which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Federal Communications Commission to specify additional sources from which a radio station licensee must obtain information to enable the licensee to announce that a foreign governmental entity has paid for a broadcast.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Announcement of payment for broadcast</header><text display-inline="no-display-inline">Section 317(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/317">47 U.S.C. 317(c)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id219D031C33A14988BE880D5B3E0F5559"><subsection commented="no" display-inline="no-display-inline" id="ID408965912A4B45E5AB293A7F9EC25CB2"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idC119865F16C44451B6B61B707BBB7C43"><enum>(1)</enum><text display-inline="yes-display-inline">The licensee of each radio station shall exercise reasonable diligence to obtain information to enable such licensee to make the announcement required by this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6C7F79028ACC460EB5188539DEDDE44C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In carrying out paragraph (1), the licensee of a radio station shall consult—</text><subparagraph commented="no" display-inline="no-display-inline" id="idBAA626D70C7A46B09779D20C8E70B857"><enum>(A)</enum><text display-inline="yes-display-inline">its employees;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA05F5A4FF0644698EA22EDD8CD75B79"><enum>(B)</enum><text display-inline="yes-display-inline">other persons with whom it deals directly in connection with any program or program matter for broadcast; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9006EC115EB040A4A0B23CDBD5B0F54D"><enum>(C)</enum><text display-inline="yes-display-inline">any additional source of information the Commission designates that may enable the licensee to verify whether the matter broadcast by the radio station was paid for or furnished by a foreign governmental entity.</text></subparagraph></paragraph><paragraph id="id501F64CDB0184EA5BCAD5036B48817CE" indent="up1"><enum>(3)</enum><text>The licensee of a radio station shall—</text><subparagraph id="id45388F295A714549AE9A43E00958EB41"><enum>(A)</enum><text>obtain the information required under paragraph (1)—</text><clause id="id9C77B5E7802748BFB5FB66CF0C1EC429"><enum>(i)</enum><text>when the licensee enters into an agreement to lease time on the radio station; and</text></clause><clause id="id12F301A0092345538932C717BA479BB7"><enum>(ii)</enum><text>when the licensee renews any agreement described in clause (i); and</text></clause></subparagraph><subparagraph id="idE6E70FA210BC45EC974B1BD53DC2A79B"><enum>(B)</enum><text>keep a record of the information required under paragraph (1).</text></subparagraph></paragraph><paragraph indent="up1" id="id38FE626AE8B043F3943A105FDE44560E"><enum>(4)</enum><text>For purposes of this subsection—</text><subparagraph id="id6A8A1EC9084A4754BCBC963621188373"><enum>(A)</enum><text>the term <term>agent of a foreign principal</term> means an agent of a foreign principal, as defined in section 1(c) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(c)</external-xref>)—</text><clause id="id97399ADD5500403B83A15E3639795E79"><enum>(i)</enum><text>that is registered as such with the Attorney General under section 2 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/22/612">22 U.S.C. 612</external-xref>);</text></clause><clause id="id17027C551E674ACA93245BAF18A10896"><enum>(ii)</enum><text>if the agent's foreign principal—</text><subclause id="id58FCDC6C1B72490C90A13042C809072F"><enum>(I)</enum><text>is a government of a foreign country or a foreign political party; or</text></subclause><subclause id="id105F431733524FC39F58ED2A1BCDB06A"><enum>(II)</enum><text>is directly or indirectly operated, supervised, directed, owned, controlled, financed, or subsidized by the government of a foreign country or a foreign political party; and</text></subclause></clause><clause id="id6B81F4134C8B4735B902C8E78ABB373C"><enum>(iii)</enum><text>that is acting in its capacity as an agent of such foreign principal described in clause (ii);</text></clause></subparagraph><subparagraph id="idE0D91BF446644B6AAA7F48EB22FBF029"><enum>(B)</enum><text>the term <term>foreign governmental entity</term> includes—</text><clause id="id38BFFD57169347908B907039BA418CB6"><enum>(i)</enum><text>the government of a foreign country;</text></clause><clause id="id5CC4BEFFBEDE491795DE13DC1659DB9D"><enum>(ii)</enum><text>a foreign political party;</text></clause><clause id="id4653424161864E48AFC772BFA01F4E67"><enum>(iii)</enum><text>an agent of a foreign principal; and</text></clause><clause id="id8262019C76004E74A2DEA48C6C433BAD"><enum>(iv)</enum><text>a United States-based foreign media outlet (as defined in section 624);</text></clause></subparagraph><subparagraph id="id5CD42171F08A4E6F8C936B36DB17573E"><enum>(C)</enum><text>the term <term>foreign political party</term> has the meaning given the term in section 1(f) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(f)</external-xref>); and</text></subparagraph><subparagraph id="idF8BB9D599FBB4DCEA0BD713BECABCE67"><enum>(D)</enum><text>the term <term>government of a foreign country</term> has the meaning given the term in section 1(e) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(e)</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
