<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4712</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220802">August 2, 2022</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> (for herself and <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify coverage of occupational therapy under the Medicare and Medicaid programs.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Occupational Therapy Mental Health Parity Act</short-title></quote>.</text></section><section id="idD2458C0EB734412E850BE077DED46D9C"><enum>2.</enum><header>Clarifying coverage of occupational therapy under Medicare</header><text display-inline="no-display-inline"> Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall provide education and outreach to stakeholders about the Medicare Benefit Policy Manual with respect to occupational therapy services furnished to individuals under the Medicare program for the treatment of a substance use or mental health disorder diagnosis using applicable Healthcare Common Procedure Coding System (HCPCS) codes. </text></section><section id="id337E9384CD754A0987E0EE8D3FFB96F0"><enum>3.</enum><header>Clarifying coverage of occupational therapy under Medicaid</header><text display-inline="no-display-inline"> Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall issue guidance clarifying that States may cover occupational therapy services furnished to individuals under the Medicaid program for the treatment of a substance use or mental health disorder diagnosis.</text></section></legis-body></bill>
