FECA3C66AF2F18E9A04"><enum>(iii)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id60956014CEE3404FBF1B814D53592088"><clause id="id6343703484AD42429CB3B2D339F4B58C" indent="up1"><enum>(iii)</enum><text>in the case of a veteran who first applies for benefits under this paragraph on or after the date of the enactment of the <short-title>Autonomy for Disabled Veterans Act</short-title>, $10,000; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H8EAA97905F254A438A3CFC130C633808"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id76AD032152A34ADEBBD73692A4A89E17"><enum>(i)</enum><text>in clause (i), by striking <quote>; or</quote> and inserting a semicolon;</text></clause><clause id="idCDA7413D881D48E2948AD5A0913D61B9"><enum>(ii)</enum><text>in clause (ii)—</text><subclause id="idA2ED5579DA434589AD253E095B8ED2D8"><enum>(I)</enum><text>by inserting <quote>and before the date of the enactment of the <short-title>Autonomy for Disabled Veterans Act</short-title></quote> after <quote>May 5, 2010,</quote>; and</text></subclause><subclause id="id8E3E29C08AAD4132B70B580E0F7194D3"><enum>(II)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></subclause></clause><clause id="id33AF3758D8EF432991CC2FB3140D32F8"><enum>(iii)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96852E324F2046849779C5DF7246FBE5"><clause id="id2E5D5691457C4B29B81345B12F430ACA" indent="up1"><enum>(iii)</enum><text>in the case of a veteran who first applies for benefits under this paragraph on or after the date of the enactment of the <short-title>Autonomy for Disabled Veterans Act</short-title>, $5,000.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H75A83E58C61D4DD5ACD1B54BE8A4BB11"><enum>(2)</enum><header>Applicability</header><text>A veteran who exhausts the eligibility of the veteran for benefits under section 1717(a)(2) of title 38, United States Code, before the date of the enactment of this Act is not entitled to additional benefits under such section by reason of the amendments made by paragraph (1).</text></paragraph></subsection><subsection id="HFD22C5CF464F491F831C74D04E855A3F"><enum>(b)</enum><header>Adjustment for inflation</header><text display-inline="yes-display-inline">Section 1717(a) of title 38, United States Code, is further amended by adding at the end the following new paragraph: </text><quoted-block style="USC" display-inline="no-display-inline" id="HF46C52C158F2486CB947CF13D18A1195"><paragraph id="H6CA460B20B6D4396A4585B463EAEE388" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">On an annual basis, the Secretary shall increase the dollar amounts in effect under paragraph (2) by a percentage equal to the percentage by which the consumer price index for all urban consumers (United States city average) increased during the 12-month period ending with the last month for which consumer price index data is available. In the event that such consumer price index does not increase during such period, the Secretary shall maintain the dollar amounts in effect under paragraph (2) during the previous fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
